BY-LAW NO. 184 -06 O F THE CORPORATION OF THE CITY OF CAMBRIDGE Being a by-law of the Corporation of the City of Cambridge to establish a system of disabled parking. (DISABLED PARKING BY-LAW) WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, Section 11(2), Table, Paragraphs 1 and 8, authorize by-laws with respect to parking; AND WHEREAS the City of Cambridge wishes to establish a system of disabled parking. NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE CITY OF CAMBRIDGE ENACTS AS FOLLOWS:- PART I-DEFINITIONS 1. The definitions contained in the Highway Traffic Act, R. S. O. 1990, c. H. 8, as amended, shall apply in the interpretation of this By-law except where such definitions are inconsistent with this By-law, in which case the definitions herein apply. In this by-law: a. "Designated Parking Space" means a parking space located: i. on-street; ii. in City owned or operated parking lots; and, iii on private property as identified in Schedule "A" of this By-law, and which parking space is identified by a sign indicating such space to be for the exclusive use of a motor vehicle displaying a permit. b. "Enforcing Official" means: i. a police officer; ii. a police cadet; iii. a civilian person engaged by the Waterloo Regional Police Service; iv. a by-law enforcement officer; V. a Provincial Offences Officer; vi. a municipal law enforcement officer engaged by The Corporation of the City of Cambridge to enforce the provisions of this by-law or any parts thereof; vii. with respect to identified properties, as identified in Schedule "B" to this By-law, the municipal law enforcement officers whose names appear in Schedule "B" of this By-law; or, viii. any person or class of persons designated pursuant to the Provincial Offences Act. c. "Permit" means: i. a disabled person parking permit issued under the Highway Traffic Act; or, ii. a permit, number plate, or other marker or device issued by another jurisdiction and which is currently valid and recognized in that jurisdiction. d. "Disabled Person" means a person unable to walk unassisted for more than two hundred metres without great difficulty or danger to his or her health and safety. e. "Sign" means a sign consisting of the International Symbol for the disabled in accordance with the requirements of the regulations made under the Highway Traffic Act and used for the purpose of designating parking spaces for the exclusive use of disabled persons. f. "Unauthorized Motor Vehicle" means a motor vehicle that does not have displayed therein or thereon a current valid permit identifying the motor vehicle as being operated by or conveying a disabled person. PART 11-REGULATIONS 1. Use of Permit No person shall use a permit other than in the manner provided for in this by-law. 2. Display of Permit A permit shall be displayed on the sun visor or on the dashboard of a motor vehicle so that the international symbol of access for the disabled, the permit number and the expiry date of the permit are clearly visible from the outside of the motor vehicle. 3. Signs Signs identifying designated parking spaces may be erected on private property and such spaces shall be subject to enforcement of this By-law the day following the date upon which Council adds the municipal address of the private property to Schedule "A" of this by-law. 4. No Parking No person shall park a motor vehicle at any time in or within any part of a designated parking space, other than a motor vehicle properly displaying a permit except: a. an emergency motor vehicle as defined within the Highway Traffic Act; b. a motor vehicle owned by the Regional Municipality of Waterloo or The Corporation of The City of Cambridge while actively engaged in performing municipal duties; c. a motor vehicle owned by a public utility (including hydro, gas, water, telephone and cable TV) while actively engaged in performing utility services. PART III-ENFORCEMENT AND PENALTIES 1. Offence a. Any person who contravenes any provision of this by-law is guilty of an offence and, upon conviction, is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990, c. P. 33, as amended. b. The set fine for each offence is set out in Schedule "C" of this By-law. c. If the set fine is not paid within the time period required, the procedures of the Provincial Offences Act, R.S.O. 1990, c. P. 33, as amended, shall apply. 2. Enforcing Officials a. Subject to Sub-section b. following, all provisions of this By-law may be enforced by Enforcing Officials. b. Enforcing Officials whose names appear in Schedule "B" hereto may enforce the provisions of this By-law only with respect to property, the municipal address of which is listed beside their name in said Schedule "B" 3. Removal of Motor Vehicles A Police Officer of the Regional Municipality of Waterloo Police Service, upon discovery of any motor vehicle parked in contravention of the provisions of this By-law, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the motor vehicle, which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O., 1990, Chapter R.25. 4. Without Owner's Consent The driver of a motor vehicle, not being the owner, is liable to any penalty provided in this By-law and the owner of the motor vehicle is liable to such penalty unless at the time of the offence was committed the motor vehicle was in the possession of a person other than the owner or their chauffeur without the owner's consent. PART IV - GENERAL 1, Sever Invalid Provision Should any part, section or provision of this By-law be declared by a Court of competent jurisdiction to be invalid, the same shall not effect the validity of the By-law as a whole or in part thereof, other than the part which was declared to be invalid. 2, Repeal By-law No. 266-90 and all By-laws amending it are hereby repealed as of the effective date set out in Section 13 below. 3. Citation This By-law may be referred to as the Parking for Persons with Disabilities By-law. 4. Effective Date This By-law shall come into force and take effect on January 1,2007.
