requiringowners
ofprivately owned outdoor swimmingpools 'to erect and maintain
fencesand gatesaround suchswimmingpools andfor prescribing the heightand

HASTINGSHEREBYENACTSAS FOLLOWS:
i.
'Thatheowner
ofaprivately owned outdoorswimming.
pool shallerect and
maintainanadequate enclosuresurrounding the entire swimmingpool area
andsufficient
to makesuch body of water not readily accessibleto small

_Thatsuchenclosures,includinggates therein,shall extend fromthe ground
to a height, measured on the outside of the enclosure of not lessthan ?ve
(5) feet.

Thata fenceor its equivalent forming part of such enclosures shallbe of
verticallyboardedwood construction,chainlinkconstruction,or of other
materialsand constructionas provided for in clause 3 (c).

as prescribed bythisBy-Lawhave
beenerected.
6.
(a)
Thatplans forany fencesand gates as prescribed

firstbe produced to the Municipalityof Centre HastingsBy-Law
EnforcementOfficerfor approval prior to construction.
(b)

Thatthe Municipalityof Centre HastingsBy-LawEnforcementOf?cer
be given five days from receipt of plans as noted in 6(a) above to
review and make decisionon said plans.
7.
That no one shallexcavate
for or erect'a
privately ownedswimmingpool
unless;
(a)
(l)
the plans of all fencesand gates are ?rst produced to the
, Municipalityof CentreHastingsBy-LawEnforcementOf?cer.
(ii)
such plans confonn to this By-Law
(iii)
a pennit is issuedby the Municipalityof CentreHastingsBy-
LawEnforcementOf?cer certifyingapprovalofsuch plans
(b)
A pem1it for such fencesand gates shallbe re?ssedforany such
fencesor gates that if erected would be contraryto theprovisions of
thisBy-Law.
8.
That any person convicted of a breachof any of therprovisionsof this By-
- Lawshallforfeitand pay, at the discretionof the convicting justice a penalty
not exceeding,exclusiveof costs, the sum of two thousanddollars
($2,000.00) for each offence.
9.
That thisBy-Lawshallcome into full force and effect upon the passing
hereof.
