DEFINITIONS AND INTERPRETATIONS 1. "Apartment Building" means the whole of a building that contains four (4) or more dwelling units, which have a common entrance from street level and are served by a common corridor and the occupants of the units have the right of use in common of the corridors, stairs, yards, or one or more of them. An "apartment building" includes a maisonette dwelling, but does not include a quadruplex dwelling, a group of row dwellings, nor any other dwelling house otherwise defined herein. 2. "Authorized Emergency Vehicle" means: (a) a fire department vehicle, including an emergency crash extrication vehicle, while proceeding to or returning from a fire or emergency call; (b) a vehicle while used by a person in the lawful performance of his duties as a police officer; (c) an ambulance or cardiac arrest emergency vehicle while responding to an emergency call or being used to transport a patient or injured person in an emergency situation; or (d) an emergency vehicle of a public or private utility, or Federal, Provincial or Municipal Department when such a vehicle is being used in the performance of emergency duties. 3. "Authorized Sign" means any parking or traffic control device or traffic signal placed or erected on a highway under the authority of this By-law for the purpose of regulating, warning or guiding traffic and includes such signs as described in the regulation made pursuant to the Highway Traffic Act, R.S.O 1980, c. 198, as amended. 4. "Boulevard" means that part of the highway situated between the curb line and property line of the lot abutting the highway, but does not include a sidewalk, shoulder, or combined facility, if any. 5. "Bus Stop" means that portion of a highway designated by an authorized sign, for the use of buses as a point for loading and unloading passengers and including an area sufficient to accommodate the length of the bus. 6. "By-law Enforcement Officer" means a By-law Enforcement Officer of the Corporation of the City of Brockville and any other officer authorized by the Corporation of the City of Brockville for the enforcement of By-laws in the City of Brockville. 7. "Chief of Police" means the Chief of Police of the City of Brockville and any person or persons on his staff or under his command and supervision and any person or persons designated by him as may be required from time to time; 3 8. "City" means the Corporation of the City of Brockville. 9. "Commercial Motor Vehicle" means a motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses and tractors used for hauling purposes on the highway. 10. "Controlled Parking Area" means the parking lots or parts of parking lots which are controlled and regulated by parking machines or signs. 11. "Corner" means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic. 12. "Council" means the Council of the Corporation of the City of Brockville. 13. "Crosswalk" means: (a) that part of the highway at an intersection that is included within the confines of the lateral lines of the sidewalk on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or (b) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface. 14. "Cul-de-sac" means a highway terminating in a turn around. 15. "Curb" shall include the edge of the traveled portion of the highway. 16. "Curb Line" means: (a) here a curb has been constructed the line of the curb; or (b) here no curb has been constructed the edge of the roadway. 17. "Designated Building" means an apartment building, hospital, hotel, motel, shopping centre, townhouse, industrial building and municipal facility and any other structure which is used for the accommodation of public or for the gathering or assembling of people. 18. "Designated Officer" means a By-law Enforcement Officer. 19. "Disabled Person Parking Permit" means a permit issued under the Highway Traffic Act or a permit, numbered licence plate or other marker or device issued by another Provincial jurisdiction and recognized under the Highway Traffic Act. 20. "Driver" means a person who drives a vehicle on a highway. 21. "Driveway" means the improved land on a highway which provides vehicular access from the roadway to adjacent land. 4 22. "Fire Access Route" means any road, driveway, lane, ramp or other means of vehicular access or egress and shall conform to the requirements of the Ontario Fire Code Act and Regulations thereto, as amended. 23. "Fire Access Route Sign" means a permanently legible sign, approved by the Fire Chief placed at intervals of not more than 20 metres along the fire access route and shall display the following information: (a) Fire access route; (b) Parking prohibited; (c) Motor vehicles will be tagged and/or towed away; and (d) The number of this By-law; and (e) Shall be a minimum size of 30.5 cm x 45.7 cm (12" x 18"). 24. "Fire Chief" means the Chief Fire Official of the City of Brockville and any person or persons on his staff or under his command and supervision and any person or persons designated by him as may be required from time to time. 24(a) "Heavy Trucks" means a commercial motor vehicle having a weight when unloaded of 3 tonnes or more, or when loaded of 5 tonnes or more, but does not include a passenger vehicle, an ambulance, a vehicle of the Police or Fire Departments, a municipal vehicle, a bus operated by or for the Board of Education, a bus operated by or for the Municipality, a bus operated by a company having a franchise from the from the Municipality when operating on routes as approved by By-law, or a commercial vehicle making a delivery to or a collection from a bona fide destination which cannot be reached via highway or highways upon which heavy traffic is not prohibited by the By-law. 25. "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, via-duct or trestle designed and intended for, or used by, the general public for the passage of vehicles and includes the area between the lateral property lines thereof. 26. "Highway Traffic Act" Unless modified or changed herein, words or expressions used in this by-law have the same meaning as given or used in the Highway Traffic Act, R.S.O. 1980 c. 198, as amended. 27. "Hospital" means a private or public hospital as defined in "The Private Hospitals Act" or "The Public Hospitals Act". 28. "Hotel/Motel" means a building or part of a building in which a minimum of six rooms are rented for gain on a temporary or transient basis. 29. "Industrial Building" means a building or structure for the purpose of manufacturing, assembling, making, preparing, inspecting, ornamenting, finishing, treating, altering, repairing, warehousing, or storing or adapting 5 for sale of any goods, substance, article or thing, or any part thereof and the storage of building and construction equipment and materials. 30. "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other. 31. "Island" means a portion of a highway so constructed or designed as to separate or direct vehicular traffic onto specific portions of the highway. 32. "Issuing Officer" means a Provincial Offences Officer. 33. "Median Strip" means that portion of a highway so constructed as to separate traffic traveling in one direction from traffic traveling in the opposite direction by a physical barrier or an unpaved strip of ground. 34. "Motor Vehicle" includes an automobile, motorcycle, motor assisted bicycle, unless otherwise indicated in this by-law, and any other vehicle propelled or driven otherwise than by muscular power, but does not include the cars of electric or steam railways, or other motor vehicles running only rails or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement or husbandry of road-building machine within the meaning of the Highway Traffic Act, R.S.O. 1980 c. 198 as amended. 35. "Municipal Facility" means a library, arena, swimming pool, community hall, skating rink, administration building owned or controlled by the City, and all other municipal buildings owned or controlled by the City. 36. "One Way Street" means a highway upon which the movement of vehicular traffic is designated by by-law for movement in one direction only. 37. "Park or Parking", when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. 38. "Parking Lot" means an area of land controlled by the City which has been arranged, laid out or improved to provide for the parking of motor vehicles. 39. "Parking Pass" means a device, provided by the City which allows the parking of vehicles in parking meter zones or controlled parking areas. 40. "Parking Meter" means a mechanical or electronic device together with its standard or other means of support, erected for the purpose of: (a) controlling and regulating the parking of any vehicle in a parking space; and 6 (b) measuring and indicating the parking time for which payment has been made, and signaling mechanically or electronically when such time has elapsed. 41. "Parking Meter Area" means those streets, or parts of streets, or parking lots, or parts of parking lots on which parking, where permitted, on such streets or parts of streets or parking lots or parts of parking lots, is controlled and regulated by the use of parking meters. 42. "Parking Permit Area" means those parking lots or parts of parking lots on which parking, where permitted, is controlled and regulated by the use of parking permits. 43. "Police Officer" means a member of the Police Force or a person authorized by the Chief of Police to regulate or direct traffic. 44. "Parking Permit" means a device, provided by the City, at rates established from time to time by Council, which allows parking of vehicles in parking meter zones or controlled parking areas. 45. "Parking Space" means that part of the highway, the use of which is designated by signs or posts or lines or other markings on the highway or any other area used for the purpose of parking a vehicle. 46. "Parking Machine" means a mechanical or electronic device, other than a parking meter, used for the control and regulation of the parking of vehicles measuring and indicating the parking time for which payment has been made, and signaling mechanically or electronically when such time has elapsed. 47. "Person" means a person, firm or corporation used in the normal context of the word. 48. "Roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively. 49. "Sidewalk" means that portion of a highway between the curb lines and the property lines of the lot abutting the highway and which is intended for the use of pedestrians. 50. "Provincial Offences Officer" means a Police Officer, Peace Officer or other person appointed to enforce the by-laws of the Corporation. 51. "Reserved Parking Area" means an area owned or controlled by the City and designated for the purpose of the parking of vehicles, as required. 52. "Shopping Centre" means a group of commercial establishments related to one another by the sharing of a common parking lot and/or driveway, as 7 opposed to a business area comprising unrelated individual commercial establishments. 53. "Shoulder" means that part of the highway lying adjacent to the roadway where there is no barrier curb, and which is improved with granular or paved surface which extends for a maximum distance of 3 metres. 54. "Stand or Standing", when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. 55. "Stop or Stopping", when prohibited, means the halting of a vehicle even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal. 56. "Street" means a highway. 57. "Time" means, whenever certain hours are named herein Standard Time or Daylight Saving Time, whichever shall be in official current use in the City. 58. "Trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily draw, propelled or moved upon such highway, and except for a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn. 59. "Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power does not include a motorized snow vehicle or the cars of electric or steam railways running only upon rails. 8 2. TIME 60. Notwithstanding the Time Act, R.S.O. 1980 c. 501, as amended, so long as the time commonly observed in the City is one hour in advance of standard time, the times mentioned in this by-law shall be reckoned in accordance with the time so commonly observed and not standard time. 3. SCHEDULES AND SEVERABILITY 61. The schedules attached to this by-law shall be read with and form part of this by-law. 62. Should any part, section, subsection or portion of this by-law be repealed or declared by a court of competent jurisdiction to be illegal the same shall not affect the validity of the by-law as a whole or in part thereof, except for that which was declared to be invalid. PART 2 - GENERAL REGULATIONS 4. PARKING PERMITS AND PARKING PASSES AND MUNICIPAL VEHICLES 63. General: (a) The City may make available Parking Permits for the parking of vehicles in the parking areas identified in Schedule "9" and Schedule "10" hereto. (b) Notwithstanding the provisions of anything contained in this by-law, the Chief Administrative Officer or his designate, may issue parking passes or permits and the holder of said passes or permits shall be permitted to park in any of the parking areas, except handicapped parking areas, without being required to pay for such parking privileges, during the period for which said parking passes or permits are valid. (c) Parking passes or permits shall be in a form as prescribed by the Chief Administrative Officer or his designate. (d) Fees for parking passes may be established by Council from time to time. 64. (a) The fees for parking permits shall be established by Council from time to time and the current fees are indicated in Schedule "9" and Schedule "10" of this by-law. (b) Vehicles parking in parking areas shall park as closely as practicable within the limits of the parking spaces provided. (c) The parking space in which vehicles are to be parked shall be designated by lines or marks on the surface of the parking lot or roadway, or designated by other suitable markings or devices. 9 (d) During the times allowed for parking in the areas outlined in Schedule "9" and Schedule " 10" of this by-law, it shall be unlawful to permit a vehicle to remain parked in a parking space unless the vehicle has a current parking permit or pass displayed in the front windshield of the vehicle. The fact that a vehicle is parked in a parking space, during the times allowed in Schedule "9" and Schedule "10" of this by-law, without displaying a current parking permit or pass affixed to the vehicle as described herein, shall be prima facia evidence that such vehicle is unlawfully parked, and it shall be unlawful for any person to cause or permit any vehicle registered in his or her name to be so unlawfully parked. (e) It shall be unlawful for any person to cause or permit any vehicle registered in his or her name to be parked in other than a parking space whether or not a current parking permit or pass is displayed in the vehicle as prescribed herein. 65. (a) The provisions of this by-law shall not apply to the operator of any vehicle used for the purpose of delivering goods, wares, or merchandise or any other commodity sold by the person, provided that a permit has been obtained by the operator of such commercial or other vehicle from the City as provided, and provided that the said operator complies with the provisions of this Section. (b) Any person who in consequence of his business delivers goods, wares, or merchandise to any person, in the City may apply to the City for a commercial parking zone permit and if such permit is granted and the prescribed fee is paid, the operator of the vehicle delivering goods, wares or merchandise as aforesaid may occupy any of the individual parking spaces within the said parking meter zones without using the said parking meters provided that in parking the said vehicle in any of the said areas the operator does not use the said area for a period exceeding 20 minutes, and of the premises to which the goods, wares or merchandise are being delivered, delivery shall be made from such land when possible and no parking space shall be occupied. A commercial parking zone permit, in the form approved by the City, shall be exhibited on the passenger side of the front windshield of the vehicle for which the permit has been issued. (c) The permit fee for each Commercial Parking Zone Permit shall be $30.00 for each calendar year or portion thereof. (d) No vehicle of greater length than six metres shall be parked in any metered area designated for parking of vehicles at an angle to the sidewalks, curb or boulevard. (e) For the purposes of this Section, a vehicle which may be entitled to display a Commercial Parking Zone Permit shall be a commercial 10 vehicle as defined herein or other delivery vehicle upon which is affixed a permanent business sign, business name or business logo which clearly describes the business pursuit of the owner/operator of the said vehicle. 66. Municipal Vehicles (a) Any vehicle owned by the City of Brockville or the Brockville Public Utilities Commission shall be permitted to park in any parking area, and the operator of such vehicle shall not be required to deposit any coins in the meter(s) adjacent to any such parked vehicle. (b) Any vehicle operated by, or operated on behalf of the City of Brockville may be furnished with permits or passes referred to in this by-law and the operator of such vehicle shall display the required parking permit or pass in the form approved and shall not be required to deposit any coin or coins in the meter adjacent to such vehicle provided that the provision of the Section shall apply only when the said vehicle is being used by the owner operator thereof in the performance of his duties as an employee of the City. 5. RESERVED PARKING 67. (a) Council may establish reserved parking areas which are to be used solely for the parking of vehicles which display a parking pass or parking permit. (b) No person, firm or corporation shall park or allow to be parked a vehicle in a reserved parking area unless an approved parking pass or parking permit is displayed in the front windshield of the vehicle. 6. CONTROLLED PARKING 68. (a) The provisions of this Section shall apply to those parking lots as described in Schedule "10" of this by-law. (b) Vehicles parking in controlled parking areas shall park as closely as practical within the limits of the parking space provided. (c) The parking spaces in which vehicles are to be parked shall be designated by lines or markings on the surface of the pavement parking lot or designated by other suitable markings or means. (d) On the days and between the hours specified in Schedule "10" of this by-law, it shall be unlawful to permit a vehicle to remain parked in a parking space in a controlled parking area for a period of time in excess of the time indicated in Schedule "10" to this by-law 11 whether or not a coin or coins in excess of the prescribed fee is or are deposited in the parking machine controlling the said controlled parking area. Where the parking limit is designated by signs and not by a machine as noted above, no person shall park in excess of the time limit indicated on said signs. After having committed an offence as hereinbefore prescribed, it shall be deemed to be a separate and additional offence for each additional hour during which the vehicle is so permitted to remain. (e) Parking machines may be erected, maintained and operated in a controlled parking area, for the purpose of controlling and regulating parking of any vehicle in such area and measuring and recording the duration of such parking in the controlled parking areas as described in Schedule "10" of this by-law. (f) Except or otherwise provided in this by-law, the parking of vehicles in controlled parking areas, unless a parking machine or parking meter is made use of and the appropriate fee paid, is prohibited, and the privilege of the parking of vehicles in the controlled parking area is hereby limited to such drivers as do make use of the said parking machine or parking meter and pay the said appropriate fees as outlined in Schedule "10" to this by-law between the hours of 9:30 a.m. and 6:00 p.m. Monday through Friday of each week. (g) In addition to the foregoing it shall be unlawful to permit a vehicle to remain parked in a parking space in a controlled parking area unless the driver of said vehicle makes use of the parking machine or parking meter and pays the appropriate fees. The fact that a vehicle is parked in a controlled parking area parking space, as outlined in Schedule "10" of this by-law, without paying the appropriate fees shall be prima facia evidence that such vehicle is unlawfully parked. (h) Vehicles parked in contravention of Section 6(68) may be tagged and towed away upon the order of any Police or By-law Enforcement Officer at the owners expense. 12 68.1 Controlled Parking for Boat Trailers: (a) The provisions of this Section and subsection shall apply to those parking lots described in Schedule 16 of this by-law (b) The municipal parking lots described in Schedule 16 are designated parking lots in which the payment of parking fees are required in order to be parked lawfully during the periods of time described in Schedule 16. Where the parking limit is designated by signs and not by a machine, no person shall park in excess of the time limit indicated on said signs. (c) No person shall park a vehicle in the lots indicated on Schedule 16 unless he or she has paid the required fee or has applicable permit. (d) No person shall park a vehicle without a trailer in the lots indicated on Schedule 16. (e) Residents of Leeds and Grenville are eligible to purchase a Seasonal Parking Permit for the lots indicated in Schedule 16 upon proof of residency. Persons not living within Leeds & Grenville are not eligible for Seasonal Parking Permits. (f) Vehicles parked in contravention of Section 68.1 may be tagged and towed away upon the order of any Police or By-law Enforcement Officer at the owners expense. 7. DISABLED PERSON PARKING 69. (a) Council may establish parking areas on highways, in City parking lots, on City owned or controlled lands or on private property which are to be used solely for the parking of vehicles which display a disabled person parking permit. (b) The said parking areas shall be clearly marked as areas set aside for the parking of vehicles displaying a disabled person parking permit. (c) (Repealed by By-law 147-90) (d) The said disabled person parking permit shall be displayed on the sun visor or on the dashboard of the vehicle so that the international symbol of access for the disabled, the permit number and the expiry date of the permit are clearly visible from the outside of the vehicle." (e) Those areas and locations listed on Schedule "11" and Schedule "12" are designated as disabled persons parking areas. 13 (f) No person, firm or corporation shall park, or permit to be parked, a vehicle in a disabled persons parking area unless said vehicle is equipped with a disabled person parking permit. (g) No person, corporation nor organization shall display a Disabled Person Parking Permit in any vehicle unless that person, corporation or organization is operating a vehicle which is being used to pick up or transport the holder of a disabled person parking permit. (h) No person shall, (i) Have in his or her possession a disabled person parking permit that is fictitious, altered or fraudulently obtained; (ii) display a disabled person parking permit otherwise than in accordance with this By-law; or (iii) fail or refuse to surrender a disabled person parking permit in accordance with this By-law; (iv) Every person having possession of a disabled person parking permit shall, upon the demand of a police officer, police cadet or municipal law enforcement officer surrender the permit for reasonable inspection to ensure that the provisions of this By-law are being complied with; (v) An officer or cadet to whom a disabled person parking permit has been surrendered may retain it until disposition of the case if the officer or cadet has reasonable ground to believe that the permit, a. was not issued under the Highway Traffic Act; b. was obtained under false pretenses; c. has been defaced or altered; d. has expired or been cancelled; or e. is being or has been used in contravention of this By-law. (i) A police officer, police cadet or municipal law enforcement officer upon discovery of any vehicle parked or left in contravention of this Section, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle which may be enforced in the manner provided by Part III of the Repair and Storage Liens Act, 1989. PART 3 - PARKING AND STOPPING 8. METHOD OF PARKING 14 70. (a) Parallel No person shall park a vehicle on any street, other than a one-way street, unless on the right-hand side of the street having regard for the direction in which the vehicle had been proceeding and unless the right front and right rear wheels or runners of the vehicle are paralleled to and distant respectively not more than 15 cm from the edge of the roadway, provided that this provision shall not apply where angle parking is specifically authorized by by-law. (b) Angle Where angle parking is permitted, no person shall park a vehicle except at an angle as marked, consistent with the line markings. (c) One-Way Streets Where parking is permitted on a one-way street a person may park a vehicle facing only in the direction in which it was proceeding and with the right front and right rear wheels paralleled to and not more than 15 cm. from the edge of the roadway, providing that this provision shall not apply where parking on the left-hand side of a one-way street is specifically authorized by by-law. (d) Motorcycle Parking A maximum of three (3) motorcycles be permitted per parking space. 71. PARKING PROHIBITED AT ANY TIME No person shall park or cause to be parked a vehicle in any of the following places; 1. On a sidewalk; 2. In front of a public or private driveway; 3. Within an intersection; 4. Within a distance of 3 metres from any fire hydrant and for the purpose of this Section, such distance shall be defined as being measured longitudinally along the curb or edge of the traveled road as the case may be, from the vehicle to a point on a line at right angles to the roadway and passing through the centre of the hydrant; provided that where a vehicle is properly parked in a designated parking area marked on a highway, the 3 metres distance shall not apply; 5. On a crosswalk; 15 6. Within 9 metres of a crosswalk at an intersection; 7. On private property without the consent of the owner or occupant of such property; 8. On any bridge, or the approaches thereto; 9. In any subway, or the approaches thereto; 10. On any street in such a manner as to obstruct traffic; 11. In such a position as will prevent the convenient removal of any other vehicle previously parked or standing; 12. On City owned or controlled lands, except designated parking areas, without the consent of the City; 13. On a boulevard; 14. In front of the entrance to any place where goods or merchandise are regularly delivered or removed when properly worded signs have been erected; 15. In front of the entrance to a hospital; 16. On any roadway for an unreasonable time having regard for the traffic requirements for such roadway and in no case for a longer period than twenty-four hours. 72. PARKING PROHIBITED WHERE AUTHORIZED SIGNS ARE ON DISPLAY Where authorized signs prohibiting parking are on display, no person shall park a vehicle at any time in the following places: (a) On any highway or parts thereof named or described in Schedule "1" to this by-law. (b) In a fire access route; (c) On any highway in front of the entrance to a theatre, auditorium, office building or apartment building; (d) On any highway in front of an entrance to any place where goods or merchandise are regularly delivered or removed; (e) In a cul-de-sac within the turn around; (f) On any highway within 15m of the termination of a dead end highway; (g) On a public lane; (h) On both sides of a highway within 30m of a pedestrian crossover; 16 (i) On any highway within 50m or less of an intersection; (j) On any highway within 50m of a level railway crossing; (k) In a reserved parking area; (l) On both sides of a highway having a pavement width of less than 7.4m; (m) On one side of any highway having a pavement width of less than 7.4m and in excess of 4.9m where such highway has been designated by by-law as a one-way street; or (n) On one side of any highway having a pavement width of not less than 7.4m nor more than 11.6m. 73. PARKING PROHIBITED - SIGNS ERECTED In addition to the foregoing provisions of this by-law, the parking of vehicles is prohibited when properly worded signs have been erected: (a) On both sides of a street having a pavement width of less than 7.4 metres; (b) On one side of any street having a pavement width of less than 7.4 metres and in excess of 4.9 metres where such street has been designated by by-law as a one-way street; or (c) On one side of any street having a pavement width of not less than 7.4 metres nor more than 11.6 metres. (d) On any highway or part thereof listed in Schedule "15" attached hereto, from the location listed in Column 2 to the location listed in Column 3 during the times set out in Column 4 of said Schedule 17 74. NO PARKING FOR RESTRICTED TIMES (a) Times and Months During those times and months described in Schedule "2", no person shall park or permit to be parked a vehicle for a period longer than is indicated in the said Schedule. (b) Side of Highway Where authorized signs to that effect are on display, no person shall park a vehicle on any highway or parts thereof named or described in Schedule "3" to this by-law, during the times and days indicated. (c) When authorized signs have been erected and are on display, no person shall park a vehicle on any of the highways or part of highways named or described in Schedule 13 to this by-law, except on the side or sides of highways set out, during the times and/or days set out, for the length of time set out in the said Schedule. (d) When authorized signs have been erected and are on display, no person shall park a vehicle on any of the highways or part of highways named or described in Schedule 5 to this by-law, except on the side or sides of highways set out, during the times and/or days set out, for the length of time set out in the said Schedule. (e) No person shall park a vehicle or permit a vehicle to remain parked on a highway within two (2) hours from the time of its removal from a part of highway referred to in subsection (c) or Schedule 13 to this by-law, within two hundred and fifty (250) metres of such part of highway. 75. EMERGENCY PROHIBITION OF PARKING (a) Prohibited Parking And Procedures Notwithstanding anything to the contrary contained herein, the Chief of Police, Fire Chief, Peace Officer or By-law Enforcement Officer, during any emergency or special circumstance may; (i) prohibit any or all parking on a highway within the area affected by the emergency or special circumstances; (ii) authorize the erection of "No Parking" traffic control devices and traffic signals; or (iii) declare that any vehicle already parked is parked illegally regardless of the time permitted for parking such vehicle under the provisions of this by-law. (b) Notification 18 Where possible, the owner or driver of a vehicle declared to be illegally parked shall be notified by a Police Officer, Police Cadet or By-law Enforcement Officer that such has been prohibited. (c) Removal Where: (i) the owner or driver so notified to remove the vehicle does not do so; or (ii) Where the owner or driver cannot immediately be located, then the said vehicle may be removed and impounded forthwith by an order of the Chief of Police, Fire Chief, or a Peace Officer and at the owner's expense. All costs and charges for removing, care and storage of any vehicle removed or impounded are a lien upon the vehicle which may be enforced in the manner provided by Section 52 of the Mechanic's Lien Act R.S.O. 1980, and amendments thereto. 76. ANGLE PARKING Where pavement markings or other devices are on display, angle parking is permitted on any highway or parts thereof named or described in Schedule "4" to this by-law. 77. BOULEVARD PARKING Where authorized signs permitting boulevard parking are on display, boulevard parking is permitted on any highway or parts thereof." 78. STOPPING PROHIBITED No person shall at any time stop a vehicle in the following places, unless otherwise posted: (1) on or within 6 metres of a crosswalk other than at an intersection controlled by a traffic signal; (2) on or within 25 metres of any crosswalk at an intersection controlled by a traffic signal; (3) within 3 metres of a fire hydrant; (4) in such a position so as to obstruct any pedestrian passageway; (5) adjacent to any median strip or island; (6) on either side of a highway that is divided by a median strip; (7) within 15 metres of either side of a signed bus stop, excepting public transit buses; 19 (8) on or within 100 metres of a bridge, over, under or across which the highway passes; (9) within a school bus loading zone, excepting school buses; or (10) on or within 3 metres of a railway crossing. 79. STOPPING PROHIBITED Where authorized signs prohibiting parking are on display, no person shall at any time stop a vehicle in the following places: (1) within 50 metres or less, of an intersection on a highway; (2) on the side of a roadway abutting any school property; (3) on the side of a roadway abutting any park or playground; (4) in front of or within 15 metres of either side of any Fire Hall on the same side of the highway as the Fire Hall, or within 45 metres from a point in the curb or edge of roadway directly opposite the centre point of the Fire Hall on the opposite side of the highway from the Fire Hall; (5) on any highway or parts thereof named or described in Schedule "6" to this by-law; or (6) in a bus stop; (7) a distance of 24 metres west of Perth Street on the north side of King Street during the time indicated on the signs on display. 80. LOADING ZONES (a) Where properly worded signs identifying a loading zone have been erected and are on display, no person shall stand or park any vehicle, except as may be provided for on the signs identifying the loading zone, other than a commercial vehicle in any area designated as a loading zone. Those areas listed in Schedule "8" are hereby designated as loading zones. Commercial vehicles shall not be parked in a loading zone for a period exceeding twenty (20) minutes. (b) Tour Bus Loading and Unloading Zone - The locations described in Schedule "17" are designated as tour bus loading and unloading zones that are reserved, at all times, for the parking of tour buses for a maximum of 15 minutes, and no person shall park a vehicle, other than a tour bus, in a tour bus parking zone. 81. GOVERNING PARKING IN FRONT OF RESIDENCES, ETC. (a) No person shall park a vehicle on any part of a street or highway for a period longer than three (3) hours between the hours of 7:00 am and 11:00 pm, and if such vehicle is removed it shall not be parked 20 within three hundred (300) metres from the point at which it was first parked within one (1) hour from the time of its removal. (b) No person engaged in the business of selling, storing, repairing, exhibiting for sale or renting vehicles, shall park the same while engaged in any such business, upon any street. (c) No person shall repair, or cause to be repaired, a vehicle in a street except that this section shall not apply to temporary repairs as may be necessary to allow such vehicle to be moved. (d) Notwithstanding Section (a), when signs are posted to the contrary, parking shall be permitted in accordance with the signs posted. 82. TAXI STANDS (a) Where authorized signs stating "Taxi Stand" are on display, No person shall stop a vehicle, other than a taxi cab. (b) Notwithstanding the provisions governing the parking of taxi cabs herein contained, such vehicles may park in other parking areas when the top light designating such vehicle as a taxi has been removed and under such circumstances said vehicle shall be subject to all other provisions of this By-law. 83. OVERNIGHT PARKING PROHIBITED (a) Except for authorized emergency vehicles, no person shall park on any highway in the City of Brockville between the hours of 2:00 a.m. and 7:00 a.m. during the months of November through March inclusive, with the following exceptions: (b) Parking will be permitted between the hours of 2:00 a.m. and 7:00 a.m. until after the first significant snowfall occurs. A public notice at that time will inform the general public that the Winter Control Parking By-law is now in effect. (c) Upon public notice that the Public Works division will be executing their ice and snow control operation (road snow plowing and/or snow removal), the parking prohibition time will be extended until 11:00 p.m. on the evenings that this operation is taking place. The City will inform the public by 6:00 p.m. each evening that the operation is to take place. (d) The area of extended parking prohibition will be restricted to the following geographical areas depending upon the extent and type of operation announced and engaged: 1. City wide 2. Area south of the CNR 3. Area between CNR & 401 21 4. Area north of 401 (e) (Repealed by By-law 315-90) (f) No person shall park a vehicle between the hours of 1:00 a.m. and 7:00 a.m. in the following areas where properly worded signs are on display to that effect: (i) Market Street West Parking Lot (ii) Home Street West Parking Lot (iii) George Street West Parking Lot (iv) Water Street West Parking Lot (v) Henry Street Parking Lot (vi) John Street Parking Lot (vii) Buell Street Parking Lot (viii) St. Paul Street/King Street West Parking Lot (ix) Home Street (South of Water Street, west side) (x) Ernie Fox Quay (between Home Street and Apple Street, south side) (xi) Kincaid Street (south of Water Street, east side) 84. TOWING Vehicles parked in contravention of Section 70, 71, 72, 73, 74, 78, 79, 80, 81, 83 & 87 may be tagged and towed away upon the order of any Police Officer or By-law Enforcement Officer at the owner's expense. 85. DISABLED VEHICLES Paragraph 83 of this Part does not apply to the driver or operator of a vehicle that is disabled while on a highway such that it is impossible to avoid temporarily a contravention of such provisions. 86. EXEMPTION Section 88 shall not apply to authorized emergency vehicles or vehicles of a public or private utility, telephone company or, Federal, Provincial, Municipal Department, or City of Brockville Police Force when such vehicle is actually engaged in work being carried out within the highway. 87. PARKING ON PRIVATE LANDS No person shall park or leave any vehicle on private property without the consent of the owner or occupant of such property. 22 PART 4 - METER PARKING 9. GENERAL 88. LOCATION Metered Parking and parking meters shall be located, erected, maintained and operated at the parking spaces on those highways and parts of highways described in Schedule "9" to this by-law and metered parking shall be in effect in those areas unless otherwise provided for in this by- law. 89. METER PARKING RESTRICTIONS (a) No person shall park a vehicle in any metered parking area for a period longer than is indicated by sign, either upon the meter or otherwise, for longer than the time periods set out in Schedule "9" between the hours of 9:00 a.m. and 5:00 p.m. on Monday through Friday inclusive. (b) No person shall park a vehicle in any metered parking area without depositing in the adjacent parking meter and turning the handle if any, after deposit of each coin, the parking fees prescribed in Schedule "9" to this by-law. (c) No person shall park a vehicle in any metered parking area or leave parked in any metered parking area, any vehicle at any time when the words "expired time" or "violation" are indicated on the adjacent parking meter. (d) No person shall deposit or cause to be deposited in any parking meter anything except nickels, dimes, quarters, or dollar coins of lawful money of Canada or such similar coins of lawful money of the United States of America. (e) No person shall park a vehicle in any metered parking area listed in Schedule "9", except in a parking space. (f) No person shall park a vehicle in any metered parking area when a Municipal Department has placed a meter bag or other device on the adjacent parking meter thereby prohibiting the use of the parking space. 90. TOWING Vehicles parked in contravention of Section 89 may be tagged and towed away by order of the Police, a Police Cadet or a By-law Enforcement Officer, at the owner's expense. 91. COLLECTIONS OF COINS The collection of the coins deposited in the parking meters on the highways shall be under the control of the City. 23 92. DAMAGING PARKING METERS & SIGNS No person shall damage, deface or tamper with any parking control sign or parking meter or parking machine, meter, and no unauthorized person shall move, open or attempt to open the same. 93. FUNERALS AND WEDDINGS (a) Churches and Funeral Homes, within the parking meter zone at which wedding or funeral services are being held, may place signs of a type and in a manner approved by the Chief of Police, the Engineer or his designates indicating that parking, except for those attending such services, is temporarily prohibited in the parking spaces so marked for a period of one hour in advance of, and during, the scheduled time of such service. (b) No person other than those persons attending the services referred to in subsection (a) herein, within a period of one hour in advance of and during the scheduled time of such service, shall park or leave parked any vehicle in the parking spaces so marked as set out in subsection (a). (c) Notwithstanding the provisions of subsection (b) it shall not be necessary for an owner or driver of a vehicle parked in connection with the services referred to in subsection (a) herein within the parking meter zone to deposit any coin in respect of a period of one hour in advance of, and during, the scheduled time of such service. 94. EXEMPTIONS Section 93 shall not apply to authorized emergency vehicles when such a vehicle is actually engaged in work being carried out within the highway. 95. HOODING OF PARKING METERS (a) When, as a result of construction or maintenance or other similar purposes metered parking spaces are required to be occupied solely by vehicle or materials required for said purposes the person responsible for or associated with said works shall apply to the City, for hoods which shall clearly indicate that parking is not permitted in the parking spaces normally served by the parking meters which are hooded. (b) The fees for the use of said hoods are as follows: Single Hooded Meters Doubled Hooded Meters $ 0.50 / hour $ 1.00 / hour $ 6.50 / day $ 13.00 / day $20.00 / week $40.00 / week 24 Plus a deposit of $20.00 per single hood; and Plus a deposit of $25.00 per double hood (c) During the period that a meter is hooded as described herein, no person shall park or permit to be parked a vehicle registered in his or her name in a parking space for which the parking meter has been hooded. This Section does not apply to the vehicle or vehicles which are used in the work for which parking meters have been hooded. (d) Failure to return the meter hood/hoods on expiration of the time for which it/they were rented will result in additional rental charges being levied until said hood/hoods are satisfactorily accounted for or returned to the City. (e) Should the rented hood/hoods not be accounted for the person having rented the hood/hoods shall forfeit the deposit. PART 5 - OFFENCES AND PENALTIES 10. PENALTIES 96. VOLUNTARY PAYMENT OF PENALTIES (a) Form of Notice Where a vehicle is found to be in contravention of the parking or stopping provisions of this by-law, the Issuing Officer may issue and place on the vehicle a serially numbered Parking Infraction Notice in the form prescribed by the Provincial Offences Act. The serially numbered Parking Infraction Notice shall state: 1. the license number and description of the vehicle; 2. the nature of the alleged infraction; 3. the date, time and place of the alleged infraction; 4. the minimum fee provided herein for the violation; 5. that the owner thereof may within seven (7) days pay the minimum fee provided for the infraction by taking it or forwarding it to the Tax Office of the City at City Hall between 08:30 hours and 16:30 hours, exclusive of Saturdays, Sundays and holidays; 6. that the owner thereof shall within fifteen (15) days pay the set fine provided for the infraction by taking it or forwarding it to the Tax Office of the City at City Hall between 08:30 hours and 16:30 hours, exclusive of Saturdays, Sundays and holidays. 25 (b) Copies of Forms The Parking Infraction Notice mentioned in Subsection (a) above shall be prepared as required and the Issuing Officer shall attach one copy to the vehicle and deliver the other copy or copies to the By-law Enforcement Office of the City. (c) Recovery If voluntary payment is not made in accordance with the procedure set out on the Parking Infraction Notice provided for in subsection (a) above, the Provincial Offences Act, as amended shall apply. 97. MINIMUM AND MAXIMUM PENALTIES (a) Amount For any contravention of those infractions set out in Schedule "14" to this by-law the minimum penalty shall be set out in Column 3 and the set fine shall be the amount approved under the Provincial Offences Act, as amended. (b) General Penalty Every person who contravenes any provision of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act. (c) Owner Penalties The owner of any vehicle which is found in contravention of any of the parking or stopping provisions of this by-law is guilty of the offence and is liable to the penalty or fines provided by law for such contravention unless at the time of such contravention the vehicle was in the possession of some person other than the owner without the owner's consent. PART 6 - APPLICATION AND ADMINISTRATION 11. ENFORCEMENT AND AUTHORITY 98. ENFORCEMENT This by-law may be enforced by Police Officers, Peace Officers and By- law Enforcement Officers of the City. 99. PARKING CONTROL DEVICES (a) The Chief of Police, Fire Chief, Engineer, Chief Planning Officer, or their designates are hereby authorized to place, erect and maintain 26 such authorized signs as may be necessary to give effect to the provisions of this by-law or which are authorized by the Schedules to this by-law. (b) The Chief of Police, Fire Chief, Engineer, Chief Planning Officer, or their designates are further authorized for a temporary period not exceeding 30 days to place, erect and maintain such authorized signs as are not otherwise authorized by this by-law, but are required for safety reasons. (c) All parking control signs and parking meters erected and/or on display as of the effective date of this by-law whether identified in any schedule to this by-law or not shall be deemed to be authorized signs for the purposes of this by-law. 100. UNAUTHORIZED SIGNS Unless otherwise permitted, no person shall place, maintain, or display upon or in view of any highway any sign, signal, marking or device which purports to be or is an imitation of or resembles any parking control device. 12. BY-LAWS REPEALED 101. THAT the following By-laws and parts of By-laws be and are hereby repealed: (a) Those parts of by-law 212-78, Being a by-law to Prohibit The Parking of Motor Vehicles In Fire Access Routes To And From Apartment Buildings And Other Structures Used For The Accommodation Of The Public Or For The Gathering Or Assembling Of People prescribing penalties; (b) By-law 43-82, being a by-law to Prohibit The Parking Or Leaving Of Motor Vehicles on Private Property without the Authority from the Owner or Occupant of Such Property; (c) By-law 142-80, being a by-law to Regulate and Control the Parking of Vehicles in the City of Brockville; (d) Those parts of By-law C1428, being a by-law for the Regulation of Traffic which touch upon the matters of parking; and (e) By-law 281-86, being a by-law to Provide for the Establishment of Parking Facilities for the Handicapped on lands not owned by the Corporation of the City of Brockville. 13. SHORT TITLE 102. This by-law may be cited as "The Parking By-law". 27 14. EFFECTIVE DATE OF BY-LAW/BY-LAW IN FORCE 103. (a) This by-law shall come into force on the 1st day of September, A.D., 1989. (b) The restrictions to parking as set out in this by-law having to do with metered parking and controlled parking shall not be effective on the following days; New Year's Day, Good Friday, Victoria Day, Dominion Day, Labour Day, Christmas Day, Boxing Day, Thanksgiving Day, any Saturday, any Sunday or other holiday declared by Civic proclamation.
