1 THE CORPORATION OF THE TOWNSHIP OF CRAMAHE BY-LAW NUMBER 07-31 BEING A BY-LAW FOR THE REGULATION OF TRAFFIC IN THE TOWNSHIP OF CRAMAHE. WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, Section 11(1) states Municipalities may pass by-laws to regulate highways, including parking and traffic on highways; and WHEREAS the Council of the Corporation of the Township of Cramahe deems it expedient to pass a by-law to regulate traffic within the Township; and WHEREAS a public meeting was held on 17 May 2007 to seek public input on traffic control in Cramahe Township; NOW THEREFORE The Council of the Corporation of the Township of Cramahe HEREBY ENACTS as follows: In this by-law: (a) Words imparting the singular number or masculine gender only, including more persons, parties or things of the same kind than one and females as well as males and the converse. (b) A word interpreted in the singular number has a corresponding meaning when used in plural. (c) "May" to be construed as permissive. (d) "Shall" to be construed as imperative. (e) The various prohibitions of this by-law are cumulative and not mutually self-exclusive. SECTION 1 - DEFINITIONS - FOR THE PURPOSE OF THIS BY-LAW (a) "Boulevard" - means that portion of every street of the Township lying between the curb or edge of the travelled portion of the highway and the street line, exclusive of the area covered by any sidewalk and shall include any ornamental median strip of the highway. (b) "Commercial Motor Vehicle" - Means a motor vehicle having permanently attached thereto a truck or delivery body and including an ambulance, hearse, fire apparatus, police patrol, motor bus or tractor, used for hauling purposes on the highway. (c) "Reduced Speed Zone" - Means a section of a municipal highway that has been designated by council to be assigned a lower speed limit as per Highway Traffic Act Section 128(2) and (3). (d) "Corner" - Means the point of intersection of curbs or edges of that section of the highway used for vehicular traffic. (e) "Crosswalk" - Means that part of a highway at an intersection, or elsewhere, which is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway, measured from the curbs, or in the absence of curbs from the edges of the approved portion of the highway or any portion of a roadway, at an intersection or elsewhere, distinctly indicated for pedestrian crossing by signs or by-laws or other markings on the surface. (f) "Designated Handicapped Parking Space" - means a parking space marked by a sign indicating such space to be for the sole use of a vehicle operated by or conveying a physically handicapped person and in respect of which a permit has been issued. (g) "Director of Public Works" - shall mean the Director of Public Works for the Township of Cramahe (h) "Double Park(ing)" - as applied to a vehicle shall mean to allow that vehicle to remain stationary on the same side of the highway along side and parallel with or nearly parallel to another vehicle already parked or standing or stopped at the curb of such highway except in obedience to traffic regulations, signs or signals. (i) "Gross Weight" - Means the combined weight of vehicle and load. (j) "Heavy Truck" - shall mean a commercial vehicle having a weight of three tonnes or more and shall include construction equipment, farm equipment, repair or towing vehicles and recreational or camping vehicles, but does not include the following; (i) any vehicle of a police or fire department, (ii) any vehicle operated by or on behalf of the Township of Cramahe, 2 (iii) any vehicle operated by or on behalf of the Lakefront Utilities Incorporated, (iv) an in service ambulance, (v) any vehicle operated by or on behalf of Bell Tel., Union Gas or Ontario Hydro, (vi) any passenger vehicle, (vii) any school bus or transient bus which is in the course of transporting people, (viii) recreational vehicle or other facility designed exclusively to provide camping accommodations. (k) "Highway" or "Street" - Includes a common / public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct, or trestle designed and intended for use by the general public for the passage of vehicles. (l) "Intersection" - Means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other. (m) "Park" or "Parking" - When prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. (n) "Pedestrian" - Means a person afoot and/or in wheeled carriages: i.e. - wheelchairs, baby carriages, etc. (o) "Police Officer" - Means a member of the Ontario Provincial Police or a person authorized by them to regulate or direct traffic. (p) "Municipal Law Enforcement Officer" - Means an officer appointed by the Township by- law to enforce the provisions of this by-law. (q) "Municipal Parking Lot" - shall mean a parking lot owned, leased or operated by or on behalf of the Township. (r) "Roadway" - Means the part of the highway that is improved, designed or originally used for vehicular traffic but does not include the shoulder, and where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway and not to all of the roadways collectively. (s) "Set Fine" - means that fine for parking infractions pursuant to the provisions of Part II of the Provincial Offences Act, R.S.O. 1990, Chapter P.33 as amended and as set by the Chief Justice of the Ontario Court of Justice (Provincial Division). (t) "Sidewalk" - Means that portion of a street between the curb lines or the lateral lines of a roadway and the adjacent property lines intended for the use of pedestrians. (u) "Sign" or "Sign, Authorized" - means any sign which is authorized pursuant to the Highway Traffic Act or the Regulations passed there under or the council of the Township or an Official designated by the Council to exercise its authority in this regard. (v) "Stand" or "Standing" - When prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. (w) "Stop" or "Stopping" - When prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal. (x) "Township" - means the Corporation of the Township of Cramahe (y) "Traffic" - Includes pedestrians, ridden or herded animals, vehicles and other conveyances, either singly or together, while using any street for the purpose of travel. (z) "Traffic Control Device" - Means any sign, or roadway, curb or sidewalk marking or other devices, erected or placed under the authority of the Municipal Council, for the purpose of guiding or directing traffic. (aa) "Traffic Signal" - Means any device, manually, electrically or mechanically operated, for the regulation of traffic. (bb) "Treasurer" - shall mean the Treasurer of the Township of Cramahe. (cc) "U-Turn" - Means to turn a vehicle within a roadway so as to proceed in the opposite direction. 3 (dd) "Vehicle" - Includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any other vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle, the cars of electric or steam railways running only upon rails. SECTION 2 - OBEDIENCE TO TRAFFIC REGULATIONS (a) The Municipal Law Enforcement Officer, as appointed by by-law by the Council of the Township shall enforce the provisions of this by-law. (b) Every person shall promptly obey all signals given, either by a police officer or a traffic control device or a traffic signal. (c) The Director of Public Works is hereby authorized to place or erect and to maintain such signs as may be necessary to give effect to the provisions of this by-law or as are required to warn or guide traffic for the safety or convenience of the public. (d) No person shall wilfully move, alter, deface or otherwise interfere with any traffic control device erected or placed pursuant to the provisions of this by-law. (e) The O.P.P. or the Director of Public Works is hereby authorized to erect temporary "NO PARKING" signs for special events that may take place within the Township. SECTION 3 - PARKING (a) No person shall park a vehicle on any street or highway in the Township, other than on a one-way street, unless: 1. That vehicle is parked on the right hand side of the street having regard for the direction in which the vehicle has been proceeding before it stopped, and 2. The right front and right rear wheels are parallel to the right hand curb, and 3. The right front and right rear wheels are not more than six inches (6") from the edge of the roadway. (b) Where parking is permitted on a one-way street, no person shall: 1. Park any vehicle unless that vehicle is facing in the same direction as is the traffic which is to travel on that street. (c) Where "Angle" parking is permitted, no person shall park a vehicle except at an angle of 45° or within the clearly marked lines directing "Angle" parking. (d) No person shall park on an individual parking space unless parked entirely within that individual parking space. (e) No vehicle shall park on any street at any time within the Township in such a way as to obstruct the removal of snow. Any vehicle parked in such a way may be removed in accordance with Section 170(15) of the Highway Traffic Act. 4 SECTION 4 - PROHIBITED PARKING (a) In Specified Places - No Sign Required. No person shall park a vehicle in any of the following places: 1. On a sidewalk, crosswalk or boulevard. 2. In front of a public or private driveway. 3. Within an intersection. 4. Within two (2) meters of a fire hydrant. 5. Within ten (10) meters of a crosswalk or an intersection. 6. On any bridge or the approaches thereto. 7. On any street in such a manner as to obstruct traffic. 8. In such a position as will prevent the convenient removal of any vehicle previously parked or standing. 9. There shall be no overnight parking on any highway or street within the Township between Nov. 1st of one year and April 15th of the following year. Overnight is detailed as between the hours of 11:00 p.m. and 7:00 a.m. Upon the discovery of any vehicle parked or standing in contravention of this section, the Municipal Law Enforcement Officer, Director of Public Works or the O.P.P. may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof are the responsibility of the vehicle owner. 10. In front of the entrance to any place where goods or merchandise are regularly delivered or removed. 11. In a park, unless designated as a parking space. 12. No vehicle shall be parked on any highway for a time period in excess of three (3) hours. In Specified Places Where Signs on Display (b) Fire Station -Where properly worded signs have been erected and are on display, no person shall park a vehicle within ten (10) Meters of the entrance of the Fire Hall on that side of the street on which the fire hall is located, or on the opposite side of the street within ten (10) Meters of the extension of the property lines of the lands on which the Fire Hall is located. (c) Police Reserved - No person shall park a motor vehicle in any parking space which is reserved for the Ontario Provincial Police when properly worded signs are erected and displayed unless the motor vehicle is owned and/or operated by the O.P.P. (d) Wheelchair Reserved - Where properly worded or marked signs are erected and are on display no person shall park a vehicle in a wheelchair reserved parking area at any time without having a wheelchair sticker or licence plates affixed to their vehicle and actually be engaged in discharging or taking on a passenger/passengers who is/are certifiably disabled. Handicapped reserved parking spaces are listed in Schedule 1 attached to and forming part of this by-law. (e) Municipal Office and Library Reserved - Where properly worded or marked signs are erected and are on display no person shall park a vehicle in the Municipal Office or Library parking spaces unless actively engaged in Municipal Office business or actively making use of the Library facilities. The parking spaces are generally located on the 1 Toronto Street property and more particularly located on the south side of the Municipal Office building and the south side of the Library building and in between the Municipal Office and Library buildings. (f) Keeler Centre Reserved - Where properly worded or marked signs are erected and are on display, no person shall park a vehicle in the Keeler Centre parking spaces unless actively engaged in Keeler Centre business. The parking spaces are generally located on the property at 80 Division Street in the Township of Cramahe. (g) Private Property - Where properly worded or marked signs are erected and are on display, no person shall park a vehicle on private property unless permission has been granted by the owner or his agent. A written complaint shall be required from the property owner or agent prior to any action being taken under this section. 5 SECTION 5 - PARKING RESTRICTIONS ON SPECIFIED STREETS (Schedules 2 and 3) (a) Restrictive Parking - When properly worded signs are erected and are on display no person shall park a vehicle on the highways or parts of the highways as set out in Schedule 2 attached to and forming part of this by-law. (b) Parking for Specified Periods - When properly worded signs are erected and are on display, no person shall park a vehicle on the highways at the side and between the limits set out respectively in Columns 1, 2, and 3 for a longer period than that set out in Column 4, of Schedule 3 attached to and forming part of this by-law. SECTION 6 - ONE WAY STREETS (Schedule 4) (a) One - Way Traffic - Upon those highways or parts of highways described in Schedule 4 attached to and forming part of this by-law, vehicular traffic shall move on the direction indicated when signs indicating the direction of traffic have been erected and are on display at every intersection where movement in the opposite direction is prohibited. SECTION 7 - THROUGH STREETS (Schedule 5) (a) The streets set out in Column 1 of Schedule 5 attached to and forming part of this by-law between limits set out in Columns 2 & 3 of the said Schedule are, except as provided in Sub-Section (b) of this section, hereby designated as through streets for the purpose of the Highway Traffic Act (b) The designation in Sub-Section (a) of this section of a street or part of a street as a through street shall not include any intersection thereon where traffic control devices are installed. SECTION 8 - "STOP" STREETS (Schedule 6) (a) The Township shall erect stop signs at the intersection set out in Column 1 of Schedule 6 attached to and forming part of this by-law facing traffic proceeding in the direction set out in Column 2 of the said schedule, on the street or part of street set out in column 3 of the said schedule. SECTION 9 - OPERATION OF VEHICLES (a) Funerals and Other Processions 1. No person shall intersect a funeral, or other properly authorized procession while it is in motion, except under the direction of a police officer. 2. The driver of a vehicle in a funeral or other procession shall drive as near to the right hand edge of the roadway as is practical and follow the vehicle ahead as close as it is practical and safe. (b) Parking of Heavy Trucks 1. Where authorized signs to that effect are displayed at the main highway entrances to the Township, no person shall park a heavy truck as defined in this by-law in areas zoned for residential use, as defined by the zoning by-law of the Township. 2. Any heavy trucks parked in any other part of the Township after dark must use reflective markers at the rear of the trailer and along the side of the trailer closest to the road in an effort to be more visible to all other motorists. 3. The provisions of Section 9(b)(1) shall not apply to any person who is using a heavy truck to make a delivery to or pick up goods from any premises which abut those portions of highways as designated in Section 8(b)(1) above provided that the person that owns or operates the heavy truck parks it in such a manner that it does not obstruct the normal flow of traffic on the highway in question. 4. A recreational vehicle which exceeds 8.5 metres in length may be permitted to park in areas zoned residential use as defined by the zoning by-law of the Township for a period of no more than 72 consecutive hours. ( c) Operation of Heavy Trucks (Schedule 7) 6 1. Where authorized signs to that effect are displayed at the entrance to a roadway, no heavy truck shall drive on that roadway except to make a delivery of merchandise, where no alternative route is available. (d) Reduced Speed Zones (schedule 8) 1. Where council have designated a section of highway as a Community Safety Zone and speed limit signs are properly posted it is an offence under the Highway Traffic Act to exceed the posted speed limit. SECTION 10 - NOTICE OF VIOLATION (a) Where a vehicle is found parked in contravention of the parking provisions of this by-law, the Municipal Law Enforcement Officer so finding the vehicle shall attach to the vehicle a parking ticket in the form of a prepared notice stating: 1. Licence number and concise description of the vehicle. 2. That the vehicle is unlawfully parked with reference to the section of this by-law 3. Date, time and place of the alleged offence 4. That the owner or operator thereof may report to the Municipal Office within seven (7) days, exclusive of Saturdays, Sundays and holidays, after the date when the ticket is attached, to make payment of the penalty 5. That in the event of failure to so report and make such payment, a Notice of Impending Conviction will be issued under the Provincial Offences Act. (b) The parking ticket shall be prepared in duplicate and the officer shall attach one copy to the vehicle and keep one copy himself. (c) The owner or operator of the vehicle may, within seven (7) days, exclusive of Saturdays, Sundays and holidays, after the ticket is attached to the vehicle, report to the Municipal Office and voluntarily pay such payment indicated in Schedule 7 which shall be accepted as payment of the penalty in full satisfaction in respect of the alleged offence and a receipt therefore shall be given to the person making the payment. (d) If voluntary payment is not made in accordance with the procedure provided in Section 10 (a) and (c), the procedure of the Provincial Offences Act and the penalties provided for under this by-law, alleged to have been contravened, shall apply. (e) Upon presentation of each parking infraction notice, and if voluntary payment is duly made, no further proceedings against the defendant for such violation shall be taken. (b) The parking ticket shall be prepared in duplicate and the officer shall attach one copy to the vehicle and keep one copy himself. (c) The owner or operator of the vehicle may, within seven (7) days, exclusive of Saturdays, Sundays and holidays, after the ticket is attached to the vehicle, report to the Municipal Office and voluntarily pay such payment indicated in Schedule 7 which shall be accepted as payment of the penalty in full satisfaction in respect of the alleged offence and a receipt therefore shall be given to the person making the payment. (d) If voluntary payment is not made in accordance with the procedure provided in Section 10 (a) and (c), the procedure of the Provincial Offences Act and the penalties provided for under this by-law, alleged to have been contravened, shall apply. (e) Upon presentation of each parking infraction notice, and if voluntary payment is duly made, no further proceedings against the defendant for such violation shall be taken. SECTION 11 - GENERAL (a) This by-law where it applies to highway, only applies to highways under the jurisdiction of the Township. (b) Schedules 1 to 6 inclusive annexed hereto and forming part of this by-law and each entry in a column of each schedule shall be read in conjunction with the entry or entries across there from and not otherwise. (c) No person shall place, maintain or display upon or in view of any street/highway , any sign, signal or marking or device which purports to be or is in imitation of or resembles any traffic control device which conceals from or interferes with the effectiveness of any traffic control device. 7 (d) No person shall wilfully move, alter, deface or otherwise interfere with any traffic control device erected or placed pursuant to the provisions of this by-law. (e) Where any vehicle is parked in contravention of any provision of this by-law, the Municipal Law Enforcement Officer may cause it to be moved or taken and placed in storage pursuant to the provisions of Section 63(1) of the Municipal Act, S.O. 2001 c.25 and the costs for removing and storing the vehicle shall be a lien upon the vehicle which may be enforced in the manner provided in the Repair and Storage Lien Act, R.S.O. 1990. (f) For the purpose of this by-law, where a numbered plate issued pursuant to the provisions of Section 7 of the Highway Traffic Act, R.S.O. 1990, is exposed on a vehicle, the holder of the permit corresponding thereto shall be deemed to be the owner of that vehicle unless the numbered plate was exposed on that vehicle without the permit holder's consent and the burden of proof is on the permit holder. (g) The owner of a vehicle that is parked, stopped or left standing in contravention of this by- law as the case may be is guilty of an offence and on conviction is liable to such fines as provided in this by-law unless the owner proves to the satisfaction of the Court that at the time of the offence the motor vehicle was in possession of another person without the owner's express or implied consent. (h) No person shall coast, whether on a sleigh, skateboard, bicycle, cart, express wagon, inline skates, scooter or toboggan on sidewalks and municipal parking lots within the Township. (i) No person shall move or operate a vehicle other than a police or fire department vehicle on any street or lane within 150 Meters of a fire, fire apparatus or firefighting equipment, except as directed by a constable or firefighter. No person shall drive a vehicle over a fire hose on any street unless authorized by a constable or firefighter. (j) No person shall, except under the direction of a police officer, drive or operate a vehicle on a highway between vehicles comprising a funeral cortege or other procession recognizable as such by the display of pennants or other identifying insignia while the vehicles in such processions are in motion. (k) A pedestrian crossing a highway shall yield the right-of-way to all vehicles upon the roadway, but nothing in this section shall relieve the driver of a vehicle from the obligation of taking all due care to avoid an accident. (l) No person shall play or take part in any game or sport upon a highway, and where there are sidewalks, no person upon roller skates, skateboards or riding in or by means of any coaster, toy vehicle, toboggan or similar device shall go upon a highway except for the purpose of crossing it, and when so crossing, such person shall have the rights and be subject to the obligations of a pedestrian. SECTION 12 - PENALTIES FOR VIOLATIONS UNDER THE PROVINCIAL OFFENSES ACT (Schedule 9) (a) Any person who contravenes any provision of this by-law is guilty of an offence and on conviction is liable to a fine as provided for in the Provincial Offences Act, and all such penalties shall be recoverable under the Provincial Offences Act, and all the provisions of the Provincial Offences Act shall apply hereto. (b) Notwithstanding any other provisions of this by-law, where it is alleged that there has been in respect of any vehicle a violation of any of the provisions of Sections 3, 4, 5, 6, 7 and 10 of this by-law and notice of such alleged violation has been given to the owner or driver of such motor vehicle by means of a parking infraction notice, issued by the Municipal Law Enforcement Officer and attached to or left on such vehicle, or delivered to the operator thereof, the defendant or any person on his/her behalf may, within seven (7) days, in person or by mail, at the Municipal Office, P.O. Box 357, Colborne, Ontario, K0K 1S0, after the time and date marked on such parking infraction notice voluntarily pay the by-law payment of : (a) the sum of ten dollars ($10.00) in respect of each violation of Sections 3(a)(1), 3(b)(1), 3(c), 3(d), 4(a)(1), 4(a)(2), 4(a)(3), 4(a)(4), 4(a)(5), 4(a)(6), 4(a)(7), 4(a)(8), 4(a)(10), 4(a)(11), 4(a)(12), 4(b), 5(a), and 5(b)of this by-law. (b) the sum of twenty-five dollars ($25.00) in respect of each violation of Section 4(a)(9) and 9(b)(1). 8 (c) the sum of two hundred dollars ($200.00) in respect of each violation of Section 4(d). SECTION 13 - EFFECTIVE DATE OF THIS BY-LAW This by-law shall become effective on the date of passing and proper signs referred herein have been erected and are on display. Township of Cramahe By-Law 05-49 is hereby repealed.
