BY-LAW No. 2012-068
OF THE
CORPORATION OF THE TOWN OF COLLINGWOOD
Being a by-law to designate reduced load periods and the highways or portions thereof
to which the designation applies.
WHEREAS Section 122 (7) of the Highway Traffic Act, R.S.O. 1990, chapter H.8, as
amended, provides that the municipal corporation or other authority having jurisdiction
over a highway may by by-law designate the date on which a reduced load period shall
start or end and the highway or portion thereof under its jurisdiction to which the
designation applies;
AND WHEREAS the reduced load period is deemed necessary for the protection of
certain highways located within the Corporation of the Town of Collingwood;
AND WHEREAS Section 110(1) of the Act enables a municipality having jurisdiction
over a highway, upon application in writing, to grant a permit for use of the highway or
portion thereof by a vehicle or combination of vehicles in excess of the dimensional
limits set out in Section 122 of the Act;
AND WHEREAS the Council of the Corporation of the Town of Collingwood deems it
necessary to repeal By-Law No. 92-21 and incorporate a new By-Law having
consideration for expanded town boundaries as part of County of Simcoe's restructuring
program effective January 1st, 1994;
NOW THEREFORE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD
ENACTS AS FOLLOWS:
1.Short Title
This by-law shall be known and maybe cited as the "Reduced Load Restriction By-
law"
2.Definitions

"Director" means the Executive Director of Public Works.
"Highway Traffic Act" means the Highway Traffic Act, R.S.O. 1990, c.H.8, as
amended from time to time.
"Motor Vehicle" has the meaning ascribed thereto in the Highway Traffic Act.
"Official Sign" means a load restriction sign erected in accordance with the
regulations under the Highway Traffic Act.
"Reduced Load Period" means a reduced load period within the meaning of
section 122 of the Highway Traffic Act.
"Vehicle" has the meaning prescribed thereto in the Highway Traffic Act.
3.THAT subject to sections 3,4, and 6 herein, a reduced load period for all roads within
the Town of Collingwood road system shall commence on the first day of January to
the thirty-first day of December inclusive in each and every year.
4.THAT the designation in this by-law shall apply to all roads within the Town of
Collingwood road system, except the road, or parts thereof, specified in Schedule
"A" hereto.
5.THAT notwithstanding anything to the contrary, section 3 shall only apply during such
times when and where the official signs have been erected.
6.THAT the Director or his/her designate, shall have the authority to place or remove
any or all reduced load signs as may be necessary to implement this by-law.
7.THAT the Director or his/her designate, shall have the authority to grant permits for
use of highway or portion thereof during any reduced load period by a vehicle in
excess of limits set out in this By-law, where such a permit is deemed to be required
and necessary.
8.THAT every person who contravenes any provision of this By-law is guilty of an
offence and upon conviction is liable to a fine as set out in the Highway Traffic Act.
9.THAT By-law No. 92-21 of the Corporation of The Town of Collingwood is hereby
repealed.
10.THAT this By-law shall come into full force and effect on the date of final passage
hereof at which time all By-laws and/or resolutions that are inconsistent with the
provisions of this By-law and the same are hereby repealed or rescinded insofar as it
is necessary to give effect to the provisions of this By-law.
