The Corporation of the Township of Centre Wellington By-law 2025-82 A By-law to regulate the Parking or Stopping of Vehicles on Highways, Municipal Parking Lots, Municipal Property and Private Property within the Township of Centre Wellington Whereas Section 11(3)(1) and (8) of the Municipal Act, 2001, S.O. 2001, c.25, as amended ("Municipal Act"), authorizes both upper and lower-tier municipalities to pass by-laws respecting highways, including parking and traffic on highways, and parking on private property; and Whereas Section 63 of the Municipal Act authorizes that, where a municipality passes a by-law for prohibiting or regulating the placing, Stopping, standing or parking of an object or Vehicle on a Highway, it may provide for the removal and impounding or retraining and immobilizing of any object or Vehicle placed, Stopped, standing or parked on a Highway in contravention of the by- law; and Whereas Section 100 of the Municipal Act authorizes a municipality to pass by-laws to regulate or prohibit the parking or leaving of Motor Vehicles on private land used as a parking lot without the consent of the Owner of the land; and Whereas Section 100.1 of the Municipal Act authorizes a municipality to regulate or prohibit the parking or leaving of Motor Vehicles on private property without the consent of the Owner of the land; and Whereas Section 101(1) of the Municipal Act states that, if a municipality passes a by-law regulating or prohibiting the parking or leaving of a Motor Vehicle on land, it may provide for the removal and impounding or restraining and immobilizing of any Vehicle, at the Vehicle Owner's expense, parked or left in contravention of the by-law and subsection 170(15) of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, applies with necessary modifications to the by-law; and Whereas Section 101(2) of the Municipal Act, 2001 states that a municipality may enter on land at reasonable times for the purposes described in subsection 101(1); and Whereas Section 101(3) of the Municipal Act, 2001 states that, if signs are erected on land specifying conditions on which a Motor Vehicle may be parked or left on the land or regulating or prohibiting the parking or leaving of a Motor Vehicle on the land, a Motor Vehicle parked or left on the land contrary to the conditions or prohibition shall be deemed to have been parked or left without consent; and Whereas Section 7.1 of the Fire Protection and Prevention Act, 1997 S.O. 1997, c. 4 authorized municipal councils to pass by-laws designating private roads as Fire Routess along which no parking of Motor Vehicles shall be permitted; and WHEREAS Section 102.1 of the Municipal Act and Ontario Regulation 333/07: Administrative Penalties authorize a municipality to require a Person to pay an administrative penalty for a Contravention of any By-law respecting the parking, standing or Stopping of a Vehicle; and WHEREAS Section 434.1 of the Municipal Act authorizes a municipality to require that a Person pay an administrative penalty if the municipality is satisfied that the Person has failed to comply with a municipal by-law; WHEREAS Subsection 434.2(1) of the Municipal Act, 2001 provides that an administrative penalty that is imposed by a municipality on a Person constitutes a debt of that Person to the municipality; and Whereas the Council of the Township considers it desirable and necessary to continue to enforce failures to comply with Parking By-law 6000-23 prior to the date this By-law comes into force under the Provincial Offences Act and By-law 6000-23 as if this By-law had not come into force. Now Therefore the Council of the Corporation of the Township of Centre Wellington hereby enacts as follows: 1. Title 1.1. This By-law may be known and cited for all purposes as "Parking By-law 2025-82." 2. Definitions 2.1. For the purposes of this By-law: "Accessible Parking Permit" means a Parking Permit issued by the Minister of Transportation under the authority of Highway Traffic Act R.R.O. 1990 Regulation 581 Accessible Parking For Persons with Disabilities; "Accessible Parking Space" means a parking space designated for the use of Persons with Disabilities as required by Ontario Regulation 191/11 (Integrated Accessibility Standards) as amended made under the Accessibility for Ontarians with Disabilities Act, 2005 as amended, and identified by an Accessible Parking Permit sign as set out in Section 11(a) of Ontario R. R. O. 1990, Reg 581 (Accessible Parking for Persons with Disabilities) of the Highway Traffic Act; "Administrative Penalty" means an administrative monetary penalty as set out in Schedule 'A' of the AMPS By-law for a Contravention of this By-law. "AMPS By-law" means the Corporation of the Township of Centre Wellington By-law 2025-82: A By-law to establish an Administrative Monetary System (AMPS), as amended; "Angle Parking" means the parking of a Vehicle whether occupied or not at an angle indicated by pavement markings or Authorized Signs for angle parking purposes, or if not indicated by such pavement markings or Authorized Signs, at an angle of forty-five (45) degrees from the lateral curb line so that the front end of the vehicle is angled toward the direction in which the vehicle is permitted to proceed; "Angle Parking Zone" means an area on a Highway in which Angle Parking is permitted, as designated in Schedule "A" to this By-law; "Authorized Sign" means any sign, pavement marking or other device which has been placed, installed or erected by the municipality, by another party acting under the direction or authority of the municipality or as required by this By-law, to designate, regulate and/or enforce the provisions of this By-law; "Boulevard" means that part of a Highway from the edge of the Roadway to the nearest lateral property line, but does not include a shoulder, Sidewalk or multiuse trail; "Bus" means a Vehicle designed for carrying ten or more passengers and used for the transportation of Persons; "Bus Stop" means an area on a Highway where Authorized Signs are on display indicating that the area is reserved for the Parking of Buses as designated in Schedule "B" to this By-law; "Commercial Motor Vehicle" means a Motor Vehicle, used or intended to be used for commercial purposes, with a gross Vehicle weight rating of more than 4,500 kg and having permanently attached thereto a truck or delivery body and may include, without limiting the foregoing, catering or canteen trucks, Buses, cube vans, tow trucks, tilt and load trucks, dump trucks, transport tractors, hearses, fire apparatus, Taxis and limousines; "Contravention" means the failure to comply with any provision of this By-law; "Crosswalk" means: (a) that part of a Highway at an Intersection that is included within the connections of the lateral lines of the Sidewalks on opposite sides of the Highway measured from the curbs or in the absence of curbs from the edges of the Roadway, or (b) any portion of a Highway at an Intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings upon the surface of that Highway; "Dead-End Street" means a Highway with only one way in or out, ending in a rounded area. "Designated By-law" means a Township By-law, or part or provision of a Township By-law, that is designated under the AMPS By-law or another By-law as being subject to Administrative Penalties; "Designated Parking Space" means a Parking Space upon a Highway or on a Municipal Parking Lot or on Municipal Property where Authorized Signs or pavement markings are on display indicating that the parking space is designated for the use of a Township Vehicle or Vehicle displaying a currently valid parking permit issued by the Township as designated in Schedule "C" to this By-law. "Director" means the Managing Director of Infrastructure Services or their designate for the Township; "Driveway" means an approved vehicular access-way providing access from a Highway to a building or property, loading space, an approved Parking area or garage, and does not include a public Sidewalk; "Electric Vehicle" means, (a) a battery electric Vehicle that runs only on a battery and an electric drive train, or (b) a plug-in hybrid electric Vehicle that runs on a battery and an electric drive train and also uses an internal combustion engine; "Electric Vehicle Charging Station" means a publicly or privately-owned Parking Space that provides access to equipment that supplies a source of electricity for charging Electric Vehicles; "Emergency Vehicle" means, (a) a fire department Vehicle while responding to a fire alarm or other emergency call; or (b) a Vehicle while used by a Person in the lawful performance of his or her duties as a Police Officer; or (c) an ambulance while responding to an emergency call or being used to transport a patient or injured Person in an emergency situation; or (d) a cardiac arrest Emergency Vehicle operated by or under the authority of a hospital; "Fire Route" means an area on a Highway or on a public parking lot or on Private Property where Authorized Signs are on display indicating that Parking is prohibited in order to provide fire department and other Emergency Vehicles unobstructed access to adjacent properties in the event of fire or other emergency or where a Fire Route is required to be established under a municipal site plan agreement or any municipal approval requiring the establishment of a Fire Route. "Highway" includes a common and public Highway, street, avenue, parkway, Driveway, square, place, bridge, laneway, viaduct or trestle, any part of which is intended for or used by the general public for the passage of Vehicles and includes the area between the lateral property lines thereof. Without limitation, Highway includes unassumed or unopened road allowances. "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or if none then of the lateral boundary lines of two or more Highways that join one another at an angle whether or not one Highway crosses the other. "Metered Zone" means a part of a Highway or Municipal Parking Lot designated by this By-law for Parking purposes timed by Parking Meters and for which a fee is required to be paid to Park; "Municipal Law Enforcement Officer" means a duly authorized Person appointed by the Township of Centre Wellington for the purpose of enforcing the Parking or Stopping provisions of this By-law. "Municipal Parking Lot" means Municipal Property not on a Highway to which the public has access designated for the purpose of providing Parking for Vehicles as designated in Schedule "D" to this by-law. "Municipal Property" means land, buildings, structures, parking areas, rights-of-way, easements or premises that are owned, leased, occupied or controlled by the Township, including but not limited to Municipal Parking Lots, parks, community centres, municipal offices, and any lands used or intended for municipal purposes, but does not include a public Highway; "No Parking Zone" means an area on a Highway where Authorized Signs are on display indicating that Parking is prohibited as designated in Schedule "E" to this By-law. "No Stopping Zone" means an area on a Highway where Authorized Signs are on display indicating that Stopping is prohibited as designated in Schedule "F" to this By-law. "Occupant" when used in relation to property, means: (a) The tenant of the property or part thereof whose consent shall extend only to the control of the property of which he is tenant and any Parking Spaces allotted to him under his lease or tenancy agreement (b) The spouse of a tenant (c) A Person authorized by an Occupant as defined in (a) or (b) above, to act on the Occupant's behalf for requesting enforcement under this By-law; "Officer" means a Municipal Law Enforcement Officer, Police Officer, or any other Person appointed by by-law to enforce this By-law; "One-Way Street" means a Highway where Authorized Signs are on display indicating that traffic is to proceed in one direction only; "Owner" when used in relation to property means: (a) The registered owner of the property (b) The registered owner of a condominium unit, whose consent shall extend only to the control of the unit or which he is owner and any Parking Spaces allotted to him by the condominium corporation or reserved for his exclusive use in the declaration or description of the property (c) The spouse of a Person as defined in (a) or (b) above (d) Where the property is included in a description registered under the Condominium Act, the Board of Directors of the condominium corporation (e) A Person authorized by the property owner as defined in (a), (b), (c) and (d) above to act on the owner's behalf for requesting enforcement under this By-law (f) An Occupant "Park" or "Parking" means the standing of a Vehicle whether occupied or not except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; "Parking Meter" means all devices intended to control parking within a Township parking facility or on a Highway. These devices include but are not limited to all parts associated with: a Parking Meter, pay and display parking machine, pay upon foot machine, pay by space parking machine, pay by plate machine, event attendant, scanning device, license plate recognition device, publicly zoned and publicly signed pay areas. These parking control devices may also include but are not limited to all parts associated with same: pay upon entry machine, pay upon exit machine, spitter machine, entrance gate, exit gate, mobile phone application, QR code associated website and other such emerging technologies or staff as implemented into the Township parking facility or on- street locations; "Parking Space" means an area designated by Authorized Signs, painted lines, curbs or other markings, for the purpose of parking a Vehicle either on a Highway or within a Municipal Parking Lot, on Private Property or on Municipal Property. "Pedestrian Crossover" means any portion of a Roadway distinctly indicated for pedestrian crossing by signs on the Highway and lines or other markings on the surface of the Roadway as prescribed by the regulations; "Permit(s)" means a permit issued by the Director or designate as set out in this By-Law; "Person" includes an individual, sole proprietorship, partnership, limited partnership, trust, corporation, and an individual in his or her capacity as a trustee, executor, administrator, or other legal representative; "Persons with Disabilities" has the same definition as "person with a disability" in Ontario R. R. O. 1990, Reg 581 (Accessible Parking for Persons with Disabilities) of the Highway Traffic Act; "Police Officer" means a member of a Police Service as defined in the Community Safety and Policing Act, 2019; "Private Property" means legal designation for the ownership of property by non- governmental legal entities; "Public Utility Vehicle" means a Vehicle owned, operated, or contracted by a utility provider and used for installing, maintaining, or repairing electricity, gas, telecommunications, water, wastewater, stormwater, or similar utility infrastructure. The Vehicle must display utility identification or be actively engaged in utility work; "Roadway" means the part of the Highway that is improved, designed or ordinarily used for vehicular traffic and where a Highway includes two or more separate roadways, the term "Roadway" refers to any one Roadway separately and not to all of the Roadways collectively; "Roundabout" means a form of intersection which accommodates traffic flow in a circular direction around a central island; "School Bus" means a Bus that, (a) is painted chrome yellow, and (b) displays on the front and rear thereof the words "School Bus" and on the rear thereof the words "do not pass when signals flashing" "School Bus Loading Zone" means an area on a Highway or on Private Property as designated by Schedule "G" to this By-law where Authorized Signs are on display indicating that Parking is prohibited in order to provide School Bus(es) with the facility to load or discharge passengers; "Sidewalk" means that portion of a Highway between each edge of the roadway and the adjacent property lines, and intended for the use of pedestrians; "Stop" or "Stopping", when prohibited, means the halting of a Vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer or of a Traffic Control Device; "Taxicab" shall mean a motor Vehicle which is used for the conveyance of passengers with a seating capacity of no more than (9) nine but does not include a public Vehicle as defined under the Public Vehicles Act, or successor legislation, or a Vehicle for Hire" "Taxicab and Vehicles for Hire stand" means an area on a Highway as designated by Schedule "H" to this By-law where Authorized Signs are on display indicating that Parking is prohibited in order to provide Taxicabs and Vehicle for Hire with the facility to load or discharge passengers; "Temporary No Parking Zone" means an area on a Highway or on a Municipal Parking lot where Authorized Signs are on display in accordance with the provisions of Section 4 of this By-law; "Temporary Parking Permit" means a permit issued by the Director which allows Parking in a designated area during a time period when Parking may otherwise be prohibited in the following circumstances: (1) Parking for out-of-town delegates to attend conventions or other community events; or (2) during construction or maintenance activities which preclude access to other lawful Parking areas. "Time Limited Parking Zone" means an area on a Highway where Authorized Signs are on display indicating that Parking is restricted to certain times and days as designated in Schedule "I" to this By-law; "Township" means the Corporation of the Township of Centre Wellington or the land within the geographic limit of the Corporation of the Township of Centre Wellington as the context requires; "Traffic Control Device" means any sign and/or any Highway, curb or Sidewalk marking or other device whether temporary or not erected or placed under the authority of the municipality for the purpose of guiding or directing traffic; "Vehicle" includes a Motor Vehicle, trailer, traction engine, farm tractor, road-building machine, bicycle and any Vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow Vehicle or a street car; "Vehicle for Hire" means a Vehicle which provides transportation for a Vehicle for Hire Service; "Vehicle for Hire Service" shall mean the use of a Vehicle for Hire for the conveyance of Passengers arranged through a Vehicle for Hire Business; "Vehicle for Hire Business" means a business which, through an Electronic Platform, arranges transportation of passengers by drivers in a Vehicle for Hire, that is commenced within the boundaries of the Township of Centre Wellington for compensation, but does not include: (i) Any Taxicab Service or Accessible Taxicab service; (ii) Any Bus transportation service; (iii) Any carpooling arrangement as defined in the Public Vehicles Act; or (iv) Any ambulance, fire truck or other Emergency Vehicle service. 3. Application 3.1. This By-law applies to Parking and Stopping of Vehicles on: (i) Highways within the geographical boundaries of the Township; (ii) Town facilities; (iii) Municipal Property; or (iv) Private Property. 3.2. Every Vehicle Parked on a Highway or in a Municipal Parking Lot shall be Parked at the risk of its Owner and the Township is not responsible for any loss or damage to any Vehicle or its contents 3.3. All attached Schedules form part of this By-law 4. Authority 4.1. The Director is authorized to place, erect and maintain or cause to be placed, erected and maintained such Traffic Control Devices and traffic control signs that are required to give effect to the provisions of this By-law and/or that are authorized by the Schedules to this By-law. 4.2. The Director is authorized, notwithstanding the other provisions of this By-law, to place, erect, maintain, move and remove such Traffic Control Devices and traffic control signs as are required for reasons of emergency or safety or for an activity for which the County or the Township has granted a permit. 4.3. Unless otherwise permitted, no Person shall place, maintain or display upon any Highway any sign, signal, marking or device that purports to be or is an imitation of or resembles any Traffic Control Device or traffic control signal without the prior written approval of the Director. 4.4. Pursuant to S. 110 of the Highway Traffic Act, the Director is authorized to issue permits for the use of a Highway by a Motor Vehicle or combination of Motor Vehicles in excess of the dimensions and weight limits set out in the Highway Traffic Act. 4.5. This By-law is a Designated By-law to which the Administrative Penalties under the AMPS By-law applies. 4.6. The Provincial Offences Act, R.S.O, 1990, c. P. 33, as amended, does not apply to this By-law. 5. Fire Routes 5.1. A Fire Route may be located upon a Highway, Municipal Parking Lot or Private Property where Authorized Signs are erected. 5.2. A Fire Route may be located upon Private Property that is subject to a municipally approved site plan agreement that designates such Private Property to be a Fire Route. 5.3. A Fire Route may be located upon Private Property where the property Owner has requested the designation of a Fire Route and that request has received municipal approval. 6. Enforcement 6.1. This By-law is a Designated By-law to which the Administrative Penalties under the AMPS By-law applies. 6.2. The provisions of this by-law shall be enforced pursuant to the AMPS By-law, and the AMPS By-law applies to each Administrative Penalty issued pursuant to this By-law. 6.3. Every Person who contravenes any provision of this By-law is liable to pay the Township an Administrative Penalty and any applicable Administrative Fee(s) pursuant to the AMPS By-law. 6.4. An Officer may enforce any or all provisions of this By-law. 7. Private Property Enforcement 7.1. No Person shall Park or leave any Vehicle on Private Property without the consent of the Owner or Occupant of the property. 7.2. A Vehicle Parked or left contrary to this section may be removed or impounded at the Vehicle Owner's expense. The driver or Owner of the Vehicle Parked on Private Property is not liable to any penalty or to have the Vehicle removed from such property or impounded to the provisions of this By-law except upon written complaint of the Owner or Occupant of the property given to a Police Officer, Municipal Law Enforcement Officer or other Person appointed for the purpose of carrying out the provisions of this By-law. 7.3. Where an Owner or Occupant of the property has posted an Authorized Sign stating conditions under which a Vehicle may be Parked or left on the property or that Parking or leaving a Vehicle is prohibited on the property, a Vehicle Parked contrary to such conditions or prohibition shall be deemed to have been Parked without consent. 7.4. To enforce this By-law on a particular property, a Municipal Law Enforcement Officer shall be deemed to have written authority of the Owner or Occupant of the property, and such Municipal Law Enforcement Officer is not required to receive a written complaint before authorizing the removal of a Vehicle for the property. 8. Municipal Property Enforcement 8.1. No Person shall Park a Vehicle on Municipal Property, other than as posted by Authorized Signs stating the conditions under which a Vehicle may be Parked or left on the property or that Parking or leaving a Vehicle is prohibited on the property. 8.2. A Vehicle Parked or left contrary to this section may be removed or impounded at the Vehicle Owner's expense. The driver or Owner of the Vehicle Parked on Municipal Property is not liable to any penalty or to have the Vehicle removed from such property or impounded to the provisions of this By-law except upon written complaint of the Owner or Occupant of the property given to a Police Officer, Municipal Law Enforcement Officer or other Person appointed for the purpose of carrying out the provisions of this By-law. 8.3. To enforce this By-law on a particular property, a Municipal Law Enforcement Officer shall be deemed to have written authority of the Owner or Occupant of the property, and such Municipal Law Enforcement Officer is not required to receive a written complaint before authorizing the removal of a Vehicle for the property. 9. Deemed Contravention by Vehicle Owner 9.1. Where a Vehicle has been left Parked or Stopped in contravention of this By-law the Owner of the Vehicle even though the Owner was not the driver of the Vehicle at the time of the Contravention is liable for the Administrative Penalty including any Administrative Fee(s) prescribed for the Contravention unless at the time of the Contravention the Vehicle was in the possession of some Person other than the Owner without the Owner's consent. The onus to prove that the Vehicle was not in the possession of, or under the care and control of another person who was provided consent by the Owner, lies with the Owner. 10. Towing of Vehicles 10.1. In addition to any other penalties provided for in this By-law, a Police Officer or Municipal Law Enforcement Officer may, where a Vehicle is Parked or Stopped in Contravention of this By-law, cause that Vehicle to be removed, taken away and stored in a suitable place. 10.2. Where, acting reasonably in all the circumstances, a Police Officer or Municipal Law Enforcement Officer deems it necessary for public safety to relocate a Vehicle lawfully Parked on a Highway, the Police Officer or Municipal Law Enforcement Officer may remove or cause to be removed the Vehicle to a nearby location in order to facilitate snow clearing operations, the repair of the Highway, or in order to eliminate any immediate risk to health or safety. 10.3. Any Vehicle Parked or left standing on any Highway for a period exceeding 168 hours shall be deemed to be abandoned and upon discovery of such abandonment, a Police Officer or Municipal Law Enforcement Officer may cause that Vehicle to be removed, taken away and stored in a suitable place. 10.4. Any Vehicle Parked or left standing on a Highway where there are three (3) or more undisputed Penalty Notices, and where a minimum of 90 days has elapsed from the last date of Contravention, may be towed without further notice. 10.5. All costs and charges incurred for removing, taking away and storing a Vehicle pursuant to s. 10.1,10.2, 10.3 and 10.4 of this By- law, shall be a lien upon the Vehicle, which lien may be enforced in the manner prescribed by the Repair and Storage Liens Act, R. S. O. 1990, Chapter R.25, as amended. 11. Permits 11.1. Notwithstanding any other section of this By-law, any Person may apply to the Director, in writing, for a Temporary Parking Permit allowing a Vehicle(s) to be Parked in a Municipal Parking Lot or on a Highway. 11.2. When applying for a Permit, an applicant may be required by the Director to submit any or all of the following: (i) name and address of applicant; (ii) make, model, and license plate number of the Vehicle (iii) a description of the purpose for the Temporary Parking Permit; (iv) location of where the Vehicle(s) are proposed to be Parked; (v) duration of time the Temporary Parking Permit is needed. (vi) reasoning of why the Temporary Parking permit is needed and should be granted; and (vii) applicable fee, pursuant to the Township's Fees and Charges By-law. 11.3. In considering an application for a Permit, the Director shall have regard to the following: (i) description of the purpose for the Temporary Parking Permit; (ii) location of where the Temporary Parking Permit will take place; (iii) time of day and duration of time the Temporary Parking Permit is needed; (iv) potential interference with the normal functioning of the parking lot, or any safety concerns; (v) any other required approval(s); and (vi) applicable Township By-laws, agreements or policies. 11.4. After considering the merits of a Temporary Parking Permit application, the Director may: (i) Grant the Temporary Parking Permit (ii) Grant a Temporary Parking Permit, subject to certain terms and conditions as deemed fit by the Director; or (iii) Deny the Temporary Parking Permit 11.5. A Temporary Parking Permit may be revoked by the Director, if the Director deems it necessary to do so: (i) with prior notice to the Permit holder, where the Director deems it appropriate; or (ii) immediately and without prior notice to the Permit Holder, where the Director deems it appropriate. Where a Permit is revoked without prior notice, the Director will provide notice to the Permit Holder as soon as practicable following revocation. 12. Exemptions 12.1. The following are exempt from this By-law: (i) any ambulance, police, or fire department Vehicles; (ii) Public Utility Vehicle; (iii) Township Vehicles or Municipal Law Enforcement Officers engaged in the course of their duties on behalf of the Township; 13. Parking Contraventions Within the Township of Centre Wellington: 13.1. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot in a No Parking Zone. 13.2. No Person shall Park a Vehicle upon a Highway less than 1 metre from either edge of a Driveway 13.3. No Person shall Park a Vehicle upon a Highway in front of the entrance to a Driveway so as to prevent ingress to or egress from such Driveway. 13.4. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot or on Private Property, in a Fire Route. 13.5. No Person shall Park a Vehicle upon a Highway within 3 metres of a fire hydrant or within 3 metres of the point on the edge of the roadway nearest any fire hydrant. 13.6. No Person shall Park a Vehicle upon a Highway with its left wheels or runners as the case may be adjacent to the curb of the Highway or where no curb exists, the edge of the Highway unless otherwise permitted by a Traffic Control Device. 13.7. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot in a Time Limited Parking Zone for a period of time in excess of the time designated in Schedule "I" to this By-law. 13.8. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot in a Time Limited Parking Zone during a prohibited time as designated in Schedule "I" to this By-law. 13.9. No Person shall Park a Vehicle upon a Highway with the Vehicles right side further than 0.15 metres from the curb of the Highway or where no curb exists, the edge of the Highway. 13.10. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot (with the exception of 160 Provost Lane, Menzies Lane between the Fergus Public Library and the Grand River, and 25 Metcalfe) between the hours of 2 a.m. and 6 a.m. of any day during the months of November, December, January, February and March of any year. 13.11. No Person shall Park a Vehicle upon a Highway where a Parking Space exists for the purpose of facilitating Parking except within such Parking Space. 13.12. No Person shall Park a Vehicle upon a Highway where Parking is permitted under the provisions of this By-law for an unreasonable length of time and in no case for a period longer than 24 consecutive hours. 13.13. No Person shall Park a Vehicle on a Municipal Parking Lot for an unreasonable length of time and in no case for a period longer than 24 consecutive hours. 13.14. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot in a Temporary No Parking Zone. 13.15. No Contravention shall be created if the Vehicle described in Section 13.14. of this By-law was Parked in the Temporary No Parking Zone prior to the erection of temporary no Parking signs unless the operator of the Vehicle has been requested to move such Vehicle by a Police Officer or Municipal Law Enforcement Officer and has refused to do so. 13.16. No Person shall Park a Vehicle on or over a Sidewalk. 13.17. No Person shall Park a Vehicle upon a Highway within an Intersection. 13.18. No Person shall Park a Vehicle upon a Highway within 9 metres of an Intersection. 13.19. No Person shall Park a Vehicle upon a Highway in a Taxicab and Vehicles for Hire Stand. 13.20. No Person shall Park a Vehicle other than a School Bus upon a Highway in a School Bus Loading Zone. 13.21. No Person shall Park a Vehicle upon a Highway in a Pedestrian Crossover. 13.22. No Person shall Park a Vehicle upon a Highway within 9 metres of a Pedestrian Crossover. 13.23. No Person shall Park a Vehicle upon a Highway in a Crosswalk. 13.24. No Person shall Park a Vehicle upon a Highway within 9 metres of a Crosswalk. 13.25. No Person shall Park a Vehicle upon a Roadway in such a manner as to leave available less than 3 metres of the width of the Roadway for free movement of vehicular traffic. 13.26. No Person shall Park a Vehicle upon a Highway on the Roadway side of any Vehicle Stopped or Parked at the edge or curb of the Highway. 13.27. No Person shall Park a Vehicle other than a Bus upon a Highway in a Bus Stop. 13.28. No Person shall Park a Vehicle upon a Highway for the purpose of repairing, washing or maintenance of the Vehicle other than in an emergency. 13.29. No Person shall Park a Vehicle upon a bridge unless otherwise permitted by a Traffic Control Device. 13.30. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot so as to obstruct an access ramp provided for the use of Persons with Disabilities. 13.31. No Person shall Park a Vehicle upon a Highway within an Angle Parking Zone, except at the angle indicated by markings painted upon the Highway for that purpose or as indicated by Authorized Signs 13.32. No Person shall Park a vehicle in reverse in an Angle Parking Zone upon a Highway. 13.33. No Person shall Park a Vehicle upon a Highway or on a Municipal Parking Lot or on Private Property in an Accessible Parking Space indicated by signage as depicted in Schedule "L" of this By-law unless that Vehicle is transporting Persons with Disabilities and also displays a valid Accessible Parking Permit. 13.34. No Person shall Park a Commercial Motor Vehicle upon a Highway between the hours of 1 a.m. and 6 a.m. of the same day other than upon a section of Highway which is under construction. 13.35. No Person shall Park a Commercial Motor Vehicle on a Municipal Parking Lot unless otherwise permitted by a Traffic Control Device. 13.36. No Person shall Park a Vehicle upon a Highway within 15 metres of any railroad crossing. 13.37. No Person shall Park a Vehicle in a Designated Parking Space unless that Vehicle displays a currently valid Permit issued by the Township of Centre Wellington or is a Township Vehicle. 13.38. No Person shall Park a Vehicle upon a Highway in such a manner as to interfere with the movement of traffic. 13.39. No Person shall Park a Vehicle upon a Highway in such a manner as to interfere with the clearing of snow from the Highway. 13.40. No Person shall Park a Vehicle on a Highway designated as a One-Way Street other than with the Vehicle facing in the direction in which it is permitted to proceed. 13.41. No Person shall Park, where Parking is permitted on either or both sides of a Highway designated as a One-Way Street, with its wheels or runners as the case may be, no further than 0.15 metres from the curb of the Highway or where no curb exists, the edge of the Highway. 13.42. No Person shall Park a Vehicle in an Electric Vehicle Charging Station that is identified by a sign that satisfies the prescribed requirements of the Highway Traffic Act or is an Authorized Sign unless the Vehicle is an Electric Vehicle 13.43. No Person shall Park a Vehicle in an Electric Vehicle Charging Station that is identified by a sign that satisfies the prescribed requirements of the Highway Traffic Act or is an Authorized Sign unless the Vehicle is attached to the station charging equipment and is actively charging. 13.44. No Person shall Park a Vehicle on a Highway in such position as will prevent the removal of any other Vehicle previously Parked. 13.45. No Person shall Park a Vehicle on a Highway on the inside or outside curve portion of an angle bend from the beginning of curve to the end of curve. 13.46. No Person shall Park or leave a Vehicle on Private Property without the consent of the Owner or Occupant of the property. 13.47. No Person shall Park or leave a Vehicle on Private Property contrary to any posted signs. 13.48. No Person shall Park a Vehicle on Private Property on a Driveway without the consent of the Owner or Occupant of the land. 13.49. No Person shall Park a Vehicle in the centre of a Dead-End Street. 13.50. No Person shall Park a Vehicle so as to overhang a curb. 13.51. No Person shall Park an immobile or derelict Vehicle on a Highway including an unattached trailer. 13.52. No Person shall Park a Vehicle on a Highway for the purpose of displaying the Vehicle for sale. 13.53. No Person shall Park a Vehicle on a Highway that does not display a valid license plate. 13.54. No Person shall Park a motorcycle at more than an angle of forty-five degrees to the curb or edge of the road where no curb exists 13.55. No Person or Persons shall Park more than three (03) motorcycles in one (01) Parking Space. 13.56. No Person shall Park a Vehicle on Municipal Property in such a position so as to prevent the removal of another Parked Vehicle. 13.57. No Person shall Park a Vehicle on Municipal Property that is immobile, in disrepair, or is not licensed. 13.58. No Person shall Park a Vehicle on Municipal Property not within a designated Parking Space. 13.59. No Person shall Park a Vehicle in a Student Drop Off and Pick Up Zone for longer than five (05) minutes during the time period indicated on an Authorized Sign for a Student Drop Off and Pick Up Zone. 13.60. No Person shall Park a Vehicle within 3m of a Roundabout. 13.61. No Person shall Park a Vehicle upon a Highway within a Roundabout. 14. Stopping Contraventions Within the Township of Centre Wellington: 14.1. No Person shall Stop a Vehicle upon a Highway in a No Stopping Zone. 14.2. No Person shall Stop a Vehicle upon a Highway on the Roadway side of any Vehicle Stopped or Parked at the edge or curb of that Highway. 14.3. No Person shall Stop a Vehicle upon a Highway within 9 metres of an Intersection. 14.4. No Person shall Stop a Vehicle other than a Bus upon a Highway in a Bus Stop. 14.5. No Person shall Stop a Vehicle, other than a School Bus upon a Highway in a School Bus Loading Zone. 14.6. No Person shall Stop a Vehicle upon a Highway with its left wheels or runners as the case may be adjacent to the curb of the Highway or where no curb exists the edge of the Highway unless otherwise permitted by a Traffic Control Device. 14.7. No Person shall Stop a Vehicle on or over a Sidewalk. 14.8. No Person shall Stop a Vehicle on a Highway in such a manner as to obstruct traffic. 14.9. No Person shall Stop a Vehicle in a Roundabout. 14.10. No Person shall Stop a Vehicle in a Student Drop Off and Pick Up Zone for longer than five (05) minutes during the time period indicated on an Authorized Sign for a Student Drop Off and Pick Up Zone. 15. Lower Driveway Boulevard Parking Where Boulevard Parking is permitted: 15.1. No Person Shall Park on the abutting Roadway or any part thereof; 15.2. No Person shall Park on the landscaped portion of the Boulevard; 15.3. No Person Shall Park a Vehicle on a Boulevard within 9.0 metres of an Intersection; 15.4. No Person shall Park a Vehicle on a Boulevard so as to hinder another Vehicle from entering or exiting a Driveway. 16. Loading Zones 16.1. When Authorized Signs are on display, no Person shall Stop a Vehicle other than a Commercial Motor Vehicle on a Highway or parts of a Highway named or described in Schedule 'M' to this By-law, on the side or sides of a Highway set out, during the times and/or days set out in the said Schedule, except that the driver of a passenger Vehicle may temporarily Stop in a Loading Zone for the purpose of and while actually engaged in loading or unloading passengers and/or merchandise, provided that such Stopping does not interfere with any Commercial Motor Vehicle entering or exiting such Loading Zone. 17. Metered Zones 17.1. The erection, maintenance and operation of Parking Meters, a Pay and Display System, or other devices is authorized on those Highways set forth in Zones 1 and 2 of Schedule "N" to this By-law, for the times identified on the said Schedule to this By- law. 17.2. The erection, maintenance and operations of Parking Meters, a pay and display system, or other devices is authorized at any Municipal Parking Lot and on any Municipal Highway in order to collect, or assist in the collection of, all applicable fees and charges, at the rate(s) as set out Schedule "N". 17.3. Notwithstanding any other provisions of this By-law, where Parking Meters are authorized, no Person shall Park a Vehicle in a Parking Space governed by a Parking Meter without paying the amount identified on the Parking Meter, or an Authorized Sign, for the Parking Space within the prescribed zone. 17.4. No Person shall allow a Vehicle to remain Parked in a Parking Space governed by a Parking Meter in Zone 1 to Schedule "N" to this By-law beyond the maximum period specified for that Parking Space as set out in said Schedule. 17.5. No Person shall Park a Vehicle in a Parking Space governed by a Parking Meter unless it is wholly within that Parking Space. 17.6. No Person shall Park more than one Vehicle in any one Parking Space at any one time. 17.7. No Person shall Park a Vehicle in a Parking Space that is partly or completely occupied by another Vehicle. 17.8. For the purpose of enforcing the maximum period specified in Zone 1 of to Schedule "N" to this By-law, no Person shall re-Park a Vehicle to another on-street location within Zone 1 for a period of five (05) hours from the start of the initial period of having Parked the Vehicle in Zone 1. 18. Severability 18.1. If a court of competent jurisdiction should declare any section or part of a section of this By-law to be invalid such section or part of a section shall not be construed as having persuaded or influenced Council to pass the remainder of the By-law and it is hereby declared that the remainder of the By-law shall be valid and shall remain in force. 19. Singular and Plural Use 19.1. In this By-law, unless the context otherwise requires, words importing the singular shall include the plural, where applicable. 20. Transition 20.1. Notwithstanding the repeal of By-law 6000-23 (A by-law to regulate the Parking or Stopping of Vehicles on Highways, public Parking lots and Private Property within the Township) in Article 14.1 of the AMPS By-law, By-law 6000-23 shall continue to apply to any Contraventions of By-law 6000-23 prior to the date this By-law comes into force. Contraventions of By-law 6000-23 will continue to be enforced under the Provincial Offences Act and By-law 6000-23 as if this By-law had not come into force. 21. Effective Date 21.1. This By-law shall come into force and take effect on January 5, 2026.
