## PROVINCIAL OFFENCES ACT ## Part II IT IS ORDERED pursuant to the provisions of the Provincial Offences Act and the rules for the Ontario Court of Justice, that the amount set opposite each of the offences in the schedule of offences under the Provincial Statutes and Regulations thereunder and Municipal By-law 47-17 as amended of the Corporation of the Town of Deseronto, attached hereto is the set fine for that offence. In This By-law: - (1) "Accessible Person Parking Permit" means a valid permit for a Person with a Disability as issued by the Ontario Ministry of Transportation or by another jurisdiction; - (2) "Accessible Person Parking Zone" means a parking space designated by pavement markings and/or authorized signs for the exclusive use of a Motor Vehicle displaying an Accessible Person Permit in accordance with the requirements of the Highway Traffic Act, as amended, the regulations made thereunder and this Bylaw. - (3) "Authorized Sign", means a sign erected at the side of or above a road to give instructions or provide information to road users. - (4) "Boulevard" shall mean the untraveled portion of the road allowance, including the sidewalk, which is not intended for use by vehicular traffic. - (5) "Business Improvement Area" shall mean the entire Town of Deseronto with the exception of the lands zoned under the Zoning By-law for the Town of Deseronto for a manufacturing use. - (6) "Commercial Business District" shall mean the area bounded by and including Mill Street to the west, Thomas Street to the north, Prince Street to the east and Main Street to the south. - (7) "Commercial Motor Vehicle" means a vehicle having a weight, when unloaded, is one tonne or more, when loaded, is 3 tonnes or more, but does not include a passenger vehicle, an ambulance, a hearse, a casket wagon or any vehicle of a Police or Fire Department. - (8) "Court" means a Provincial Offence Court or, where jurisdiction in respect of the offence is conferred upon a Provincial Court (Family Division) by any other Act, the Provincial Court (Family Division). - (9) "Corner" means the point of intersection of curbs or edges of the travelled portion of the highway used for vehicular traffic. - (10) "Crosswalk" shall have the same meaning as defined in the Highway Traffic Act, R.S.O. 1990 c.H.8 as am. ## THE CORPORATION OF THE TOWN OF DESERONTO ## BY-LAW NUMBER 47-17 Being a By-law to regulate traffic and parking in the Corporation of the Town of Deseronto. The Council of the Corporation of the Town of Deseronto enacts as follows: ## Part I - DEFINITIONS - (11) "Curb" includes the edge of the travelled portion of the roadway. - (12) "Driveway" shall mean that part of the sidewalk or boulevard used as a vehicular access to a parking lot, or to private or public property. - (13) "Emergency Vehicle" includes an ambulance, police vehicle and fire apparatus. - (14) "Highway" shall have the some meaning as defined in the Highway Traffic-Act, R.S.O. 1990 c. H.8. as am. - (15) "Holiday" means New Year's Day, Family Day, Good Friday, Easter Sunday, Victoria Day, Canada Day, Civic Holiday (first Monday in August), Labour Day, Thanksgiving Day, Christmas and Boxing Day; if New Year's Day or Canada Day falls on a Saturday or Sunday then the following Monday is also a holiday; if Christmas Day falls on a Friday then the following Monday is also a holiday; and if Christmas Day falls on a Saturday or Sunday then the follow Monday and Tuesday are also holidays. - (16) "Intersection" means "the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other. - (17) "King's Highway" includes the secondary highways and tertiary roads designated under The Public Transportation and Highway Improvement Act, R.S.O 1990 c.PSO. - (18) "Lot" means a parcel of land. - (19) "Motor assisted bicycle" shall have the same meaning as defined in the Highway Traffic Act, R.S.O. 1990 c.h. 8 as am. - (20) "Motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor scooter but does not include a motor assisted - (21) "Motor Vehicle" includes an automobile, bus, motorcycle, motor assisted bicycle, motor scooter truck and any other vehicle propelled or driven other than by muscular power, but does not include an electric bicycle, a traction engine, farm tractor, other farm vehicle, or machine used for road construction or maintenance. 12. "Municipal Law Enforcement Officer" means a person(s) appointed to enforce the provisions of this By-law and includes a Peace Officer employed with the Deseronto - (23) "One Way Street" means a street upon which vehicular traffic is limited to movement in one direction. - (24) "Operator" means a person who operates a Motor Vehicle on a Highway. - (25) "Park" or "Parking" shall have the same meaning as defined in the Highway Traffic Act, R.S.O. 1990 c.H.8 as am - (26) "Parking Infraction" means any unlawful parking, standing or stopping of a vehicle that constitutes an offence under this By-law. - (27) "Parking Space" means a portion of a parking space zone designated as such by suitable markings on the surface of the street. - (28) "Pedestrian" means a person afoot, in a wheelchair and a child in a baby carriage. - (29) "Pedestrian Crosswalk" shall have the same meaning as defined in the Highway Traffic Act, R.S.O. 1990 c.H.8 as am. - (30) "Private Roadway" shall mean any privately owned road, lane, ramp or other means of vehicular access to or egress from a building or structure and it may include a parking lot. - (31) "Police Officer" means a member of a Police Service or a person authorized by the Chief Constable to regulate or direct traffic. - (32) "Provincial. Offences Officer" means a Police Officer or a person designated under Section 1(2) of the Provincial Offences Act, R.S.O. 1990 c.P. 33, as amended from time to time. - (33) "Recreational Vehicle" a vehicle designed for recreational use (as in camping) - (34) "Roadway" shall have the same meaning as defined in the Highway Traffic Act, R.S.O. 1990 c.H.8 as am. - (35) "Service Vehicle" includes a marked vehicle operated by members of the Public Works or Water and Waste Water Department of the Corporation of the Town of Deseronto. - (36) "Sidewalk" means that portion of a street between the curb lines or the lateral; lines of a roadway and the adjacent property line intended for the use of pedestrians. - (37) "Stand" or "Standing" means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in the receiving or discharging passengers or merchandise. - (38) "Stop" or "Stopping" means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer, a Provincial Offence Officer, Municipal By-law Enforcement Officer, or of a traffic control sign or signal. - (39) inster or transe "Through Highway" means a highway or part of a highway designated as such by the Minister of Transportation or by this By-law, and every such highway shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry of Transportation. - (40) "Town Employee" means any person employed by the Town of Deseronto. - (41) "Traffic" shall include pedestrians, ridden or herded animals, vehicles and other conveyances either singly or together while using any highway for the purpose of travel. - (42) "Traffic Control Signal" means any device, manually, electrically or mechanically operated for the regulation of traffic. - (43) "Traffic Official" means an individual appointed by the Council of the Corporation of the Town of Deseronto who is authorized to place, erect or maintain Authorized Signs and Traffic Control Signals and includes a member of the Department of Public Works. - (44) "Turning Basin" means a roadway that terminates in a circular manner. - (45) "Vehicle" shall have the same meaning as defined in the Highway Traffic Act, R.S.O. 1990 c.H.8 as am. - (46) "Wheelchair" shall have the same meaning as defined in the Highway Traffic Act, R.S.O. 1990 c.H.8. as am. ## 2. Interpretation - General 2.1 This by-law applies to all Town streets, alleys, municipal parking lots, and all other property owned or occupied by the Town of Deseronto, and those private properties identified within this by-law, as defined here-in. ## PART II - REGULATION OF TRAFFIC ## Traffic Signs and Signals 3. Traffic Officials appointed by the Council of the Corporation of the Town of Deseronto are authorized to place, erect and maintain such Authorized Signs and Traffic Control Signals as are required to give effect to the provisions of this By-law or as are required to warn or guide Traffic for the safety and convenience of the general public. 4. No person shall place, maintain, or display upon or in view of any road any sign, signal, marking or device, which purports to be or is an imitation of or resembles an Authorized Sign or Traffic Control Signal,; or which conceals from view or interferes -with the effectiveness of an Authorized Sign or Traffic Control Signal. 5. The erection of Traffic Control Signals and Stop Signs is hereby authorized at the Intersections or locations set out in Schedule A of this By-law. 6. The Highways set out in Column 1 of Schedule B to this By-law, between the limits set out in Column 2 of the said schedule are designated as Through Highways for the purpose of the Highway Traffic Act, R.S.O. 1990, cH-8 as am. ## PART III - STOPPING & PARKING REGULATIONS 7. (1) No person shall Park or Stop any Vehicle on any Roadway carrying two-way Traffic or any portion thereof except as follows: 2. (a) Where there is a raised Curb, on the right side on the travelled portion of the Roadway, having regard to the direction such Vehicle was proceeding, with its right front and rear wheels parallel to and not more than 30.0 centimeters out from such Curb; 3. (b) Where there is no Curb or a rolled Curb, with the right front and rear wheels parallel to and as near to the right-hand limit of the Roadway as is practicable without Stopping or Parking over a Sidewalk or footpath Or over any part of the Roadway where grass is grown or which is not intended for the use of Vehicles. - (2) No person shall Park or Stop any Vehicle on any Roadway carrying one-way Traffic or any portion thereof except as follows: 5. (a) Where there is a raised Curb on either side of the travelled portion of the Roadway, with its outside front and rear wheels parallel to and no more than 30.0 centimeters out from such Curb; 6. (b) Where there is no Curb or a rolled Curb, with its outside front and rear wheels parallel to and as near to the outside limit of the Roadway as is practicable without Stopping or Parking over a Sidewalk or footpath or over any part of the Roadway where grass is grown or which is not intended for the use of Vehicles; 7. (C) Centennial Park Road south side, in a manner where Authorized Signs to that effect are displayed. 8. The provisions of Section 7 do not apply to Emergency Vehicles, hearses or Service Vehicles. 9. No person shall on any Highway Stand, Stop or Park any Vehicle. - (1) on or over any Sidewalk, Boulevard, Crosswalk or footpath. - (2) within an Intersection or Crosswalk. - (3) alongside or across the Highway from any excavation or obstruction in the Roadway when free flow of Traffic would thereby be impeded. - (4) on the Roadway side of any Stopped or Parked Vehicle. - (5) upon any bridge or elevated structure except for the specific purpose of the disembarking or picking up of passengers or parcels. - (6) To obstruct the flow of traffic 10. No person shall on any Highway Park any Vehicle; - (1) facing the opposite direction of traffic - (2) so as to obstruct Vehicles in the use of a Driveway or laneway, and in any event not closer than 1.5 metres to the edge of the Driveway or laneway. - (3) within 3.0 metres of a point on the Curb or edge of the Roadway opposite any fire hydrant. - (4) within 7.5 metres of an Intersection. - (5) on any Roadway where the Roadway width is less than 6.0 metres. - (6) between the hours of 12:00 midnight and 8:00 a.m. from December 1st to March 31st of the following year. - (7) for the purpose of displaying the Vehicle for sale. - (8) for the purpose of washing, greasing or repairing the Vehicle, except for such repairs as have been necessitated by an emergency. - (9) in front of an entrance to or exit from any building or enclosed space in which persons may be expected to congregate in large numbers, such as a hotel, theatre or auditorium. - (10) in such a position as will prevent the removal of any other Vehicle previously parked. - (11) so as to interfere with the formation of a funeral procession. - (12) where Authorized Signs to the effect are displayed - (13) directly in front of a fire hall or police station. 11. No person shall Park any Vehicle in a Parking Space designated "Police Only" at any time, unless it is a Police Vehicle. 12. No person shall Park any Vehicle in such a manner that it is not wholly within a Parking Space; however, if such Vehicle is of such length as to prevent it from being Parked within one Parking Space, then the person Parking the same may lawfully occupy one or more Parking Spaces as required 13. No person shall park a Commercial Motor Vehicle outside of the Commercial Business District of the Town of Deseronto for a longer period of time than 90 minutes. 14. Where Authorized Signs to that effect are displayed, no person shall Park a Vehicle on any Highway in the Commercial Business District, between the hours of 8:00 o'clock a.m. and 6:00 o'clock p.m. for a period in excess of 2 hours at any time excepting that period between Saturday at 6:01 o'clock p.m. and Monday 7:59 o'clock a.m. inclusive. 15. No person shall Park a boat trailer or a camping trailer on the "Park Roadway" running parallel to Centennial Park. 16. No person shall park or leave an unattached trailer of any kind on a street. 17. No person shall park a recreational vehicle of any kind on any street 18. No person shall Park a Vehicle within 7.5 metres of the lot on which a fire hall is located on that side of the street on which such fire hall is located or within 30 metres of such lot on the opposite side of said street unless the person is a volunteer firefighter. 19. The provisions of Section 18 do not apply to Emergency Vehicles, hearses, or Service Vehicles. ## Stopping for Resale of Goods, Etc. 20. (1) No person who sells, offers for sale or takes orders for goods, wares, merchandise or produce from a Vehicle shall for the purpose of carrying on his/her business, Stop the Vehicle on any Roadway between two intersecting Roads for more than thirty minutes on any one day, or for more than ten minutes at any one location. - (2) Nothing in this section shall be deemed to permit the Stopping or Parking of a Vehicle where Stopping or Parking is prohibited ## Loading Zone 21. No person shall Park any Vehicle on a Roadway at a place marked by an Authorized Sign as a passenger or freight loading zone during the time shown on such sign, unless the person is Parked there for the purpose of loading or discharging passengers or freight. ## School Zone 22. Where Authorized Signs to that- effect are displayed, no person shall Park any Vehicle on either side of the portion of Roadway adjacent to a school or playground. ## Accessible Parking Zones 23. When authorized signs have been erected, no person shall park or stop a vehicle or permit a vehicle to remain parked or stopped in an Accessible Person Parking Zone other than a vehicle clearly identified as a mode of transportation by way of an Accessible Person Parking Permit clearly visible on the dash board of the vehicle. The identification is valid only if an accessible person is either the driver of the vehicle or a passenger in the vehicle. 24. "No Parking" and "No Stopping" Signs may be erected by a Police Officer or Town Employee in the event of emergency, approved parades, special events or funerals on any Highway or portion thereof during such time or times as may be deemed necessary for the proper and orderly control and regulation of Traffic for the safety of Pedestrians. No person shall Park or Stop, as the case may be, where prohibited by Authorized Signs erected pursuant to this section. ## Restricted Parking on Municipal Property 25. No person shall Park a Vehicle in such a manner as to interfere with necessary civic services such as road repairing, snow ploughing or snow removal that already is in progress, nor Park a Vehicle at any place where Authorized Signs have been placed indicating any snow removal or other civic operations are to be commenced 26. Where Authorized Signs to that effect are displayed, no person shall Park or leave a Motor Vehicle on municipal property. ## PART IV - ENFORCEMENT, OFFENCES AND PENALTIES ## 27. Offences Punishable by the Highway Traffic Act - 27.1 Every person who contravenes any provision of this bylaw is guilty of an offence and upon conviction is liable to a fine as provided for by the Provincial Offences Act, R.S.O. 1990, Chapter P. 33, as amended. 28. Fines and Penalties (Public Property) - 28.1 Subject to any other provision of this by-law, any person who contravenes the provisions of this By-law, for violations of parking, stopping or standing offence, shall be subject to a penalty as per Schedule D. ## 29. Payment of Parking Penalties - 29.1 Notwithstanding all other provisions of this by-law in respect to penalties for violations of sections of this by-law, any person may, upon presentation of a ticket at the office listed on the ticket issued alleging commission of any of the offences provided in the said sections, pay out of court within fifteen calendar days from the date of issue of the said ticket the set fine provided for such offence by this by-law at the office listed on the ticket and upon such payment no further proceedings shall be taken under this by-law in respect to the said offence alleged in the ticket. The receipt for payment signed by the person assigned to the duty of receiving payments shall be evidence of payment of the penalty provided for the violation. In addition to the above provisions, a person may make an early payment within seven (7) days of the date of the infraction as specified in the "Table of Fines and Penalties". ## 30. Volunteer Payment of Parking Penalties (Public Property) - 30.1 Notwithstanding all other provisions of this by-law in respect to penalties for violations of parking, stopping or standing offence under this By-law, any person may, upon presentation of a ticket at the office listed on the ticket issued alleging commission of any of the offences provided in the said sections, pay out of court within fifteen calendar days from the date of issue of the said ticket the set fine provided for such offence by this by-law at the office listed on the ticket and upon such payment no further proceedings shall be taken under this by-law in respect to the said offence alleged in the ticket. The receipt for payment signed by the person assigned to the duty of receiving payments shall be evidence of payment of the penalty provided for the violation. Volunteer Payment of Parking Penalties (Private Property) - 31.1 Notwithstanding all other provisions of this by-law in respect to penalties for violations of parking, stopping or standing offence under this By-law, any person may, upon presentation of a ticket at the office listed on the ticket issued alleging commission of any of the offences provided in Section 15 hereof, pay out of court within fifteen calendar days from the date of issue of the said ticket the set fine provided for such offence by this by-law at the office listed on the ticket and upon such payment no further proceedings shall be taken under this by-law in respect to the said offence alleged in the ticket. The receipt for payment signed by the person assigned to the duty of receiving payments shall be evidence of payment of the penalty provided for the violation. In addition to the above provisions, a person may make an early payment within seven (7) days of the date of the infraction as specified in the "Table of Fines and ## 32. Vehicles Subject to Removal when Illegally Parked 32.1 In addition to any other penalties provided by this by-law, upon discovery of any vehicle parked, stopped, or standing on any roadway in contravention of the provisions of this by-law, a police officer or by-law enforcement officer may cause such vehicle to be moved or taken to and placed or stored in a suitable place and all costs and charges for the removing, care and storage, thereof, if any, are in lien upon the vehicle being released and may be enforced in the manner provided by the Repairs and Storage Liens Act and subsequent regulations. ## 33. Liability of Owner 33.1 The owner of a vehicle shall incur the penalties provided for any contravention of this bylaw unless at the time of the contravention, the vehicle was in the possession of some person other than the owner or his chauffeur without the owner's consent and the driver or operator of a vehicle not being the owner shall incur the penalties provided for any such contravention in accordance with the Highway Traffic Act. ## PART V - APPLICATION AND ADMINISTRATION ## 34. Enforcement - 34.1 This by-law shall be enforced by a Police Officer, Special Constables and/or designated By-Law Enforcement Officers of the Town of Deseronto. 35. Application of By-law - 35.1 This by-law applies to all roadways and property under the jurisdiction of the Town of Deseronto and those private properties identified within this by-law. 36. By-law Subject to the Highway Traffic Act 2. 36.1 The provisions of this by-law are subject to the provision of The Highway Traffic Act. 37. All Parts of this By-law in Force 4. 37.1 All parts of this by-law shall come into force and take effect on the day of its final passing thereof. 5. 37.2 In the event of a conflict between the provision of this bylaw and the Highway Traffic Act, the provisions of said Act prevail. 38. Schedules 7. 38.1 Schedules A to Schedule D inclusive forms a part of this By-law as if each of these Schedules were included in the body of the By-law. 39. Short Title 9. 39.1 This by-law shall be referred to as the "Parking Bylaw". 40. By-law Repealed 11. 40.1 Bylaw number 6-97 hereby repealed. 41.
