A BY-LAW OF THE COUNCIL OF THE CORPORATION OF THE TOWN OF
CARLETON PLACE REGULATING TRAFFIC AND PARKING ON STREETS;
WHEREAS Section 27 of the Municipal Act, 2001 permits a municipality to regulate the
Traffic and Parking on municipal streets that they have jurisdiction over;
AND WHEREAS Section 63(1) of the Municipal Act, 2001 permits a municipality to
remove, impound, restrain or immobilize an object or vehicle placed, stopped, standing
or parked on a highway in contravention of a by-law that a municipality has passed
regarding placing, stopping, standing or parking an object or vehicle on a highway;
AND WHEREAS the Council of the Town of Carleton Place deems it desirable and
necessary to adopt a Traffic and Parking By-law;
NOW THEREFORE the Council of the Corporation of the Town of Carleton Place
enacts as follows:
PART "A"
PART I - DEFINITIONS AND INTERPRETATION
1.
DEFINITIONS
In this By-law:
Access Aisle1 means an accessible pedestrian space for an Accessible Parking
Space, that conforms to the requirements and regulations made under the
Accessibility for Ontarians with Disabilities Act;
Accessibility for Ontarians with Disabilities Act2 means the Accessibility for
Ontarians with Disabilities Act, 2005, S.O. 2005, c.11, as amended, and the

regulations made thereunder;
Accessible Parking Permit 3 or "permit" means:
(a) A current and valid parking permit for a Person with a Disability as
issued by the Ministry of Transportation under the provisions of the
Highway Traffic Act; or
(b) A current and valid permit, number plate or other marker or device
bearing the international symbol of access for people with disabilities
which has been issued by a legally recognized jurisdiction outside
Ontario.
Accessible parking permit holders4 - means a person who:
(c) has applied for and has met the requirements of the appropriate
regulations and has been issued an Accessible parking permit, in
accordance with the Highway Traffic Act.
(d) functions under a major physical impairment which requires the use of
some artificial means such as, without restricting the generality of the
foregoing, crutch, artificial limb, or wheelchair for the purpose of going.
from place to place.
Accessible Parking Space5 - means a Parking Space designated by Authorized
Parking Signs for the exclusive use of a vehicle displaying an Accessible Parking
Permit in accordance with the requirements of the Highway Traffic Act and this By-
law.
Authorized Emergency Vehicle6 means a Town fire department vehicle, an
Ontario Provincial Police vehicle, or an ambulance.
Bed and Breakfast - means a single detached dwelling in which not more than 4
guest rooms each having a minimum floor area of 11 square metres, are used to
accommodate the travelling or vacationing public for gain or profit, and may
include the provision or meals to the guest room occupants only.7
Bicycle - includes any device which has two tandem wheels and is propelled by
human power and upon which any person may ride, and a tricycle.
Boulevard - means all the parts of the highway save and except any roadway,
shoulder or sidewalk and
(a) Central Boulevard - means that part of the highway lying between the

travelled portions of a divided highway and includes channelizing islands
(b) Outer Boulevard - means that part of the highway lying between the
travelled portions of a divided highway and includes channelizing islands
(c) Inner Boulevard - means that part of the highway lying between the
property line and the near edge of the sidewalk, and where there is no
sidewalk it means that part of the highway lying between the property line
and the travelled portion of the highway or the outer edge of the shoulder
where such exists
Constable - means Police Officer or By-law Enforcement Officer having
jurisdiction for the Municipality
Commercial Motor Vehicle - means any motor vehicle having permanently
attached thereto a truck or delivery body and includes ambulances, hearses,
casket wagons, fire apparatus, police patrols, motor buses and tractors used for
hauling purposes on the highways
Corner - with reference to a highway intersection mean the point of intersection of
the prolongation of the lateral curb lines or in the absence of curbs the
prolongation of the edges of the roadways
Corporation - means the Corporation of the Town of Carleton Place
Crosswalk - means
(a) that part of a highway at an intersection that is included within the
connection of the lateral lines of the sidewalks on opposite sides of the
highway measured from the curbs or, in the absence of curbs, from the
edges of the roadway; or
(b) any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by signs or by lines or other markings
on the surface
Designated Parking Space - means a parking space designated under this by-
law for the exclusive use of vehicle displaying a permit in accordance with the
requirements of the Highway Traffic Act and the regulations made thereunder
and this by-law.
Driveway - means improved land on a highway which provides vehicular
access from the roadway to a laneway or a parking area on adjacent land

Farm Tractor - means a self-propelled vehicle designed and used primarily as
a farm implement for drawing ploughs, mowing machines and other
implements of husbandry and not designed or used for carrying a load
Gross Weight - means the combined weight of vehicle and load
Heavy Truck - means a motor vehicle having a carrying capacity in excess of
900 kgs and any vehicle having a gross weight in excess of 3600 kgs.
Highway - includes a common and public highway, street, avenue, parkway,
driveway, square, place, bridge, viaduct, or trestle, designed and intended for,
or used by, the general public for the passage or vehicles
Highway, One-Way - means a highway upon which the movement of vehicular
traffic is limited to one direction
Holidays - includes Sunday, New Year's Day, good Friday, Easter Monday,
Victoria Day, Dominion Day, the day proclaimed as a Civic holiday by the
Corporation, Labour Day, Thanksgiving Day, Remembrance Day, Christmas
Day, Boxing Day, the day proclaimed as the birthday or day fixed by
proclamation of the Governor General for the celebration of the birthday of the
reigning sovereign, and any day appointed by proclamation of the Governor
General of the Lieutenant-Governor-in-Council as a public holiday or for the
general fast or Thanksgiving, and the next following day when any such
holiday falls on a Sunday.
Intersection - means the area embraced within the prolongation of connection
of the lateral curb lines or, if none, then of the lateral boundary, lines of two or
more highways which join one another at an angle, whether or not one
highway crosses the other
King's Highway - means a highway so designated under The Highway
Improvement Act
Laneway - means improved land adjacent to the highway which provides
access from the highway to a parking area on adjacent land
Loading Zone - means the part of a highway set apart for the exclusive
purpose of parking a vehicle to load or unload the same
Mobile Canteen - includes all vehicles of any king in or from which any food or
other edible substance or any beverage is offered for sale or sold
Motorcycle - means a self-propelled vehicle (also a motor assisted vehicle)
having a seat or saddle for the use of the driver and designed to travel on not

more than three wheels in contact with the ground, and includes a bicycle with
a motor attached and a motor scooter
Motorized Snow Vehicle - means a self-propelled vehicle designed to be driven
exclusively on snow or ice or both
Motor Vehicle - includes an automobile, motor cycle and any other vehicle
propelled or driven otherwise than by muscular power; but does not include
the cars of electric or steam railways, or other motor vehicles running only
upon rails or a motorized snow vehicle, traction engine, farm tractor, self-
propelled implement of husbandry or road-building machine within the
meaning of The Highway Traffic Act.
Municipality - means the Corporation of the Town of Carleton Place
Municipal or Private Property - means any open area or portion of a structure,
other than a street or highway intended for the temporary parking of vehicles
and on which there are designated parking spaces, whether their use involves
the payment of a fee or otherwise
Park or Parking - when prohibited means the standing of a vehicle, or a
motorized snow vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in loading or
unloading merchandise or passengers
Parking Space - means that part of the surface of the travelled part of the
highway forming part of a highway, the use of which is designated for the
purpose of parking a vehicle
Pavement Markings8 means the markings on the pavement within a Type A
Parking Space or Type B Parking Space, containing the International Symbol of
Access which includes a 1525 mm x 1525 mm white border and symbol with a
blue background field colour;
Pedestrian - means:
(a)
a person on foot or
(b)
a child, or other person in a wheeled chair, baby carriage, or toy
vehicle being carried and propelled by another person on foot 9
Pedestrian Crossover - means pedestrian crossover as defined in The Highway
Traffic Act
Permit - means an Accessible parking permit holder parking permit issued

under the Highway Traffic Act or a permit, number plate or other marker or
device issued by another jurisdiction and recognized under the Act
Pickup/Drop Off Zone - means the part of a highway set apart for the
exclusive purpose of stopping a vehicle to pick up or discharge passengers.10
Police - means The Ontario Provincial Police Force
Police Department - means the Ontario Provincial Police detachment for the
Town of Carleton Place.
Police Officer, Constable, By-law Enforcement Officer, Special Constable
- means a person so employed by the Corporation of the Town of Carleton
Place to carry out the duties 9f enforcement of this by-law within the Municipal
limits of the Corporation.
Public Parking Area11 means any open area or portion of a structure other than a
street or Highway, intended for the temporary parking of vehicles and on which
there are Accessible Parking Spaces, whether their use involves the payment of a
fee or otherwise;
Public Vehicle - means a motor vehicle operated on a highway by, for or on
behalf of any person for the transportation for compensation of passengers, or
passengers and express freight, that might be carried in a passenger vehicle,
but does not include the cars of electric or steam railways running only upon
rails, taxi cabs, or motor vehicles operated solely within the corporate limits of
one urban municipality
Roadway - means that part of the highway that is improved, designed or
ordinarily used for vehicular traffic, but does not include the shoulder, and,
where a highway includes two or more separate roadways, the term 'roadway'
refers to any one roadway separately and not to all of the roadways
collectively
Roadway, Laned - means a highway which has been divided into separate
lanes for vehicular traffic which lanes are indicated by lines or other markings
of the surface of the roadway or in any other manner
Side, Approach - means the side of a part of a highway opposite the leaving
side
Side, Leaving - means the side of a part of a highway opposite the approach
side

Sidewalk - includes all such parts of a highway as are set aside by the
Municipality for the use of pedestrians or used by the general public for the
passage of pedestrians
Sign, Authorized, - means any sign or roadway, curb or sidewalk marking or
other device placed or erected on a highway under the authority of the By-law
for the purpose of regulating, warning or guiding traffic
Sign, Official - means a sign approved by the Ministry of Transportation
Sign Point - means a point on the curb or edge or roadway opposite a sign
Stand or Standing - when prohibited, means the halting of a vehicle, whether
occupied or not, except for the purpose of and while actually engaged in
receiving or discharging passengers
Stop or Stopping - when prohibited, means the halting of a vehicle when
necessary to avoid conflict with other traffic or in compliance with the·
directions of a Constable or other Police Officer or of a traffic control sign or
signal
Through Highway - means any highway or part of a highway so designated
by this By-law
Traffic - includes pedestrians, ridden, led, or herded animals, vehicles,
motorized snow vehicles and other conveyances either single or together while
using a highway for the purpose of travel
Traffic Control Device - means any sign, signal or other roadway, curb, or
sidewalk marking, or any other device erected or placed under the authority of
the by-law for the purpose of warning, regulating, guiding or directing traffic
Traffic Control Signal - means any device operated manually, electrically or
mechanically for the regulation or control of traffic
Traffic, One-Way - means movement by vehicles upon a Highway in one direction
only
Trailer - means any vehicle that is at Anytime drawn upon a highway by a motor
vehicle, except an implement of husbandry, other motor vehicle, or any device or
apparatus not designed to transport persons or property, temporarily drawn,
propelled or moved upon such highway and except a sidecar attached to a
motorcycle, and shall be considered a separate vehicle and not part of the motor
vehicle by which it is drawn
Truck Route - means a truck route established by this By-law

Type A Parking Space12 means an Accessible Parking Space for those who use
mobility devices and need more space for the deployment of ramps, and has
signage that identifies the space as "van accessible";
Type B Parking Space13 means an Accessible Parking Space for those who may
need the use of canes, crutches or walkers and do not need the extra space of a
Type A Parking Space.
U-Turn - means the turning of a vehicle within the highway so as to proceed in the
opposite direction to that in which the vehicle was travelling immediately prior to
making the turn
Vehicle - means a motor vehicle, trailer, traction engine, farm tractor, road-
building machine and any vehicle drawn, propelled or driven by any kind of power,
including muscular power, but does not include a motorized snow vehicle, or the
cars of electric or steam railways running only upon rails.
Wheelchair - means a chair mounted on wheels driven by muscular, or any other
kind of power and used for the carriage of a person who has a physical defect or
disability.
1. A person driving a wheelchair upon a roadway shall:
(a) drive as near the right-hand side of the roadway as practical, and
(b) exercise due care when passing a parked, stopped or standing vehicle
or one proceeding in the same direction.
(c) bear the slow-moving vehicle sign required by the Highway Traffic Act
Regulation 616 and comply with any other provisions required by an
applicable legislation, including Regulation 625 of the Highway Traffic
Act.
(d) be equipped with mirrors attached to the wheelchair or the operator
and placed in such a position as to afford the operator a clearly
reflected view of the roadway in the rear, or of any vehicle
approaching from the rear.
2. A person driving a wheelchair upon a roadway designated for one-way
traffic shall:
(a) obey and follow the designated one-way street direction.
(b) drive as near the right-hand side of the roadway as practicable and,
(c) exercise due care when passing a standing vehicle or one proceeding
in the same direction. 14

3. Persons driving wheelchairs upon a roadway shall do so in a single file. 15
4. When on the roadway at Anytime from one-half hour before sunset to one-
hour after sunrise and at any other time when, due to insufficient light or
unfavourable atmospheric conditions, persons and vehicles on the highway
are not clearly discernible at a distance of 150 metres or less, a wheelchair
shall carry on the front thereof a lighted lamp displaying a white or amber
light and on the rear thereof a lighted lamp displaying a red light. 16
5. No person driving a wheelchair shall carry any package, bundle or article
which prevents the operator from keeping both hands on the handle bars or
one hand on the joystick control, which would prevent safe operation of the
wheelchair. 17
6. No person shall operate a wheelchair towing, hauling, pulling or pushing
any kind of attachment, except those provided by the manufacturer as
integral part of the equipment for the wheelchair, shall be operated upon a
public highway or sidewalk. 18
7. No person shall operate a wheelchair and permit any person riding upon a
bicycle, coaster, roller skates, skis, wagon, toboggan, sled or toy vehicle to
attach the same himself or herself to the wheelchair. 19
8. No person shall park a wheelchair on a highway except in such a manner
as to cause the least possible obstruction to pedestrian or vehicular traffic.

9. No person shall operate a wheelchair upon a public highway or sideway
except for the purpose of the carriage of a person who has a physical defect
or disability. 21
10. No person shall operate a wheelchair carrying more than one person upon
a public highway or sidewalk. 22
11. A person driving a wheelchair upon the sidewalk shall:
(a) drive as near the right-hand side of the sidewalk as practical, and
(b) exercise due care, slowing down, even coming to a full stop as the case

may require, when encountering oncoming pedestrians or while
overtaking pedestrians proceeding in the same direction, always yielding
the right-of-way to pedestrians, which would ensure free movement and
safety of other pedestrians.
(c) be equipped with mirrors attached to the wheelchair or to the operator
and placed in such a position as to afford the operator a clearly reflected
view of the sidewalk in the rear, or of any pedestrian approaching from
the rear. 23
2.
INTERPRETATION
(1)
General
In this By-law:
(a)
words importing the singular number of the masculine gender
only include more persons, parties or things of the same kind
that one and females as well as males and the converse
(b)
a word interpreted in the singular number has a corresponding
meaning when used in the plural
(c)
'may' shall be construed as permissive
(d)
'shall' shall be construed an imperative
(2)

(3)
Distances
Where a distance is used in this By-law as part of a prohibition of parking or
stopping within a specified distance of ail object, structure, land or a part of a
highway, such distance shall be measured:
(a)
along the curb or edge of the roadway from a point in such
curb or edge of roadway opposite such object, structure, land
or part of a highway, unless the context otherwise requires,
and
(b)
from such object, structure, land or part of a highway in
all directions.
(4)
Cumulative Effect
The various prohibitions of this By-law are cumulative and not
mutually self-exclusive.
(5)
Severability
It is declared that if any section, subsection or part or parts thereof be declared
by any Court of Law to be bad, illegal or ultra vires, such part or parts shall be
deemed to be severable and all parts hereof are declared to be separate and
independent and enacted as such.
3.
Standard Time and Daylight-Saving Time
Where any expression of time occurs or where any hour or other period of time
is stated, the time referred to shall be standard time, provided however, if what
is known as 'daylight saving time' has been generally adopted in the Town of
Carleton Place for any period of the year, under any statute, order-in-council,
By-law, resolution or proclamation, whether the same is effective in law or not,
such time shall be the time referred to during such period in any reference to
time in this By-law.

4.
General Regulations
(1)
Two-way Highways and Right side of One-way Highways
Subject to subsections 2 and 3 no person shall park or stop any vehicle or
permit a vehicle to remain parked or stopped on any highway except as follows:
(a)
where there is a raised curb, on the right side of the travelled
portion-of-the- highway, having-regard to the direction in which the
vehicle was travelling, with its right front and rear wheels parallel to and
not more that fifteen centimetres (15cm) away from the curb without
stopping or parking over any part of a highway, boulevard or sections
which are landscaped, or which are not intended for the
use of vehicles: or
(b)
where there is no curb or a rolled curb, on the right side of the highway
having regard to the direction in which the vehicle was travelling with the
right front and rear wheels parallel to and as near to the right-hand limit
of the highway as is practicable without stopping over any part of a
highway which is landscaped or which is not intended for the use of
vehicles.
(2)
One-way Highways
Subject to subsection 3 where parking is permitted on the left side of a highway
designated for one-way traffic, a person may park or stop any vehicle provided
the vehicle is parked:
(a)
where there is a raised curb, on the left side of the travelled portion of the
highway having regard to the direction in which the vehicle was
travelling, with its left front and rear wheels parallel to and not more than
fifteen centimetres (15 cm) away from such curb;
(b)
where there is no curb or a rolled curb, on the left side of the highway
having regard to the direction in which the vehicle was travelling, with the
left front and rear wheels parallel to and as near to the left-hand limit of
the highway as is practicable without stopping over any part of a highway
which is landscaped or which is not intended for the use of vehicles.
(3)
Exemption - Angle Parking
Subsections 1 and 2 do not apply where angle parking is permitted under this
By- law.

Vending Vehicles

(1)
No person who is selling or offering for sale goods or produce from a
stationary vehicle on a highway shall park the vehicle or permit the
vehicle to remain parked in such a manner as to obstruct traffic.
(2)
No person shall offer for sale or sell goods or produce from a vehicle on
a highway except from the side of such vehicle facing the sidewalk or
curb.
(3)
No person shall permit a vehicle from which food is offered for sale or
sell goods or products from to remain parked on a highway except in an
approved location as specified by the current Refreshment Vehicle By-
law for the Town of Carleton Place.
(4)
No person shall permit a vehicle from which food is offered for sale or
sell goods or products from to remain parked on a highway except for the
approved time limit as specified by the current Refreshment Vehicle By-
law for the Town of Carleton Place.
6.
Parking Prohibited with Signs
(1)
When authorized signs have been erected, no person shall park a
vehicle or permit a vehicle to remain parked on any highway or municipal
property24:
(a) in accordance with Schedule I of this By-law regarding specified
times and places, and
(b) within nine metres (9m) on an intersection;
(c) within thirty metres (30m) of an intersection controlled by a traffic
signal;
(d) in front of the main entrance to, or any emergency exit. from any
hotel, hospital, nursing home, senior citizen building, theatre,
auditorium or other building or enclosed space in which persons may
be expected to congregate in large numbers;
(e) on either side of a highway adjacent to a school or playground
between the hours of 8:00 o'clock a.m. and 6:00 o'clock p.m., other
than school buses loading or unloading students;
(f) so as to interfere with the formation of a funeral procession;

(g) within the turning basin of a cul de sac; or
(h) within fifteen metres (15m) of the end of the roadway on a dead-end
highway;
(i) in front of or within three metres (3m) of a truck loading door or dock.

Parking Reserved for Authorized Vehicles Only
When authorized signs have been erected, no person shall, at Anytime, park a
vehicle or permit a vehicle to remain parked, save and except as detailed on
Schedule 'XV'.
Section 6 (1) be deleted and replaced with the following:
When authorized signs have been erected, no person shall park a vehicle
or permit a vehicle to remain parked on any highway or municipal
property.25
7.
Parking Prohibitions Without Signs
No person shall park a vehicle or permit a vehicle to remain parked on any
highway;
(a)
within nine metres (9m) of an intersection;
(b)
within three metres (3m) of a fire hydrant;
(c)
in front of or within one and one-half metres (1.5m)
of a laneway or driveway;
Item 7 (c) be deleted and replaced with the following:
In front of or within one-half metres (0.5m) of a laneway or driveway.
The parking restriction for heavy vehicles only is detailed below in Item 7
(c)(i).

so as to obstruct a vehicle in the use of any laneway or driveway;

in such a position that will prevent the convenient
removal of any other vehicle previously parked

(f)
for the purpose of display the vehicle for sale;
(g)
for the purpose of greasing or repairing the
vehicle except for such repairs as have been
necessitated by an emergency;
(h)
having a width of six metres (6m) or less;
(i)
on a boulevard where there is a sidewalk, or partly on or over
a sidewalk or footpath;
(j)
where there is no sidewalk or footpath closer that one and
one-half metres (1.5m) to the roadway;
(k)
on a driveway within one-third of a metre (.33m) of a sidewalk
or footpath, or if there be no sidewalk or footpath, within one
and one- half metres (1.5m) of the roadway.
8.
Parking Prohibited - Special Circumstances
(a)
If the Director of Protective Services27 or Designate is of the opinion
that for some temporary period the safety of the public, the proper
movement of traffic or the proper and safe performance of some vital
function of the Corporation, or a local board, requires the prohibition
of limitation of parking on a highway, he is authorized to prohibit
parking on such highway during such times and days as he deems
proper and necessary, and he shall erect authorized signs or
otherwise give notice of indicate such prohibition.
(b)
When authorized signs have been erected or notice has otherwise
been given under subsection 1, no person shall park a vehicle or
permit a vehicle to remain parked on the highway at Anytime during
which such parking is prohibited. A vehicle already parked when such
signs are erected shall be forthwith removed.
9.
Parking Regulations - Highway Clearing, Snow Removal, Highway
Cleaning, Municipal Parking Lot Snow Removal and Cleaning
1.
No person shall park a vehicle or permit a vehicle to remain parked on
any highway or municipal parking lot:
(a) while the work of removing snow or ice therefrom or

clearing of snow therefrom is in progress, or;
(b) in such manner as to interfere with highway or municipal
parking lot cleaning operations.
2.
Overnight Winter Parking
3. No person shall park a vehicle or permit a vehicle to remain parked on any highway
or in any municipal parking lot between 12:00 a.m. midnight to 7:00 a.m. from
November 15th of any given year to April 1st of the following year.
4. Notwithstanding the above, parking will be permitted in the locations listed in
Schedule 'XX' between 12:00 a.m. midnight to 7:00 a.m. at Anytime during the
year.28
10. Restrictions Waived - Special Circumstances29
a) If the Director of Protective Services or Designate is of the opinion that special
circumstances warrant the temporary waiving of parking or stopping restrictions in
order to permit the efficient flow of traffic or persons, he is authorized to permit the
parking or stopping of vehicles on a highway as he deems proper and necessary for
a period of no more than 90 days. He shall erect or remove such signage or utilize
such other means as required to inform the citizenry of the temporary changes to
the regulations.
b) If the Director of Protective Services or Designate is of the opinion that the
special circumstances still exist and that the waiving of restrictions beyond 90 days
is advisable, the extension of time beyond 90 days must be confirmed either by
resolution of Council or by amendment of this by-law.
11. Stopping Prohibited in Specified Places - No Signs
No person shall stop any vehicle or permit any vehicle to remain stopped on any
highway;
(a)
on or partly on or over a sidewalk or footpath;
(b)
within an intersection, pedestrian crossover or crosswalk;
(c)
between the hours of 7:00 a.m. and 7:00 p.m. along the curb
within fifteen metres (15m) of the approach side of a school
crosswalk, designated by markings and authorized signs, and
within nine metres (9m) of the leaving side of a school
crosswalk, designated by markings and authorized signs;

(d)
alongside or across the highway from any excavation or
obstruction in the roadway when the free flow of traffic would
thereby be impeded;
(e)
on the roadway side of any stopped or parked vehicle;
(f)
upon any bridge or elevated structure or within any tunnel or
under pass or within thirty metres (30m) of either end of any
such structure except where parking in these locations is
otherwise permitted by this By-law;
(g)
on any central boulevard or on any outer boulevard or adjacent
to either side or the ends of any central boulevard or centre strip
separating two roadways, except when parking in these
locations is otherwise permitted by this By-law;
(h)
within fifteen metres (15m) of the approach side of the nearest
rail of any level crossing of a railway;
(i)
within fifteen metres (15m) of the leaving side of the nearest rail
of any level crossing of a railway;
12.
Stopping Prohibited in Specified Places - Signs - Schedule 'II'
When authorized signs have been erected, no person shall stop a vehicle or permit
a vehicle to remain stopped on any highway, at the side and between the limits set
out respectively in Columns 1, 2, and 3 of Schedule 'II' to this By-law during the
times and days set out in Column 4 of the said Schedule.
13.
Taxis Receiving or Discharging Passengers
The provisions of Section 12 of the By-law relating to stopping do not apply to
prevent the stopping of a taxi cab provided:
(a)
it is operated under a valid taxi licence;
(b)
its stopping does not exceed thirty (30) seconds; and
(c)
it is in the process of receiving or discharging passengers.

The provisions of Section 12 of this By-law relating to stopping do not apply to
prevent the stopping of a passenger motor vehicle for the purpose of and while
actually engaged in receiving or discharging an Accessible parking permit holder.
15.
Maximum Parking Limit
(1)
Specified Parking Period - Specified Highways - Schedule III
When authorized signs have been erected, no person shall park a vehicle or
permit a vehicle to remain parked on any highway at the side and between the
limits set out respectively in columns 1, 2 and 3 of Schedule 'III' to this By-law
during the times or days set out in Column 4 of the said Schedule for a longer
period of time than is set out in column 5 of the said Schedule.
(2)
General Limit - Unreasonable Period
Subject to the other provisions of this By-law, no person shall park a vehicle or
permit a vehicle to remain parked on any highway for an unreasonable period of
time having regard to the traffic on such highway and the traffic requirements of
such highway, and in no case for a period of time longer than forty-eight hours.
(3)
General Limit - Heavy Vehicles
Subject to the other provisions of this By-law, no person shall park a heavy
truck (refer to Part 1 - Definitions) on any highway for an unreasonable period of
time having regard to the Traffic on such highway and the traffic requirements
of such highway, and in no case for a period of time longer than four (4) hours.
16.
Angle Parking
(1)
Pavement Markings
Where an angle parking space is designated by lines or other markings
on the roadway, or otherwise, no person shall stop, stand or park a
vehicle or permit a vehicle to remain parked or standing therein except
within an area so designated as a parking space.
(2)
Angle
Where angle parking is permitted on a highway, no person shall stop,
stand or park any vehicle or permit a vehicle to remain parked or
standing except at the angles designated by signs or markings.

Where other than right angle 90 degrees parking is permitted on a
highway, no person shall park a vehicle or permit a vehicle to remain
parked on such highway except with the front end of the vehicle at the
curb or edge of the roadway.
(4)
Highway for Angle Parking - Schedule 'IV'
Angle parking is permitted on the highways at the sides and between the
limits set out respectively in Columns 1, 2 and 3 of Schedule 'IV' to this
By-law.
PART III
TRAFFIC MOVEMENTS, TURNS, STOPS, YIELDS
MULTI-LANED HIGHWAYS, TRAFFIC SIGNALS, ONE-WAY HIGHWAYS
17.
Through Highways - Schedule 'V'
(1)
The highways set out in column 1 of Schedule 'V' to this By-law between
the limits set out in column 2 of the said Schedule, are, except as
provided in subsection 2 of this Section, hereby designated as through
highways for the purpose of The Highway Traffic Act.
(2)
The designation set out in subsection 1 of this Section of a highway or
part of a highway as a through highway shall not include any intersection
thereon where the highway intersected is a King's Highway or where
traffic control signals are installed.
18.
Stop Signs at Intersections - Schedule 'VI'
The Corporation shall erect stop signs at the intersections set out in Column I of
Schedule 'VI' of this By-law facing traffic proceeding in the direction set out in
Column 2 of the said Schedule on the highway or part of highway set out in
Column 3 of the said schedule.
19. Signal Light Traffic Control Systems - Schedule 'VIII'
The Corporation shall erect and operate signal light traffic control systems at
the intersections and places named and described in Schedule 'VII' to this By-
law.
20. Yield Signs at Intersections - Schedule 'VIII'

The Corporation shall erect yield right-of-way signs at each of the intersections
set out in Column 1 of Schedule 'VIII' to this By-law for the control of traffic
entering the intersection in the direction set out in Column 3 and from the
highway set out in Column 2 of the said Schedule.
21. U-Turns
Where a U-turn is not otherwise prohibited under this By-law, such a turn shall
be made only where it can be made in safety and without interfering with other
traffic.
22. One-Way Highways - Schedule 'IX'
The highways set out in Column 1 of Schedule 'IX' to this By-law between the
limits set out in Column 2 of the said Schedule during the times or days set out
in Column 3 of the said Schedule are established as one-way
highways for the passing of vehicles only in the direction
set out in Column 4 of the said Schedule.
PART IV - SPEED REGULATIONS
23. Decreased Speed Limits in Parks - Schedule 'X'
When signs have been erected at the vehicular entrances to any public park or
exhibition grounds set out in Column 1 of Schedule 'X', the maximum rate of
speed in such public park or exhibition grounds shall be the rate of speed set
out in column 2 of the said Schedule.
24. Decreased Speed Limits in School Areas - Schedule 'XI'
The highways set out in Column 1 of Schedule 'XI' to this By-law between the
limits set out in Column 2 of the said Schedule shall not be traveled in excess of
the maximum rate of speed set out in Column 3 of the said Schedule.
PART V - DRIVING AND RELATED RULES
25. Emerging From Lanes
The driver of operator of a vehicle emerging from a driveway, laneway, lot,
building or bus loop onto a highway shall, upon driving onto a sidewalk or
footpath, yield the right-of-way to pedestrians upon such sidewalk or footpath.
26. Barricaded Highways

No person shall drive, operate or park a vehicle or permit a vehicle to remain
parked on any part of any highway barricaded and marked by signs showing
that its use for the time is prohibited or restricted.
27. Coasting on Roadways
No person shall coast, whether on a sleigh, skateboard, cart, express wagon or
toboggan on a roadway.
28. Traffic Control at Fires
(1)
No person shall move or operate a vehicle other that a Police or Fire
Department vehicle on any highway within ninety-one (91m) of a fire, fire
apparatus or fire-fighting equipment, except as directed by a Constable
or Officer of the Fire Department.
(2)
Unless directed by a Constable or Officer of the Fire Department no
person shall drive a vehicle over a fire hose on any highway.
29. Racing Prohibited
No person shall drive a vehicle or bicycle on a highway in a race or on a bet or
wager.
30. Vehicles Obstructing Traffic
No person shall drive or park a vehicle or permit a vehicle to be driven or parked
on a highway in such a manner as to obstruct traffic.
31. Emergency Regulations
Notwithstanding any provisions of the By-law, to the contrary, a Police Officer may
during any emergency or special circumstance by the erection of appropriate
signs or signals, prohibit the movement of vehicles on any street or part of a street
and no person shall drive or operate a vehicle in contravention of any such signs
or signal.
32. Funeral and Other Processions
(1)
No person shall, except under the direction of a Police Officer, drive
or operate a vehicle on a highway between vehicles comprising a
funeral cortege or other procession recognizable as such by the
display of pennants or other identifying insignia while the vehicles in
such procession are in motion.

(2)
No person shall drive a vehicle in a funeral cortege or other
procession on a highway except as near to the right hand edge of the
roadway as practicable and follow the vehicle ahead as close as is
practicable safe.
33. Vehicles Crossing Sidewalks, Boulevards and Curbs
(1)
Vehicles on Sidewalks Prohibited
No person shall drive a vehicle upon a sidewalk or footpath on a
highway except for the purpose of directly crossing the sidewalk or
footpath. This subsection shall not apply to invalid chairs, baby
carriages, tricycles, children's wagons, or a youth bike with training
wheels.
(2)
Curb and Sidewalk Depressions
No person shall drive a vehicle over a raised curb or sidewalk except at
a place where there is a ramp, rolled curb, or depressed curb provided
however, this Section shall not apply to invalid chairs, baby carriages,
tricycles, children's wagons or a youth's bike with training wheels.
(3)
Vehicles on Boulevards Prohibited
No person shall drive any vehicle on any boulevard except for the
purpose of directly crossing a boulevard at a driveway or other
designated vehicular crossing.
34. Motorcycles
No person operating a motorcycle on a street shall carry on such motorcycle more
persons than the motorcycle is designed and properly equipped to carry.
35. Boarding and Alighting from Moving Vehicles
No person shall board or alight from any vehicle while such vehicle is in motion.
36. Obedience to Police Officers, Traffic Signs and Traffic Control Signals
Notwithstanding any provisions of this By-law, every person shall promptly obey all
signals given by a traffic control signal, traffic control devise of a traffic sign and all
directions given by a Police Officer or of any Officer having jurisdiction over the
regulation of traffic on a highway including a school-crossing guard, appointed by

the Corporation, and nothing in the by-law shall affect the powers to regulate traffic
held by the Board of Commissioners of Police.
37. Exemption - Municipal Vehicles Performing Work on Highways
The provisions of this By-law do not apply to vehicles of the Corporation or vehicles
working on behalf of the Corporation while such vehicles are engaged in the
performance of cleaning, clearing, maintenance, repair, construction or other work
on any highway.
38. Emergency Vehicles - Exemption
This By-law shall not, in the case of emergency, apply to ambulances or police, fire
or emergency measures department vehicle.
PART VI - PEDESTRIANS AND PEDESTRIAN MALLS
39. Pedestrian to Yield to Vehicular Traffic
Except where traffic control signals are in operation or where traffic is being
controlled by a Constable or crossing guard, a pedestrian crossing a highway shall
yield the right-of-way to all vehicles upon the roadway, but nothing in this section
shall relieve the driver of a vehicle from the obligation of taking all due care to avoid
an accident.
40. Pedestrians Prohibited on Roadway
Except for the purpose of crossing a roadway where there is a sidewalk that is
reasonably passable on one side or on both sides of a roadway, no person shall
walk on the roadway.
41. Pedestrian Barriers
No pedestrian shall proceed over or go under a barrier permanently installed on a
sidewalk, or any other location within a highway.
PART VII - SCHOOL CROSSING GUARDS
42. Appointment and Duties
(1)
The Corporation may appoint school crossing guards to direct traffic
during the school year at such places where, in the interests of the ·
safety of pedestrians, the Physical Environment Committee of

Council deems it necessary.
(2)
It shall be the duty of the school crossing guards to be
present at their appointed places within such times as
shall be specified by the OPP Inspector or designate, and
to direct traffic, both pedestrian and motor vehicle, in such
a manner as to ensure the safety of pedestrians crossing
the street and in accordance with the authority of the
Highway and Traffic Act R.S.O. 1990.
PART VIII - MOTORIZED SNOW VEHICLES
43. Application
Subject to the Provisions of By-law No. 19-92, the provisions of this By- law
regulating the movement and parking of vehicles shall apply mutatis mutandis to
motorized snow vehicles.
PART IX - BICYCLES
44. Bicycles
(1) A person driving a bicycle upon a roadway shall:
(a)
drive as near to the right-hand side of the
roadway as practicable, and
(b)
exercise due care when passing a parked,
stopped or standing vehicle or one
proceeding in the same direction.
(2)
A person operating a bicycle upon a highway
designated for one- way traffic shall:
(a)
drive as near the right hand or left-hand side of the
roadway as practicable, and
(b)
exercise due care when passing a standing
vehicle or one proceeding in the same direction.
(3)
Persons operating bicycles upon a roadway shall do so
in a single file.

(4)
No person operating a bicycle shall carry any package,
bundle or article which prevents the rider from keeping
both hands on the handlebars.
(5)
No person riding a bicycle or tricycle on a highway shall
remove his feet from the pedals while the bicycle or tricycle is
in motion.
(6)
No person shall park a bicycle on a highway except in such
manner as to cause the least possible obstruction to
pedestrian or vehicular traffic.
(7)
A person riding upon a bicycle, a coaster, roller skates,
skis, a toboggan, a sled or a toy vehicle shall not attach it
or them to a vehicle on a roadway.
(8)
No person riding on a bicycle designed for carrying one
person only shall carry any other persons thereon.
(9)
No person shall attach himself to the outside of a
vehicle on a roadway for the purpose of being drawn
along the roadway.
PART X
ACCESSIBLE30 PARKING
45.
Accessible Parking31
Number of Parking Spaces
(1)
Every owner or operator of a Public Parking Area shall provide
Accessible Parking Spaces in conformity with the provisions of this By-
law for the use of vehicles with permits.
(2)
The minimum number and type of Accessible Parking Spaces which
must be provided shall be calculated in accordance with the Town's
current Development Permit By-law, as may be amended from time to
time.

(3)
Every owner or operator of a Public Parking Area may voluntarily provide
a number of Accessible Parking Spaces above and beyond the
requirements of the Town's current Development Permit By-law.
Accessible Parking Spaces
(4)
Every Accessible Parking Space shall:
(a)
have an unobstructed rectangular area with a minimum width of
3400 mm and a minimum depth of 6000 mm for a single off-street
Type A Parking Space;
(b)
have an unobstructed rectangular area with a minimum width of
2750 mm and a minimum depth of 6000 mm for a single off-street
Type B Parking Space;
(c)
be distinctly indicated with Pavement Markings containing the
International Symbol of Access which includes a 1525 mm x 1525
mm white border and symbol with a blue background field colour;
(d)
be comprised of a stable surface such as asphalt, concrete,
pervious materials or other hard-surfaced material;
(e)
be drained so as to control the pooling of surface water and
prevent the flow of surface water to adjacent lands;
(f)
be readily accessible to an Accessible Parking Permit Holder,
whether via ramps, depressed curbs or other appropriate means
and where the Public Parking Area is intended to serve a
particular building or complex, located within easy access of said
building or complex;
(g)
be placed with sufficient clearance around the vehicle in terms of
other vehicles or obstacles such as light standards or waste
receptacles;
(h)
have an accessible path of travel by means of an access with a
width of 1.5 m and which runs the length of the parking space and
is marked by high-tonal contrast lines.
(i)
be distinctly identified in accordance with the requirements of the
Highway Traffic Act and the regulations made thereunder.

(5)
Every Accessible Parking Space shall be kept free and clear from
obstructions, and kept free and clear of snow, ice or other material which
could render the parking space unusable.
Accessible Parking Signs
(6)
Authorized signs for parking spaces for persons with disabilities shall
comply with the signs described under Section 11 of Ontario Regulation
581 made under the Highway Traffic Act.
(7)
The owner and operator of an obligated organization shall be jointly
responsible for the procurement and installation of the authorized signs.
(8)
The owner and operator of an obligated organization shall be jointly
responsible:
(a)
for the maintenance of the authorized signs which shall include
repainting when necessary; and
(b)
for ensuring that the shape, symbols and colours of the authorized
signs conform to the provisions of this by-law.
Exemptions
(9)
The provisions of this By-law shall not apply to an Authorized Emergency
Vehicle and shall also not apply to any vehicles while engaged in works
undertaken for or on behalf of the Town.
Prohibitions
(10)
No person shall Park, Stop or leave a vehicle in an Accessible Parking
Space unless:
(a)
a valid Accessible Parking Permit is properly displayed upon the
vehicle ensuring the permit number and expiry date are clearly
visible; and
(b)
the vehicle is positioned fully within the Accessible Parking Space;
and
(11)
No fee shall be charged for the use of an Accessible Parking Space in
excess of that fee charged to other members of the general public in
request of the abutting non-Accessible Parking Spaces.

PART XI - MUNICIPAL PARKING LOTS
46.
Municipal Parking Lots
(1)
No person shall park a vehicle or permit a vehicle to remain parked in
a Municipal Parking Lot for a period of time longer than four hours
between 7:00 a.m. and 11:00 p.m. without first obtaining a parking
permit.
(2)
Notwithstanding the above, the Municipal Parking Lot on Allan Street
will have no restrictions in regards to the length of time parked, nor
shall a permit be required to park there.
(3)
Except where provided elsewhere in this By-law, there shall be no
limitations for all Municipal Parking Lots between 11:00 p.m. and 7:00
a.m.
(4)
Annual, six months, one day and guest parking permits are available
for purchase to the public. The permit validation will begin upon date of
purchase.
(5)
No person shall park a vehicle or permit a vehicle to remain parked in
such a manner that it is not wholly within the area designated as a
parking space unless the vehicle is of such length as to render it
impossible to park it in one parking space, in which case the adjoining
parking space may, in addition, be used but in no case shall any
person park a vehicle or permit a vehicle to remain parked in such
manner as to obstruct the parking lot entrance, exit or roadway that is
laid out for the movement of vehicles through the parking lot.
PART XII - SIGNS
47.
Erection of Signs, Traffic Signals, Etc.
The Town Engineer is hereby authorized and directed to erect and maintain
such signs, traffic control signals, markings, barricades, traffic control devices
and other structures, plants and equipment as are required to give effect to this
by-law and as required to regulate, direct, warn or guide pedestrian and
vehicular traffic for the safety and convenience of the public.
48.
Signs by OPP Inspector or Designate
The OPP Inspector or designate may erect, place and maintain such
authorized signs as are required to give effect to the provisions of this By- law

coming within his jurisdiction for emergency purposes.
49.
Conflicting Private Signs
No person shall place, maintain or display upon or be visible from any highway
any sign, signal, marking or device which:
(d)
conceals a traffic control device, traffic signal or parking meter
from view;
(e)
interferes with the effectiveness of a traffic control device,
traffic control signal or parking meter, or;
(f)
purports to be or is an imitation of or resembles any
official or authorized sign, traffic control signal or traffic
control device.
50. Defacing Signs and Traffic Signals
No person shall move, remove, deface or in any manner interfere with any sign,
traffic control signal, marking or other traffic control device placed, erected or
maintained under this By-law.
51. Freshly Painted Lines on Roadway
No person shall willfully drive any vehicle over any marking on the roadway where
markers are in place to indicate that the marking material has been freshly applied
nor shall any person drive into or over any markers so placed.
PART XIII-OFFENCES AND PENALTIES
52. Penalties
Any person who contravenes any of the provisions of this By-law and the
procedures with respect thereto is guilty of an offence, and the enforcement and the
penalty imposed thereunder shall be subject to the provisions of The Provincial
Offences Act, R.S.O. 1990 Chapter P.33 and· any amendments thereto, and the
penalty for the commission of any such. offence shall be as provided for in the said
Provincial Offences Act.
53. Early Payment and Voluntary Payment of Parking Penalty
Notwithstanding all other provisions of this By-law with respect to
penalties for violations of the provisions relating to parking hereinafter set
out, any person may upon presentation of a Parking Infraction Notice at

the Office listed on the Notice, pay out of Court within the set time
specified on the Notice the amount stipulated for early payment of set
fine as the case may be and upon such payment no further
proceedings shall be taken under this By-law in respect to the said
offence alleged on the Notice. A receipt for payment signed by the
person assigned to the duty of receiving payment shall be evidence of
payment of the penalty alleged in the Notice.
54. Vehicles Subject to Removal When Illegally Parked
A Police Officer, Police Cadet, Municipal Law Enforcement Officer or an Officer
appointed for carrying out the provisions of the Highway Traffic Act, upon discovery
of any vehicle parked or left in contravention of this By-law, may cause it to be
moved or taken to and placed or stored in a suitable place and all costs and
charges for removing, caring and storage thereof, if any, are a lien upon the vehicle
which may be enforced in the manner provided by The Repair and Storage Liens
Act, R.S.0 1990 Chapter R. 25.
55.
Liability of Owner
The owner of a vehicle may be charged with and convicted of an offence under
this By-law for which the driver of the vehicle is subject to be charged unless, at
the time of the offence, the vehicle was in the possession of some person other
than the owner without the owner's consent and on conviction the owner is liable
to the penalty prescribed or provided for the offence.
PART XIV - APPLICATION AND ADMINISTRATION
56. Enforcement
This By-law shall be enforced by the OPP Inspector or designate, the Municipal
Law Enforcement Officers for the Town of Carleton Place and any other person
employed to enforce the rules of this by-law.

Application of By-law
This By-law applies to all highways under the jurisdiction of the Corporation of the
Town of Carleton Place

By-law Subject to Highway Traffic Act
The provisions of this By-law are subject to the provisions of The Highway Traffic
Act.

61.
Parking on Private Property
No person shall park or leave any motor vehicle on private property without
authority from the owner or occupant of such property.
62.
Removal of Vehicles Parked on Private Property
Whenever a motor vehicle is parked or left on private property without the express
authority of the owner of such property, a Constable or any Officer appointed for the
carrying out of the provisions of Section 170, subsection 15 of The Highway Traffic
Act, R.S.O. 1990, c.48, upon the written complaint of the occupant or any adult
resident of the property, shall cause the said motor vehicle to be moved or taken to
and placed or stored in a suitable place and all costs and charges for removing,
care and storage thereof, if any, shall be paid by the owner of the said vehicle and
such costs and charges shall be a lien upon the said motor vehicle which may be
enforced in the manner provided by The Repair and Storage Liens Act, R.S.O.
1990.
63.
Note: Schedules 'I' through 'XX' are part of this By-law.
64.
This By-law shall not take effect until an order regarding set fines
have been approved by the appropriate Judge of the Ontario
Court of Justice Provincial Division.

MAXIMUM POSTED SPEED LIMIT ON MCNEELY AVENUE
The maximum speed limit on McNeely Avenue between the southerly boundary of
the municipality and the southerly street line of Lake Avenue East shall be 80 kph
and the maximum speed on McNeely Avenue between the northerly street line of
Lake Avenue East and the southerly street line of William Street shall be 60 kph.

2. Only vehicles with boating trailers attached may park within the longer designated
parking spots specifically designed for such vehicles as indicated by signs at the

1. No person shall use, draw, haul or propel any skateboard along or
upon any sidewalk or roadway as set out in Schedule 'XVIll'. This
