The Corporation of the Municipality of Brockton
By-Law 2020-052
Being a By-Law to Regulate and Control Traffic and Parking Within
the Municipality of Brockton.
Whereas the Municipal Act, 2001, S.O. 2001, c. 25, Section 5(1), as amended, provides that the powers
of a municipal corporation are to be exercised by its council;
And Whereas the Municipal Act, 2001, S.O. 2001, c. 25, Section 5(3), as amended, provides that a
municipal power, including a municipality's capacity rights, powers and privileges under section 9; shall
be exercised by By-Law;
And Whereas t the provisions of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, and the
Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorize Municipal Councils to pass by-laws to
regulate and control traffic;
And Whereas the Council of the Corporation of the Municipality of Brockton deems it expedient to pass
a by-law to regulate and control traffic within the Municipality of Brockton.
Now Therefore the Council of the Corporation of the Municipality of Brockton Enacts as Follows:
The provisions of this By-Law are subject to the provisions of the Highway Traffic Act and regulations
hereunder.
1.
Definitions
1.1
"boulevard" means the strip of land between a sidewalk and a curb or the centre strip of
land dividing traffic travelling in different directions;
1.2
"commercial motor vehicle" means a motor vehicle having permanently attached thereto
a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus,
buses and tractors used for hauling purposes on the highway;
1.3
"corner" means the point of intersection of curbs or edges of the roadway;
1.4
"crosswalk" means:
i. that part of a highway at an intersection that is included within the connections of
the lateral lines of the sidewalks on opposite sides of the highway measured from
the curbs or, in the absence of curbs, from the edges of the roadway, or
ii. any portion of a roadway at an intersection or elsewhere distinctly indicated for
pedestrian crossing by signs or by lines or other marking on the surface;
1.5
"driver" means a person who drives a vehicle on a highway;
1.6
"heavy traffic" means the use of a highway by a vehicle, object or contrivance for moving
loads having a gross weight including the vehicle, object or contrivance and load in excess
of five (5) tonnes:
1.7
"highway" includes a common and public highway, street, avenue, parkway, driveway,
square, place, bridge, municipally owned and operated parking lot, viaduct or trestle, any
part of which is intended for or used by the general public for the passage of vehicles and
includes the area between the lateral property lines thereof;
1.8
"intersection" means the area embraced within the prolongation or connection of the
lateral curbs lines, or if none, then of the lateral boundary lines of two or more highways
that join one another at an angle, whether or not one highway crosses the other;
1.9
"Minister" means the Minister of Transportation;
1.10
"Ministry" means the Ministry of Transportation"
1.11
"motor vehicle" includes an automobile, motorcycle, motor assisted bicycle and any
other vehicle propelled or driven otherwise than by muscular power, but does not include
a street car or other motor vehicles running only upon rails, or a motorized snow vehicle,
traction engine, farm tractor, self-propelled implement of husbandry or road-building
machine within the meaning of the Highway Traffic Act;
1.12
"municipal service vehicles" includes but is not limited to vehicles owned by the
Municipality of Brockton and/or contractors having a valid contract with the Municipality
to supply municipal services. These services may include road building, road
maintenance, emergency services, garbage collection, recycling, hydro, water, etc.
1.13
"municipal references":
i.
Brant shall mean the former Township of Brant;
ii.
Bruce shall mean the former Township of Bruce;
iii.
Carrick shall mean the former Township of Carrick;
iv.
Culross shall mean the former Township of Culross;
v.
Elderslie shall mean the former Township of Elderslie;
vi.
Greenock shall mean the former Township of Greenock;
vii.
Walkerton shall mean the former Town of Walkerton.
1.14
"official sign" means a sign approved by the Ministry and the Municipality of Brockton.
1.15
"one-way street" means a street upon which vehicular traffic is limited to movement in
one direction;
1.16
"park or parking" when prohibited, means the standing of a vehicle, whether occupied or
not, except when standing temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers;
1.17
"pedestrian" includes a person in a wheelchair;
1.18
"pedestrian crossover" means any portion of a roadway designated by by-law of a
municipality, at an intersection or elsewhere, distinctly indicated for pedestrian crossing
by signs on the highway and lines or other markings on the surface of the roadway as
prescribed by the regulations;
1.19
"Police Officer" means a sworn Police Office of a law enforcement agency engaged to
provide policing services for the Municipality of Brockton and By-Law Enforcement
Officer, or any other officer appointed for enforcing or carrying out the provisions of this
By-Law.
1.20
"regulations" means the regulations made under the Highway Traffic Act, R.S.O. 1990,
Chapter H.8 as amended;
1.21
"roadway" means the part of the highway that is improved, designed or ordinarily used
for vehicular traffic, but does not include the shoulder and, where a highway includes two
or more separate roadways, the term "roadway" refers to any one roadway separately
and not all of the roadways collectively;
1.22
"school bus" means a chrome yellow bus that is used for the transportation of,
i.
children, or
ii.
adults with developmental disabilities to or from a training centre, that bears on
the front and rear thereof the words "school bus" and on the rear thereof the
words "do not pass when signals flashing".
1.23
"stop or stopping" when prohibited, means the halting of a vehicle, even momentarily,
whether occupied or not, except when necessary to avoid conflict with other traffic or in
compliance with the directions of a police officer or a traffic control sign or signal;
1.24
"through highways" means a highway or part of a highway designated as such by the
Minister or by by-law of the municipality, and every such highway shall be marked by a
stop sign in compliance with the regulations;
1.25
"traffic" means lawful vehicle or pedestrian movement on the highway;
1.26
"traffic control signal" means any device, manually, electrically or mechanically operated
for the regulation or control of traffic;
1.27
"vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-building
machine and any vehicle drawn; propelled or driven by any kind power, including
muscular power, but does not include a motorized snow vehicle or a street car;
1.28
"U turn" means the turning of a vehicle within a highway so as to proceed in the opposite
direction;
1.29
"wheelchair" means a chair mounted on wheels driven by muscular or any other kind of
power that is designed for and used by a person whose mobility is limited by one or more
conditions or functional impairments;
1.30
"words" where any word or expression used in this By-law is not defined herein, reference
shall be made to the Highway Traffic Act, the Interpretation Act, R.S.O. 1990, Chapter I.11
as amended or re-enacted from time to time, or a generally accepted dictionary and the
interpretation that best suits the spirit and intent of this By-law shall be adopted.
Any reference in this By-law to the Highway Traffic Act or any provision thereof shall be deemed
to be a reference to the Highway Traffic Act, R.S.O. 1990, Chapter H.8 or the provisions thereof
amended or re-enacted from time to time.
Where any expression of time occurs or where any hour or other period of time is stated, the time
referred to is standard except in periods when daylight savings time is in effect, in which periods,
it is daylight savings time.
2.
Obedience to Traffic Regulations
Where official signs have been erected and are on display, no person shall park a vehicle in
disobedience to the direction given by the official sign.
3.
Motor Vehicles on Sidewalks Prohibited
3.1
No person shall drive a motor vehicle upon a sidewalk or footpath of a highway except
for the purpose of directly crossing the sidewalk or footpath;
3.2
No person shall drive a motor vehicle over a raised curb except at a place where there is
a ramp.
4.
General Stopping and Parking Regulations
4.1
No person shall park or stop any vehicle on any highway or portion thereof except as
follows:
i.
where there is a raised curb, on the right side on the roadway, having regard for the
direction such vehicle was proceeding, with its right front and rear wheels parallel to
and not more than .15 metres out from such curb;
ii.
where there is no curb or rolled curb, with the right front and rear wheels parallel to
and as near to the right hand limit of the highway as is practicable without stopping
or parking on a sidewalk or footpath or on any part of the highway where grass is
grown or which is not intended for the use of vehicles.
4.2
The provisions of subsection 1 do not apply where angle parking is permitted as described
on Schedule "E" hereof or to parking or stopping a vehicle on the left-hand side of the
roadway of a highway designated for one-way traffic.
4.3
Where angle parking is permitted on a highway, no person shall stop or park any vehicle
except at an angle of ninety (90°) degrees from the curb or boundary of the roadway with
the front end of the vehicle at such curb or boundary.
4.4
Where angle parking spaces are designated by lines painted on the roadway, no person
shall stop or park any vehicle except within an area designated as a parking space.
4.5
Where parking is permitted on the left-hand side of the roadway of a highway designated
for one-way traffic, no person shall park or stop any vehicle on the left-hand side of the
roadway or portion thereof except as follows:
i.
where there is raised curb, on the left-hand side of the roadway, having regard to
the direction such vehicle was proceeding, with its left front and rear wheels parallel
to and not more than .15 meters out from such curb;
ii.
where there is no curb or rolled curb, with the left front and rear wheels parallel to
and as near to the left-hand limit of the highway as is practicable without stopping
or parking on a sidewalk or footpath or on any part of the highway where grass is
grown or which is not intended for the use of vehicles.
5.
No Vehicle Stopping as Listed
No person shall STOP a vehicle on a highway in any of the following places:
5.1
on or over a sidewalk;
5.2
within an intersection;
5.3
within a designated pedestrian crosswalk;
5.4
within 9 meters of a pedestrian crosswalk;
5.5
between a safety zone and the adjacent side of the roadway or within 15 meters of the
points of such opposite the ends of a safety zone;
5.6
alongside or across the highway from any excavation or obstruction in the roadway when
the free flow of traffic would thereby be impeded;
5.7
on the roadway alongside of any stopped or parked vehicle (double park);
5.8
upon any bridge or within any tunnel or underpass;
5.9
on any centre boulevard or centre strip separating two roadways or adjacent to either
side or ends of such middle boulevard or centre strip;
6.
No Vehicle Parking as Listed
No person shall Park a vehicle on a highway in any of the following places:
6.1
within three (3) meters of a fire hydrant;
6.2
in a fire route;
6.3
in from or within one (1) metre of a driveway or laneway or so as to obstruct vehicles in
the use of a driveway or laneway and within three (3) meters of a commercial driveway
or laneway;
6.4
within nine (9) meters of an intersecting roadway;
6.5
on any roadway having an overall width of less than six (6) metres;
6.6
in front of an entrance to or exit from any building or enclosed space in which persons
may be expected to congregate in large numbers;
6.7
in such a position as will prevent the removal of any other vehicle previously parked;
6.8
in front of the entrance to any place where goods or merchandise are regularly delivered
or removed;
6.9
on any boulevard;
6.10
on any roadway in such a manner as to obstruct traffic;
6.11
within 9 meters of a pedestrian crosswalk;
6.12
on the roadway alongside of any stopped or parked vehicle (double park);
6.13
upon any bridge or within any tunnel or underpass;
7.
Highway Traffic Act Parking Regulation
Where signs in accordance with the regulations of the Highway Traffic Act are erected and on
display, no person shall on any highway park any vehicle:
7.1
within fifteen (15) metres of an intersection;
7.2
within thirty (30) metres of any intersection controlled by traffic signals;
7.3
on any bridge or within fifteen (15) metres of the approaches thereto;
7.4
within twenty-five (25) metres of any point designated as a bus or coach stop;
7.5
within five (5) metres of any fire hall on the side of the highway on which the fire hall is
located;
7.6
within a turning basin;
7.7
between 8:30 a.m. to 4:30 p.m. upon that side of a highway adjacent to any school
property;
8.
Winter Parking
No person shall park on any highway between the hours of 2:00 a.m. and 6:00 a.m. inclusive
during the months of November, December, January, February, March and April.
9.
Continuous Parking
No Person shall park a vehicle on a highway for a continuous period of time of more than thirty-
six (36) hours.
10.
Vehicle Service
No person shall repair, paint or service a vehicle on any highway unless the repairs or service is
of an emergency nature.
11.
Locking of Vehicles
No person driving or in charge of a motor vehicle, other than a commercial motor vehicle, shall
allow such motor vehicle to stand unattended unless it is locked in such a manner as to prevent
its operation by any person not authorized by the owner, driver or person in charge.
12.
Restricted Parking
Where signs in accordance with the regulations of the Highway Traffic Act are erected and are
on display, no person shall park a vehicle on any highway at the side and between the limits set
out respectively in Columns 1, 2, 3 and 4 of Schedule "F" to this by-law during the times or days
set out in Column 5 of the said Schedule or for a longer period than that set out in Column 5 of
the said Schedule.
13.
No Stopping
Where signs in accordance with the regulations of the Highway Traffic Act are erected and are
on display, no person shall stop a vehicle on any highway at the side and between the limits set
out respectively in Columns 1, 2 3 and 4 of Schedule "G" to this by-law during the prohibited
times or days set out in Column 5 of the said Schedule.
14.
Parking for Disabled Persons
14.1
The municipality may designate certain parking spots for use by disabled persons only as
defined in Regulation 581 to the Highway Traffic Act, as amended. The parking spots set
out on Schedule "I" to this by-law and designated by the appropriate disabled person
parking permit sign shall be for the exclusive use of any individual having a valid disabled
person parking permit issued under and displayed in accordance with the Highway Traffic
Act and the regulations made thereunder. No person shall park a vehicle in the
designated spots identified on Schedule "I" without displaying a valid disabled person
parking permit
14.2
The provisions of this by-law in respect to Restricted Parking as detailed in section 14 and
15 and as described on Schedule "F" to this by-law shall not apply to vehicles parked for
the convenience of the physically handicapped and which display a valid disabled person
parking permit issued under the Highway Traffic Act.
14.3
Any vehicle parked in contravention of this section may be removed and impounded at
the owner's expense and all costs incurred become a lien against the motor vehicle.
15.
Designated One Way Streets
15.1
The highways set out in Schedule "C" to this by-law are hereby designated for one-way
traffic only in the direction set out in the said Schedule.
15.2
Each designation made by subsection (a) shall be effective upon the erection of official
signs.
16.
Stop Signs
16.1
The intersection of streets as set out in Schedule "A" to this by-law are designated as
intersections where stop signs shall be erected for traffic travelling as per said Schedule
"A".
16.2
The intersections set out in Column 1 of section 2 of Schedule "A" to this by-law are
designated as intersections where all way stop signs shall be erected for traffic travelling
in directions as designated in Column 2 of section 2 of the said schedule.
17.
Designated Pedestrian Crosswalks
17.1
The portions of roadways set out in Column 1 of Schedule B at the locations named in
Column 2 of the said Schedule are designated as pedestrian crosswalks.
17.2
Where sidewalks are not provided on a highway a pedestrian walking along the highway
shall walk on the left side thereof facing oncoming traffic and, when walking along the
roadway, shall walk as close to the left side thereof as possible.
18.
Signage
Each designation made by Section 15, 16, and 19 shall be effective upon signs being erected in
accordance with the regulations of the Highway Traffic Act.
19.
No Heavy Traffic
19.1
Where regulation "No Heavy Truck" signs are on display, no person shall operate a
vehicle in contravention of the signs on any highway or part thereof as shown on
Schedule "H".
19.2
The Schedules referred to in this by-law form part of this by-law and each entry in a
Column 1 of such a Schedule shall be read in conjunction with the entry or entries across
therefrom and not otherwise.
20.
Emergency Parking
Notwithstanding any other provisions of this By-law Police, during emergency or special
circumstances, may declare a period of emergency parking prohibition and by use of appropriate
signs or other clear directions suspend parking of vehicles on any streets or portions thereof. A
vehicle parked previous to the declaration of the Police, may be deemed to be parked in
contravention of this section providing the owner or driver of the vehicle has been personally
notified of the emergency parking prohibition and has been allowed a reasonable period of time
to remove vehicle. No person shall park a vehicle in an area declared closed during an emergency
or special circumstances parking prohibition.
21.
Municipal Service Vehicles
The provisions of this By-law do not apply to municipal service vehicles while actually engaged in
the performance of their duties.
22.
Penalties
22.1
Save as otherwise provided herein, any person violating any of the provisions of this by-
law of an offence and subject to the penalties as prescribed in the Provincial Offences
Act. R.S.O. 1990, c. P. 33, as amended.
22.2
Any person violating any of the provisions of Section 14 (designated parking space) is
guilty of an offence and on conviction is liable of a fine of not less than $300.00 as
provided by the Municipal Act, 2001, s. 427.
22.3
Where a vehicle has been left parked, stopped or standing in contravention of this by-
law, the owner of the vehicle is guilty of an offence, even though the owner was not the
driver of the vehicle at the time of the contravention, and is liable to the applicable fine
unless, at the time of the offence, the vehicle was in the possession of another person
without the owner's consent.
23.
Voluntary Payment of Penalties
Section 432 of the Municipal Act, 2001 authorizes a by-law to establish a procedure for the
voluntary payment of penalties out of court when dealing with by-laws related to parking,
standing or stopping of vehicles.
23.1
Notwithstanding all other provisions of this Part in respect to penalties for violation of
the provisions of this by-law, any person may, upon presentation of a Certificate of
Parking Infraction or Information issued by a police officer or a by-law enforcement
officer alleging commission of any of the offences under this by-law, pay out of court
within the time limit specified on the said Certificate of Parking Infraction or Information
the penalty set out opposite such offence.
Under such payment, no further proceedings shall be taken under this by-law in respect
of the said offence alleged in the parking violation Certificate of Offence.
23.2
If a voluntary payment is not made in accordance with the procedure provided in sub-
section 23.1 of this Section, the procedures of the Provincial Offices Act or any successors
thereof shall apply.
24.
Effective Date
24.1
That this By-Law shall come into effect upon receiving approval of the set fines from the
Regional Senior Judge of the Ontario Court of Justice.
24.2
This By-Law may be cited as the "Consolidated Traffic and Parking By-Law".
24.3
Upon coming into effect, this By-law shall repeal and replace By-law 2012-40, including all
amendments thereto, including By-law 2012-81, By-law 2012-95, By-law 2012-015,
2014-038, By-law 2016-048 ,By-law 2017-103, By-law 2018-071, and By-law 2007-83,
By-law 2012-36, By-law 2014-084 and By-law 2017-102.

Stop Signs
1.
Every driver approaching a stop sign at an intersection;
i.
shall stop his vehicle at a marked stop line or if none, then immediately before entering the
nearest crosswalk or if none, then immediately before entering the intersection,
ii.
shall yield the right of way to traffic in the intersection or approaching the intersection on
another highway so closely that to proceed would constitute an immediate hazard and
having so yielded the right of way, may proceed, and
iii. when appropriate signs are on display, vehicles traveling on the street listed in Column 1, in
the direction listed in Column 3, must come to a complete stop and yield the right of way to
traffic traveling on the street listed in Column 2.

Every driver approaching an all way stop sign at an intersection:
i.
shall stop his/her vehicle at a marked stop line or if none, then immediately before
entering the nearest crosswalk or if none, then immediately before entering the
intersection,
ii.
shall yield the right of way to traffic in the intersection or to traffic that has already come
to a complete stop as outlined in section a) above prior to the subject vehicle having done
so and having so yielded the right of way, may proceed, and enter the intersection only if

No Heavy Traffic
Heavy traffic means a vehicle or combination of vehicles having a total registered gross vehicle weight
in excess of 4,500 kilograms (9,940 pounds) or having a combined length in excess of 7.5 metres (24.6
feet),
Heavy traffic parking is prohibited on streets in any area of the Walkerton ward excepting those areas
that are zoned Industrial or commercial by the current Town of Walkerton Comprehensive Zoning By-
law as amended.
The intent of this provision is to prohibit the practice of parking larger vehicles in a residential
neighbourhood.
Heavy traffic parking is prohibited in Residential zones as defined by the Town of Walkerton's
Comprehensive Zoning By-law as amended.
1.
When appropriate signs have been erected and are on display, heavy traffic is prohibited on:
i.
that part of May Street lying south of Durham Street and north of Huron Street,
ii.
that part of Maple Street lying south of Huron Street and north of Elgin Street,
iii.
that part of Ridout Street lying south west of Maple Street and north of McGivern Street,
iv.
that part of Yonge Street lying south of Durham Street and north of Jackson Street,
v.
that part of McGivern Street lying west of Yonge Street and east of Ridout Street,
vi.
that part of Thomas Street lying south of Durham Street West and north of Ridout Street;
and
vii.
that part of Elgin Street lying west of Yonge Street and east of Maple Street

School Bus traffic is hereby prohibited from travel on Hinks Street excepting the most
southerly two hundred forty (240) meters

Designated Parking Spots for Disabled Persons
The following parking spots are designated exclusively for the use of disabled persons who have been
issued and clearly display in accordance with the Highway Traffic Act and the regulations thereunder a
disabled persons parking permit and these spots shall be signed as such:
