Page. .1 THE CORPORATION OF THE TOWN OF COCHRANE BY-LAW NO. 1992--82 BEING A BY--LAW TO CONTROL THE ERECTION OF FENCES IN THE MUNICIPALITY OF THE TOWN OF COCHRANE. WHEREAS the Council of the Town of Cochrane is desirous of passing a By--law to control the erection of fences in the Municipality of the Town of Cochrane; AND WHEREAS the Council of the Town of Cochrane is desirous of passing a By--1aw to control the erection of fences for the safety and welfare of its inhabitants; AND WHEREAS under Section 210, Paragraph 18, of the Municipal Act, R .S .0 . 1980, Chapter 302 as amended, a Municipality may pass By~laws for prescribing the height and description of all lawful fences; AND WHEREAS under Section 104 of the Municipal Act, R .S.O. 1980, Chapter 137 the Municipality may pass the By--laws for the health, safety, moral and welfare of the inhabitants in the Municipality; NOW THEREFORE the Council of the Town of Cochrane enacts as follows: 1. In this By--Law fence includes a gate or gates. 2. In the Residential Zone as designated in Schedule "A" of By---Law 1835-80, no person shall erect a fence of greater height than five (5) feet if the fence is erected back of the front wall of the dwelling, and not higher than three (3) feet if the fence is located between the front wall of the dwelling and the front property line. The height shall be taken from the finished grade of the property along the fence. 3. Any person erecting, constructing or maintaining a fence made partly or totally of barbed wire or other barbed material shall ensure that persons or animals are properly and sufficiently protected against injury. 4. No person shall erect, construct or maintain along a highway a fence partly or wholly made of barbed wire or any other barbed material. 5. No person shall erect, construct or maintain along a roadway within the Municipality a single length chain, wire, cable, rope or wood fence, or any other fence which is not properly marked so as to be fully and safely visible by day or night. 6. On corner lots fences located between the front wall of the dwelling or structure and thewfrontproperty line shall not exceed thirty--six (36) inches in height, The height shall be determined by the centre line elevation of the abutting streets. 7. For lots used for residential purposes in the Industrial and Commercial Zones, as designated in Schedule "A" of By--Law 1835-80, fence restrictions shall be as outlined in Section 1 of this By--Law. 9. A building permit shall be required for the erection of a fence on any property, unless included in the original application for a building permit for a new structure. The fee shall be $10.00. 10. Every person who contravenes any provision of this By--Law is guilty of an offence and is liable upon summary conviction to a fine of not more than $2,000.00. 11. By--Law 1588-76 is hereby repealed. Adshead Clerk --Treasurer C:\WFl)OCS\l7ENCE2.LM'J dg October 27, 1994 (1:3'Ipm) Page vageuz THE CORPORATION OF THE TOWN OF COCHRANE BY--LAW NUMBER 2074-84 BEING A BY-LAW TO AMEND BY-LAW 1992-82 WHEREAS the Council of the Corporation of the Town of Cochrane has passed By- law Number 1992-82 to control the erection of fences in the Municipality of the Town of Cochrane; AND WHEREAS the Council of the Corporation of the Town of Cochrane is desirous of amending By--law Number 1992--82; NOW THEREFORE the Council of the Corporation of the Town of Cochrane enacts as follows: 1. 2. That Section two (2) of By--law Number 1992 is hereby amended by deleting line three (3) to seven (7) inclusive and substituting therefore the following: height than (a) three (3) feet if the fence is located between the front wall of the dwelling and the front property line; (b) five (5) feet if the fence is located between the front wall of the dwelling and the back wall of the dwelling; (c) six (6) feet if the fence is located between the back wall of the dwelling and the rear property line, so that the said Section two (2) shall now read: "2. In the Residential Zone as designated in Schedule "A" of By--law 1835-80, no person shall erect a fence of greater height than (a) three (3) feet if the fence is located between the front wall of the dwelling and the front property line; (b) five (5) feet if the fence is located between the front wall of the dwelling and the back wall of the dwelling; (c) six (6) feet if the fence is located between the back wall of the dwelling and the rear property line.
