By-law 2022-1772 - Traffic and Parking Page 1 of 11 THE CORPORATION OF THE MUNICIPALITY OF CALLANDER BY-LAW NO. 2022-1772 Being a By-law for the regulation of Traffic and Parking on Highways within the Municipality of Callander Office Consolidated Version - including amendments made by By-laws 2022-1778, 2023-1870 WHEREAS Sections 100, 101 and 102 of the Municipal Act, S.O. 2001 c.25, as amended, empowers municipalities to prohibit or regulate parking. WHEREAS Subsection 128(2) of the Highway Traffic Act, R. S. O. 1990, Chapter 8, authorizes the Council of a municipality to prescribe a rate of speed for motor vehicles driven on any highway or portion of highway under its jurisdiction. WHEREAS Subsection 128 (5) of the Highway Traffic Act, R.S.O. 1990, Chapter 8, authorizes the Council of a municipality designate a portion of a highway under its jurisdiction that adjoins the entrance to or the exit from a school and that is within 150 metres along the highway in either direction beyond the limits of the land used for the purpose of the school. WHEREAS pursuant to Section 214.1(1) of The Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended, the council of a municipality may by by-law designate a part of a highway under its jurisdiction as a Community Safety Zone if, in the council's opinion, public safety is of special concern on that part of certain highways; WHEREAS Council may authorize the creation and designation of parking spaces on municipal or private property for the exclusive use of vehicles which are displaying a permit in accordance with the requirements of the Highway Traffic Act and the regulations made thereunder, the Municipal Act, 2001 and the regulations made thereunder, and the Ontarians with Disabilities Act and the regulations made thereunder and this By-law. AND WHEREAS the Council may create special parking exemptions for the drivers and operators of vehicles which are displaying a permit in accordance with the requirements of the Highway Traffic Act and the regulations made thereunder and this By-law. WHEREAS it is deemed desirable to provide for the enforcement necessary to prevent the unauthorized use of such permits, designated parking spaces and exemptions. WHEREAS Section 181 of the Highway Traffic Act, R.S.O. 1990, c. H.8 empowers municipalities to regulate the depositing of snow on highways or bridges. AND WHEREAS the paved shoulder in the Osprey Subdivision was identified in the Municipality's Active Transportation Plan as a link from the Kate Pace Way to Main Street in Callander. NOW THEREFORE The Council of the Corporation of the Municipality of Callander enacts as follows: PART 1 - DEFINITIONS (1) In this By-Law: (a) "Authorized sign" means any sign, or any marking placed or made on any highway or roadway, curb, sidewalk, or public place by the Municipality. (b) "Boulevard" means an area between: 1. the outer edge of the shoulder of a roadway and the sidewalk or property line; or 2. where there is a curb along the roadway between the curb and the sidewalk or property line. (c) "Commercial motor vehicle" means a motor vehicle having attached to it a truck or delivery body and includes an ambulance, a hearse, a casket wagon, a fire apparatus, a bus and a tractor used for hauling purposes on a highway; (d) "Corner" means the point of intersection of curbs or edges of the portion of the highway By-law 2022-1772 - Traffic and Parking Page 2 of 11 used for vehicular traffic. (e) "Council" means the Council of the Corporation of the Municipality of Callander. (f) "Crosswalk" means: 1. that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or 2. any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface. (g) "Curb" means the raised edge of the outer limits of the traveled portion of the roadway. (h) "Designated Parking Space" means a parking space designated under this by-law for the exclusive use of a vehicle displaying a permit in accordance with the requirements of the Highway Traffic Act regulations and this bylaw. (i) "Emergency Vehicle" means vehicles of the police and fire departments, ambulances, civil defence, and public utility emergency vehicles. (j) "Gross Weight" means the registered gross weight of the vehicle. (Includes Load). (k) "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle designed and intended for, or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof, and "street" and "road" shall have a like meaning. (l) "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses another. (m)"Lane" means the entire width of the roadway surface between property lines at the rear or side of places of business or residential properties. (n) "Motor Vehicle" includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in this by-law and any other vehicle propelled or driven otherwise than by muscular power, but does not include a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road building machine within the meaning of this by-law. (o) "Municipal By-Law Enforcement Officer" means the By-Law Enforcement Officer appointed by the Corporation of the Municipality of Callander. (p) "Municipality" means the Municipality of Callander. (q) "Park/Parking" and "Stand/Standing" means, when prohibited, the stopping of a vehicle, whether occupied or not, except for the purpose of and while engaged in loading or unloading goods and/or passengers, unless otherwise prohibited in this By-law. (r) "Pedestrian" means any person who is not on a bike or in a vehicle, regardless of what the person is doing. (s) "Permit" means an Accessible Parking Permit issued under the Highway Traffic Act. (t) "Person" includes a person, owner, firm, association, co-partnership, joint venture, corporation, or any entity, public or private in nature. (u) "Police Officer" means a sworn officer as defined by the Police Services Act in the Province of Ontario. (v) "Private road or driveway" means every way or place in private ownership and used for vehicular traffic by the owner and those having expressed, or implied permission given by the owner or duly authorized agent. (w) "Roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder or the sidewalk, and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all the roadways collectively. (x) "Sidewalk" means the part of the highway specifically set aside or commonly understood to be for pedestrian use, typically consisting of a paved surface but does not include By-law 2022-1772 - Traffic and Parking Page 3 of 11 crosswalks, medians, boulevards, shoulders or any part of the sidewalk where cleared snow has been deposited. (y) "Stop/Stopping" means, when prohibited, the complete cessation of movement of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or of a traffic control sign or signal. (z) "Storage" means any vehicle parked in the same location for more than 72 hours. (aa) "Traffic" includes pedestrians, ridden or herded animals, vehicles, and other conveyances either singly or together while using any highway for the purpose of travel. (bb) "Traffic Control Device" means any sign, roadway, curb, sidewalk marking, or other device erected or placed under the authority of the Council for the purpose of guiding or directing traffic. (cc)"Traffic Control Signal" means any device manually, electrically, or mechanically operated for the regulation of traffic and placed or erected by the authority of the Council. (dd) "Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine, bicycle, and any vehicle drawn, propelled, or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle. PART 2 - PARKING This By-law identifies municipal roads (see Schedule A) or sections of municipal roads (see section 2.1 and 2.2) where parking is not permitted. Some roads have signs indicating no parking areas. Other roads do not have no parking signs. The absence of a no parking sign does not necessarily mean that parking is permitted in that area. Please refer to the By-law for specific information about permitted parking areas. Section 2.1 - Parking Regulations (1) Where a parking space is designated by signs and/or painted lines on a highway, no person shall park a vehicle on a highway other than within the confines of the parking space. (2) No person shall park a vehicle on any highway or on a highway where parallel parking is permitted except: (i) on the right-hand side of the highway, having regard for the direction of travel, with the right front and right rear wheels not more than 15 centimetres from the curb or the edge of the roadway. (ii) where no parking space is designated, the right front and rear wheels of the vehicle are parallel to the distant respectively not more than 15 centimeters from the edge of the roadway. (iii) on uncurbed highways or in winter, the vehicle is parked parallel to and as close as circumstances and weather conditions permit, to the edge of the boulevard or sidewalk. (3) No person shall stop or park a vehicle on a highway in such a manner as to interfere with the movement of traffic. (4) Where angle parking is permitted, no person shall park a vehicle except at the angle indicated by the authorized signs and/or painted lines. Section 2.2 - No Parking Areas (1) No person shall, at any time, park a vehicle in any of the following places: (i) Fire Hydrant - within 3 metres of a fire hydrant. (ii) Fire - within 90 metres of the scene of a fire in progress. (iii) Fire Route - as approved by the Chief Fire Official, or designate, in accordance with Schedule C By-law 2008-1098 (By-law 2008-1098 removed and replaced by Schedule C, by By-law 2023-1870). (iv) Priority - in such a position as to prevent the removal of any other vehicle previously parked. By-law 2022-1772 - Traffic and Parking Page 4 of 11 (v) Sidewalk - on any sidewalk. (vi) Crosswalk - on any crosswalk. (vii) Bridge - on any bridge or within 15 metres of the approaches. (viii) Fire Hall - in front of any fire hall or on the opposite side of the street for the full width of the said fire hall and an additional distance of 7.5 metres each way from the said fire hall. (ix) Intersection - within 3 metres of any intersection or beyond the posted signs depicting parking distances from an intersection (x) Signs - in any place where authorized signs prohibiting parking are on display. (xi) Medical Centre - in front of the entrance to a medical centre. (xii) Obstruct - in such a manner as to obstruct a public or private driveway, or within one (1) metre of a public or private driveway. (xiii) Municipal Property - on any municipally owned property where public parking is not authorized. (xiv) Overnight Parking - on any highway between the hours of 12:00 am and 7:00 am from November 1 to March 31, inclusive. (xv) Snow Removal - within twelve hours of posting snow removal signs on any streets and within 48 hours of a snowfall from November 1 to March 31, inclusive. (xvi) School Zones - Between 8:00 AM and 5:00 PM Monday to Friday, upon either side of the highway adjacent to or opposite any school property. (xvii) Schedule "A" Roads - On any of the parts of highways named and described in Schedule "A", attached hereto, and forming part of this by-law. Section 2.3 - Accessible Parking (1) A permit shall be used by displaying it: (i) Affixed to the sun visor on the driver's side of the vehicle with the visor turned down or, (ii) On the driver's side of the dashboard of the vehicle. (2) Municipally designated parking spaces are defined in Schedule B. A designated parking space shall be distinctly indicated in accordance with the requirements of the Highway Traffic Act and the regulations made thereunder. (added by By-law 2023-1870) (3) Construction and maintenance of a designated parking space shall generally accord with the following criteria: (i) Have a minimum length of 5 metres, (ii) Be hard surfaced, (iii) Be level, (iv) Where practical, be placed so that sidewalks will be accessible to physically challenged persons whether via ramps, depressed curbs, or other appropriate means, (v) Placed with sufficient clearance around the vehicle to permit ingress and egress in relation to other vehicles or obstacles such as light standards or waste receptacles, and (vi) Be kept clear of all accumulations of ice, snow, or other material which could render the parking space unusable. (4) The owners and operators of parking lots or other parking facilities to which the public has access, whether on payment of a fee or otherwise, shall provide designated accessible parking spaces and shall keep such space in good condition and as described in Section 2.3(3). (5) No person or organization shall: (i) Park a vehicle in a designated accessible parking space, or (ii) Be entitled to the benefit of an exemption under this by-law, unless: (a) A currently valid permit has been issued to that person, organization, or to a passenger being picked up or transported in the vehicle, and By-law 2022-1772 - Traffic and Parking Page 5 of 11 (b) Such permit is displayed on or in the vehicle in accordance with the requirements of the Highway Traffic Act, the regulations, and this by-law. Section 2.4 - Vehicle Parked for Sale, Repair, or Storage (1) No person shall stand or park a vehicle upon the highway for any of the following purposes: (i) Displaying and advertising a vehicle for sale. (ii) Washing, greasing, or repairing such vehicle except for immediate repair due to an emergency. (iii) Storage. PART 3 - TRAFFIC Section 3.1 - Speed Limits (1) Unless otherwise posted, the speed limit on all municipal roads is 40 km/h with the following exceptions: (i) Community Safety Zones - See Section 3.2 (ii) Hart Road from Pinecreek Road South to McDonald Road - 60 km/h (iii) Hart Road from McDonald Road to Hazel Glen Road - 70 km/h (iv) Callander Bay Drive - 80 km/h Section 3.2 - School Zone (1) The portion of highways set out in this By-Law are hereby designated as a School Zone and shall be enforced during the period of times set out in this By-Law. (2) The following portion of described highways within the Municipality are designated as a "School Zone": (i) Within the 100 Block to 300 Block of Lansdowne Avenue East. (ii) Within the 1300 Block to 1400 Block of Main Street North. (iii) Upon either side of the highway adjacent to or opposite any school property. (3) All designated areas will be marked by official signs. (4) The "School Zones" are in effect from September 1 to June 30, inclusive, Monday to Friday from 8:00 am to 5:00 pm. Section 3.3 - Community Safety Zone (1) The portion of highways set out in this By-Law are hereby designated as a Community Safety Zone and shall be enforced during the period of times set out in this By-Law. (2) The following portion of described highways within the Municipality are designated as "Community Safety Zone": (iv) Within the 100 Block to 300 Block of Lansdowne Avenue East. (v) Within the 1300 Block to 1400 Block of Main Street North. (3) All designated areas will be marked by official signs and flashing lights. (4) The "Community Safety Zones" are in effect from September 1 to June 30, inclusive, Monday to Friday from 8:00 am to 5:00 pm. (5) The speed limit within the "Community Safety Zone" is 30km, during the specified times. PART 4 - ADMINISTRATION AND ENFORCEMENT Section 4.1 - Administration (1) The Senior Municipal Director, or designate, is hereby authorized to place, or erect, and to maintain such official signs and traffic control devices as may be necessary to give effect to the provisions of this by-law or as required to warn or guide traffic for the safety or convenience of the public. (2) The Senior Municipal Director, or designate, is hereby authorized to place, and maintain By-law 2022-1772 - Traffic and Parking Page 6 of 11 temporary traffic signs for the purpose of regulating or prohibiting traffic where highway construction, repair, painting, community events or other emergency occurs. (3) The Senior Municipal Director, or designate, is hereby authorized to remove or cause to be removed without notice any sign, signal, marking device found on a highway which resembles an official sign or authorized sign, but which is not an official or authorized sign. (4) No person shall interfere with any sign or barricade erected on a highway by the Municipality. (5) That minor modifications or corrections of a grammatical or typographical nature where such modifications or corrections do not alter the intent of the by-law may be made by resolution of Council. Added by By-law No. 2022-1772 Section 4.2 - Interpretation (1) The provisions of this by-law prohibiting parking or stopping shall not apply to: (i) vehicles of the Police, Emergency Medical Services, and Fire departments who are actively providing services to the Municipality of Callander, (ii) vehicles of third-party contractors or agents, employed by the Municipality of Callander, (iii) vehicles of Her Majesty's mail, (iv) a vehicle, the crew of which is engaged in making repairs to a public utility or service, (v) a vehicle of the By-Law Enforcement Officer who is actively providing services to the Municipality of Callander, and (vi) personal vehicles of members of Callander Fire & Emergency Services responding to a fire call, emergency incident, or attending training. (2) Whenever this by-law refers to a time of day or hour, the same shall be construed in accordance with standard time or daylight-saving time as may be in current use in the Municipality of Callander. (3) The Manual of Uniform Traffic Control Devices of the Ministry of Transportation of Ontario is hereby adopted as it applies to the provisions of this by-law. (4) All sections and subsections of this by-law shall be deemed and be separate and independent and the invalidity of any section or provision thereof shall not affect the remaining sections or subsections of the by-law. (5) The provisions of this by-law apply only to highways in the Municipality which are under jurisdiction of the Municipality. (6) Schedules A, B and C which are attached hereto are hereby made a part of this by-law and shall be construed herewith. (7) Unless otherwise stated in this by-law, subsection 1 of Section 1 of The Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended from time to time, is hereby adopted in this by-law for the purpose of definition and interpretation. (8) If a provision of this By-law conflicts with an Act or Regulation or another By-law, the provision that is the most restrictive shall prevail. Section 4.3 - Penalties - Schedule C (1) Any person who contravenes any provision of this by-law is guilty of an offence and is subject to fine recoverable under the Provincial OffencesAct. (2) Voluntary payment of a parking infraction notices according to the amount set on Schedule C in strict compliance with the conditions set out on the parking infraction notice shall be in lieu of any penalty otherwise provided by law. (3) The owner of a vehicle may be charged and convicted of an offence under this By-law for which the driver of the vehicle is subject to be charged unless, at the time of the offence, the vehicle was in the possession of some person other than the owner without the owner's consent, and upon conviction the owner is liable to the penalty described or provided for the offence. By-law 2022-1772 - Traffic and Parking Page 7 of 11 (4) Where a motor vehicle is found parked in contravention of the parking provisions of this by-law, and the Officer finding the vehicle shall attach to the motor vehicle a parking infraction notice in the form of a serially numbered notice stating: (i) the motor vehicle plate number, province of number plate issuance and validation expiry date, (ii) that the vehicle is unlawfully parked, providing the wording of the offence, (iii) the date, time, and location of the alleged offence, and (iv) the amount of the fine for the offence. (v) The infraction notice shall be placed in a conspicuous place on the vehicle. (5) The owner or operator of the vehicle may, within seven (7) days, exclusive of Sundays and holidays, after the date when the violation notice was issued make payment. (6) Should a violation of this by-law continue more than four (4) hours, the Officer may charge the violator with a second offence, and subsequently charge further offences every two (2) hours thereafter until the violation ceases. (7) An Officer, upon discovery of any vehicle parked or left in contravention of this by-law, may at their discretion, order the removal of the vehicle violating the by-law when deemed necessary and placed or stored in a suitable place and all costs for removing, care, and storage thereof, if any, are a lien upon the vehicle which may be enforced in the manner provided by Part III of the Repair and Storage Liens Act, R.S.O., 1990, as amended. (8) It is an offence for a person to operate a vehicle in contravention of this By-law or any Provincial Statute, and every person who contravenes this By-law or any Provincial Statute is guilty of an offence and, on conviction, is subject to the penalties provided under the Highway Traffic Act. SECTION 5 - SEVERABILITY (1) If any section or sections of the By-law or parts thereof, are found in any court of law to be illegal or beyond the power of the Municipality to enact, such section or sections or parts thereof shall be deemed to be severable and all other sections or parts of the By-law shall be deemed to be separate and independent thereof and have been enacted as such. PART 6 - REPEAL (1) That By-law No. 97-658, 2006-2018, 2006-1020, 2006-1022, 2009-1159, 2010-1187, 2012-1324, 2017-1521, 2020-1646, 2021-1683, and 2021-1723, are hereby repealed once By-law 2022-1769 comes into force. PART 7 - EFFECTIVE DATE That this By-law shall come into force on the 16th day of August, 2022. TAKEN AS READ A FIRST TIME THIS 16 TH DAY OF AUGUST, 2022.
