THE CORPORATION OF THE TOWNSHIP OF CRAMAHE
BY-LAW NO. BL-2026-27
Being a By-law to provide for Rates of Speed Within the Township of Cramahe.
WHEREAS the Municipal Act, 2001, Chapter 25, as amended, Section 5 (3),
states that municipal power, including a municipality's capacity, rights, powers
and privileges, shall be exercised by by-law unless the municipality is specifically
authorized to do otherwise; and
WHEREAS Section 128(2) of the Highway Traffic Act, R.S.O. 1990, c. H.8 allows
that the council of a municipality may by by-law prescribe a rate of speed
different from the rate set out in Section 128 (1) for motor vehicles driven on a
highway or portion of highway under its jurisdiction; and
WHEREAS Section 8 of the Municipal Act, 2001, Chapter 25, as amended,
provides that a municipality has the authority to govern its affairs as it considers
appropriate and enables the municipality to respond to municipal issues; and
WHEREAS Section 9 of the Municipal Act, 2001, Chapter 25, as amended,
provides that a municipality has the capacity, rights, powers and privileges of a
natural person for the purpose of exercising its authority under this or any other
Act; and
WHEREAS the Council for the Corporation of the Township of Cramahe deems it
advisable that the speed limit for motor vehicles on portions of certain highways
in the municipality be either decreased or increased; and
WHEREAS the provisions of this By-law shall be subject to the provisions of the
Highway Traffic Act, Chapter H.8, R.S.O. 1990, as amended from time to time,
NOW THEREFORE BE IT RESOLVED THAT the Council of The Corporation of
the Township of Cramahe hereby enacts as follows:
1. THAT Schedule A, attached hereto and forming part of this by-law,
and which may be amended from time to time, set out the rates of
speed for specific portions of highways under the jurisdiction of the
Municipality.
2. THAT By-law 2025-56 and all other amendments be hereby
repealed.
Read a first, second and third time and finally passed this 23rd day of June,
2026.
