THE CORPORATION OF THE TOWNSHIP OF
CHAPLEAU BY-LAW NO. 2020-52
Being a By-Law to Regulate
Parking and Traffic in the
Township of Chapleau.
WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes
municipalities to pass by-laws respecting highways under their jurisdiction, including
parking and traffic on such highways; and
WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes
municipalities to pass by-laws regarding parking on municipally owned and privately owned
lands; and
WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes
municipalities t::) pass by-laws for prohibiting or regulating noises likely to disturb the
inhabitants; and
WHEREAS the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, authorizes
municipalities to, among other things, pass by-laws prescribing community safety zones and
rates of speed for motor vehicles on highways under their jurisdiction and provides
regulations for accessible parking for persons with disabilities;
WHEREAS Council deems it desirable to consolidate all existing parking and traffic
regulations which will be enforced using the Part II Procedures of the Provincial Offenses
Act.
NOW T:IEREFORE the Council of the Corporation of the Township of Chapleau
ENACTS AS FOLLOW:
DEFINITION:
1.
(i)
In this By-Law:
(A)
"accessible parking permit" means a valid accessible parking
permit issued by the Ministry of Transportation of Ontario
under the provisions of the Highway Traffic Act; or
A valid permit, number plate or other marker or device bearing
the international symbol of access for the disabled which has
been issued by a jurisdiction outside of Ontario;
(B)
"accessible parking space" means a parking space described
in Schedule 10 which is for the exclusive use of a vehicle
displaying a permit in accordance with the requirements of
Part III of the Highway Traffic Act and this By-Law, and
which is distinctly indicated as such by signs and/or markings
directed or placed in accordance with the requirements of the
Highway Traffic Act and this By-Law.
(C)
"Engine Compression Exhaust Style Brake" (Jake Brake)
means a system by which vehicle braking is achieved by using
the engine compression stroke to slow the vehicle drive wheels
and is accomplished by opening the exhaust valve at or near
the end of the compression stroke thereby turning the power
producing engine into a power absorbing air-compressor.

(D) "highway" includes a common and public highway, street,
avenue, parkway, driveway, square, place, bridge, viaduct or
trestle, designed and intended for, or used by, the general
public for the passage or vehicles;
(E) "intersection" means the area embraced within the
prolongation or connection ofthe lateral curbs lines or, ifnone,
then ofthe lateral boundary lines oftwo ormore highways that
join one another at an angle, whether or not one highway
crosses the other;
(F) "motor vehicle" includes and automobile, motorcycle, motor
assisted bicycle and any other vehicle propelled or driven
otherwise than by muscular power but does not include the
cars of electric or steam railways, or other motor vehicle
running only upon rails, or a motorized snow vehicle, traction
engine, farm tractor, self-propelled implement ofhusbandry or
road building machine;
(G) "official sign" means a sign approved by the Ministry of
Transportation;
(H)
oopark or parking, when prohibited", means the standing of a
vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers;
"pedestrian" includes a person on foot and an invalid or child
in a wheelchair or carriage;
"pedestrian crossover" means any portion of a roadway,
designed By-Law of a Municipality, at an intersection or
elsewhere, distinctly indicated for pedestrian crossing by signs
on the highway and lines or other markings on the surface of
the roadway as prescribed by the regulations under the
Highway Traffic Act.
(K)
"By-Law Enforcement Officer" means a person appointed by
Council.
(L)
"roadway" means that part of the highway that is improved,
designed or ordinarily used for vehicular traffic, but does not
include the shoulder, and, where a highway includes two or
more separate roadways, the term roadway refers to any one
roadway separately and not to all of the roadway collectively;
(M) "stop or stopping, when prohibited", means the halting of a
vehicle, even momentarily, whether occupied or not, except
when necessary to avoid confiict with other traffic or in
compliance with the directions of a constable or other police
officer or of a traffic control sign or signal;
(N) "street" shall mean the 66'Right of Way

ENFORCEMENT:
(i)

(P) "traffic control signal" means any device, manually,
electrically or mechanically operated for the regulation or
control of traffic;
(a) "lJ-turl" means the turning of a vehicle within a highway so
as to proceed in the opposite direction;
(R) "vehicle" includes a motor vehicle, motor assisted bicycle,
trailer, traction engine, farm tractor, road building machine
and any vehicle drawn, propelled or driven by any kind of
power, including muscular power, but does not include a
motorized snow vehicle, the care of electric or steam railways
running only upon rails.
(iD
Where any expression of time occurs or where any hour or other
period oftime is stated, the time referred to shall be standard time
except in periods when daylight saving time is in effect, in which
periods, it shall be daylight saving time.
The By-Law Enforcement Officer shall enforce the provisions of
this By-Law.
MISCELLANEOUS DRIVING RULES :
Where U-turns are not prohibited under the provisions ofthis By-
Law, such a turn shall be made only where it can be made in
safety and without interfering with other traffic.
No person shall drive a motor vehicle upon a sidewalk or footpath of
a highway except for the purpose of directly crossing the sidewalk or
footpath.
(iD No person shall drive a motor vehicle over a raised curb except at a
place where there is a ramp.
No person shall park or stop any vehicle on any highway or portion
thereof except as follows:
(A) where there is a raised curb on the right side of the roadway,
having regard to the direction such vehicle was proceeding,
with its right front and rear wheels parallel to and not more
than 0.15 meters out from such curb;
(B) where there is no curb or a rolled curb, with the right front and
rear wheels parallel to and as near to the right-hand limit of the
highway as is practicable without stopping or parking on a
sidewalk or footpath or on any part ofthe highway where grass
is grown or which is not intended for the use of vehicles.
(2)
The provisions of subsection I do not apply where angle parking is
permitted under section 2 hereof or to parking or stopping a vehicle
on the left-hand side of the roadway or a highway designated for one-
way traffic.
(3)
Where angle parking is permitted on a highway, no person shall stop
or park any vehicle except at an angle of90 degrees from the curb or

boundary ofthe roadway with the front end ofthe vehicle at such curb
or boundary.
(4)
Where angle parking spaces are designated by lines painted on the
roadway, no person shall stop or park any vehicle except within an
area designated as a parking space.
(5)
Where parking is permitted on the left-hand side of the roadway of a
highway designated for one-way traffic, no person shall park or stop
any vehicle on the left-hand side of the highway or portion thereof
except as follows:
(A) where there is raised curb, on the left-hand side of the
roadway, having regard to the direction such vehicle was
proceeding, with its left front and rear wheels parallel to and
not more than 0.15 meters out from such curb;
(B) where there is no curb or a rolled curb, with the left front and
rear wheels parallel to and as near to the left-hand limit of the
highway as is practicable without stopping or parking on a
sidewalk or footpath or on any part ofthe highway where grass
is grown or which is not intended for the use of vehicles.
No person shall on a highway stop a vehicle in any of the following
places:
on or over a sidewalk;
within an intersection;
within a designated pedestrian crossover;
between a safety zone and the adjacent side of the roadway or
within 15 meters of the points of such side opposite the ends
ofthe safety zone;
alongside or across the highway from any excavation or
obstruction in the roadway when the free flow oftraffic would
thereby be impeded;
on the roadway alongside of any stopped or parked vehicle;
upon any bridge or within any tunnel or underpass;
on any centre boulevard or centre strip separating two
roadways or adjacent to either side or ends of such middle
boulevard or centre strip.
No person shall on a highway park a vehicle in any of the
following places:
in front of or within 3 meters ofa driveway or laneway or
so as to obstruct vehicles in the use of a driveway or
laneway;
Within 3 meters of a point in the edge of the
roadway and nearest a fire hydrant;

within 7.61 meters of an intersecting roadway;

within l5 meters of any level crossing or a railway;
on any roadway having an overall width of less than
9.143 meters, unless otherwise posted.
in front of an entrance to or exit from any building or
enclosed space in which persons may be expected to
congregate in large numbers;
alongside the tracks of any railway;
in such a position as will prevent the removal of any
other vehicle previously parked;
in front of the entrance to any place where goods or
merchandise are regularly delivered or removed.
Where appropriate signs are erected and are on display, no person
shall on any highway park any vehicle.
within any point designated as a Bus, Coach, or Taxi
Parking;
within any point designated as Special Needs Children
Parking, September ltt to June I't, Monday to Friday, ten
(10) minute parking limit.
within 7.5 meters of any fire hall on the side of the highway
on which the fire hall is located or within 30 meters of such
fire hall on the opposite side of the roadway;
within a turning basin.
ALL-NIGHT PARKNG PROHIBITED:
No person shall park on any streets within the Township of
Chapleau between the hours ofone o'clock in the morning to seven
o'clock in the morning of any day, during the period ofNovember
lst. to April 30th. in each year. In any case the By-Law
Enforcement Officer may take such vehicle or case to be taken and
stored in a suitable place, and all costs and charges for removal,
care and storage thereof shall be a lien upon such vehicle.
OBSTRUCTING TRAFFIC OR CIVIC SERVICES:
(A) No vehicle shall be parked on any street in such a manner as to
interfere with civic services such as snow ploughing or snow
removal. In any such case, a By-Law Enforcement Officer may
take such vehicle or cause same to be taken to and stored in a
suitable place, and all casts and charges for removal, care or
storage thereof shall be a lien upon such vehicle. Where it is
determined by the By-Law Enforcement Oflicer or tow truck
operator that any vehicle parked in contravention of this By-Law
is unable to be towed or removed for any reason, the vehicle shall
be left as it, where is. Said vehicle shall be deemed to be
obstructing civic services.

(B) No vehicle shall remain on any street for a period exceeding forty-

STOPPING AND PARKING RESTRICTION AND PROHIBITIONS ON
CERTAIN HIGHWAYS:
eight hours and any vehicle so remaining on any street after the
above stipulated period of time, shall then be considered to be an
abandoned vehicle and a By-Law Enforcement Officer may take
such vehicle or cause same to be taken to and stored in a suitable
place and all costs and charges for removal, care or storage thereof,
shall be a lien upon such vehicle. Provided however that if the
owner of such vehicle cannot be located by a registered letter
forwarded to the said owners last known address and/or the
ownership of the vehicle cannot be ascertained, then and in every
such case the said vehicle may be disposed of in such a manner
according to law.
PERMITTED ANGLE PARKING:
Angle parking in accordance with the provisions of subsection 3 and
4 of section 5 is permitted on the highways at the sides and between
the limits set out respectively in Columns 1,2, and 3 of schedule I to
this By-Law.
NO PARKING:
Where appropriate signs are erected and are on display no person
shall park a vehicle on any highway at the side and between the
limits set out respectively in columns l, 2 and 3 of Schedule 2 to
this By-Law.
(A) NO STOPPTNG:
Where appropriate signs are erected and are on display no person
shall stop a vehicle on any highway at the side and between the
limits set out respectively in Columns 1,2, and 3 of Schedule 3 to
this By-Law during the prohibited times or day set out in Column
4 ofthe said schedule.
(B) ACCESSIBLE PARKNG:
The accessible parking spaces on the highways identified in
Schedule 10 and the accessible parking spaces on Township
owned or occupied lands other than highways, and on the lands
not owned or occupied by the Township and which are marked in
accordance with the provisions of the Highway Traffic Act and
the Regulations thereunder, are designated as accessible parking
spaces.
No personal shall park a vehicle in an accessible parking spaces
unless:
A valid accessible parking permit has been issued to that person
and the permit is displayed in accordance with the provisions of
the Highway Traffic Act; and
The driver of the vehicle is transporting, picking up or dropping
offa person who has been issued a valid permit and the permit is
displayed in accordance with the provisions of the Highway
Traffic Act.

DESIGNATED ONE-WAY STREETS:

(A) The highways set out in Column 1 of Schedule 4 to this By-Law
between the limits set out in Column 2 of the said schedule, are
hereby designated for one-way traffic only in the direction set out
in Column 3 of the said schedule
(B) Each designation made by subsection I shall be effective upon
the erection of official signs.
DESIGNATED FIRE ROUTES

(A) The areas set out in Column I of Schedule 5 to this By-Law
between the limits set out in Column 2 of the said schedule, are
hereby designated as Fire Routes.
(B) Where appropriate signs are erected and on display no person
shall park a vehicle in any area designated a Fire Route.
THROUGH HIGHWAYS STOP SIGNS:
16. (1)
The highways set out in Column 1 of Schedule 6 to this By-Law,
between the limits set out in Column 2 of the said
Schedule, are, except as provided in subsection 2 ofthis
section, hereby designated as through highways.
(2)
The designation in Subsection I of this section of a
highway or part of a highway as a through highway shall
not include any intersection thereon where the road
intersected in a King s Highway or where traffic control
signs are installed.
(3) All highways intersecting the through highways as shown
in Schedule 6 shall have Stop Signs erected in accordance
with the regulations, requiring that all vehicular traffic
come to a complete stop before proceeding.
YIELD SIGNS AT INTERSECTIONS:
17.
Those intersections set out in Column 1 of Schedule 7, shall be
designated with yield signs for direction oftraffic set out in column
2 ofthe said schedule.
18.
The Schedules referred to in this By-Law shall form part of this
By-Law shall form part ofthis By-Law and each entry in a Column
I of such a Schedule shall be read in conjunction with the entry of
entries across therefrom and not otherwise.
PEDESTRI,ANS:
(1)
Direction - pedestrians shall keep to the right while
walking on the sidewalk.
Crossing the Street: - Pedestrians shall not step from the
sidewalk in crossing a street without looking in both
directions and shall cross at right angles to the street, at
intersections only.

Engine Compression Exhaust Style Brake (Jake Brake)

(A) No person shall at any time apply an Engine Compression
Exhaust Style Break (Jake Brake) on any highway under the
jurisdiction of the township from a point of commencing at Fox
Lake Road intersection and Highway 129 North, between the
hours of 9:00p.m. and 7:00 a.m.
(B) Notwithstanding Subsection (a), no person shall at any time apply
an Engine Compression Exhaust Style Brake (Jake Brake) on
Highway 129 from the Fox Lake Road intersection to Monk
Street, including the overhead bridge and Lisgar Street, or any
street within the Municipality, between the hours of 9:00 p.m. and
7:00 a.m.
where a vehicle is found parked in contravention ofprovisions of this
By-Law, Enforcement Oflicer so finding such vehicle shall attach to
the said vehicle a Parking Infraction Notice in the form of a serially
numbered ticket stating:
(A) That the vehicle is unlawfully parked or that a parking
violation has been committed;
(B)
the permit number;
(C) the date, time and place of the alleged offence;
(D) the owner or operator of said vehicle may pay a
voluntary payment as indicated on the parking
Infraction Notice, within five working days of the date
of issue of the notice by:

(E) that failure to make a voluntary payment or paying the
set fine or penalty imposed within the period
prescribed by the Provincial Offences Act, the
procedures of the Provincial Offences Act and the
penalties provided for in this By-law shall apply.
(ii)
The parking ticket shall be prepared in triplicate, and the By-Law
Enforcement oflicer shall attach the envelope copy to the vehicle and
deliver the other copies to the Township Clerk.
(iiD If a vehicle remains parked after a violation ticket has been attached

thereto;
(A) such vehicle will be subject to further additional violation
tickets to be attached on the previous one, every hour
thereafter.
(B) if that same vehicle still remains parked after four (4)
consecutive violation tickets, a By-Law Enforcement Officer
may cause such vehicle to be taken to storage in a suitable
place and all costs and charges for removal care, or storage
thereof, shall be a lien upon such vehicle and be paid before
surrender of such vehicle.
By-Law shall not apply to vehicles registered to the Township when
such vehicles are suitably marked and are actually being used for or
on behalf of the Township.
Every person who contravenes any provisions of this By-Law is
guilty of an offense and on conviction is liable to a fine as provided
for in the Provincial Offences Act R.S.O. 1990, c. P. 33.
24.
That By-Laws 88-54, 90-47, 94-46, 95-47, 95-51, 96-33,2000-03,
2000-1 I, 2001-27, 2004-05, 2004-46, 2004-49, 2004-49, 2005-16,
200 5 -21, 2006-22, 2009 - I 6, 20 l2-I 0, 20 I 2-25, 201 6 - I 4, 20 I 6-21 of
the Township of Chapleau shall be deemed to be and are hereby
repealed.
That this By-Law shall come into force and take effect on the 14th of
December,2020.
