BY-LAW NO. 2021-32
Being a By-Law to Regulate Traffic and Parking of Vehicles in the Town of Cobalt
Whereas the Council of the Corporation of the Town of Cobalt deems it necessary and expedient to pass a By-
Law to regulate traffic and parking of vehicles within the Town of Cobalt;
And whereas under Section 8.(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, the powers of a
municipality shall be interpreted broadly to enable it to govern its affairs as it considers appropriate and to
enhance the municipality's ability to respond to municipal issues;
And whereas under Section 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, a municipality has the
capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or
any other Act;
And whereas under Section 10.(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, a single-tier
municipality may provide any service or thing that the municipality considers necessary or desirable for the public;
And whereas Section 10.(2) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes a municipality
to pass By-Laws respecting the health, safety and well-being of persons;
And whereas Section 100 through 102.1 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that
a municipality may make regulations regarding traffic and parking of vehicles;
And whereas Section 100 of the Municipal Act, 2001, S.O. 2001, c. 25,as amended, provides that a municipality,
may, in respect of land not owned or occupied by the municipality that is used as a parking lot, regulate or prohibit
the parking or leaving of motor vehicles on that land without the consent of the owner of the land or regulate or
prohibit traffic on that land if a sign is erected at each entrance to the land clearly indicating the regulation or
prohibition;
And whereas Section 100.1 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a
municipality may, in respect of land not owned or occupied by the municipality, that is not used as a parking lot,
regulate or prohibit the parking or leaving of motor vehicle without the consent of the owner of the land;
And whereas Section 101.(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that if a
municipality passes a By-Law regulating or prohibiting the parking or leaving of a motor vehicle on land, it may
provide for the removal and impounding or restraining and immobilising of any vehicle, at the owner's expense,
parked or left in contravention of the By-Law;
And whereas Section 102.(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that if a
municipality passes a By-Law for establishing a system of accessible parking, the sole manner of identifying
vehicles shall be an accessible parking permit issued and displayed in accordance with the Highway Traffic Act
and the regulations made under it;
And whereas Section 102(2) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a
municipality may require the owners or operators of parking lots or other parking facilities to which the public has
access, whether on payment of a fee or otherwise, to provide designated parking spaces for vehicles displaying
on accessible parking permit and if it does so, the municipality shall prescribe the conditions of use of the
accessible parking permit and shall prohibit the improper use of the permit;
And whereas Section 102.1(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a
municipality may require a person to pay an administrative penalty if the municipality is satisfied that the person
has failed to comply with any By-Laws respecting the parking, standing and stopping of vehicles;
And whereas under Section 425 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a
municipality may pass By-Laws providing that a person who contravenes a By-Law of the municipality passed
under this Act is guilty of an offence;
And whereas under Section 427 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a By-
Law establishing a system of accessible parking shall provide that every person who contravenes the By-Law is
guilty of an offence and on conviction is liable to a fine of not less than $300;
And whereas under Section 428 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, a By-Law may
provide that, where a vehicle has been left parked, stopped or standing in contravention of a By-Law passed
under this Act, the owner of the vehicle is guilty of an offence, even though the owner was not the driver of the
vehicle at the time of the contravention of the By-Law, and is liable to the applicable fine unless, at the time of the
offence, the vehicle was in the possession of another person without the owner's consent;
And whereas under Section 429 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that
municipality may establish a system of fines for offences under a By-Law of the municipality passed under this
Act;
And whereas under Section 432 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, a By-Law under
section 425 may establish a procedure for the voluntary payment of penalties out of court where it is alleged that
a By-Law related to parking, standing or stopping a vehicles has been contravened;
And whereas Section 128(2) of the Highway Traffic Act, R.S.O. 1990, c. H8, as amended, provides that a
municipality may by By-Law prescribe a rate of speed for motor vehicles driven on a highway or portion of a
highway under its jurisdiction and may prescribe different rates of speed for different times;
And whereas Section 137(a) of the Highway Traffic Act, R.S.O. 1990, c. H8, as amended, provides that a
municipality may, in addition to stop signs required at intersections on through highways, by By-Law provide for
the erection of stop signs at intersections on highways under its jurisdiction;
And whereas Section 140(15) of the Highway Traffic Act, R.S.O. 1990, c. H8, as amended, provides that a police
officer, police cadet, municipal law enforcement office or an officer appointed for carrying out the provisions of the
Act, upon the discovery of any vehicle parked or standing in contravention of a municipal By-Law, may cause it to
be moved or taken to and placed or stored in a suitable place and all costs and charges for the removal, care and
storage of the vehicle, if any, are a lien upon the vehicle, which may be enforced in a manner provided by the
Repair and Storage Liens Act;
And whereas Section 214.1(1) of the of the Highway Traffic Act, R.S.O. 1990, c. H8, as amended, provides that
a municipality may by By-Law designate a part of a highway under its jurisdiction as a community safety zone if,
in the council's opinion, public safety is a special concern on that part of the highway;
Now therefore the Council of the Corporation of the Town of Cobalt hereby enacts as follows:
1. That Council adopts a By-Law to regulate traffic and parking of vehicles within the Town identified as
Schedule "A", attached hereto and forming part of this By-Law.
2. That By-Law the following By-Laws are hereby repealed on the date this By-Law become effective.
a. By-Law 2009-009 being a By-Law Regulating Traffic and Parking upon the Streets of the Town of
Cobalt and amending By-Law 2014-33 thereto; and
b. By-Law 2008-20 being a By-Law Regulating Traffic and Parking upon the Streets of the Town of
Cobalt
3. That the Clerk of the Corporation of the Town of Cobalt is hereby authorized to make minor modifications
or corrections of an administrative, numerical, grammatical, semantically or descriptive nature or kind to
the By-Law and schedule as may be deemed necessary after the passage of this By-Law, where such
modifications or corrections do not alter the intent of the By-Law.
4. That this By-Law shall come into force and take effect on the date of its final passing.

Part 1
General Provisions
1.1
Short Title
This By-Law shall be cited as the "Traffic and Parking By-Law"
1.2
Scope
The provisions of this By-Law shall apply to all Town owned streets and property within the municipality and to all
privately owned property within the municipality.
1.3
Enforcement
This By-Law shall be enforced by a By-Law Enforcement Officer or a Police Officer.
1.4
Conflicts with other By-Law
Where a provision of this By-Law conflicts with a provision of another By-Law in force in the Town of Cobalt, the
provisions of this By-Law shall prevail in order to protect the health, safety and welfare of the general public.
1.5
Conflicts with Highway Traffic Act
In the event of conflict between the provisions of this By-Law and the Highway Traffic Act, the provisions of the
said Act shall prevail.
Part 2
Definitions
Definition of words, phrases and terms used in this By-Law that are not included in the list of definitions in this
section shall have the meanings which are commonly assigned to them in the context in which they are used in
this By-Law.
The words phrases and terms defined in this section have the following meaning for the purposes of this By-Law.
2.1
"Accessible Parking Permit" means an "accessible parking permit" issued by the Minister in
accordance with the Highway Traffic Act to individuals or organizations and entitles the vehicle in which it
is displayed to park in a designated accessible parking space.
2.2
"Accessible Parking Space" means a parking space designated for the sole use of a person to park
vehicles displaying a valid Accessible Parking Permit.
2.3
"All Terrain Vehicle" means an "off-road vehicle" as defined by the Off Road Vehicle Act, R.S.O. 1990,
Chapter 0.4, as amended.
2.4
"Assembly Occupancy" means the occupancy or the use of a building, or part thereof, by gathering of
persons for civic, political, travel, religious, social, educational, recreational or like purposes, or for the
consumption of food or drink.
2.5
"Authorized Emergency Vehicle" means
I.
ambulance or hearse;
II.
any vehicle of the fire department;
III.
any vehicle of the municipal, provincial or federal police;
IV.
a Ministry of Public Safety and Security (Correctional Services) vehicle;
V.
an armoured car carrying cash or negotiable securities;
VI.
a Ministry of Transportation of Ontario maintenance vehicle;
VII.
any vehicle, including snow removal equipment, operated by or for the Town; or
VIII.
a public utility company while actively engaged in the construction, maintenance or repair of any
highway, or any equipment or facilities thereon and any vehicle or equipment required to
address an ongoing or imminent danger to persons or property or any extraordinary response
required to mitigate harm to the environment or community.

2.6
"Boulevard" means that portion of Highway that is not used as a sidewalk, driveway, roadway, median
strip or shoulder.
2.7
"Bus" means a vehicle designed for carrying ten or more passengers and used for the transportation of
persons.
2.8
"Bus Stop" means an apportion of a curb lane or roadway, designed for the purpose of stopping buses
operated by the Town transit while picking up or discharging passengers.
2.9
"By-Law Enforcement Officer" means the person or persons duly appointed by Council as Municipal
By-Law Enforcement Officers for the purpose of enforcing regulatory By-Laws of the Town.
2.10
"Commercial Motor Vehicle" means a vehicle having permanently attached thereto a truck or delivery
body and includes ambulances, hearses, fire apparatus, buses, and tractors used for hauling purposes
on the streets.
2.11
"Community Safety Zone" means a portion of street designated by Council as having a special concern
for public safety, as provided in the Highway Traffic Act.
2.12
"Corner" means the point of intersection of curbs or edges of the roadway.
2.13
"Council" means the Municipal Council of the Town of Cobalt.
2.14
"Crosswalk" means:
a) That part of a street at an intersection that is included within the connections of the lateral lines of
the sidewalk on opposite sides of the street measured from the curbs or, in the absence of curbs,
from the edges of the roadway; or
b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian
crossing by signs or by lines or other markings on the surface.
2.15
"Curb" means a physical boundary where provided identifying the outside edge of a curb lane.
2.16
"Curb Lane" means that portion of the shoulder adjacent to a roadway designated for the purpose of
parking of vehicles.
2.18
"Double Parking" means the parking of a vehicle on any street, beside another vehicle which is legally
parked, so that vehicles are side by side or any part of the vehicle is side by side.
2.19
"Driver" means a person who drives a vehicle on a street.
2.20
"Driveway" means the portion of a street, which is improved to permit the passage of vehicles between a
roadway and the adjacent property.
2.21
"Fire Access Route" means any portion of a street or a private road designated to provide access for
fire department vehicles, pursuant to the Ontario Building Code, Ontario Fire Code or Municipal By-Law.
2.22
"Fire Access Route Sign" means a sign approved by the Chief Fire Official in accordance with the
Ontario Fire Code.
2.23
"Fraser Tenants and Customers" includes tenants, employees, clients and visitors of the building
located at 24 Prospect Avenue.
2.24
"Gross Vehicle Weight" means the total weight in kilograms transmitted to the street by a vehicle, or
combination of vehicle and load.

2.25
"Heavy Traffic" means any vehicle or commercial motor vehicle which has a gross vehicle weight
exceeding 5,000 kilograms.
2.26
"Highway Traffic Act" means the Highway Traffic Act, R.S.O. 1990. c. H.8 as amended.
2.27
"Intersection" means the area embraced within the prolongation or connection of the lateral curb lines
or, if none, then of the lateral boundary lines of two or more roadways which join one another at an angle,
whether or not one roadway crosses the other.
2.28
"Laneway" means a public thoroughfare, whether or not improved for use, which has a right-of-way
width of ten (10.0) metres or less and which affords only a secondary means of access for vehicular traffic
to abutting lots, and which is not intended for general traffic circulation.
2.29
"Minister" means the Minister of Transportation.
2.30
"Ministry" means the Ministry of Transportation.
2.31
"Motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the driver and
designed to travel on not more than three wheels in contact with the ground, and includes a motor
scooter, but does not include a motor assisted bicycle.
2.32
"Motorized Snow Vehicle" means a "motorized snow vehicle" as defined by the Motorized Snow
Vehicle Act, R.S.O. 1990, c, M.44, as amended.
2.33
"Municipality" means the land within the geographic limit of the Town of Cobalt.
2.34
"Median Strip" means is the reserved area that separates opposing lanes of traffic.
2.35
"Official Standard Time" means whenever certain hours are named herein, they shall mean standard
time or daylight savings time as may be use in the Town.
2.36
"One-Way Street" means a street upon which vehicular traffic is limited to movement in one direction.
2.37
"Park" or "Parking" when prohibited, means the stopping or standing of a vehicle whether occupied or
not, except when stopping or standing temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers.
2.38
"Parallel Parking" means the parking of a vehicle with both right wheels thereof drawn up parallel to the
right-hand side of the curb lane or curb where provided.
2.39
"Parking Lot" means an area designed to accommodate the parking of vehicles of patrons and/or users
of an adjacent facility. A facility shall include, but is not limited to, a community centre, retail outlet, or
commercial establishment.
2.40
"Person" means an individual, firm or corporation.
2.41
"Provincial Offences Act" means the Provincial Offences Act, R.S.O. 1990. c.P. 33, as amended.
2.42
"Police Officer" means a member of the Ontario Provincial Police.
2.43
"Private Road" means every privately owned way or place, driveway, road, lane, ramp, path or sidewalk
used by pedestrians and/or vehicular traffic to access a roadway or sidewalk and may include portions of
a parking lot.
2.44
"Recreational Vehicle" means a piece of equipment designed for use as both a vehicle and for lodging
and shall include conventional travel trailers, fifth wheel travel trailers, folding camper trailers, truck
campers, type A, B and C motor homes and luxury bus conversions.

2.45
"Repair and Storage Liens Act" means the Repair and Storage Liens Act, R.S.O. 1990, c. R.25, as
amended.
2.46
"Roadway" means that part of the street that is improved, designed or ordinarily used for vehicular
traffic, but does not include the shoulder, and, where a street includes two or more separate roadways
refers to any one roadway separately and not to all the roadways collectively.
2.47
"School Bus Loading Zone" means any portions of any street upon which school buses are operated in
which an area is set aside and designated as a "Safety Zone" for school bus unloading or loading.
2.48
"Shoulder" means that area of a street between the edge of the roadway and the adjacent lateral
property lines.
2.49
"Sidewalk" means any municipal walkway, or that portion of a street between curb lines or the lateral
lines of a roadway, and the adjacent property line, primarily intended for use by pedestrians.
2.50
"Stand" or "Standing" when prohibited, means the halting of a vehicle, whether occupied or not, except
for the purpose of and while actually engaged in receiving or discharging passengers.
2.51
"Street" means a common and public highway, street, roadway, crescent, avenue, parkway, driveway,
square, place, bridge, viaduct, trestle, or other such place designated and intended for, or used by the
general public for the passage or parking of vehicles and includes the area of land between the lateral
property lines thereof.
2.52
"Street Maintenance" encompasses all the tasks related to cleaning, repairing and maintaining
municipal infrastructure, roadways and other public areas.
2.53
"Through Highway" means a street or part of a street designated as such by the Minister or by By-Law
of a municipality, and every such street which intersects it shall be marked by a stop sign or yield right-of-
way sign in compliance with the regulations of the Ministry.
2.54
"Town" means the Corporation of the Town of Cobalt.
2.55
"Traffic" shall mean pedestrians, ridden or herded animals, vehicles, and other conveyances either
singly or together while using any street for the purpose of travel.
2.56
"Traffic Control Device" means any sign or other device erected or placed by the authority of the
Council or delegate of the Town for the purpose of guiding, directing or regulating traffic.
2.57
"Traffic Signal" means any device manually, electronically or mechanically operated, for the regulation
of traffic.
2.58
"Trailer" means a vehicle that is at any time drawn upon a street by a motor vehicle, except an
implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed
to transport persons or property, temporarily drawn, propelled or moved upon such street, and except a
side car attached to a motorcycle, shall be considered a separate vehicle and not part of the motor
vehicle by which it is drawn.
2.59
"Vehicle" means an automobile, motor vehicle, all-terrain vehicle, bicycle, bus, farm tractor, truck, trailer,
traction engine, motorcycle, motorized snow vehicle, road building machine, motor assisted bicycle, and
any vehicle drawn, propelled, or driven by any kind of power, including muscular power.
Part 3
General Regulations
3.1
Obedience to Traffic Signs and Signals
Every person, or any driver of vehicle, on any street or private road, shall promptly obey all signals given
by a Police Officer or by a traffic control device or traffic signal and shall, where applicable, comply with

the requirements of every sign authorized by this By-Law.
3.2
Traffic Control Devices and Traffic Signals
3.2.1
Traffic control devices and traffic signals authorized in this By-Law shall be identified in the Appendices
attached hereto and forming part of this By-Law.
3.2.2
No person shall place, maintain or display upon or in view of a roadway any sign, signals, marking or
device which purports to be or is an imitation of, or resembles, or conceals from view or interferes with the
effectiveness of, any Traffic Control Device.
3.2.3
Except when authorized by law or by the Town, no person shall place, maintain or display upon a
roadway any drawing, graffiti, art or the like which may distract or confuse any motorist using such
roadway.
3.2.4
The driver of any vehicle shall obey the instructions of all traffic control devices and traffic signals
authorized by this By-Law.
3.3
Driving Regulation
3.3.1
No person shall drive, stop, stand or park any vehicle upon a sidewalk, median strip, footpath or
boulevard of a roadway except for the purpose of directly crossing such sidewalk, footpath or boulevard
and only at a location designed for vehicular access.
3.3.2
No person shall drive, stop, stand or park a vehicle over a raised curb except at a place where the curb is
designed for such purpose.
3.3.3
No person shall drive a vehicle over any unprotected fire hose of the Town of Cobalt Fire Department,
when laid down to be used at any fire, alarm of fire or training operations, unless directed to do so by a
Police Officer, employee of the Town of Cobalt or volunteer of the Town of Cobalt Fire Department.
Part 4
Designations
4.1
Designation of One-Way Street
Upon those streets and parts of streets described in Appendix "11" of this By-Law, vehicular traffic shall
move only in the direction of posted signage.
4.2
Designation Through Highways
The streets or parts of streets as set out in Appendix "13" of this By-Law coming under the jurisdiction of
the Town are designated as through highways, and every such street that meets a through highway shall
be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry.
The designation of a street or part of a street as set out in this section, as a through highway shall not
include any intersection thereon where the road intersected is a Queen's Highway or where traffic control
devices are installed.
4.3
Designation of School/Pedestrian Crosswalks
The portions of streets or roadways set out in Appendix "6" attached hereto and forming part of this By-
Law and designated as school/pedestrian crosswalks.
Part 5
Parking Regulations
5.1
Method of Parallel Parking
Where parallel parking is permitted, no person shall stop, stand or park a vehicle:

a) on any street except upon the right hand side of the street, in the direction in which the vehicle is required
to proceed;
b) on any street where a curb is provided, with the right front and right rear wheels of the vehicle more that
thirty (30cm) centimetres from the curb;
c) on any street where a curb is not provided other than on the curb lane; or
d) in a manner which obstructs or interferes with traffic on a roadway.
5.2
Loading Zone
Curb lanes or portions thereof as set out in Appendix "7" attached hereto and forming part of this By-Law,
are hereby designated as loading zones.
5.3
Loading Zone - Offence
Where the Town has erected sign giving notice thereof, no person shall stop, stand, or park any vehicle in
a loading zone except while loading or unloading goods or passengers.
5.4
Laneway - Offence
No person shall stop, stand or park any vehicle on a laneway.
5.5
Commercial Motor Vehicles - Offence
No person shall stop, stand or park a commercial motor vehicle on any street between the hours of 12:01
a.m. and 8:00 a.m., Monday to Saturday or at all times on Sundays or Legal Holidays.
5.6
Limited Commercial Parking - Offence
No person shall stop, stand or park any tractor trailer unit or truck having three (3) or more axles or with a
gross weight of five-thousand (5,000) kilograms or greater on any street within the Town, for a period of
longer than two (2) hours.
5.7
Winter Parking Restrictions - Offence
a)
No person shall stop, stand or park in locations set out in Table (A) of Appendix "17" during the period of
November 1st in one year to May 1st of the next year.
b)
No person shall stop, stand or park in locations set out in Table (B) of Appendix "17 between the hours of
4:00 a.m. to 9:00 a.m. during the period of November 1st in one year to May 1st of the next year.
c)
No person shall stop, stand or park in locations set out in Table (C) of Appendix "17" between the hours
of 4:00 a.m. to 12:00 p.m. during the period of November 1st in one year to May 1st of the next year.
5.7.1
Municipal Snow Dumps
Where the Town has erected signs giving notice thereof, no person shall stop, stand, or park a vehicle in
locations set out in Table "D" of Appendix "17" between the hours of 9:00 a.m. to 5:00 p.m. during the
period of November 1st in one year to May 1st of the next year.
5.8
Bus Stops
Curb lanes or portion thereof as set out in Appendix "5" attached hereto and forming part of this By-Law
are hereby designated as bus stops.
5.9
Bus Stops - Offence
Where the Town has erected signs giving notice thereof, no person shall stop, stand or park a vehicle in a
bus stop except the operator of a bus.
5.10
Parking Prohibition - At All Times in Designated Places
Those portions of streets as set out in Appendix "4" attached to and forming part of this By-Law, shall be
designated as areas where stopping, standing, or parking of vehicles is prohibited at all times.
5.11
Parking Prohibition - At All Times in Designated Places - Offence
Where the Town has erected signs giving notice thereof, no person shall stop, stand or park a vehicle at
any time in an area where stopping, standing, or parking is prohibited.
5.12

Those portions of streets as set out in Appendix "8" attached hereto and forming part of this By-Law, shall
be designated as locations where stopping, standing, or parking of vehicles is limited to time prescribed in
this Section.
5.12.1 Parking Prohibition - Time Limited 90 Minutes- Offence
Where the Town has erected signs giving notice thereof, no person shall stop, stand, or park a vehicle in
locations set out in Table (C) of Appendix "8" for a period exceeding ninety (90) minutes between the
hours of 9:00 a.m. and 6:00 p.m. daily excluding Sundays and Statutory Holidays.
5.12.2 Parking Prohibition - Time Limited 15 Minutes - Offence
Where the Town has erected signs giving notice thereof, no person shall stop, stand, or park a vehicle in
locations set out in Table (A) of Appendix "8" for a period exceeding fifteen (15) minutes at all times
excluding Sundays and Statutory Holidays.
5.12.3 Parking Prohibition - Time Limited 15 Minutes (8:30 a.m. to 8:45 a.m. and 3:15 p.m. to 3:30 p.m.) -
Offence
Where the Town has erected signs giving notice thereof, no person shall stop, stand, or park a vehicle in
locations set out in Table (B) of Appendix "8" for a period fifteen (15) minutes between the hours of 8:30
a.m. to 8:45 a.m. and 3:15 p.m. to 3:30 p.m. daily except for Saturday, Sunday and School Holidays.
5.12.4 Parking Prohibition - Time Limited 120 Minutes- Offence
Where the Town has erected signs giving notice thereof, no person shall stop, stand, or park a vehicle in
locations set out in Table (D) of Appendix "8" for a period exceeding one hundred and twenty (120)
minutes at all times, excluding Sundays and Statutory Holidays.
5.13
Assembly Occupancy - Offence
Where the Town has erected signs giving notice thereof, no person shall stop, stand or park a vehicle on
any street in front of an exit from a building with an assembly occupancy.
5.14
Parking Prohibition - General
5.14.1 No person shall stop, stand, or park a vehicle that obstructs access to or egress from a driveway.
5.14.2 No person shall stop, stand, or park a vehicle within three (3) metres of a fire hydrant.
5.14.3 No person shall stop, stand or park a vehicle on any bridge or within thirty (30) metres of the approaches
thereto.
5.14.4 No person shall stop, stand, or park a vehicle on any street in a manner which obstructs or interferes with
traffic.
5.14.5 No person shall stop, stand, or park a vehicle on any street in a manner which prevents the convenient
removal of vehicles previously parked.
5.14.6 Where the Town has erected signs giving notice thereof, no person shall stop, stand, or park a vehicle on
any street closer to an intersection than the distance indicated on the signs.
5.14.7 Notwithstanding Section 5.14.6, where no signs have been erected giving notice thereof, no person shall
stop, stand, or park a vehicle within nine (9) metres of an intersection.
5.14.8 Where the Town has erected signs giving notice thereof, no person shall stop, stand, or park a vehicle on
any street closer to a crosswalk than the distance indicated on the signs.
5.14.9 No person shall stop, stand or park a vehicle within fifteen (15) metres of the nearest rail of a level railway
crossing.

5.14.10 No person shall stop, stand, or park a vehicle in front of the entrance to a fire hall or fire vehicle exit.
5.14.11 No person shall stop, stand, or park a vehicle on any Town sidewalk, boulevard, parkland, garden, lawn
or other place set apart for ornament or embellishment, unless such parking has been authorized by the
Council.
5.14.12 No person shall stop, stand, or park a vehicle on any street or Town property for the purpose of displaying
the vehicle for sale or rent.
5.14.13 No person shall stop, stand, or park a vehicle on any street or Town property for the purpose of washing,
greasing, or repairing such vehicles.
5.14.14 No person shall stop, stand, or park a vehicle on any street or Town property for any purpose if the
vehicle is inoperable or does not have valid license plates or a corresponding current validation sticker,
issued by the Ministry of Transportation of Ontario or an extra-provincial government agency, and
registered to such vehicle.
5.14.15 No person shall stop, stand, or park a vehicle on any street or Town property when such vehicle is
leaking any fluid, including but not limited to, oil or gasoline, but not including water from the vehicle's air-
conditioning unit.
5.14.16 Where a vehicle in contravention of subsection 5.14.15 leaks any fluid onto any portion of the roadway,
the owner of the vehicle shall cause the fluid to be cleaned up to the satisfaction of the Town.
5.14.17 If the owner of the vehicle fails to comply with Subsection 5.14.16, the Town may, in addition to any other
remedy, clean up the fluid at the vehicle owner's expense, and the Town may recover the expense by
action or in like manner as municipal taxes.
5.14.18 No person shall stop, stand, or park any portion or a vehicle in a parking space except wholly within the
road paint markings for such parking space.
5.14.19 No person shall stop, stand or park a vehicle on any street or Town owned parking lots as to interfere with
street maintenance.
5.15
Parking of Recreational Vehicles
5.15.1 No person shall stop, stand, or park a recreational vehicle on any street, boulevard or Town owned
parking lot for the purpose of providing lodging, shelter or to camp.
5.15.2 No person shall stop, stand, or park a recreational vehicle on any street, boulevard or Town owned
parking lot for a period exceeding forty-eight (48) hours.
5.16
Parking of Taxicab
5.16.1 No person shall stop, stand, or park a taxicab upon any street where a parking time limit has been
established in accordance with Section 5.14, during the period for which the time limit is in force.
5.16.2 Notwithstanding Section 5.19.1, a taxicab may temporarily stop upon any street where a parking time limit
has been established in accordance with Section 5.14, while engaged in loading or unloading
passengers.
5.17.1 Method of Angle Parking
Where angle parking is permitted, no person shall stop, stand or park a vehicle:
a) Except within the limits defined by pavement markings;
b) Where no pavement markings are visible, except at an angle not less than forty (40) degrees and not
exceeding sixty (60) degrees to that side of the street or curb where provided, having regard for the
direction in which the vehicle is required to proceed, and with the front end of the vehicle drawn up to
that side of the street, or at a distance of not more that thirty (30) centimeters from a curb where
provided;
c) Where a load being carried upon the vehicle extends beyond the rear of the vehicle;

d) Where the vehicle is attached to a trailer; or
e) In a manner which obstructs or interferes with traffic in any way while so parked.

5.18
Municipal Parking Lots
Public parking shall only be permitted where the Town has erected signs giving notice thereof in those
areas set out in Appendix "20" attached hereto and forming part of this By-Law.
5.18.1 Municipal Parking Lots - Offence
No person shall stop, stand or park a vehicle in a municipal parking lot described in Column 1 of
Appendix "20" without adhering to the designated use identified in Column 5 in the same row.
5.18.2 No person shall stop, stand, or park a vehicle on any street, boulevard or Town owned parking lot for a
period exceeding 48 hours.
Part 6
Designated Parking Spaces
6.1
Designated On-Street Accessible Parking Spaces
The designated parking spaces described in Appendix "14" attached hereto and forming part of this By-
Law are hereby designated as accessible parking spaces.
6.2
Requirement for On-Street Accessible Parking Spaces
All on-street accessible parking spaces on streets or private roadways shall be in accordance with the
following requirements:
a) they shall be identified by the prescribed sign for identifying accessible parking spaces;
b) where parallel parking conditions exist, spaces shall be no less than 7 metres (23ft) in length;
c) a vertical clearance of 2.75 metres (9ft) must be maintained below overhead structures;
d) placed with sufficient clearance around the vehicle, in terms of other vehicles, or obstacles such as light
standards, waste receptacles or other barriers; and
e) placed where sidewalks are accessible to persons with disabilities whether via ramps, depressed curbs or
other appropriate means.
6.3
Designated Accessible Parking Spaces on Town and Privately Owned/Operated Parking Lots
On Town and privately owned/operated parking lots, a minimum number of accessible parking spaces
shall be provided in accordance with Appendix "19" attached hereto and forming part of this By-Law.
Notwithstanding the above, Section 6.3 shall not apply to parking lots serving residential apartments,
where tenants are assigned parking spaces.
6.4
Requirements for Off-Street Accessible Parking Spaces
All accessible parking spaces on Town or privately owned/operated parking lots where this By-Law is in
effect shall:
a) be identified by the prescribed sign for identifying accessible parking spaces;
b) have a width of not less than 4.6 metres (15ft);
c) have a vertical clearance of 2.75 metres (9ft); and
d) have no barriers such as but not limited to chains, steel barriers or blockades that imped the deployment
of doors, lifts, or ramps from vehicles.
6.5
Prescribed Sign for Identifying Accessible Parking Spaces
The prescribed sign for identifying accessible parking spaces authorized elsewhere in this By-Law, is as
set out in Appendix "15" attached hereto and forming part of this By-Law and in accordance with the
Highway Traffic Act.
6.6
Accessible Parking Spaces Exempt from Time Limits (Section 5.14)
The provisions of Section 5.14 with respect to parking time limits shall not apply to accessible parking
spaces.

6.7
Accessible Parking Spaces - Offence
Where prescribed signs are erected giving notice thereof, no person shall stop, stand or park a vehicle in
an accessible parking space, without a valid accessible parking permit being displayed on the dashboard
or sun visor of the vehicle. Any person violating this provision is guilty of an offence and on convictions is
liable of a fine of not less than $300.00 as provided by the Municipal Act, 2001, d. 427.
6.8
Enforcement of Accessible Parking Spaces on Privately Owned/Operated Parking Lots
The enforcement provision of this By-Law with respect to parking in accessible parking spaces shall apply
to accessible parking spaces located on privately owned parking lots.
6.9
Fire Access Route - Offence
Where fire access route signs are erected giving notice thereof, no person shall stop, stand, or park a
vehicle in a fire access route.
Part 7
Rate of Speed
7.1
Designated Speed Limits
The streets or portion of streets described in Tables A, B, C, D and E of Appendix "12" attached hereto
and forming part of this By-Law, are hereby designated for a prescribed speed limit for vehicles driven on
these streets or portion thereof.
7.2
Community Safety Zone
The designated street or portion of streets described in Appendix "16" attached hereto and forming part of
this By-Law, are hereby designated as a community safety zone.
7.3
Speed Limit in Community Safety Zones
To prescribe a rate of speed for vehicles driven upon the portion of a street so designated in Appendix
"16" attached hereto and forming part of this By-Law, each calendar day between the hours of 8:00 a.m.
and 8:00 p.m. at which such speed is effective.
Part 8
Penalties
8.1
General Penalties
a) Every person who contravenes any provision of this By-Law is guilty of an offence and upon conviction is
liable to a fine as provided for by Section 61 of the Provincial Offences Act, R.S.O. 1990, Chapter P. 33,
as amended.
b) Where an offence is committed, each day on which a person contravenes any provisions of this By-Law
shall be deemed to constitute a separate offence under this By-Law as provided for in Section 429 of the
Municipal Act, S.O. 2001, c.25.
8.2
Notice of Parking Infraction
Where a vehicle is parked or found to be parked or left in contravention of any provision of this By-Law, a
Police Officer or By-Law Enforcement Officer so finding the vehicle may issue a Parking Infraction
Certificate and Notice in accordance with the provisions of the Provincial Offences Act.
8.3
Voluntary Payment
a)
Notwithstanding the provisions in Section 8.1, any person may, upon presentation of a Parking Infraction
Notice alleging the commission of any offence under any provision of the By-Law, make voluntary
payment out of court within the time limit specified on said Parking Infraction Notice the penalty set out in
Appendix "19" attached hereto and forming part of this By-Law. Under such payment, no further
proceedings shall be taken under this By-Law in respect of the said offence alleged in the Parking
Infraction Notice.
b)
If a voluntary payment is not made in accordance with the procedure provided in Section 8.3 (a) , the
procedures of the Provincial Offences Act or any successors thereof shall apply.

8.4
Authority to Remove Vehicles
Notwithstanding any other penalty imposed by this By-Law, a Police Officer or By-Law Enforcement
Officer, or designates, may cause any vehicle left stopped, standing or parked in contravention of the
provisions of this By-Law to be moved or taken to and placed or stored in a suitable place. Removal of
the vehicle shall be at the owners risk and expense and all such costs and charges for removing, care
and storage, if any, shall be collectable pursuant to the provisions of the Repair and Storage Liens Act.
Part 9
Validity
9.1
Validity of By-Law
If any section, clause, or provision of this By-Law, is for any reason declared by a court of competent
jurisdiction to be invalid, the same shall not affect the validity of the By-Law as a whole or any part
thereof, other than the section, clause or provision so declared to be invalid and it is hereby declared to
be the intention of the remaining sections, clauses or provisions of this By-Law shall remain in full force
and effect until repealed. Notwithstanding that one or more provisions thereof shall have been declared to
be invalid.
