CORPORATION OF THE TOWN OF DESERONTO
BY-LAW NO. 33-24
A by-law respecting water and wastewater service charges in the Town of Deseronto.
WHEREAS The Corporation of the Town of Deseronto (the "Town) owns, operates and maintains the Deseronto Water & Wastewater Treatment Plants.
AND WHEREAS Section 11(3) of the Municipal Act, 2001, S.O. 2001, Chapter 25 authorizes the Town to pass by-laws respecting public utilities that include water and wastewater works and services;
AND WHEREAS Section 391(1) and (2) of the Municipal Act, 2001, authorizes the Town to pass by-laws imposing fees or charges on persons
(a) for services or activities provided or done by or on behalf of it;
(b) for costs payable by it for services or activities provided or done by or on behalf of any other municipality or any local board; and
(c) for the use of its property including property under its control. 2006, c. 32, Sched. A, s. 163 (1).
A fee or charge imposed for capital costs related to services or activities may be imposed on persons not receiving an immediate benefit from the services or activities but who will receive a benefit at some later point in time.
AND WHEREAS Council deems it necessary to adjust the water charges and other related charges to the users;
NOW THEREFORE the Council of the Corporation of the Town of Deseronto (the "Town') hereby enacts as follows:
THAT Schedule A of this By-law be implemented as water and sewer charges and other related charges.
AND THAT the rates included in Schedule A to this by-law shall come into force for the fourth billing of 2024 and apply to all water and sewer used since the last meter readings undertaken for the Town.
AND THAT this bylaw come into force and take effect immediately upon passing.
AND THAT this bylaw takes precedent over any by-law inconsistent with this bylaw.
AND THAT bylaw 46-20 be repealed and replaced by this bylaw.
READ a first, second and third time and finally passed this 14th day of August 2024.

SCHEDULE "A"
Water and Sewer Charges for the fourth billing of 2024 and onward
Residential and Commercial rates indicated below are for a two month period
Base Charges
20 mm meter or less $ 46.94

(Where multiple meters /compound meter are installed on the same service line, the customer shall pay the base rate for the largest meter only.)

Metered Billing - All Customer Classes
Flat Rate - Minimum bill based on meter size, applicable only where it is impractical to install a meter.
Meter Refusal - Where a resident refuses to allow a water meter to be placed on the property and it is deemed practical to do so, the minimum water and sewer bill will be two times the flat rate.
Multi-Residential and Commercial
Services for residential, commercial, industrial or institutional buildings (15 mm meter size and over) with no apartments, shall be billed a base charge (based on meter size) + 40 m3 commodity charge + commodity charge for any use greater than 40 m3 + the sewer bill at 86% of total water charges.
Services for multi-residential buildings with a single service and meter shall be billed a minimum (20 mm base charge PLUS a 40 m3 commodity water charge), multiplied by the number of dwelling units in the building.
Service Charges
Water Meter - Town cost for meter plus inspection fee of $50.00
Meters shall be installed by customer's plumber at customer's expense
Turn water service on and/or off at the street per event (unless it is on the same day) $30.00
(normal weekdays, 8 am to 4 pm)
Above service charges during holidays and weekends $100.00
Lawn Watering Restrictions - June 15th to September 15th
(i) On that side of the street where the municipal numbers are odd, lawns and gardens may be watered on odd-numbered days of the calendar month
(ii) On that side of the street where the municipal numbers are even, lawns and gardens may be watered on even-numbered days of the calendar month
