Municipality of Central Manitoulin By-law No. 2009-10 Being a By-law to Establish NO SMOKING ZONES in Areas Adjacent to Public Buildings in the Municipality of Central Manitoulin Whereas the Municipal Act, 2001, S.O. 2001, Chapter 25, Part 2 section 10 (2) empowers municipalities to enact By-laws in respect to the health, safety and well-being of persons. And Whereas the Municipality of Central Manitoulin does hereby deem it advisable to establish a By-law designating certain areas as "No-Smoking Areas" within the Municipality. Now Therefore, the Municipality of Central Manitoulin enacts as follows: 1) For the purposes of designating No-Smoking Areas the Municipality deems all Municipal Buildings to be "Prescribed Areas" as in the Smoke Free Ontario Act S.O. 1994 c.10 , Section 9 (2) ch. 7. 2) That the areas within a 9 meter radius of all public entrances to the aforementioned buildings be designated to be "Prescribed Areas" as in the Smoke Free Ontario Act S.O. 1994 c.10, Section 9 (2) ch. 7. 3) That all restrictions and prohibitions described in the Smoke Free Ontario Act or its' Regulations, pertaining to "Prescribed Areas" , shall form a part of this By-law. 4) Severability Should any section, or part of a section of this By-law for any reason be found to be invalid, it is the intention that all the remaining provisions shall remain in full force and effect. 5) Definitions "Prescribed Area " shall mean but not be limited to; Any building or structure owned or operated by the Municipality of Central Manitoulin and areas adjacent to a public entrance at any of the aforementioned locations. "No Smoking Area" shall mean; An area where no person shall smoke or hold lighted tobacco products. Enforcement It will be the responsibility of the By-law Enforcement Officer as appointed by the Council of the Municipality of Central Manitoulin to enforce this By-law. OFFENCES and PENALTIES Any person found to be in contravention of this By-law is guilty of an offence and shall therefore be subject to a fine upon conviction pursuant to the guidelines of the "Smoke Free Ontario Act" S.O. 1994, c. 10 Section 15, Offences. Read its First time on April 9, 2009. Read a Second Time on May 14, 2009.
