## BY-LAW No. 2016-071 OF THE CORPORATION OF THE TOWN OF COLLINGWOOD

BEING A BY-LAW TO PERMIT RETAIL BUSINESS ESTABLISHMENTS TO OPERATE ON HOLIDAYS FOR THE MAINTENANCE OR DEVELOPMENT OF TOURISM IN THE TOWN OF COLLINGWOOD
WHEREAS Section 2 of the Retail Business Holiday Act, R.S.O 1990, c. R.30, as amended, (the Act) provides that no person carrying on a retail business in a retail business establishment shall sell or offer for sale any goods or services therein by retail or admit members of the public thereto on a holiday;
AND WHEREAS Subsection 4(1) of the Act provides that council of a municipality may by bylaw permit retail business establishments in the municipality to be open on holidays for the maintenance or development of tourism;
AND WHEREAS there is compliance with the tourism criteria set out in the Ontario Regulation 711/91 (hereinafter referred to as "O'Reg.711/91") that must be met before a municipality may pass an exemption by-law under Section 4(1) of the Act;
AND WHEREAS the Municipal Council of the Town of Collingwood is satisfied that the tourism criteria as set out in the regulations of the Act have been met;
AND WHEREAS the municipality held a public meeting on September 7, 2016 and September 12, 2016, notice of which was published in the Enterprise-Bulletin, being a newspaper having general circulation in the municipality, and at which persons in attendance were given the opportunity to make representations in respect of the proposed by-law;
AND WHEREAS it is deemed expedient to pass a new by-law under the provisions of the Act,
AND WHEREAS the Council of the Corporation of the Town of Collingwood deems it appropriate to enact a by-law to permit retail business establishments in the Town of Collingwood to be open on certain holidays for the maintenance or development of tourism should they wish to be open;
## NOW THEREFORE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:
1. THAT pursuant to the Retail Business Holidays Act, R.S.O. 1990, c. R.30, as amended, all retail business establishments within the Town of Collingwood may be permitted to open on a Holiday described in the Act, as amended from time to time;
2. THAT this by-law shall be known as the "Retail Business Holiday Exemption Bylaw";
3. THAT By-law Nos. 92-13, 92-14, 92-15, and 92-16 are hereby repealed;
4. THAT this By-law shall come into full force and effect thirty-one days following the date of final passage and not appealed hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
