1993 A By-law To Regulate Traffic Within the Corporate Limits of the City of Brockville WHEREAS pursuant to the provisions of Subsections 207 (42), 210 (105) (106)(123), 239 (1) and 314 (7) of the Municipal Act, R.S.O. 1990, Chapter M.45, Councils of all Municipalities are empowered, subject to the Highway Traffic Act, to pass by-laws governing the regulation of traffic on highways and the placing of regulating signs; and WHEREAS it is deemed necessary to amend By-law No. 221-92, and all of its amendments thereto, being a By-law to regulate traffic within the corporate limits of the City of Brockville; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE CITY OF BROCKVILLE ENACTS AS FOLLOWS: 1. THAT By-law No. 21-93 shall be a By-law for the regulation of traffic in the City of Brockville, including Appendix "A" being Schedules I to XIV inclusive, attached herewith. 2. THAT By-law No. 221-92 and any amendments thereto are hereby repealed. 3. THAT this By-law shall take effect upon its being approved by Council. Barnes, District Engineer District # 8, Kingston City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 2 The Council Of The Corporation Of The City Of Brockville Hereby Enacts As Follows: Part I - Interpretation Section 1 - Definitions For the purpose of this By-law: 1.1 "authorized emergency vehicle" means (a) A fire department vehicle, including an emergency crash extrication vehicle, while proceeding to a fire or emergency call or responding to, but not returning from, a fire alarm or other emergency call; (b) A vehicle while used by a person in the lawful performance of his duties as a police officer; (c) An ambulance or cardiac arrest emergency vehicle while responding to an emergency call or being used to transport a patient or injured person in an emergency situation; or (d) An emergency vehicle of a public or private utility, or federal, provincial or municipal department, when such a vehicle is being used in the performance of emergency duties; 1.2 "authorized sign" means any traffic control device or traffic signal placed or erected on a highway under the authority of this By-law for the purpose of regulating, warning or guiding traffic, and includes such signs as described in the Regulations pursuant to the Highway Traffic Act, Revised Statutes of Ontario, 1990, Chapter H.8, as amended; 1.3 "authorized traffic control device" and "authorized traffic signal" means the same as authorized sign; 1.4 "boulevard" means that part of the highway situated between the curb line and the property line of the lot abutting the highway, but does not include a sidewalk, shoulder or combined facility, if any; 1.5 "Chief of Police" means the Chief of The City of Brockville Police Force, or his designate; 1.6 "combined facility" means that portion of a highway between the curb line and the property line of the lot abutting the highway, intended for the use of pedestrians and muscular powered vehicles including wheelchairs; City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 3 1.7 "corner" means the point of intersection of curb lines; 1.8 "Council" means the Council of The Corporation of the City of Brockville; 1.9 "crosswalk" means (a) that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or (b) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface; 1.10 "curb line" means (a) where a curb has been constructed, the line of the front face of curb; or (b) where no curb has been constructed, the edge of the roadway; 1.11 "driver" means a person who drives a vehicle on a highway; 1.12 "driveway" means the improved land on a highway which provides vehicular access from the roadway to adjacent land; 1.13 "Engineer" means the City Engineer, or his designate; 1.14 "farm tractor" means a self-propelled vehicle designed and used primarily as a farm implement for drawing ploughs, mowing- machines and other implements of husbandry and not designed or used for carrying a load; 1.15 "Fire Chief" means the Fire Chief of the Municipality, or his designate; 1.16 "gross weight" means the combined weight of vehicle and load; 1.17 "heavy traffic means a commercial motor vehicle having a weight when unloaded of 3 tonnes or more, or when loaded of 5 tonnes or more, but does not include a passenger vehicle, an ambulance, a vehicle of the Police or Fire Departments, a municipal vehicle, a bus operated by or for the Board of Education, a bus operated by or for the Municipality, a bus operated by a Company having a franchise from the Municipality when operating on routes as approved by By- City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 4 law, or a commercial vehicle making a delivery to or a collection from a bona fide destination which cannot be reached via highway or highways upon which heavy traffic is not prohibited by the By-law; 1.18 "highway" includes a common and public highway, street, avenue, parkway, lane, alley, driveway, square, place, bridge, viaduct or trestle, or any part of which is designed and intended for, or used by, the general public for the passage of vehicles and includes the area between the lateral property lines thereof; 1.19 "Highway Traffic Act" means the Highway Traffic Act, Revised Statutes of Ontario, 1990, Chapter H.8, as amended. 1.20 "intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other; 1.21 "island" means a portion of a highway so constructed or designed as to separate or direct vehicular traffic onto specific portions of the highway; 1.22 "King's highway" means a highway so designated under The Public Transportation and Highway Improvement Act; 1.23 "median strip" means the portion of a highway so constructed as to separate traffic travelling in one direction from traffic travelling in the opposite direction, by a physical barrier or an unpaved strip of ground; 1.24 "motor vehicle" includes an automobile, motorcycle, motor assisted bicycle and any other vehicle propelled or driven otherwise than by muscular power, but does not include a streetcar or other motor vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road-building machine within the meaning of the Highway Traffic Act, Revised Statutes of Ontario, 1990, Chapter H.8, as amended; 1.25 "Municipality" means the Corporation of the City of Brockville; 1.26 "one way street means a highway upon which the movement of vehicular traffic is designated by this By-law for movement in one direction only; City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 5 1.27 "pedestrian means a person on foot, in a wheelchair or in or on a play vehicle, but shall not include a person on a bicycle; 1.28 "pedestrian crossover" means any portion of a roadway designated by By-law of the municipality, at an intersection or elsewhere, distinctly indicated for pedestrian crossing by signs on the highway and lines or other markings on the surface of the roadway, as prescribed by the Regulations pursuant to the Highway Traffic Act, R.S.O., 1990, Chapter H.8 as amended; 1.29 "police officer" means a member of the Brockville Police Force or a person authorized by the Chief of Police to regulate or direct traffic; 1.30 "roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all the roadways collectively; 1.31 "roadway, laned" means a highway that has been divided into separate lanes for vehicular traffic, which lanes are indicated by lines or other markings on the surface of the roadway or in any other manner; 1.32 "safety zone" means the area established within a roadway for the exclusive use of pedestrians, protected or so marked or indicated as to be plainly visible at all times; 1.33 "shoulder" means that part of the highway lying adjacent to the roadway where there is no barrier curb, and which is improved with granular or paved surface which extends for a maximum distance of 3 metres; 1.34 "sidewalk" means that portion of a highway between the curb lines and the property lines of the lot abutting the highway and which is intended for the use of pedestrians. "Sidewalk" shall also include a public walkway and/or footpath designed for and intended to be used by the public for the pass of pedestrians and which is maintained by the Corporation of the City of Brockville; 1.35 "street" means a highway; 1.36 "through highway" means a highway or part of a highway designated as such by this By-law, and every highway intersecting with such City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 6 highway shall be marked by a stop sign or yield right-of-way sign in compliance with this By-law and the Regulations pursuant to the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended; 1.37 "traffic" includes vehicles, pedestrians, animals which are ridden, herded or led, motorized snow vehicles and other conveyances, either singly or together, while on any highway; 1.38 "traffic control device" means any sign or other device on a highway for the purpose of prohibiting, regulating or directing traffic and includes roadway, curb and sidewalk markings; 1.39 "traffic signal" means any device, manually, electrically or mechanically operated for the regulation of traffic; 1.40 "trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport person or property, temporarily drawn, propelled or moved upon such highway and, except for a side car attached to a motorcycle, shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn; 1.41 "truck route" means a truck route established by Part IV of this By- law; 1.42 "U-turn" means the turning of a vehicle within a highway so as to proceed in the opposite direction; 1.43 "vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road building machine, bicycle and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or a streetcar; 1.44 "wheelchair" means a chair mounted on wheels driven by muscular or any other kind of power and used for the carriage of a person who has a physical defect or disability. 1.45 "Community safety zone" means a highway designated in this by-law under the authority of the Highway Traffic Act on which public safety is, in Council's opinion, of special concern. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 7 1.46 "segway" means a two-wheeled motorized personal vehicle consisting of a platform for the feet mounted above an axle and an upright post surmounted by handles. 1.47 "mini-trains" means an electric powered, rubber tired train that has four cars and an engine with a maximum capacity of 450 pounds per car. Section 2 - General Interpretation 2.1 General In this By-law: a) Unless modified or changed herein, words or expressions used have the same meaning as given or used in the Highway Traffic Act; b) Words importing the singular number of the masculine gender only include more persons, parties or things of the same kind than one, and females as well as males and the converse; c) A word interpreted in the singular number has a corresponding meaning when used in the plural; d) "may" shall be construed as permissive; and e) "shall" shall be construed as imperative. 2.2 Abbreviations In the schedules to this By-law the following abbreviations, definitions and symbols stand for the words respectively set forth opposite thereto as follows: a) Ave. - Avenue Blvd. - Boulevard Pl. - Place St. - Street Sq. - Square Cres. - Crescent Ct. - Court b) m - metre mm - millimetre City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 8 cm - centimetre km - kilometre km/h - kilometre per hour c) N. - north S. - south E. - east W. - west d) A.M. - Ante Meridian P.M. - Post Meridian 2.3 Distances Where a distance is used in this By-law as part of a prohibition of parking or stopping within a specified distance of an object, structure, land or a part of a highway, such distance shall be measured: a) along the curb or edge of the roadway from a point in such curb or edge of roadway opposite such object, structure, land or part of a highway, unless the context otherwise requires; and b) from such object, structure, land or part of a highway in all directions. 2.4 Cumulative Effect The various prohibitions of this By-law are cumulative and not mutually self-exclusive. Section 3 - Severability It is declared that if any section, subsection or part of parts thereof of this By-law be declared by any Court of Law to be bad, illegal or ultra vires, such part or parts shall be deemed to be severable and all parts hereof are declared to be separate and independent and enacted as such. Section 4 - Standard Time and Daylight Saving Time Where any expression of time occurs or where any hour or other period of time is stated the time referred to shall be standard time provided, however, if what is known as "daylight saving time" has been generally adopted in the Municipality for any period of the year, under any statute, order-in-council, By-law, resolution or proclamation, whether City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 9 the same is effective in law or not, such time shall be the time referred to during such period in any reference to time in this By-law. Section 5 - Schedules In this By-law: a) the Schedules attached, numbered I to XV inclusive, are included in and shall be considered part of this By-law; and b) where any column in any Schedule referred to is not completed any and all reference to the said column in this By-law shall be deemed to be deleted. Part II - Driving and Related Rules - General Section 6 - Operation of Vehicle 6.1 Obedience to Police Officers, Traffic Signs and Traffic Signals Notwithstanding any provisions of this By-law every person shall promptly obey all signals given by a traffic signal, traffic control device or a traffic sign and all directions given by a police officer having jurisdiction over the regulation of traffic on a highway, and nothing in this By-law shall affect the powers to regulate traffic held by the Police Services Board. 6.2 Emerging from Lanes The driver or operator of a vehicle emerging from a driveway, lane way, lot, building or bus loop on to a highway shall bring the vehicle to a full stop immediately before driving on to a sidewalk or footpath, and upon proceeding shall yield the right-of-way to pedestrians upon the sidewalk or footpath. 6.3 Barricaded Highways No person shall drive, operate or park a vehicle or permit a vehicle to remain parked on any part of any highway barricaded and marked by signs showing that its use for the time is prohibited or restricted. 6.4 Racing Prohibited City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 10 No person shall drive a vehicle or bicycle on a highway in a race or on a bet or wager unless authorized by special permission of City Council. 6.5 Obstructing Traffic No person shall drive or place a vehicle or permit a vehicle to be driven or placed on a highway in such a manner as to obstruct traffic. 6.6 Direction of Traffic When, in the opinion of a police officer, it is necessary for the preservation of public order and safety of the movement of traffic, he shall direct and control traffic and for such purposes shall divert, halt, restrain or direct the movement of traffic while such necessity exists, and every person shall promptly obey his directions. 6.7 Starting, Stopping Vehicles Every person in charge of a vehicle before starting, stopping, turning or changing its course shall take the necessary precaution to make such movement in safety and without interfering with other traffic. 6.8 U-Turns Where U-turns are not prohibited on any highway, no driver of a vehicle shall make a U-turn upon any highway unless it can be made in safety and without interfering with other traffic. 6.9 Sidewalks No person shall keep or leave standing, use, draw, haul or propel any vehicle along or upon any sidewalk except for the purpose of crossing such sidewalk to enter a driveway; provided that this section shall not apply to vehicles used for the carriage of small children or invalids and vehicles approved by the Chief of Police. 6.10 Vehicle Unattended No person driving or in charge of a motor vehicle, other than a commercial motor vehicle, shall allow such motor vehicle to stand unattended unless it is locked in such a manner as to prevent its operation by any person not authorized by the owner, driver or person in charge. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 11 6.11 Repairing Vehicles a) No person shall use any highway to repair or paint vehicles. b) Notwithstanding (a) above, a person may repair or attempt to repair any vehicle upon a highway when such use of the highway is unavoidable through emergency. 6.12 Newly Painted Lines No person shall drive or attempt to drive on or over, or tamper with, or walk on any newly painted line or series of lines, or any newly painted sign, or any permanent pavement marking on any highway or crosswalk, when the presence of such is indicated by marker, electric lanterns or otherwise. 6.13 Removal of Authorized Sign No unauthorized person shall alter, deface, injure, knock down or remove any authorized sign or sign with shield or insignia thereon. 6.14 Interception of Authorized Procession The driver of a vehicle shall yield the right-of-way to a funeral or other properly authorized procession except when directed by a police officer to do otherwise. 6.15 Driving in Authorized Procession The driver of a vehicle in a funeral or other such procession shall drive as near to the right hand edge of the roadway as practicable and follow the vehicle ahead as closely as is practicable and safe. 6.16 Parades The Chief of Police is authorized to stop or divert traffic on any highway during the passage of a parade or a procession. 6.17 Exemption - Municipal Vehicles Performing Work on Highways The provisions of Part II Section 6, Subsections 6.3, 6.5, 6.9, 6.12 and Part lV and Part V of this By-law do not apply to vehicles of the Municipality while such vehicles are engaged in the performance of City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 12 cleaning, clearing, maintenance, repair, construction or other work on any highway. 6.18 Authorized Emergency Vehicles - Exemption Part II Section 6, Subsections 6.2, 6.3, 6.4, 6.6, 6.8, 6.9, 6.10, 6.12, 6.14, 6.16 and Part lV and Part V of this By-law shall not, in the case of emergency, apply to authorized emergency vehicles. 6.19 Physically Handicapped Persons - Exemptions The provisions of Part II Section 6, Subsection 6.9 of this By-law shall not apply to persons operating a motorized or battery operated self- propelled vehicle. 6.20 Emergency Signs The Chief of Police may erect temporary traffic control devices for a period not to exceed 30 days in the case of a special event, emergency or a situation which may arise from time to time. Anyone disobeying these signs shall be subject to the normal penalties provided in this By-law. 6.21 Raised Curbs No person shall drive a motor vehicle over a raised curb except at a place where there is a ramp. 6.22 Guided Segway Tours - Exemption a) Except for the purpose of crossing a roadway at a signed pedestrian crossing location, no person shall operate a Segway on the roadway. Operation of a Segway is restricted to use on the Brock Trail and on Blockhouse Island while operating as part of a guided tour. b) The provisions of Part II Section 6, Subsection 6.9 of this By-law shall not apply to persons operating a Segway as part of a guided Segway tour 6.23 Pedestrian Crossover When an authorized sign is on display on any highway named or described in Schedule XVII of this By-law, any location set out therein is designated as a pedestrian crossover. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 13 Section 7 - Pedestrian Rights and Duties 7.1 Crossing Roadway a) No pedestrian shall cross a highway within 50 metres of a crosswalk except by way of that crosswalk. b) Subject to (a) above no pedestrian shall cross a roadway at any place other than by a route at right angles to the curb or by the shortest route to the opposite curb. 7.2 Yield Right of Way Except where traffic signals are in operation or where traffic is being controlled by a police officer, a pedestrian crossing a highway shall yield the right-of-way to all vehicles upon the roadway, but nothing in this Subsection shall relieve the driver of a vehicle from the obligation of taking all due care to avoid an accident. 7.3 Pedestrian Prohibited on Roadway Except for the purpose of crossing a roadway, where there is a sidewalk that is reasonably passable on one side or both sides of a roadway, no person shall walk on the roadway. 7.4 Pedestrian Barriers No person shall go over or under a pedestrian barrier installed on a sidewalk, or any other location within a highway. 7.5 Playing on Roadway Prohibited a) No person shall play or take part in any game or sport upon a roadway. b) Where there are sidewalks, no person on or riding in or by means of any children's wagon, toboggan or similar device shall go upon a roadway except for the purpose of crossing it and when so crossing, such person shall have the rights and be subject to the obligations of a pedestrian. 7.6 Conduct in the Streets Three or more persons shall not stand in a group or near to one another on any street or sidewalk in such a manner as to obstruct through passage for vehicles or pedestrians after a request to move City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 14 has been made to them by a police officer or other person duly authorized therefor. Nothing in the preceding paragraph shall be construed as prohibiting the congregation of individuals to attend and listen to street preaching so long as the proceedings thereat are peaceful and orderly and sufficient space is left both on the sidewalk and roadway upon which such street preaching shall take place to allow the orderly traffic thereon. Parties so obstructing the same shall upon request as aforesaid, forthwith remove from such position. Section 8 - Coasting 8.1 Coasting Coasting, whether in or on sleighs, toboggans, carts, wagons, skateboards or other similar devices, is prohibited on highways. 8.2 Roller-skating No person on roller skates or riding in or by means of a coaster toy vehicle, skateboard or other similar device shall use or enter a roadway. 8.3 No person shall ride a skateboard, bicycle or roller blades on sidewalks located on a) King Street between Clarissa Street and Bethune Street b) Blockhouse Island c) Court House Avenue at the cenotaph Section 9 - Bicycles 9.1 Operation of Bicycle Every rider of a bicycle shall at all times when riding on a highway keep his feet on the pedals and both hands on the handlebars except as may be necessary to give proper hand signals. No person while riding a bicycle on a highway shall indulge in trick riding or otherwise ride so as to prevent the full use of both hands to control the bicycle. 9.2 Riding Abreast City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 15 No person shall ride a bicycle on any highway abreast of another bicycle except in the course of passing the other bicycle. 9.3 Passengers a) No person, shall on a highway, carry a passenger on a bicycle unless the bicycle is designed for such purposes. b) No person shall ride a bicycle on a highway and carry any goods in such a manner so as to interfere with the full control of the bicycle. 9.4 Parking a) No person shall park a bicycle on any roadway, shoulder, bicycle route or combined facility. b) No person shall park a bicycle on any boulevard or sidewalk except in an upright position and in a manner so as not to impede the intended use of the boulevard or sidewalk. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 16 Section 10 - Construction, Maintenance and Emergency Situations 10.1 Obstructing Traffic No person shall erect barricades or hoardings, store earth or construction material or park work equipment on any portion of any highway without providing proper fencing, lights or any other warning necessary for the sake of safety, subject to the following: a) For a period exceeding thirty (30) days or more, without first obtaining permission from Council; or b) For a period of thirty days (30) days or less, without first obtaining permission from Council or the Engineer. 10.2 Duty to Obey Barricades No vehicle except an authorized emergency vehicle or a vehicle authorized by the Engineer shall be driven through or enter upon any highway which is roped, barricaded or marked by authorized signs which prohibit the use of the highway. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 17 Section 11 - Animals 11.1 Riding on Other Than Roadway No person shall lead, ride or drive any horse, cattle or husbandry upon a sidewalk. 11.2 Attendance While in Motion The driver or other person in charge of an animal drawn vehicle on a roadway shall remain upon the vehicle while it is in motion or walk beside the animal drawing it. 11.3 Parking No person shall leave an animal drawn carriage, cart, wagon, sleigh or sled on a highway without the animal which is drawing it. 11.4 Horseback Riders Horseback riders and other riders or persons in charge of animals shall obey the provisions of the Highway Traffic Act and of this By-law which govern drivers of vehicles and shall obey the direction of any police officer directing traffic. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 18 Part III - Traffic Movements Section 12 - Stop Signs at Intersections (Schedule I) Vehicles travelling on the highways shown in Column 1 of Schedule II attached hereto in the direction stated in Column 2, must come to a stop before entering the intersections listed in Column 3 where stop signs are erected and on display facing traffic. Section 13 - Three-Way Stop Intersections (Schedule II) Vehicles travelling on the highways shown in Column 1 of Schedule II attached hereto in the direction stated in Column 2, must come to a stop before entering the intersections listed in Column 3 where stop signs are erected and on display facing the traffic. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 19 Section 14 - Four-Way (All-Way) Stops (Schedule III) Vehicles travelling on the highways shown in Column 1 of Schedule III attached hereto in the direction stated in Column 2, must come to a stop before entering the intersections outlined in Column 3 where stop signs are erected and on display facing traffic. Section 15 - Traffic Signal Systems (Schedule IV) The Corporation shall erect and operate traffic signals at the intersections and places described in Schedule IV to this By-law. Motorists are required to obey the signals as outlined in this By-law. Section 16 - Yield Right-Of-Way Signs (Schedule V) Vehicles travelling on the highways shown in Column 1 of Schedule V attached hereto in the direction stated in Column 2 must yield the right-of-way at the intersections outlined in Column 3 where yield signs are erected and on display facing traffic. Section 17 - Turns 17.1 Prohibited Left Hand Turns (Schedule VI) When properly worded signs have been erected and are on display, no person operating a vehicle on a highway listed in Column 1 of Schedule VI attached hereto and travelling in the direction listed in Column 2 shall turn left at the intersections listed in Column 3. 17.2 Prohibited Right Hand Turns on Red Light (Schedule VII) When properly worded signs have been erected and are on display, no person operating a vehicle on the streets listed in Column 1 of Schedule VII attached hereto and travelling in the direction listed in Column 2, shall make a right hand turn against a red traffic light at the intersections listed in Column 3. 17.3 Compulsory Turns (Schedule VIII) When properly worded signs have been erected and are on display to indicate the manner in which vehicles are to proceed, the driver of a vehicle on a highway listed in Column 1 of Schedule VIII attached hereto and proceeding in the direction listed in Column 2 of the said Schedule, shall turn the vehicle in the direction listed in Column 4 of the said Schedule, at the intersection listed in Column 5 and shall not City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 20 proceed across the intersection so as to continue in the same direction as the vehicle was travelling when it entered the said intersection. Section 18 - Do Not Enter (Schedule IX) Where properly worded signs have been erected and are on display, no person operating a vehicle shall enter the highway listed in Column 1 of Schedule IX attached hereto from the location listed in Column 2 of the said Schedule. Section 19 - One-Way Streets (Schedule X) Where properly worded signs have been erected and are on display, no person shall drive a vehicle upon those highways, parts of highways or public places listed in Column 1 of Schedule X attached hereto, in any direction other than the direction listed in Column 2 of the said Schedule. Section 20 - Rates of Speeds on Highways (Schedule XI) 20.1 No person shall drive a motor vehicle in the City of Brockville, at a rate of speed greater than 50 km/hr save and except where authorized on a highway or parts thereof, listed in Column 1 of Schedule XI attached hereto, from the location listed in Column 2 of the said schedule, to the location listed in Column 3. The maximum operating speed shall be as prescribed in Column 4 of said schedule. 20.2 Exemption The speed limits prescribed under this Section do not apply to: a) A motor vehicle of a municipal fire department while proceeding to a fire or responding to, but not returning from a fire alarm or other emergency call; b) A motor vehicle while used by a person in the lawful performance of his duties as a police officer; or c) An ambulance. Part IV - Limited Loads, Truck Traffic Section 21 - Reduced Loads on Highways (Schedule XII) 21.1 Highways City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 21 Pursuant to Subsection 122 (7) of the Highway Traffic Act, a reduced load period is hereby declared to be in force on those highways or parts thereof listed in Column 1 of Schedule XII attached hereto from the location listed in Column 2 to the location listed in Column 3 during the months or time periods listed in Column 4 of said Schedule. 21.2 Bridges Where a reduced load period is in effect upon any bridge it shall apply only once. Signs indicating such are on display at each end of the bridge. Pursuant to Subsection 122(7) of the Highway Traffic Act, a load restriction is hereby declared to be in force on those bridges listed in Column 1 of Schedule XVI attached hereto. 21.3 Exemption Subsection 21.1 above does not apply to authorized emergency vehicles, vehicles operated by or on behalf of a Federal, Provincial or Municipal Department, a vehicle operated by a local board, Board of Education, Hydro-Electric Commission, public or private utility or telephone company. Section 22 - Truck Route(s) 22.1 Prohibition No person shall park or drive heavy traffic upon any highway or part thereof except as permitted by authorized truck route signs on display on any highway listed in Column 1 of Schedule XIII attached hereto, from the location listed in Column 2 to the location listed in Column 3 during the time(s) set out in Column 4 of said Schedule. 22.2 Exception a) Subsection 22.1 above does not apply to authorized emergency vehicles, vehicles operated by or on behalf of a Federal, Provincial or Municipal Department, a vehicle operated by a local board, Board of Education, Hydro-Electric Commission, public or private utility, telephone company or any vehicle listed in Column 5 of Schedule XIII to this By-Law. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 22 b) Subsection 22.1 above is of no force and effect unless at least one highway is listed in Column 1 of Schedule XIII and Columns 2 and 3 of said Schedule are completed in conjunction therewith. Section 23 - Heavy Traffic 23.1 Prohibition Where properly worded signs have been erected and are on display prohibiting heavy traffic, no person shall park or drive any heavy vehicle upon any highway or part thereof listed in Column 1 of Schedule XIV attached hereto from the location listed in Column 2 to the location listed in Column 3 during the time(s) set out in Column 4 of said Schedule. 23.2 Exemption a) Subsection 23.1 above does not apply to authorized emergency vehicles, vehicles operated by or on behalf of a Federal, Provincial or Municipal Department, a vehicle operated by a local board, Board of Education, Hydro-Electric Commission, public or private utility, telephone company. b) The provisions of this By-law shall not extend to the use of the said highways for deliveries to or removals from a premise or business abutting thereon. Part V - Community Safety Zones 24.1 The highways described in Schedule XV are designated as community safety zones. 24.2 The designated community safety zones described in Schedule XV are in effect from 7:00 am to 5:00 pm, Monday to Friday from September 1st to June 30th inclusive, excluding the following school holidays: - Professional Development Days - Federal and Provincial Statutory Holidays - March Break - Christmas Break 24.3 The installation of signs identifying the designated community safety zones described in Schedule XV is authorized. City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 23 Part VI - Offences and Penalties Section 24 - Contravention(s) 24.1 Where a motorist or pedestrian is found to be in contravention of the provisions of this By-law, the police officer or by-law Enforcement Officer shall issue a summons to Same. Section 25 - Penalty(s) Upon conviction, the motorist or pedestrian is liable to the penalties prescribed for the offence(s) as recoverable under the Provincial Offences Act. Part VII - Application and Administration Section 26 - Enforcement This By-law may be enforced by police officers and By-law enforcement officers for their jurisdicted area of responsibility. Section 27- Authority to Install Traffic Control Devices & Traffic Signals 27.1 The Chief of Police or Engineer is hereby authorized to place, erect and maintain such authorized signs as may be necessary to give effect to the provisions of this By-Law or which are authorized by the Schedules to this By-law. 27.2 The Chief of Police or Engineer is further authorized for a temporary period not exceeding 30 days to place, erect and maintain such authorized signs as are not otherwise authorized by this By-law, but are required for safety reasons. 27.3 All traffic control signs erected and/or on display as of the effective date of this By-law whether identified in any Schedule to this By-law or not shall be deemed to be authorized signs for the purpose of this By- law. Section 28 - Unauthorized Signs Unless otherwise permitted, no person shall place, maintain or display upon or in view of any highway any sign, signal, marking or device City of Brockville By-law Number 021-1993 - Traffic Bylaw Page 24 which purports to be or is an imitation of or resembles any traffic control device or traffic signal. Section 29 - By-Laws Repealed By-law 221-92 and any and all amendments thereto enacted prior to the passing of this By-law, are hereby repealed. Section 30 - Short Title This By-law may be cited as the Corporation of the City of Brockville Traffic Control By-law. Section 31 - By-Law in Force This By-law shall come into force and take effect only upon passage by Council and, where applicable, by the Ministry of Transportation of Ontario, and provided that any particular provision hereof shall not become effective until the authorized sign, if any, applicable to such particular provision has been erected and is on display.
