## ARTICLE I
## Sewer Service Rents [Adopted 9-1-1948 by By-law No. 436]
## § 203-1. Sewer service rents established; exemption.
- A. Persons who own or occupy land within the limits of the Town of Dryden which is drained or required by by-law to be drained into the sewerage system of the Town of Dryden shall be charged the following sewer service rents:
- (1) For domestic sewer service connections: $10 per annum.
- (2) For other than domestic sewer service connections: such rate as fixed by resolution of the Municipal Council of the Town of Dryden.
§ 203-15. Offences.
- B. No rate or rent in respect of the cost of a sewer shall be charged where local improvement rates for the sewer have been or are being levied.
## § 203-2. Collection of rents.
All sewer rents shall form a lien and charge upon the real estate upon or in respect of which the same have been assessed and rated or charged and shall be collected in the same manner and with the like remedies as ordinary taxes on real estate are collected under the provisions of the Assessment Act.!
## § 203-3. Outside sewer service rents. [Added 9-1-1948 by By-law No. 437]
- A. Persons who own or occupy land outside of the limits of the Town of Dryden who desire sewer connections to existing Town of Dryden sewers may, on application to the Council of the Corporation of the Town of Dryden, be granted permission to connect private sewers to town sewerage system on the completion of an agreement in the prescribed form and the payment of the following sewer service charge:
- (1) For each domestic service connection: $30 per annum.
- (2) For service connections other than domestic: such rate as may be set by resolution of the Municipal Council of the Corporation of the Town of Dryden.
- B. All sewer service charges shall be payable annually in advance.
- C. Drain connection or connections to the Town of Dryden sewers shall be made by the Town Sewer Department, and the applicant shall pay to the said Town of Dryden all costs incurred on this account.
## ARTICLE II
## Sewage Service Rate [Adopted 9-9-1996 by By-law No. 2453-962 ]
## § 203-4. Imposition of rate.
A sewage service rate shall be imposed on all owners or occupants of land who use the municipal sewage works.
## § 203-5. Yearly rate; collection.

## ARTICLE III
## Regulation of Discharges [Adopted 6-7-1977 by By-law No. 1346-773 ]
## § 203-6. Definitions.
As used in this article, the following terms shall have the meanings indicated:
BIOCHEMICAL OXYGEN DEMAND -- The quantity of oxygen utilized in the biochemical oxidation of matter in five days at 20° C.
COLOUR OF A LIQUID - The appearance of a liquid from which the suspended solids have been removed.
COMBINED SEWER -- A sewer intended to function simultaneously as a storm sewer and a sanitary sewer.
MATTER - Includes any solid, liquid or gas.
MUNICIPALITY -- The Corporation of the City of Dryden.
pH -- The logarithm to the base 10 of the reciprocal of the concentration of hydrogen ions in grams per litre of solution.
PHENOLIC COMPOUNDS -- Those derivatives of aromatic hydrocarbons which have a hydroxyl group directly attached to the ring.
SANITARY SEWER -- A sewer for the collection and transmission of domestic, commercial and industrial sewage or any of them.
SEWAGE -- Any liquid waste containing animal, vegetable or mineral matter in solution or in suspension, except uncontaminated water
SEWAGE WORKS -- Any works for the collection, transmission, treatment or disposal of sewage, or any part of any such works.
STANDARD METHODS -- A procedure set out in "Standard Methods for the Examination of Water and Wastewater" published jointly by American Public Health Association, American Water Works Association and Water Pollution Control Federation, current at the date of testing, or a procedure approved by an analyst of the Ministry of the Environment.

STORM SEWER - A sewer for the collection and transmission of uncontaminated water, stormwater, drainage from land or from a watercourse or any of them.
STORMWATER - Water from rainfall or other natural precipitation or from the melting of snow or ice.
SUSPENDED SOLIDS - Solid matter in or on a liquid, which matter is removable by filtering.
UNCONTAMINATED WATER - Water to which no matter has been added as a consequence of its use, or to modify its use, by any person.
## § 203-7. Prohibited discharges into sewage works.
No person shall discharge or deposit or cause or permit the discharge or deposit into land drainage works, private branch drains or connections to any sanitary sewer or combined sewer matter of any type or at any temperature or in any quantity which may be or may become harmful to a sewage works, or which may interfere with the proper operation of a sewage works, or which may impair or interfere with any sewage treatment process, or which may be or may become a hazard to persons, animals or property, and without limiting the generality of the foregoing any of the following:
- A. Sewage that may cause an offensive odour to emanate from a sewage works, and without limiting the generality of the foregoing, sewage containing hydrogen sulphide, carbon disulphide, other reduced sulphur compounds, amines or ammonia.
- B. Stormwater, water from drainage of roofs or land, or from a watercourse, or uncontaminated water; except that which may be discharged into a combined sewer.
- C. Sewage at a temperature greater than 65° C. (149° F.).
- D. Sewage having a pH less than 6.0 or greater than 10.5 or which, due to its nature or content, becomes less than 6.0 or greater than 10.5 within a sewage works.
- E. Explosive matter, gasoline, benzene, naphtha, fuel oil, solvents or sewage containing any of these in any quantity.
- F. Sewage containing more than 100 to 200 milligrams per litre of solvent extractible matter of animal or vegetable origin.
- G. Sewage containing more than 15 milligrams per litre of solvent extractible matter of mineral or synthetic origin.
- H. Sewage which consists of two or more separate liquid layers.
- I. Sewage of which the biochemical oxygen demand exceeds 300 to 350 milligrams per litre.
- J. Sewage containing more than 300 to 350 milligrams per litre of suspended solids.

## § 203-8. Prohibited discharges into storm sewers.
No person shall discharge or deposit or cause or permit the discharge or deposit into land drainage works, private branch drains or connections to any storm sewer matter of any type or at any temperature or in any quantity which may interfere with the proper operation of a storm sewer, or which may obstruct a storm sewer or the flow therein, or which may be or may become a hazard to persons, animals or property, or which may impair the quality of the water in any well, lake, river, pond, spring, stream, reservoir or other water or watercourse, and without limiting the generality of the foregoing any of the following:
- A. Uncontaminated water at a temperature greater than 65° C. (149° F.).
- B. Sewage at a temperature greater than 65° C. (145° F.).
- C. Sewage having a pH less than 6.0 or greater than 9.5 or which, due to its nature or content, becomes less than 6.0 or greater than 9.5 within a sewage works.
- D. Explosive matter, gasoline, benzene, naphtha, fuel oil, solvents or sewage containing any of these in any quantity.
- E. Sewage containing more than 15 milligrams per litre of solvent extractible matter.
- F. Sewage which consists of two or more separate liquid layers.
- G. Sewage containing coloured matter, which sewage would require a dilution in excess of four parts of distilled water to one part of such sewage to produce a mixture the colour of which is not distinguishable from that of distilled water.
- H. Sewage of which the biochemical oxygen demand exceeds 15 milligrams per litre.
- I. Sewage containing any matter which will not pass through a screen having openings not larger than 3.35 millimetres square (No. 6 standard sieve).
- J. Sewage that may cause an offensive odour to emanate from a sewage works, and without limiting the generality of the foregoing, sewage containing hydrogen sulphide, carbon disulphide, other reduced sulphur compounds, amines or ammonia.
- K. Sewage containing any of the following matter in excess of the indicated concentrations:

## $ 203-9. Standard Methods for tests.
Except as otherwise specifically provided in this article, all tests, measurements, analyses and examinations of sewage, its characteristics or contents shall be carried out in accordance with Standard Methods.
## § 203-10. Monitoring devices on commercial and industrial premises.
- A. The owner or occupant of commercial or industrial premises with one or more connections to a sewage works shall install and maintain in good repair in each connection a suitable manhole to allow observation, sampling and measurement of the flow of sewage therein, provided that, where installation of a manhole is not possible, an alternative device or facility may be substituted with the approval of the municipality.
2. Every manhole, device or facility installed as required by &203-10A of this article shall be designed and constructed in accordance with good engineering practice and the requirements of the municipality, and shall be constructed and maintained on the lands of the owner or occupant of the premises at his or her expense.
- C. The owner or occupant of commercial or industrial premises shall at all times ensure that every manhole, device or facility installed as required by § 203-10A of this article is at all times accessible for the purposes of observing, sampling and measuring the flow of sewage therein.
- D. The municipality may require the owner or occupant of commercial or industrial premises to install devices to monitor sewage discharges and to submit regular reports regarding the discharges to the municipality.
## § 203-11. Agreements concerning discharges.
A person who has entered into an agreement with the municipality with respect to the discharge or deposit of sewage shall not be prosecuted under § 203-7 of this article for the discharge or deposit of sewage in accordance with the terms of that agreement.
## $ 203-12. Program approvals for commercial and industrial premises.
- A. The owner or occupant of commercial or industrial premises may submit to the municipality a program to prevent or to reduce and control the discharge or deposit of sewage or uncontaminated water into connections to a sewage works or to a storm sewer from those premises.
- B. The municipality may issue an approval to be known as a "program approval" to the person who submitted the program.
- C. A person to whom a program approval has been issued shall not be prosecuted under § 203-7 or 203-8 of this article for the discharges or deposit of sewage during the period within which the program approval is applicable, provided that the person complies fully with the terms of the program approval.
## § 203-13. Right of entry.
For the purpose of the administration of this article, an agent of the municipality may, upon production of his or her identification, enter any commercial or industrial premises to observe, measure and sample the flow of sewage to any sewer.
## § 203-14. Tampering with equipment.
No person shall break, damage, destroy, deface or tamper with:
- A. Any part of a sewage works;
- B. Any device whether permanently or temporarily installed in a sewage works for the purpose of measuring, sampling and testing of sewage.
## § 203-15. Offences. [Amended 10-15-2001 by By-law No. 2865-2001]
Any person who contravenes any provision of this article is guilty of an offence and, upon conviction, is liable to a penalty as provided in the Provincial Offences Act.4
