BY-LAW NO. 069, 1989
TRAFFIC AND PARKING BY-LAW
The Council of the Corporation of the
City of Cornwall enacts as follows:
DEFINITIONS AND INTERPRETATION
DEFINITIONS
1.
In this By-Law
(1)
"authorized sign" means any sign, any roadway, curb or sidewalk marking, or any other
device placed or erected on a highway under the authority of this By-Law for the purpose
of regulating, warning or guiding traffic;

"bicycle" includes a tricycle, a unicycle and a power-assisted bicycle, but does not

include a motor-assisted bicycle;
(3)
"boulevard" means all such parts of a highway between the curb or edge of the roadway
and the highway limit, exclusive of the area covered by sidewalk;
(4)
"bus stop" means a part of a highway designated as a point at which buses will stop to
take on or let off passengers;
(5)
"commercial motor vehicle" means a motor vehicle having permanently attached
thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire
apparatus, buses and tractors used for hauling purposes on the highways;
(6)
"corner" with reference to a highway intersection means the point of intersection of the
prolongation of the lateral curb lines or, in the absence of curbs, the prolongation of the
edges of the roadways;
(7)
"Corporation" means the Corporation of the City of Cornwall;
(8)
"crosswalk" means:
(a)
that part of a highway at an intersection that is included within the connections of
the lateral lines of the sidewalks on opposite sides of the highway measured from
the curbs or, in the absence of curbs, from the edges of the roadway, or
(b)
any portion of a roadway at an intersection or elsewhere distinctly indicated for
pedestrian crossing by signs or by lines or other markings on the roadway
surfaces;

(9)
"delivery" means the delivery of goods or services. It may include the

delivery of maintenance operations by Utility Companies, Public Works, etc. and may
not be limited to one residence.

(10)
"driveway" means a part of a highway improved to provide vehicular access from the
roadway to a laneway or a parking area on adjacent land;
(11)
"gross weight" means the combined weight of vehicle and load;

"heavy vehicle" means:

(a)
any motor vehicle having permanently attached thereto a truck or delivery body
and having a gross vehicle weight, as registered with the Ontario Ministry of
Transportation, in excess of 4500 kg., and
(b)
tractors used for hauling purposes on the highway, buses, motorized and mobile
homes, trailers and portable offices,
But does not include a passenger vehicle, an ambulance or any Police or Fire
Department vehicles;
(13)
"highway" includes the entire right-of-way of a common and public highway, street,
avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and
intended for or used by the general public for the passage of vehicles;
(14)
"highway, one-way" means a highway upon which the movement of vehicular traffic is
limited to one direction;
(15)
"holiday" includes Sunday, New Year's Day, Good Friday, Easter Monday, Victoria
Day, Canada Day, the Day proclaimed as a Civic Day, Christmas Day, Boxing Day, the
Day proclaimed as the birthday or day fixed by proclamation of the Governor General for
the celebration of the birthday of the reigning sovereign, and any day appointed by
proclamation of the Governor General or the Lieutenant-Governor-in-Council as a public
holiday or for a general fast or Thanksgiving, and the next following day when any such
holiday, except Remembrance Day, falls on a Sunday;
(16)
"intersection" means the area embraced within the prolongation or connection of the
lateral curb lines or, if none, then of the lateral boundary lines of two or more highways
that join one another at an angle, whether or not one highway crosses the other;
(17)
"King's Highway" means a highway so designated under the Public Transportation and
Highway Improvement Act;
(18)
"laneway" means improved land adjacent to the highway which provides access from the
highway to a parking area on adjacent land;
(19)
"loading zone" means that portion of any highway designated as a place where
commercial motor vehicles may be stopped only for the purpose of loading and
unloading merchandise;
(20)
"median strip" means the portion of a highway so constructed as to separate traffic
traveling in one direction from traffic traveling in the opposite direction by a physical
barrier or an unpaved strip of ground;
(21)
"motor assisted bicycle" means a bicycle:
(a)
fitted with pedals which are operable at all times to propel the bicycle,
(b)
weighing not more than fifty-five (55) kilograms,

(c)
which has no hand or foot operated clutch or gearbox driven by the motor and
transferring power to the driven wheel,
(d)
having an attached motor driven by electricity or having a piston displacement of
not more than fifty (50) cubic centimetres, and
(e)
which does not have sufficient power to enable the bicycle to attain a speed
greater than fifty (50 km/h) kilometres per hour on level ground within a distance
of two (2 km) kilometres from a standing start;
(22)
"monthly validated parking permit" means a permit issued on a monthly basis and
authorized by the City of Cornwall, for use by the owner or operator of a vehicle to park
in designated areas of municipal parking lots;
(23)
"motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the
driver and designated to travel on not more than three wheels in contact with the ground,
and includes a motor scooter; but does not include a motor assisted bicycle;
(24)
"motor vehicle" includes an automobile, motorcycle, motor assisted bicycle, unless
otherwise indicated in the Highway Traffic Act, and any other vehicle propelled or driven
otherwise than by muscular power, but does not include a street car or other motor
vehicle running upon only rails, a power-assisted bicycle unless otherwise indicated in
specific sections of this By-Law, a motorized snow vehicle, a traction engine, a farm
tractor, a self propelled implement of husbandry or a road-building machine;
(25)
"Municipal parking lot" shall mean a parking lot owned and/or operated on behalf of
the Corporation, and shall include a Parking Garage established under the provisions of
this By-Law;
(26)
"official sign" means a sign approved by the Ontario Ministry of Transportation;
(49)
"Ontario Veterans License Plate" means a license plate issued by the Ministry of
Transportation of Ontario, to a vehicle owned by a veteran.
(27)
"park" or "parking" when prohibited means the standing of a vehicle, whether occupied
or not, except when standing temporarily for the purposes of and while actually engaged
in loading or unloading merchandise or passengers;
(28)
"parking meter" means a mechanical device together with its support, erected to control
and regulate the parking of a vehicle in a parking space, and includes a "pay-and-display"
machine;
(29)
"parking meter space" means a parking space, the use of which for parking a vehicle is
controlled and regulated by a parking meter;

"parking meter zone" means that side and block of a highway where

parking is controlled and regulated by parking meters, and shall also include municipal
parking lots;
(31)
"parking space" means that part of the surface of the roadway, the use of which is
designated for the purpose of vehicle parking;
(32)
"pedestrian" means:

a person on foot, or

(b)
a child, or other person in a wheeled chair, baby carriage, or toy vehicle
being carried and propelled by another person on foot;
(33)
"pedestrian crossover", as defined in the Highway Traffic Act, means any portion of a
roadway, designated by this By-Law, at an intersection or elsewhere, distinctly indicated
for pedestrian crossings by signs on the highway and lines or other markings on the
surface of the roadway, as prescribed by regulations made under the Highway Traffic
Act;

(34)
"Provincial Offences Officer" shall mean a person who is duly

appointed by the Council of the Corporation for the purpose of enforcing
the provisions of the Corporation's By-Laws;
(35)
"police vehicle" means a vehicle owned or operated by the Board of Commissioners of
Police of the City of Cornwall, the Ontario Provincial Police, the Royal Canadian
Mounted Police, or any other Ontario Municipal Police Force;

(35 a) "power-assisted bicycle" means a bicycle that,

(a) is a power-assisted bicycle as defined in subsection 2 (1) of the Motor Vehicle Safety
Regulations made under the Motor Vehicle Safety Act (Canada),
(b) bears a label affixed by the manufacturer in compliance with the definition referred to in
clause (a)
(c) has affixed to it pedals that are operable, and
(d) is capable of being propelled solely by muscular power;
(36)
"public transit motor vehicle" means a motor vehicle owned and operated by Cornwall
Transit as part of its regular passenger transport services;
(37)
"residential zone" means an area designated as residential under the City of Cornwall
Zoning By-Law No. 751, 1969 as amended, or any subsequent zoning By-Law passed by
the Council of the Corporation of the City of Cornwall.
(38)
"roadway" means the part of the highway that is improved, designed or ordinarily used
for vehicular traffic but does not include the shoulder and where a highway includes two
or more separate roadways, the term "roadway" refers to any one separately and not all of
the roadways collectively;
(39)
"set fine" means the fine for parking infractions pursuant to the Provincial Offences Act,
Part II, as set by the Chief Judge of the Province of Ontario;
(40)
"shoulder" means that part of the highway immediately adjacent to the traveled portion
of the roadway and having a surface which has been improved with asphalt, concrete or
gravel;
(41)
"sidewalk" includes all such parts of a highway as are set aside by the Corporation for
the use of pedestrians or used by the general public for the passage of pedestrians;

"skateboard" means a platform with rollers or wheels used by a person

or persons for transportation or play;
(40)
"stand" or "standing", when prohibited, means the halting of a vehicle, whether
occupied or not, except for the purpose of and while actually engaged in receiving or
discharging passengers;
(41)
"stop" or "stopping", when prohibited, means the halting of a vehicle, even
momentarily, whether occupied or not, except when necessary to avoid conflict with
other traffic, or in compliance with the directions of a constable or other officer, or of a
traffic control sign or signal;
(42)
"through highway" means any highway or part of a highway so designated by this By-
Law, and every such highway shall be marked by a stop sign or yield right-of-way sign in
compliance with the Regulations of the Highway Traffic Act.
(43)
"traffic" includes pedestrians, animals which are ridden, led, or herded, vehicles, and
other conveyances, either singly or together, while using a highway for the purposes of
travel;
(44)
"traffic control device" means any sign, any signal or any marking on a roadway, curb,
or sidewalk, or any other device erected or placed under the authority of this By-Law for
the purpose of warning, regulating, guiding or directing traffic;
(45)
"traffic control signal" means any device manually, electrically or mechanically
operated for the regulation or control of traffic;
(46)
"U-turn" means the turning of a vehicle within a highway so as to proceed in the
opposite direction;
(47)
"vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-building
machine and any other vehicle drawn, propelled or driven by any king of power,
including muscular power, but does not include a motorized snow vehicle, or the cars of
electric or steam railways running only upon rails.

"wheelchair" means a chair mounted on wheels driven by muscular, or any other kind of
power and used for the carriage of a person who has a physical defect or disability.

"Ontario Veterans License Plate" means a license plate issued by the

Ministry of Transportation of Ontario, to a vehicle owned by a veteran.
INTERPRETATION - GENERAL
2.
(1)
In this By-Law:
(a)
words importing the singular number or the masculine gender only include more
persons, parties or things of the same kind than one, and females as well as males
and the converse,
(b)
a word interpreting in the singular number has a corresponding meaning when
used in the plural,
(c)
"may" shall be construed as permissive;
(d)
"shall" shall be construed as imperative.

Abbreviations:
In the Schedules to this By-Law, the following abbreviations, definitions and symbols
stand for the words respectively set forth opposite thereto as follows:

Distances:
Where a distance is used in this By-Law as part of a prohibition of parking or stopping
within a specified distance of an object, structure, land or a part of a highway, such
distance shall be measured:
(a)
along the curb or edge of the roadway from a point in such curb or edge of
roadway opposite such object, structure, land or part of a highway, unless the
context otherwise requires, and
(b)
from such object, structure, land, or part of a highway in all directions.
(4)
Cumulative Effect:
The various prohibitions of this By-Law are cumulative and not mutually self-exclusive.
(5)
Severability:
It is declared that, if any section, subsection or part or parts thereof be declared by any
Court of Law to be bad, illegal or ultra vires, such section, subsection or part or parts
shall be deemed to be severable and all parts hereof are declared to be separate and
independent and enacted as such.
STANDARD TIME AND DAYLIGHT SAVING TIME
3.
Where an expression of time occurs or where any hour or other period of time is stated, the time
referred to shall be standard, except in periods when daylight savings time is in effect, in which

periods it shall be daylight saving time.
PART A - PARKING AND STOPPING
GENERAL STOPPING AND PARKING REGULATIONS
Two-Way Highways and Right Side of One-Way Highways
4.
(1)
Subject to subsection (2), no person shall park or stop any vehicle or permit a vehicle to
remain parked or stopped on any highway except as follows:
(a)
where there is a raised curb, on the right side of the traveled portion of the
highway, having regard to the direction in which the vehicle was traveling, with
its right front and rear wheels parallel to and not more than fifteen (15 cm)
centimeters away from such curb; or
(b)
where there is no curb or a rolled curb, on the right side of the highway having
regard to the direction in which the vehicle was traveling, with the right front and
rear wheels parallel to and as near to the right hand limit of the highway as is
practicable without stopping over any part of a highway which is landscaped or
which is not intended for the use of vehicles.
Left Side of One-Way Highways
(2)
Where parking is permitted on the left side of a highway designated for one-way traffic, a
person may park or stop any vehicle provided the vehicle is parked:
(a)
where there is a raised curb, on the left side of the traveled portion of the
highway having regard to the direction in which the vehicle was traveling, with
its left front and rear wheels parallel to and not more than fifteen (15 cm)
centimetres away from such curb; or
(b)
where there is no curb or a rolled curb, on the left side of the highway having
regard to the direction in which the vehicle was traveling, with the left front and
rear wheels parallel to and as near to the left hand limit of the highway as is
practicable without stopping over any part of a highway which is landscaped or
which is not intended for the use of vehicles.
(3)
Subsections (1) and (2) do not apply where angle parking is permitted under Section 10
of this By-Law.
STOPPING PROHIBITED WITHOUT SIGNS
5.
No person shall on any highway stop a vehicle or permit a vehicle to remain stopped:
(a)
on or over a sidewalk or footpath;
(b)
within an intersection or pedestrian crossover;

(c)
alongside or across the highway from any excavation or obstruction in the roadway when
the free flow of traffic would thereby be impeded;
(d)
on the roadway side of any stopped or parked vehicle;
(e)
upon any bridge or elevated structure or within any tunnel or underpass;
(f)
on any median strip separating two roadways or adjacent to either side or ends of such
median strip.
STOPPING PROHIBITED WITH SIGNS
6.
Where official signs to that effect are displayed, no person shall on any highway stop a vehicle or
permit a vehicle to remain stopped:
(a)
on any highway at the side and between the limits set out respectively in columns 1, 2
and 3 of Schedule I of this By-Law during the prohibited times or days set out in column
4 of the said Schedule;
(b)
within forty-five (45 m) metres of an intersection controlled by traffic signals;
(c)
within thirty (30 m) metres of the approach side of a pedestrian crossover;
(d)
between the hours of 7:00 a.m. and 7:00 p.m. along the curb or edge of roadway:
(i)
within thirty (30 m) metres of the approach side of a school crosswalk designated
by markings and authorized school crosswalk signs, or
(ii)
within ten (10 m) metres of the leaving side of a school crosswalk designated by
markings and authorized school crosswalk signs.
VENDORS
7.
(1)
No person who sells, offers for sale, or takes orders for goods, wares, merchandise or
produce from a vehicle shall for the purpose of carrying on his business, stop the vehicle
or permit the vehicle to remain stopped on any part of the highway lying between two
intersecting highways for more than thirty (30) minutes on any day or for more than ten
(10) minutes on any day within the said thirty (30) minute period at any one location.
(2)
Nothing in this section shall be deemed to permit the stopping or parking of a vehicle
where stopping or parking is prohibited.
PARKING PROHIBITED WITHOUT SIGNS
8.
(1)
No person shall on any highway park a vehicle or permit a vehicle to remain parked:
(a)
in front of or within one point five (1.5 m) metres of a driveway or laneway;
(b)
so as to obstruct vehicles in the use of a driveway or laneway;
(c)
within three (3 m) metres of a point on the curb or edge of the roadway opposite
any fire hydrant;

(d)
within nine (9 m) metres of an intersecting roadway;
(e)
within fifteen (15 m) metres of any level crossing of a railway other than street
railway;

(f)
on any two way street, having an overall width of less than six (6

m) metres;
(g)
subject to Section 13, for a period longer than twenty-four (24) hours;
(h)
for the purpose of displaying the vehicle for sale;
(i)
for the purpose of washing, greasing or repairing the vehicle, except for such
repairs as have been necessitated by an emergency;
(j)
alongside the tracks of any railway other than a street railway;
(k)
in such a position as will prevent the removal of any other vehicle previously
parked;
(l)
so as to prevent or impede the ingress to or egress from a metered parking space
notwithstanding its use for any other purpose;
(m)
on a driveway within one (1 m) metre of a sidewalk or footpath, or if there is no
sidewalk or footpath, within three (3 m) metres of the roadway, subject to the
provisions of Section 11;

on any roadway designated as a one-way street, having an

overall width of less than five metres and eighty five centimeters (5.85 m);

on any roadway designated as a one-way street, having an

overall width of less than six metres (6 m) but more than five metres and eighty
five centimeters (5.85 m), from November 15 of one year until March 31 of the
following year.

on the left side of any roadway designated as a one way street, unless otherwise
posted or indicated by paid metered parking.
(2)
No person shall park any vehicle, or permit a vehicle to remain parked, in any public lane.
PARKING PROHIBITED WITH SIGNS
9.
Where official signs to that effect are displayed, no person shall on any highway park a vehicle or
permit a vehicle to remain parked:
(a)
on any highway at the side and between the limits set out respectively in columns 1, 2
and 3 of Schedule II to this By-Law during the prohibited times or days set out in
column 4 of said Schedule;
(b)
within twenty-five (25 m) metres of an intersection;
(c)
within forty-five (45 m) metres of an intersection controlled by traffic signals;

(d)
within eight (8 m) metres of any fire hall on the side of the highway on which the fire hall
is located;
(e)
within thirty (30 m) metres of any fire hall on the opposite side of the highway;
(f)
within a turning basin;
(g)
within fifteen (15 m) metres of the termination of a dead-end street;
(h)
upon that side of a highway adjacent to any school property, or public park;
(i)
within six (6 m) metres of a point in the edge of the roadway and nearest to a public
entrance, or any emergency exit from any hotel, hospital, nursing home, theater,
auditorium or other building or enclosed space in which persons may be expected to
congregate in large numbers;

ANGLE PARKING
10.
(1)
No person shall park a vehicle or permit a vehicle to remain parked at an angle on a
highway, except on the highways, at the side and between the limits set out respectively
in columns 1, 2 and 3 of Schedule III to this By-Law during the permitted times or days
set out in column 4 of the said Schedule, and in accordance with the provisions of
subsection (2) of this Section.
(2)
(a)
Where angle parking is permitted on a highway, no person shall stop or park any
vehicle except at an angle of 45 degrees from the curb or boundary of the
roadway with the front end of the vehicle as such curb or boundary.
(b)
Where angle parking spaces are designated by lines painted on the roadway, no
person shall stop or park any vehicle except within an area designated as a
parking space.
PARKING ON BOULEVARDS
11.
No person shall park a vehicle or permit a vehicle to remain parked on any boulevard except
where such parking has been authorized by Council, subject to the provisions of the "Streets By-
Law" No. 1979, 1976 and amendments thereto.
HIGHWAY CLEARING, SNOW REMOVAL AND HIGHWAY CLEANING
12.
No person shall park a vehicle or permit a vehicle to remain parked on any highway:
(1)
so as to interfere in any manner with the work of removing snow or ice therefrom or the
clearing of snow therefrom, or
(2)
in such manner so as to interfere with highway cleaning operations.
WINTER PARKING RESTRICTIONS

13.
No person shall park a vehicle or permit a vehicle to remain parked on any highway or

municipal parking lot between the hours of 1:00 a.m. of one day and 7:00 a.m. of the same day

(1)
Where official signs to that effect are displayed, no person shall park a vehicle or permit
a vehicle to remain parked on any highway at the side and between the limits set out
respectively in Columns 1, 2, and 3 of Schedule IV to this By-Law during the times or
days set out in Column 4 of the said Schedule for a longer period than that set out in
Column 5 of the said Schedule.
(2)
Nothing in this section shall be deemed to permit parking, stopping, or standing at any
location where or at any time when parking, stopping or standing is otherwise prohibited.
LOADING ZONES, BUS STOPS,
SCHOOL BUS LOADING ZONES, TAXI STANDS

16.(1) (a)
Where authorized signs as set out in Schedule V (b) of this By-Law are displayed, no
person shall stop or park any vehicle or permit a vehicle to remain stopped or parked,
other than a commercial motor vehicle, in any Loading Zone on any highway, at the side
and between the limits set out respectively in Columns 1, 2, and 3 of Schedule V (a) of
this By-Law during the days or times set out in Column 4 of the said Schedule.

(b)
Where authorized signs as set out in Schedule V (c) of this By-Law are displayed, no
person shall stop or park any vehicle or permit a vehicle to remain stopped or parked,
other than a vehicle operated by or conveying a physically disabled person, upon which is
displayed a valid disabled parking permit, in any physically disabled persons Loading
Zone on any highway, at the side and between the limits set out respectively in Columns
1, 2, and 3 of Schedule V (d) of this By-Law during the days or times set out in Column 4
of the said Schedule.
(2)
(a)
Where authorized signs to that effect are displayed, no person shall stop or park any
commercial motor vehicle in any Loading Zone on any highway, at the side, and between
the limits set out respectively in Columns 1, 2, and 3 of Schedule V (a) of this By-Law
for any purpose other than for the expeditious unloading and delivery or pick-up and
loading of materials, passengers or goods during the days or times set out in Column 4 of
the said Schedule. In no case shall the stop exceed fifteen (15) minutes.
(b)
When authorized signs to that effect are displayed, no person shall stop or park any
vehicle operated by or conveying physically disabled persons, upon which is displayed a
valid disabled parking permit in any Physically Disabled Persons Loading Zone on any
highway, at the side and between the limits set out respectively in Columns 1, 2 and 3 of
Schedule V (d) to this By-Law for any purpose other than for the expeditious unloading
or pick-up of Disabled Persons during the days or times set out in Column 4 of the said
Schedule. In no case shall the stop exceed fifteen (15) minutes.
BUS STOPS
17.
Parking prohibited:
(1)
Where authorized signs are displayed, no person shall park a vehicle or permit a vehicle
to remain parked:
(a)
within thirty (30) metres of a bus stop on the approach side thereof;
(b)
within eighteen (18) metres of a bus stop on the leaving side thereof.
Stopping prohibited:
(2)
Where authorized signs are displayed, no person shall stop a vehicle or permit a vehicle
to remain stopped within a bus stop.
Exception:
(3)
The provisions of this section does not apply to a public transit motor vehicle.
SCHOOL BUS LOADING ZONES
18.
Where official signs to that effect are displayed in accordance with the Highway Traffic Act and
Regulations passed thereunder, no person shall stop a vehicle or permit a vehicle to remain
stopped, other than a school bus, in a school bus loading zone, on any highway at the side and
between the limits set out respectively in Columns 1, 2 and 3 of Schedule VI adjacent or nearby
the school or institution set out in Column 4 of the said Schedule during the times or days set out
in Column 5 of the said Schedule.
TAXI STANDS
19.
(1)
No person shall park a taxicab, while waiting for hire or engagement, on any highway

except at a stand authorized and assigned for taxicabs by subsection (3) and marked as a
taxicab stand by an authorized sign.
(2)
No person shall park a vehicle or permit a vehicle to remain parked, other than a taxicab
waiting for hire or engagement, at any stand referred to in subsection (1) marked as a
taxicab stand by an authorized sign.
(3)
Stands for taxicabs are hereby authorized and assigned on the highways at the sides and
between the limits set out respectively in Columns 1, 2 and 3 of Schedule VII to this By-
Law.
PARKING METERS
PARKING ZONES

(1)
The streets or part of streets as described in Columns 1 through 4 of

immediately deposits the required money in the parking meter alongside of or
next to the said parking space; and
(b)
activates the parking meter by turning the handle to indicate the unexpired time
paid for in accordance with the hourly rate.

controlling the parking meter space as indicated by signs;
(b)
displays the valid and unexpired ticket issued by the "pay and display" machine
clearly in sight, face up, on the left side of the front dashboard of the vehicle
parked in said parking meter space, and in such a manner as to clearly show the
parking lot name, date, and expiry time.

(1)
Where parking meters or a "pay and display" machine have been

vehicle to remain parked in a parking meter space within a parking meter zone or

meter space within a parking lot on which an expired ticket is displayed.
MANNER OF PARKING

23.
(1)
No person shall park, or permit a vehicle to remain parked within a parking meter zone or
attendant parking zone unless said vehicle is parked wholly within:
(a)
the area between the lines or markings set out on the pavement, as illustrated in
Schedule X (a) for on-street parking meter zones;
(b)
the area between the lines or markings set out on the pavement as illustrated in
Schedule X (b) for paved off-street parking meter zones or attendant parking
zones; or
(c)
the area illustrated in Schedule X (c) for unpaved off-street parking meter zones
or attendant parking zones.

(2)
No person shall park a vehicle or permit a vehicle to remain parked in

such a manner that it is not wholly within the area designated as a parking space unless
the vehicle is of such length as to render it impossible to park it in one (1) parking space,
in which case the adjoining parking space or spaces may, in addition, be used if the
required coin deposits are made in the parking meters provided for all parking spaces
used by the vehicle, and in compliance with all other sections of this By-Law.
(3)
No person shall deposit or cause to be deposited in any parking meter any slug, device, or
metallic substitute for a coin of Canadian or United States currency other than tokens
issued by the Corporation of the City of Cornwall for the purpose of being used
specifically for parking meter where such meters shall be designed for the use of such
tokens.
DAMAGE TO PARKING METERS
24.
No person shall deface, injure, tamper with, open or willfully break, destroy or impair the
usefulness of any parking meter installed under the terms of this By-Law.
MONTHLY PARKING PERMITS

25.
(1)
Section 21(1) of this By-Law shall not apply to a motor vehicle having an

overall length not exceeding 6.0 metres (19.7 feet) provided that such vehicle is parked:
(a)
at a meter displaying a legal time limit in excess of three (3) hours; or
(b)
within a designated area of an attendant parking zone, as indicated by signs; or
(c)
within a designated area of a municipal parking lot controlled with a "pay and
display" machine, as indicated by signs,
subject to the provisions of subsections (2) and (3).

A Monthly Parking Permit, issued by the Corporation of the City of

COMMERCIAL MOTOR VEHICLE PARKING PERMITS

26.
(1)
Section 21(1) and 21(4) of this By-Law shall not apply to a commercial

motor vehicle having an overall length not exceeding 6.0 metres (19.6 feet) provided the
owner of such vehicle has obtained a Commercial Motor Vehicle Parking Permit, such
permit shall be issued upon payment of the appropriate fee for each such commercial
motor vehicle. Such permit is to be valid to the end of the calendar year for which it is
issued, and is to be installed
(a)
on the lower right side of the windshield of the commercial motor vehicle for
which it is issued; or
(b)
to be attached to the rear view mirror of the commercial motor vehicle for which
it is issued,
such that the entire permit is clearly visible from outside the vehicle.

The operator of a commercial motor vehicle for which a Commercial

Motor Vehicle Parking Permit has been issued under subsection (1) shall have the
privilege of parking in any designated parking meter zone, without the use of a coin for a
period time long enough to carry out official business, but under no circumstances for a
longer period of time than one hour.

the person to whom the original permit was issued under subsection (1) can produce the

PART B -- TRAFFIC
TRAFFIC MOVEMENTS
DESIGNATED ONE-WAY STREETS
27.
The highways set out in Column 1 of Schedule XI to this By-Law between the limits set out in
Column 2 of the said Schedule, are hereby designated for one-way traffic only in the direction set
out in Column 3 of the said Schedule.
DESIGNATED TRAFFIC LANES
28.
On the highways and parts of highways listed in Column 1 of Schedule XII having been divided
into clearly marked lanes between the limits indicated in Column 2, each of the lanes indicated in
Column 3 is designated for traffic moving only in the direction of directions indicated in Column
4 during the days and times indicated in Column 5 of the said Schedule.
TURNING MOVEMENT
29.
Where official signs to that effect are displayed, no person driving a vehicle in any intersection of
portion of highway or on property set out in Column 1 of Schedule XIII to this By-Law
proceeding in the direction or emerging from a property in the direction set out in Column 2 of
the said Schedule, shall be turned or proceed in the direction set out in Column 3 of the said
Schedule, during the times or days set out in Column 4 of the said Schedule.

THROUGH HIGHWAYS
30.
(1)
The highways set out in Column 1 of Schedule XIV to this By-Law, between the limits
set out in Columns 2 and 3 of the said Schedule, are, except as provided in subsection (2)
of this section, hereby designated as Through Highways.
(2)
The designation of a highway or portion of highway as a through highway in subsection
(1) of this section shall not include any intersection thereon where the highway
intersected is a King's Highway or where traffic control signals are installed.
STOP SIGNS
31.
The intersections set out in Column 1 of Schedule XV to this By-Law are designated as
intersections where stop signs shall be erected at the locations shown in Column 2 of the said
Schedule.
YIELD SIGNS
32.
The intersections set out in Column 1 of Schedule XVI to this By-Law are designated as
intersections where yield right-of-way signs shall be erected at the locations shown in Column 2
of the said Schedule.
TRAFFIC CONTROL SIGNALS
33.
The Corporation shall erect and operate traffic control signal systems at the intersections and
places named and described in Schedule XVII to this By-Law, subject to the provisions of
subsections (28) and (29) of Section 124 of the Highway Traffic Act.
HEAVY TRAFFIC
NO TRUCK ROUTES

34.
(1)
Except as provided in subsection (2), where official signs to that effect are displayed, no

person shall move, drive, park or operate a heavy vehicle as defined in Section 1,
subsection (ii) of this By-Law on any highway set out in Column 1 of Schedule XVIII to
this By-Law, between the limits set out in Column 2 of the said Schedule during the
times or days set out in Column 3 of the said Schedule, with the exceptions as set out in
Column 4 of the said Schedule.

Subsection (1) shall not apply to any vehicle actually engaged in making a delivery to or

portion of highway is traveled only insofar as is unavoidable in getting to and from such

Second Street East and Seventh Street East for the purpose of engaging and making a
delivery to or collection from said properties via the most direct route, that being Sydney
Street between Second Street East and Seventh Street East is permitted

Where official signs to that effect are displayed, the provisions of Section 104a of the Highway
Traffic Act shall extend and apply to all highways set out in Column 1 of Schedule XIX, between
the limits set out in Columns 2 and 3 of the said Schedule, between the dates set out in Column 4
of the said Schedule in each and every year.
SPEED REGULATIONS
RATES OF SPEED ON HIGHWAYS

When any highway or portion of highway set out in Schedule XX (a), (b), (c),

(d)or (e) appended hereto is marked in accordance with the regulations under the Highway Traffic
Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the Schedule.

When any highway or portion of a highway, which has been designated

Services or The Manager of Municipal Works and Services or their designates, is marked

DRIVING RULES
ENTERING HIGHWAY
37.
The driver or operator of a vehicle emerging from a private driveway, laneway, building or bus
U-TURNS
38.
Where U-turns are not prohibited under provisions of Section 29 of the By-Law or under
provisions of the Highway Traffic Act, such a turn shall be made only where it can be made in
safety and without interfering with other traffic.
SIDEWALKS, CURBS AND BOULEVARDS
By-Law

39.
For the purpose of this section, power assisted bicycles are considered "motor vehicles".
(1)
No person shall drive a motor vehicle upon a sidewalk on a highway except for the
purpose of directly crossing the sidewalk or footpath.
(2)
No person shall drive a motor vehicle over a raised curb except at a place where there is a
ramp.
(3)
No person shall drive a vehicle on a boulevard except where parking is permitted in
accordance with Section 11, or except for the purpose of directly crossing at a driveway
or other designated vehicular crossing.
PUBLIC PARKS
40.
For the purpose of this section, power assisted bicycles (e-bikes) are considered "motor vehicles",
when driven, ridden or operated where prohibited.
(1)
No person shall ride or drive a motor vehicle or motorized snow vehicle
on the turf, sward or footpath, paved area, trail, multi-use path,
recreational path or bicycle path in any of the public parks in the City of

Cornwall.
(2)
Where official authorized signs are displayed to that effect, no person
shall ride or drive a motor assisted bicycle (e-bike) on the turf, sward,
footpath, paved area, trail, multi-use path, recreational path or bicycle
path in any of the public parks in the City of Cornwall.
BARRICADED HIGHWAYS
41.
No person shall drive, operate or park a vehicle or permit a vehicle to remain parked on any part
of any highway barricaded and marked by signs showing that its use for the time is prohibited or
restricted.
VEHICLES OBSTRUCTING TRAFFIC
42.
(1)
No person driving or operating a vehicle approaching a green traffic control signal-light
at an intersection shall enter the intersection unless traffic in front of the said person is
moving in a manner that would reasonably lead him or her to believe he or she can clear
the intersection before the traffic control signal-light turns red.
(2)
Subsection (1) shall not apply to the driver or operator of a vehicle who enters an
intersection for the purpose of turning to the right or left into an intersecting highway and
signals his or her intention to make such turn prior to entering the intersection.
(3)
No person shall drive or place a vehicle on a highway in such a manner as to obstruct
traffic.
OBEDIENCE TO SIGNS, SIGNALS
43.
Notwithstanding any provisions of this By-Law, every person shall promptly obey all signals
given by a traffic control signal, traffic control device or a traffic sign and all directions given by
a Police Officer or by any officer having jurisdiction over the regulation of traffic on a highway
and nothing in this By-Law shall affect the powers to regulate traffic held by the Board of
Commissioners of Police.
PEDESTRIANS
SAFETY ZONES
44.
No pedestrian shall proceed over or go under a barrier installed at a safety zone or on a sidewalk.
PLAYING ON ROADWAY
45.
(1)
No person shall play or take part in any game or sport upon a roadway.
(2)
Where there are sidewalks, no person upon roller skates, or riding in or by means of any
coaster, toy vehicle or similar device, shall go upon a roadway except for the purpose of
crossing the highway, and when so crossing, such person shall have the rights and be
subject to the obligations of a pedestrian.

No person shall operate a skateboard on any roadway, sidewalk or boulevard on any
highway described in Schedule XXVII of this By-Law.
(4)
No person shall operate a skateboard on the turf, sward, footpath or any other ground in

YIELD TO VEHICULAR TRAFFIC
47.
Except where traffic control signals are in operation or where traffic is being controlled by a
constable, a pedestrian crossing a highway shall yield the right of way to all vehicles upon the
roadway, but nothing in this section shall relieve the driver of a vehicle from the obligation of
taking all due care to avoid an accident
PEDESTRIAN PROHIBITED ON ROADWAY
48.
Except for the purpose of crossing a roadway, where there is a sidewalk that is reasonably
passable on one side or on both sides of a roadway, no person shall walk on the roadway.

49.
The parts of the highways set out in column 1 of Schedule XXII at the intersection or location set
out in column 2 of the said Schedule are hereby designated as pedestrian crossovers.

(1)
A person driving a bicycle upon a roadway shall:
(a)
drive as near the right-hand side of the roadway as practical, and
(b)
drive as near the right-hand or left-hand side of the roadway as practicable, and
(c)
exercise due care when passing a standing vehicle or one proceeding in the same
direction.
(3)
Persons operating bicycles upon a roadway shall do so in single file.
(4)
No person operating a bicycle shall carry any package, bundle or article which prevents
the rider from keeping both hands on the handle bars.
(5)
No person riding a bicycle on a highway shall remove his or her feet from the pedals
white the bicycle is in motion.
(6)
No person shall park a bicycle on a highway except in such a manner as to cause the least
possible obstruction to pedestrian or vehicular traffic.

(7)
No person shall ride a bicycle with a wheel or wheels more than sixty (60 cm)
centimetres in diameter upon a sidewalk on any highway.

(8)
No person above the age of 12 years shall ride a bicycle upon a sidewalk.

Amended
50.A (1)
A person driving a wheelchair upon a roadway shall:

(a)
drive as near the right-hand side of the roadway as practical, and
(b)
exercise due care when passing a parked, stopped or standing vehicle or
one proceeding in the same direction.
(c)
bear the slow moving vehicle sign required by the Highway Traffic Act.
Regulation 616 and comply with any other provisions required by any
applicable legislation, including Regulation 625 of the Highway Traffic
Act.
(d)
be equipped with mirrors attached to the wheelchair or to the operator and
placed in such a position as to afford the operator a clearly reflected view
of the roadway in the rear, or of any vehicle approaching from the rear.
(2)
A person driving a wheelchair upon a roadway designated for one-way traffic
shall:
(a)
obey and follow the designated one way street direction.
(b)
drive as near the right-hand side of the roadway as practicable, and
(c)
exercise due care when passing a standing vehicle or one proceeding in the
same direction.
(3)
Persons driving wheelchairs upon a roadway shall do so in single file.
(4)
When on the roadway at any time from one-half hour before sunset to one-half
hour after sunrise and at any other time when, due to insufficient light or
unfavourable atmospheric conditions, persons and vehicles on the highway are
not clearly discernible at a distance of 150 meters or less, a wheelchair shall carry
on the front thereof a lighted lamp displaying a white or amber light and on the
rear thereof a lighted lamp displaying a red light.
(5)
No person driving a wheelchair shall carry any package, bundle or article which
prevents the operator from keeping both hands on the handle bars or one hand on
the joystick control, which would prevent safe operation of the wheelchair.
(6)
No wheelchair towing, hauling, pulling or pushing any kind of attachment, except
those provided by the manufacturer as integral part of the equipment for the
wheelchair, shall be operated upon a public highway or sidewalk.
(7)
No operator of a wheelchair shall permit any person riding upon a bicycle,
coaster, roller skates, skis, wagon, toboggan, sled, or toy vehicle to attach the
same, himself or herself to the wheelchair.
(8)
No person shall park a wheelchair on a highway except in such a manner as to
cause the least possible obstruction to pedestrian or vehicular traffic.

(9)
No wheelchair shall be operated upon a public highway or sidewalk except for the
purpose of the carriage of a person who has a physical defect or disability.
(10)
No wheelchair carrying more than one person shall be operated upon a public
highway or sidewalk.
(11)
A person driving a wheelchair upon the sidewalk shall:
(a)
drive as near the right-hand side of the sidewalk as practical, and
(b)
exercise due care, slowing down, even coming to a full stop as the case
may require, when encountering oncoming pedestrians or while
overtaking pedestrians proceeding in the same direction, always yielding
the right-of-way to pedestrians, which would ensure free movement and
safety of other pedestrians.
(c)
be equipped with mirrors attached to the wheelchair or to the operator and
placed in such a position as to afford the operator a clearly reflected view
of the sidewalk in the rear, or of any pedestrian approaching from the rear.
PART C - HANDICAPPED PARKING ZONES
DEFINITIONS - PART C
51.
For the purpose of the part:
(1)
"designated parking space" means a parking space designated under this part for the
exclusive use of a vehicle displaying a permit in accordance with the requirements of the
Highway Traffic Act and the regulations made thereunder, and this part;
(2)
"municipal or private property" means any open area or portion of a structure, other
than a street or highway, intended for the temporary parking of vehicles and on which
there are designated parking spaces, whether their use involves the payment of a fee or
otherwise;
(3)
"permit" means a disabled person parking permit issued under the Highway Traffic Act
or a permit, number plate or other marker or device issued by another jurisdiction and
recognized under the Act;
VOLUNTARY PROVISIONS OF STALLS
52.
(1)
A designated parking space shall be distinctly indicated in accordance with the
Requirements of the Highway Traffic Act and the regulations made thereunder.
(2)
Every owner or operator of a public parking area who chooses to provide designated
Parking spaces for the exclusive use of vehicles operated by or conveying physically
disabled persons, upon which is displayed a valid parking permit, shall ensure that the
designated parking spaces be:
(a)
a minimum of three (3 m) metres in width, subject to the provisions of subsection
(3);
(b)
of the same length as the other parking spaces in the same public parking area;

(c)
hard surfaced;
(d)
level;
(e)
located so as to be readily accessible to physically disabled persons, whether via
ramps, depressed curbs or other means, and, where the public parking areas is
intended to serve a particular building or complex, located within easy access of
said building or complex;
(f)
identified by signs conforming to the requirements of the Highway Traffic Act;
and
(g)
signs required under subsection (2) (f) to be mounted on a permanent post with
the bottom of the sign a minimum of 1.2 m and a maximum of 1.8 m above
ground level with said post to be located at the end of the designated parking
space at a point marking the midpoint in width of the parking space or spaces.
(h)
kept free from obstructions, kept clear of snow, and be otherwise maintained to
the same standards as all other parking spaces in the same public parking area.

Also, a separate sign indicating the time limit and penalty as

prescribed in Schedule XXXIII(a).
(3)
Every owner of operator shall provide on one side of each designated parking space, a
space one point five (1.5 m) metres in width, running the length of each designated
parking space. Said space shall be marked in a manner to prevent parking thereon.
(4)
Notwithstanding other provisions of the Section, and only until November 1, 1991, signs
designating reserved stalls may display the symbols and colours as shown in Schedule
XXIII to this By-Law, but provided that one or both of the arrows may be deleted from
the signs.
(5)
Every owner or operator of each public parking area in which signs are located pursuant
to the Highway Traffic Act and this Section shall be responsible for the procurement,
installation and maintenance of the said signs, and for ensuring that said signs conform
with the provisions of the Highway Traffic Act and this Section.
(6)
The driver or operator of a vehicle which displays a permit in accordance with the
requirements of the Highway Traffic Act and the regulations made thereunder and this
By-Law shall not be required to pay an amount in excess of the normal fee paid by other
users of the same parking lots or other parking facilities to which the public has access.
PARKING RESTRICTIONS -RESERVED STALLS
53.
(1)
No person or organization shall:
(a)
park a vehicle in a designated parking space, or
(b)
be entitled to the benefit of an exemption under this By-Law,
unless a currently valid permit has been issued to that person, organization or to a
passenger being picked-up or transported in the vehicle and such permit is displayed on
or in the vehicle in accordance with the requirements of the Highway Traffic Act, the

regulations made thereunder and under Section 55 of this part.
(2)
The provisions respecting the placement of a valid parking permit for the physically
disabled referred to in subsection (1) hereof shall be deemed to be satisfied if a valid
physically challenged permit is placed on the dashboard of the motor vehicle at the
request of a Police Officer, Provincial Offences Officer, or a public parking area owner or
operator.
(3)
Neither public parking area owners nor operators shall authorize any person, other than a
physically challenged person or person conveying a physically challenged person, to park
a motor vehicle in any space reserved for physically disabled persons.
(4)
No person, other than the person to whom it was issued or a person conveying the person
to whom it was issued, shall use or display a parking permit for the physically challenged
issued to p physically disabled person to enjoy the privileges or avoid the restrictions set
out in subsection (1) hereof.
(5)
Notwithstanding the other provisions of the By-Law, a Provincial Offences Officer
appointed for carrying out the provisions of this By-Law does not require the written
complaint of the public parking area owner or operator to enforce the provisions of
subsection (1) hereof.
TIME LIMIT
Amended
54.
Subject to the provisions of Section 54, no person shall park, or permit a vehicle

to remain parked in a designated parking space with a municipal parking lot for a period of time
in excess of two (2) hours, except for handicap parking, which can be up to a maximum of
three hours.
PART D - PARKING ON PRIVATE PROPERTY
DEFINITIONS- PART D
55.
For the purpose of this part:
(1)
"private property" shall include,
(a)
property that has been clearly marked as such by fences, hedges or barriers of
any
kind;
(b)
property on which a legible sign has been erected by or on behalf of the owner,
tenant or occupant forbidding trespassing or parking, or restricting parking
thereon;
(c)
a private road or driveway;
(d)
property owned or leased by the Corporation of the City of Cornwall.
(2)
"owner" when used in relation to property means,
(a)
the registered owner of the property;

(b)
the registered owner of a condominium unit, whose consent shall extend only to
the control of the unit of which he or she is owner and any parking spaces
allotted to him or her by the condominium corporation or reserved for his or her
exclusive use in the declaration or description of the property;
(c)
the spouse of a person described in subparagraph (a) or (b) hereof;
(d)
where the property is included in a description registered under the
Condominium Act, the board of directors of the condominium corporation;
(e)
a person authorized in writing by the property owner as defined in subparagraph
(a), (b), (c), or (d) hereof to act on the owner's behalf for requesting the
enforcement of this part of the By-Law;
(3)
"occupant" means,
(a)
the tenant of the property or part thereof whose consent shall extend only to the
control of the land which he or she is tenant and any parking spaces allotted to
him or her under his or her tenancy agreement;
(b)
a spouse of the tenant;
(c)
a person or a municipality, or a local board thereof, having an interest in the
property under an easement or right-of-way granted to or expropriated by the
person, municipality or local board whose consent shall extend only to the part of
the property that is subject to the easement or right-of-way;
(d)
a person authorized in writing by an occupant as defined in subparagraph (a), (b)
or (c) to act on the occupant's behalf for requesting the enforcement of this part
of the By-Law.
UNAUTHORIZED PARKING PROHIBITED
56.
No person shall cause a vehicle to be parked or left on private property without the express
permission of the owner or occupant thereof.
ENFORCEMENT
57.
(1)
Every person who contravenes Section 58 of this By-Law is guilty of an offence and
upon the written complain of the owner or occupant of the said property, is liable to a
penalty as set forth in Section 68 of this By-Law.
(2)
A Provincial Offences Officer or By-Law Enforcement Officer, in respect of a particular
property, may enforce Section 58 of this By-Law and shall be deemed to have the written
authority of the owner or occupant of the property to enforce this By-Law, and such
Provincial Offences Officer or By-Law Enforcement Officer is not required to receive a
written complaint before enforcing this By-Law.
PART E - FIRE ROUTES
DEFINITIONS- PART E
58.
For the purpose of this part:

(1)
"designated building" means a hospital, shopping centre, public building which is
frequented by the public, Cornwall and Area Housing Authority public housing projects,
and any commercial, industrial or residential building which exceeds three storeys in
building height or 600 m² in building area.

(2)
"fire route" means a route which is continuous along its entire length

and shall extend from a public highway to a designated building and return to a public
highway, and without limiting the generality of the foregoing, included any private
roadway, road, driveway, lane, ramp or other means of vehicular access or egress to or
exit from a designated building and shall include any part of a parking lot set aside by
visible markings or markers for the purpose of motor vehicle movement. Such fire
access route must be indicated in accordance with Section 61 of this By-Law.
(3)
"hospital" shall mean a building used or designed for the use as a hospital, sanatorium,
health centre or dispensary, nursing home, home for the aged, benevolent institution, or
convalescent home, whether public or private, but does not include an institution.
FIRE ROUTE DESIGNATION
Amended
59.
(1)
The authorized fire rout sign shall be as shown in Schedule XXIV of this
163-95
By-Law.
(2)
Fire route signs shall be mounted such that the maximum spacing of the signs does not
exceed 30 metres.
(3)
The fire rout sign must be permanently legible.
(4)
Sign posts and their foundations shall be constructed to hold the fire route signs in their
property and permanent position.
(5)
Fire route signs may be affixed to a building wall, pillar, fence, post or other suitable
backing, at a height of not less than 1.5 metres and not more than 2.5 metres, measured
from the bottom of the sign to the sidewalk or parking lot surface.
(6)
Where conditions do not permit the proper placement of a fire route sign at the height
required under subsection (5) above, the sign is to be placed at a height as close as
possible to the required height, but in no case is the height of the sign to exceed 2.75 m.
(7)
Notwithstanding the provision of subsection (5) above, any official fire route sign
erected or installed prior to July 31, 1987 which does not meet the specified height
requirements shall be considered valid and fully enforceable.
PARKING PROHIBITED
60.
Where authorized signs are displayed, no person shall park a vehicle or permit a vehicle to remain
parked in a fire route.
PART F-ADMINISTRATION AND PENALTIES
ADMINISTRATION

TRAFFIC SIGNS AND SIGNALS
61.
(1)
No unauthorized person shall place, maintain, or display or in view of any highway, any
sign, signal, marking or device which purports to be or is an imitation of, or resembles an
official or authorized sign, or traffic control signal or device, or which conceals from
view or interferes with the effectiveness of an official or authorized sign or traffic control
signal or device.
(2)
No unauthorized person shall move, remove, deface or in any manner interfere with any
sign, traffic control signal, marking or other traffic control device placed, erected, or
maintained under the authority of this By-Law.
(3)
No person shall wilfully drive any vehicle over any marking on the roadway where
markers are in place to indicate that the marking material has been freshly applied, nor
shall any person drive into or over any marker so placed.
AUTHORITY OF TRAFFIC ENGINEER
By-Law
62.
The Traffic Engineer for the Corporation of the City of Cornwall is hereby authorized to place or

erect and to maintain such official or authorized signs and traffic control signals, under section
144(31) of the Highway Traffic Act, or devices and parking meters as are required to give effect
to the provisions of this By-Law or as required to warn or guide traffic for the safety and
convenience of the public.
AUTHORITY OF CHIEF OF POLICE
63.
(1)
The Chief of Police is hereby authorized to erect or place at his discretion temporary "No
Parking " signs on any highway. Temporary changes indicated by the erection of such
signs shall not be effective after the next Council meeting, unless confirmed by resolution
of Council at such meeting, which resolution shall stipulate the length of time such
changes shall be in effect.
(2)
Without limiting the generality of subsection (1), such signs shall be erected in the event
of fires or parades, or while large assemblies are in an auditorium or otherwise, for a
reasonable period of time immediately preceding and following such assemblies,
provided however that such "No Parking" signs shall be erected one hour or more before
such parades or assemblies.
(3)
Notwithstanding any provisions of this By-Law to the contrary, a Police Officer may,
during any emergency or special circumstance, by the erection of appropriate signs or
signals, prohibit or regulate the movement of vehicles on any highway or part of a
highway and no person shall drive or operate a vehicle in contravention of any such sign
or signal.
AUTHORITY OF MANAGER OF PUBLIC WORKS
64.
The Manager of Public Works is hereby appointed as the officer of the Corporation of the City of
Cornwall to issue permits on behalf of the Corporation under Section 93 of the Highway Traffic
Act.
(1)
The Manager of Engineering, Environmental & Construction Services and the Manager
of Municipal Works and Services are hereby authorized to designate a highway or a
portion of a highway as a construction zone under Section 128 (8.1) of the Highway
Traffic Act and Regulations.

PENALTIES
GENERAL PENALTY
65.
Any person who contravenes any of the provisions of this By-Law for which a penalty for the
contravention thereof has not otherwise been provided is guilty of an offence and on conviction is
liable to a fine of not more than Two Thousand ($2000.00) Dollars, and every such penalty shall
be recoverable under the Provincial Offences Act, all the provisions of which shall apply.
By-Law
(1)
When any highway or portion of a highway set out in Schedule XXIX is

marked in accordance with the Regulations under the Highway Traffic Act and
amendments, the said highway or portion of highway shall be designated as a Community
Safety Zone, in accordance with Section 214.1 of the Highway Traffic Act and
amendments. The Community Safety Zone designation shall be in effect during the times,
days and months as set out in column III of Schedule XXIX. Any person who
contravenes the provisions of this By-Law within a community safety zone is guilty of an
offense and, on conviction, is liable to a penalty as outlined in the Highway Traffic Act.
PENALTIES - PROVINCIAL OFFENCES ACT
66.
(1)
Any person violating any of the provisions of Sections 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14,
15, 16, 17, 18, 19, 21, 22, 23, 54(1), 55, 58, or 62 of this By-Law shall be subject to a
penalty of not more than One Hundred ( $100.00) Dollars, exclusive of costs, and every
such penalty shall be recoverable under the Provincial Offences Act, all of the provisions
of which shall apply.
(2)
Where it is alleged that, in respect of a vehicle, there has been a violation of any of the
provisions as in Section 68, subsection (1) of this By-Law, then on any day after the
issuance of the Parking Infraction Notice but before the Certificate of Parking Infraction
has been filed with the Provincial Court, the defendant may pay the set fine for the
offence by mail or in person at 360 Pitt Street, Cornwall, Ontario.
VEHICLES SUBJECT TO REMOVAL
67.
In addition to any other penalties provided by this By-Law, upon discovery of any vehicle parked,
stopped or standing on any highway in contravention of the provisions of this By-Law a Police
Officer, Provincial Offences Officer, or an officer appointed for the carrying out of the provisions
of the Highway Traffic Act may cause such vehicle to be moved or taken to and placed or stored
in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a
lien upon the vehicle being released and may be enforced in the manner provided in Section 52 of
The Mechanic's Lien Act.
LIABILITY OF OWNER
68.
(1)
The owner of a vehicle that is parked, stopped or left standing in contravention of this
By-Law is guilty of an offence unless the owner proves to the satisfaction of the court
that, at the time of the offence, the vehicle was in the possession of another person
without the owner's consent, express or implied.
(2)
The owner of a vehicle shall incur the penalties provided for any contravention of this
By-Law unless, at the time of the contravention, the vehicle was in the possession of
some person other than the owner or his or her chauffeur without the owner's consent,
and the driver or operator of a vehicle not being the owner shall also incur the penalties
provided for any such contravention.

EXCEPTIONS - EMERGENCY AND WORKS VEHICLES
170-04
69.
Sections 4, 5, 6, 8, 9, 10, 11, 12 , 13, 14, 15, 16, 17, 18, 19, 21, 22, 23, 34, 39, 40, 41, 54(1) and
62 shall not, if compliance therewith would be impracticable, apply to:
(a)
an Ambulance, Police or Fire Department vehicle
(b)
a vehicle, the crew of which is engaged in making repairs to a public utility or service; or
(c)
a vehicle actually engaged in works or services undertaken for or on behalf of the
Corporation of the City of Cornwall.

70(1). Sections 21(1), 21(4), 22(1) shall not apply to a vehicle displaying a valid
100-05
Ontario Veterans license plate, and which at the time of parking, was driven by a Veteran or a
Veteran was a passenger therein.
By-Law
70(2). Subsections 21(1) and 21(4) shall not apply when a valid permit, as defined in
040-09
Section 51(3), is being displayed on or in a vehicle in accordance with the requirements of the
Highway Traffic Act and regulations made thereunder, and the vehicle, at the time of parking,
was driven by the permit holder or the permit holder was a passenger therein.
70(3). Notwithstanding the provisions of Section 22(1), 22(1a), 22(1b) and 22(4), a person who holds a
valid permit, as defined in Section 51(3), and such permit is being displayed on or in a vehicle in
accordance with the requirements of the Highway Traffic Act and regulations made thereunder,
and the vehicle, at the time of the parking, was driven by the permit holder or the permit holder
was a passenger therein; shall not park a vehicle or permit a vehicle to remain parked within a
municipal parking lot for more than three (3) hours.
70 (4). Notwithstanding the provisions of Section 15(1), a person who holds a valid permit, as defined in
Section 51(3), and such permit is being displayed on or in a vehicle in accordance with the
requirements of the Highway Traffic Act and regulations made thereunder, and the vehicle, at the
time of the parking, was driven by the permit holder or the permit holder was a passenger therein;
shall not park a vehicle or permit a vehicle to remain parked on any highway at the side and
between the limits set out respectively in Columns 1,2 and 3 of Schedule IV to this By-Law
during the times or days set out in Column 4 of the said Schedule for a longer period than three
(3) hours.
70 (5). Nothing in Section 71.2, 71.3 and 71.4 shall be deemed to permit parking, stopping or standing at
any location where or at any time when, parking, stopping or standing is otherwise prohibited.
GENERAL
APPLICATION OF BY-LAW
71.
This By-Law applies only to highways under the jurisdiction of the Corporation of the City of
Cornwall.
SCHEDULES
72.
The Schedules referred to in this By-Law form part of this By-Law and each entry in a column of
such a Schedule shall be read in conjunction with the entries across therefrom and not otherwise.
REPEAL OF BY-LAWS

73.
(1)
By-Laws No. 1950, 1975 as amended; No. 2026, 1976 as amended; No. 104, 1977 as
amended; No. 21, 1983, No.103, 1983; No. 72, 1984 as amended; No. 78, 1987; and No.
111, 1987 are hereby repealed.
(2)
Notwithstanding the provisions of subsection (1), all signs erected on private property to
restrict or prohibit parking under the provisions of By-Law No.103, 1983 shall be
considered as valid and in effect under Part D of this By-Law.
EFFECTIVE DATE:
74.
Except as provided in Section 76, the provisions of this By-Law shall become effective
September 1, 1989.
M.T.O. APPROVAL
75.
(1)
Those highways listed in Schedule XXV are designated as Connection Link Highways
pursuant to the Public Transportation and Highway Improvement Act.
(2)
The provisions of this By-Law effecting traffic on highways designated as Connecting
Links pursuant to the Public Transportation and Highway Improvement Act shall not
become effective until approved by the Ontario Ministry of Transportation.
