BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING ON ROADS
UNDER THE JURISDICTION OF THE CORPORATION OF THE
TOWN OF EAST GWILLIMBURY
WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c.25, as amended,
("Municipal Act") authorizes municipalities to enact By-laws respecting matters within the
sphere of jurisdiction of highways, including traffic on highways, in conjunction with the
Highway Traffic Act;
AND WHEREAS Section 11 (1) of the Municipal Act, authorizes a municipality to pass
By-laws prohibiting or regulating parking on highways and on properties other than
Highways;
AND WHEREAS Sections 100 through 101 of the Municipal Act, authorizes a municipality
to pass By-laws for prohibiting unauthorized parking on private or municipal property;
AND WHEREAS Section 102 of the Municipal Act authorizes a municipality to pass By-
laws requiring the owners or operators of parking lots or other parking facilities to which
the public has access, to provide designated Parking spaces for the sole use of vehicles
operated by or carrying a disabled person;
AND WHEREAS Section 7.1 of the Fire Protection and Prevention Act 1997, S.O. 1997,
c.4, authorizes a municipality to pass By-laws prohibiting parking on private roadways
designated as fire routes;
AND WHEREAS Section 175 (13) of the Highway Traffic Act R.S.O. 1990, c. H.8,
provides that the Council of a Municipality in relation to Highways under its jurisdiction
may by By-law designate school bus loading zones, in accordance with the regulations;
AND WHEREAS Section 429 (1) of the Municipal Act provides that fines may be charged
for breaches of By-laws passed pursuant to the powers set out therein and further
provides for the removal, impounding or restraining or immobilizing of any vehicle parked
on a Highway or on municipal property in contravention of a By-law or of the Highway
Traffic Act;
AND WHEREAS Section 446 of the Municipal Act, authorizes a municipality to require a
person to do a matter or thing and in default of it being done by the person directed or
required to do it, the matter of thing shall be done at the owners expense and add the
cost to the tax roll and collecting them in the same manner as property taxes;
AND WHEREAS the Corporation of The Town of East Gwillimbury desires to regulate
traffic and govern and control the parking of vehicles in the Town of East Gwillimbury;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF EAST GWILLIMBURY ENACTS AS FOLLOWS:

PART 1 DEFINITIONS AND INTERPRETATION
1.1
In this By-law:
(a)
"Abandoned Vehicle" means a Vehicle that is in a wrecked, discarded,
dismantled, inoperative, unlicensed, or derelict condition or a vehicle that has
been parked, left or abandoned on a Highway, municipal property, or other
land for a continuous period of twenty four (24) hours or more.
(b)
"Accessible Parking Permit" means an accessible Parking permit issued
under section 26 of the Highway Traffic Act, and Regulation 581 made
thereunder;
(c)
"Angle
Parking"
means
a
form
of
roadside
car Parking where
the Parking Spaces are arranged at an acute angle to the direction of
approach, allowing the driver to enter a space easily and later reverse back
out;
(d)
"Authorized Sign" means any Sign, or marking on a Roadway, or Curb or
Sidewalk or other device placed or erected on a Highway under the authority
of this By-law or the Highway Traffic Act, for the purpose of regulating,
warning or guiding Vehicular and Pedestrian traffic;
(e)
"Bicycle" includes a tricycle and unicycle but does not include a Motor
Assisted Bicycle;
(f)
"Bicycle Lane" means a portion of Roadway, which has been designated by
pavement markings and signage for the exclusive use of cyclists;
(g)
"Boulevard" includes that portion of the Highway located between the edge
of the Roadway and the property line of the Highway, and without limiting the
foregoing, may include the un-traveled portion of any Highway, a dirt,
grassed, gravelled or paved area and ditches;
(h)
"CIES" means the Community Infrastructure and Environmental Services
Department for the Town;
(i)
"Commercial Motor Vehicle" means a Motor Vehicle in excess of 6.6
metres in length and/or 3 metres in height;
(j)
"Community Safety Zone" means a section of Roadway where Pedestrian
and driver safety is deemed to be of increased concern. Areas such as school
zones, parks, senior citizens residences and collision prone areas are good
examples of locations suited for designation as Community Safety Zones.
They are identified through specific signage identified in the Highway Traffic
Act;
(k)
"Corporation" means the Corporation of the Town of East Gwillimbury;
(l)
"Crosswalk" means:
a)
that part of a Highway at an Intersection that is included within the
connections of the lateral lines of the Sidewalks on the opposite sides
of the Highway measured from the curbs or, in the absence of curbs,
from the edges of the Roadway; or
b)
any part of a Roadway at an Intersection or elsewhere distinctly
marked as a Pedestrian crossing by signs or by lines or other markings
on the surface of the Roadway;
(m)
"Curb" means the edge of a traveled portion of the Highway;
(n)
"Designated Accessibility Parking Space" means a Parking Space
designated under this By-law for the exclusive use of a Vehicle displaying a
permit issued by Service Ontario in accordance with the requirements of the
Highway Traffic Act and the regulations made thereunder and this By-law;
(o)
"Driveway" means the part of the Highway that has been improved (with the
authorization of the Town Engineer) to provide vehicular access from the
Roadway to a Private Roadway or to adjacent land;
(p)
"Emergency Vehicle" includes an ambulance, fire department Vehicle, and
police department Vehicle;

(q)
"Exterior Side Yard" means the yard of a corner lot extending from the front
yard to the rear yard between the exterior side lot line and the nearest main
walls of the main building or structure on the lot;
(r)
"Fire Route" means that part of a Private Roadway, with a minimum width
of 6 meters, unless otherwise approved, providing vehicular access to or from
a building, structure or lands, and designated as a fire route, and shall include
any part of a Parking lot identified by visible markings or markers as a fire
route for use by authorized emergency Vehicles;
(s)
"Fire Route Sign" means permanent legible Signs of minimum size of 30
cm x 45 cm placed at intervals of not more than 25 m along the fire access
route which shall display the following information:
a)
Fire access route;
b)
Parking prohibited;
c)
Vehicles will be tagged and/or towed away;
d)
"both sides" or "this side only";
e)
double head arrows, or single head arrow (to denote limit of fire route);

(t)
"Front Yard" means a yard extending across the full width of the lot between
the front lot line and the nearest main walls of the main building or structure
on the lot;
(u)
"General Manager, CIES" means the General Manager for the Community
Infrastructure and Environmental Services Department for the Town and shall
include any person authorized by the General Manager, CIES to carry out
any of the powers and or duties of the General Manager, CIES, pursuant to
this By-law;
(v)
"Heavy Truck" means a Commercial Motor Vehicle for carriage of goods
having a weight when loaded, of 4.5 tonnes or more, but does not include a
passenger Vehicle, ambulance or any Vehicle of a police or fire department;
(w)
"Highway" means a common and public highway, street, avenue, parkway,
driveway, square, place, bridge, viaduct or trestle, any part of which is used
or intended for use by the general public for the passage of Vehicles, and
includes the entire area between its lateral property lines. Without limitation,
Highway includes unassumed or unopened road allowances;
(x)
"Holiday" has the meaning ascribed thereto in subsection 29(1) of the
Interpretation Act, R.S.O. 1990, c.l.11, as amended;
(y)
"Intersection" means the area embraced within the prolongation or
connection of the lateral curb lines or, if none, then of the lateral boundary
lines of two or more Highways that join one another at an angle, whether or
not one Highway crosses the other;
(z)
"Laneway" means a narrow street or passageway, between or behind
buildings, designed, constructed and intended to provide access to and
service at the rear of places of residence or business and owned by a
government authority;
(aa)
"Motor Assisted Bicycle" includes a Bicycle that is fitted with pedals which
are operable at all times to propel the Bicycle weighing no more than fifty-five
(55) kilograms, has no hand or foot operated clutch or gearbox driven by the
motor and transferring power to the driven wheel and which does not have
sufficient power to enable the Bicycle to attain a speed greater than fifty (50)
kilometres per hour on level ground within a distance of two (2) kilometres
from a standing start;
(bb) "Motorcycle" means a self-propelled Vehicle having a seat or saddle for the
use of the driver and designed to travel with not more than three wheels in
contact with the ground, and includes a Motor Assisted Bicycle and a motor
scooter;

(cc)
"Motor Vehicle" includes an Automobile, Motorcycle, and Motor Assisted
Bicycle unless otherwise indicated in the Highway Traffic Act, R.S.O. 1990,
c. H.8, as amended, and any other Vehicle propelled or driven otherwise than
by muscular power, but does not include a street car, or other vehicles
running only upon rails, or a Motorized Snow Vehicle, traction engine, farm
tractor, self-propelled implement of husbandry or road-building machine
within the meaning of the Highway Traffic Act, R.S.O. 1990, c. H.8, as
amended;
(dd) "Motorized Snow Vehicle" means a motorized snow vehicle as defined in
the Motorized Snow Vehicle Act R.S.O.,1990;
(ee)
"Municipal By-law Enforcement Officer" means a person appointed by By-
law to enforce the Town's By-laws;
(ff)
"Municipal Parking Area" means those areas on Town owned land,
excluding Roadways or Highways, specifically set aside for the Parking of
Vehicles and as more particularly designed and defined in Schedule IV;
(gg) "Municipal Property" means an open area or portion of a structure or land,
other than a Roadway or Highway, Parking owned by the Town ;
(hh) "Municipal Service Vehicle" means a Vehicle operated by or on behalf of
the Town while the Vehicle is being used for the repair or maintenance of
Highways, the collection or transportation of waste, or other municipal
purpose for which heavy equipment is required;
(ii)
"Occupant" means:
a)
a person with care and control of real property;
b)
the spouse of the person in a);
c)
a person authorized in writing by the legal titleholder to act on his or
her behalf to request the enforcement of this By-law.
(jj)
"Officer" means a Municipal By-law Enforcement Officer or a member of the
York Regional Police Force or the Ontario Provincial Police Force;
(kk)
"Owner" means:
a)
a person with legal title to real property;
b)
the spouse of the person in a);
c)
a person authorized in writing by the legal title holder to act on his or
her behalf to request the enforcement of this By-law.
"Owned" has a corresponding meaning when describing real property;
(ll)
"Park or Parking" means the standing of a Vehicle, whether occupied or
not, except when standing temporarily for the purpose of, and while actually
engaged in, loading or unloading merchandise or passengers;
(mm) "Parking Consideration" means approval, verbal or written from the
Manager, By-Law Enforcement Services or designate to Park on designated
portion of a Roadway for a designated period of time in excess of the time
prescribed by this By-law;
(nn) "Parking Infraction" means any unlawful Parking, Standing, or Stopping of
a Vehicle that constitutes an offence;
(oo) "Parking Infraction Notice" means a notice authorized by the Provincial
Offences Act, R.S.O., 1990 and placed on any Vehicle Parked in
contravention of this By-law;
(pp) "Parking Space" means a space within any Parking area designated by
suitable markings, such as Signs or paint on the pavement, and intended for
the Parking of Motor Vehicles;
(qq) "Pedestrian" means a person on any part of a Highway who is not within a
Vehicle, or a person in a wheelchair, baby carriage;
(rr)
"Pedestrian Crossover" has the same meaning as in the Highway Traffic
Act;

(ss)
"Person" means an individual, firm, partnership, corporation, trust, trustee,
or agent, executors, or legal representatives of the Person to whom the
context can apply according to law;
(tt)
"Person with a Disability" means a person who is temporarily or
permanently confined to a wheel chair, or who is restricted to the use of
crutches or braces, or otherwise is disabled in such a way that his or her
mobility is seriously restricted; such disability being confirmed by a general
practitioner or other qualified physician;
(uu) "Personal Mobility Device" is a compact motorized transportation device
used by a Person with a Disability to allow greater freedom of movement.
Such devices are electrically powered, up to 1.3 metres in length and can
travel at speeds up to 13 kilometres per hour;
(vv)
"Pocket Bike" is a small Motorcycle powered by a gasoline engine up to 55
cc in displacement (15 horsepower). They are less than 50 centimetres in
height and less than 1 metre in length. The maximum speed can be up to 70
kilometres per hour;
(ww) "Police Officer" includes a member of the York Regional and/or the Ontario
Provincial Police;
(xx)
"Private Parking Lot" means lands used for the Parking of Vehicles that is
not owned by the Town;
(yy)
"Private Property" means any real property that is not owned by the Town;
(zz)
"Private Roadway" means any private road, lane, ramp, or other means of
vehicular access to and egress from a building, property or structure, and it
may include a part of an area designated for Parking;
(aaa) "Raised Curb" means a curb, the face of which measures not less than
thirteen (13) centimetres in height;
(bbb) "Regional Road" means a Highway designated as a regional road by the
Regional Municipality of York;
(ccc) "Roadway" means the part of the Highway that is improved, designed or
ordinarily used for vehicular traffic, but does not include the shoulder, and,
where a Highway includes two or more separate roadways, the term
"Roadway" refers to any one roadway separately and not to all of the
roadways collectively;
(ddd) "Schedule" means a schedule referred to in this By-law and forming part of
this By-law;
(eee) "School Bus Loading Zone" means an area marked by Signs indicating
such area to be for the sole use of School Purpose Vehicle engaged in
receiving or discharging passengers;
(fff)
"School Purpose Vehicle" includes but is not limited to: (i) a school bus and
(ii) a station wagon, car, van or bus operated by or under contract with a
school board or authority in charge of a school;
(ggg) "School Crossing" means a Crosswalk marked by authorized Signs and
pavement markings designating it as a School Crossing location;
(hhh) "Sidewalk" means the part of the Highway specifically set a side or
commonly understood to be for Pedestrian use, typically consisting of a
paved surface but does not include Crosswalks, medians, Boulevards and
shoulders;
(iii)
"Side Yard" means a yard other than an exterior side yard that extends from
the front yard to the rear yard between interior side lot line and the nearest
main walls of the main building or structure on the lot;
(jjj)
"Sign" means any sign, marking on a Highway, curb, Sidewalk, Parking Lot
or other traffic control device, other than a Traffic Control Signal system, that
provides notice of traffic and/or Parking regulations;

(kkk) "Stand Or Standing" when prohibited, means the halting of a Vehicle,
whether occupied or not, except for the purpose of, and while actually
engaged in, receiving or discharging passengers;
(lll)
"Stop Or Stopping", means the halting of a vehicle, even momentarily,
whether occupied or not, except when necessary to avoid conflict with other
traffic or in compliance with the directions of a police officer or of a Traffic
Control Sign or Signal;
(mmm) "Taxicab" means any Motor Vehicle for hire in the conveyance of persons
from a place within the Town to any point inside or outside of the Town, but
does not include bus operated by York Region Transit or under license under
the Public Vehicles Act, an ambulance, a funeral hearse, a limousine or a
Vehicle described subsection 155(2) of the Municipal Act, 2001;
(nnn) "Taxi Stand" means the part of a Highway designated by an authorized Sign
where Taxicabs will stop to take on or discharge passengers;
(ooo) "Through Highway" means a Highway or part of a Highway designated as
such by the Minister or by By-law of a municipality, and every such Highway
shall be marked by a stop Sign or yield right of way Sign in compliance with
the regulations of the Ministry;
(ppp) "Town" means the Corporation of the Town of East Gwillimbury;
(qqq) "Traffic Circle" is an Intersection that accommodates traffic flow in a circular
counter-clockwise direction around a centre island;
(rrr)
"Traffic Control Signal" means that part of a traffic control device that
consists of one set of no less than three coloured lenses, red, amber and
green, mounted on a frame and commonly referred to as a signal head;
(sss) "Unauthorized Area" means a Front Yard, Exterior Side Yard, or Side Yard
except as otherwise permitted under the Town's Comprehensive Zoning By-
law;
(ttt)
"U-Turn" means the turning of a Vehicle within a Roadway for the purpose
of traveling in the opposite direction;
(uuu) "Vehicle" includes a Motor Vehicle, trailer, traction engine, farm tractor,
road-building machine, and any vehicle drawn, propelled or driven by any
kind of power, including muscular power, but does not include a Motorized
Snow Vehicle or the cars of electric or steam railways running only upon rails.
1.2 Where abbreviations are used to designate direction in this By-law they shall be
deemed to mean the following:
a)
NB shall mean Northbound;
b)
SB shall mean Southbound;
c)
WB shall mean Westbound;
d)
EB shall mean Eastbound;
e)
M shall mean Metres;
f)
MON shall mean Monday;
g)
FRI shall mean Friday;
h)
R.O.W shall mean Right of Way.
1.3
In this By-law, where any expression of time occurs, the time referred to shall be
Eastern Standard Time, except in periods when daylight saving time is in effect in
which case the time referred to shall be Eastern Daylight Saving Time.
1.4
The schedules referred to in this By-law form an integral part of this By-law and
each entry in a Column of a Schedule shall be read in conjunction with the entry
or entries across from it.
1.5
The Municipal Highway and Regional/Provincial Highway names referenced in the
Schedules shall be taken as the official names of the Highways for the purposes
of this By-law.

1.6
If any section, subsection or part of this By-law is declared by any court of
competent jurisdiction to be illegal or ultra vires, such section, subsection or part
shall be declared to be separate and independent and enacted as such.
PART 2 AUTHORITY AND GENERAL REGULATIONS
2.1
This By-law applies to all Highways under the jurisdiction of the Town, and
Municipal Property and Private Property in so far as it applies to Parking
regulations.
2.2
CIES is responsible for the administration of this By-law, including the installation
and maintenance of Signs that have been authorized the General Manager.
2.3
In accordance with the requirements of the Highway Traffic Act, the General
Manager, CIES is designated by the Town as the person whose approval is
required prior to the installation or modification of any Traffic Control Signal system.
2.4
The provisions of this By-law shall not apply to any Vehicle owned by the Town,
Ambulances, Police, Fire Department Vehicles, Vehicles owned by other public
authorities and any other Vehicle while actually engaged in performing works for
the Town.
2.5
The General Manager, CIES or his/her designate shall be authorized to close local
Highways and Roadways under the jurisdiction of the Town for social,
recreational, community or athletic purposes, parades, or a combination of such
purposes, upon passing of a resolution by Council for specific events.
2.6
No Person shall erect, place, maintain or display upon or in view of any Highway,
any signal, marking or device which purports to be or, is an imitation of, or
resembles an authorized Sign or Traffic Control Signal, or which conceals from
view or interferes with the effectiveness of an authorized Sign or Traffic Control
Signal.
2.7
No person shall drive a Motor Vehicle on a Sidewalk or footpath except for the
purpose of directly crossing the Sidewalk or footpath at a Driveway.
2.8
No person shall drive a Motor Vehicle on any Highway over any Raised Curb
except at a place where there is a Driveway opening or Private Roadway.
2.9
No person shall drive any Vehicle in a Traffic Circle other than in a counter
clockwise direction.
2.10 No person shall park a Bicycle on a Highway in such a manner as to obstruct
Pedestrian or Vehicle traffic.
2.11 All measurements of distance relevant to an "Intersection" shall, where possible,
be taken to or from a point where the prolongation or connection of the edge of
pavement meet on the side of the Highway relevant to the said measurement.
PART 3 GENERAL STOPPING AND PARKING REGULATIONS
3.1
METHOD OF PARKING - PARALLEL - TWO WAY TRAFFIC:
a)
No person shall Park or Stop any Vehicle on any Highway or portion thereof
except as follows:
(i) where there is a Raised Curb, on the right side of the Roadway with the
right front and rear wheels having regard to the direction in which such
Vehicle was proceeding, parallel to and not more than 30 centimetres
out from such Curb;
(ii) where there is a rolled Curb or no Curb, with right front and rear wheels
parallel to and as near to the right limit of the Roadway as is reasonable;
b)
The provisions of subsection (a) do not apply where Angle Parking is
permitted or to Parking or Stopping a Vehicle on the left side of the Roadway
or a Highway designated for one-way traffic.
3.2
PARKING PROHIBITED IN SPECIFIED PLACES - SIGNS NOT REQUIRED:
a)
No person shall park any Vehicle:
(i)
in front of or within 2 metres of the intersection of a Private Roadway;
(ii)
for more than three (3) consecutive hours except between 7 p.m. and
11 p.m. With the exclusion of the following five (5) pilot street

locations, which are exempt from the three-hour parking restriction
for the duration of a one-year pilot program commencing on April 15,
2026, and ending on April 14, 2027:
a. Beechborough Crescent
b. Hammill Heights
c. Four Seasons Crescent
d. Mondial Crescent
e. Frank Kelly Drive;
(iii)
between the hours of 2 a.m. and 6 a.m.;
(iv)
within 60 centimetres of a Driveway on all Town Roadways;
(v)
within 3 metres of a point on the Curb or edge of the Roadway
nearest to any fire hydrant;
(vi)
within 15 metres of an intersecting Roadway;
(vii)
within 15 metres of any level crossing of a railway;
(viii)
for the purpose of displaying the Vehicle for sale;
(ix)
for the purpose of washing, greasing or repairing the Vehicle, except
for such repairs as have been necessitated by an emergency;
(x)
alongside the tracks of any railway;
(xi)
in such a position as will prevent the removal under its own power of
any other Vehicle;
(xii)
so as to obstruct a Crosswalk or Pedestrian Crossover;
(xiii)
on any median strip or adjacent to either side or ends of a median
strip;
(xiv) so as to interfere with the movement of traffic;
(xv)
on a Highway within 152 metres of firefighting apparatus where said
apparatus is actually engaged in fighting a fire, or when directed by
a member of the Police or Fire Department;
(xvi) upon any bridge or elevated structure or within any tunnel or
underpass;
(xvii) in the centre of a cul-de-sac;
(xviii) on a Boulevard;
(xix) so as to interfere with snow clearing operations;
(xx)
in such a manner as to interfere with a Highway cleaning/road
maintenance operation;
(xxi) on Municipal Property without authorization;
(xxii) on Private Property without authorization;
(xxiii) so as to let stand a trailer that is not attached to a Motor Vehicle;
(xxiv) which does not display a valid Vehicle permit affixed to the number
plate issued under the Highway Traffic Act, as amended;
(xxv) Notwithstanding subsection 3.2 (a) (ii) & (iii), a person may park a
Vehicle on a Highway for more than three hours or between the hours
of 2am and 6am, or both, where the person has been granted a
Parking Consideration and the Vehicle is parked in accordance with
all conditions that may be stipulated;
(xxvi) within 8 metres of any fire hall on the side of the Highway on which
the fire hall is located or within 30 metres of such fire hall on the
opposite side of the Highway.
b)
No person shall park a Commercial Motor Vehicle on a Highway within a
residential zone.

c)
Section 3.2(b) does not apply to prohibit the Parking or Standing of any such
Vehicle upon a Highway in any residential zone while the operator thereof is
actually engaged in the delivery of goods or services to any premises within
any such zones, or to prohibit the Parking or Standing of any bus or School
Purpose Vehicle upon any Highway in any residential zone while the operator
thereof is actually engaged in the embarking or disembarking of passengers
in any such zone.
d)
Where designated portions of a Highway have been closed for a special
event, no person shall park or stand a Vehicle or portion thereof on any
portion of the Highway that is designated as closed;
e)
No person shall park a Motor Vehicle in an Unauthorized Area.
f)
No person shall park, leave or abandon an Abandoned Vehicle on any
Highway or municipal property.
3.3
PARKING PROHIBITED IN SPECIFIED PLACES - WHERE SIGNS ARE ON
DISPLAY:
a)
Where authorized Signs are on display indicating that Parking is prohibited,
no person shall park any Vehicle on any Highway:
(i)
within 30 metres of an Intersection controlled by Traffic Control
Signals;
(ii)
within a turning basin at the end of a cul-de-sac;
(iii) upon the divided portion of the Highway including the centre median.
3.4
STOPPING PROHIBITED IN SPECIFIED PLACES - SIGNS NOT REQUIRED:
a)
No person shall Stop any Vehicle on a Highway:
(i)
on or a Sidewalk or footpath;
(ii)
on or over a Curb within a Driveway;
(iii) within an Intersection, Crosswalk, or Pedestrian Crossover;
(iv) within 9 metres of a Pedestrian Crossover measured along the side
of the Roadway in the direction opposite to the direction of travel of
Vehicles on that side of the Highway;
(v)
within 9 metres of a Pedestrian Crossover measured along the side
of the Roadway in the direction of travel of Vehicles on that side on
the Highway;
(vi) alongside or across the Highway from any excavation or obstruction
in the Roadway when the free flow of traffic would thereby be
impeded;
(vii) on the Roadway side of any Stopped or Parked Vehicle;
(viii) upon any bridge or elevated structure or within any tunnel or
underpass.
PART 4 PARKING RESTRICTIONS ON CERTAIN ROADWAYS
4.1
Where Authorized Signs to that effect are displayed, no person shall park a Vehicle
on a Highway at the side and between the limits set out respectively in Columns
1,2,3 and 4 of Schedule I and Schedule XXIII during the prohibited times or days
set out in Column 5 of Schedule I and Schedule XXIII.
PART 5 ACCESSIBLE PARKING
5.1
Where Authorized Signs to that effect are displayed in accordance with the
regulations made under the Highway Traffic Act, the Highways or portions thereof
set out in Column 1 of Schedule II at the locations described in Column 2, 3 and 4
of Schedule II are hereby Designated Accessibility Parking Spaces.
5.2
Despite any other provision of this or any other By-law of the Town, no person shall
Park, Stand or Stop a Vehicle in a Designated Accessibility Parking Space, or be
entitled to the benefit of an exemption under this By-law, unless a currently valid
Accessible Parking Permit has been issued to that person and such permit is

displayed on or in the Vehicle in accordance with the Highway Traffic Act, as
amended and this By-law.
5.3
Designated Accessibility Parking Spaces shall be distinctly signed in accordance
with Regulation 581 made under the Highway Traffic Act, as amended.
5.4
A Sign marking a Designated Accessibility Parking Space shall be mounted on a
permanent post or other vertical surface one (1) metre in height to the bottom,
which post is to be located at the end of the Designated Accessibility Parking
Space at the point marking the midpoint in width of the Parking space, and shall
not be located so as to block vehicular access to the Designated Accessibility
Parking Space.
5.5
The erection and maintenance of Signs indicating Designated Accessibility Parking
Space shall be the responsibility of the Property Owner. All such Signs shall be
the recognized official signage for spaces to be used exclusively by Accessible
Parking Permit holders. The Sign shall be placed upright on a post, or, if
necessary, fixed to a wall so as to be clearly visible to the motoring public.
5.6
No person who fails to meet the requirements for an Accessible Parking Permit
shall display an Accessible Parking Permit or use a Designated Accessibility
Parking Space when not transporting a disabled person in the Vehicle.
5.7
All Accessible Parking Permits shall be displayed on the sun visor or on the dash
board of a Vehicle so that the international symbol of access for the disabled, the
permit number and the expiry date of the permit, are clearly visible from the outside
of the Vehicle.
5.8
The provisions of this By-law governing Designated Accessibility Parking Spaces
located on Private Property may be enforced by an Officer.
PART 6 FIRE ACCESS ROUTES
6.1
Designation - by the chief fire official:
Town Emergency Services shall have the authority to designate a Fire Route on
any Municipal Property and on any Private Roadway providing access to or egress
from an apartment building, hotel, motel, church, nursing home, shopping centre,
townhouse, industrial and commercial building and any other structure or lands
used for the accommodation of the public or for the gathering or assembling of
people.
6.2
Upon designation of a Private Roadway as a Fire Route, Town Emergency
Services shall issue a notice to be sent by prepaid mail or delivered to the Owner
or Occupant of the property indicating the municipal address of the property and
which Private Roadways thereon are designated Fire Routes.
6.3
Upon receipt of a notice designating a Fire Route, the Owner or Occupant shall
install Fire Route Signs as described in Section 6 of this By-law within thirty (30)
days following the date upon which a notice is mailed.
6.4
The Town may enter upon the land and install the required Signs at the expense
of the Owner if the Fire Route Signs are not installed within the prescribed time
and such costs may be recovered by action or in like manner of municipal taxes.
6.5
The Owner or Occupant of a property upon which there is a Private Roadway that
has been designated as a fire route shall:
a) maintain the Signs in good repair;
b) maintain the Signs free of obstructions.
6.6
Sign Installation - Fire Route Signs shall be installed as follows:
a)
Signs shall be visible, and be unobstructed;
b)
Signs shall be installed from 0.3m to the bottom of the Sign and not more
than 3m to the top of the sign, measured from the travelled portion of the fire
route;
c)
Signs may not be installed on a post, light standard, building, column or other
similar structure acceptable to the Chief Fire Official;

d)
Signs shall be installed no less than 2m to the bottom of the Sign and not
more than 3m to the top of the Sign, measured from the travelled portion of
the fire route;
e)
Signs shall be installed at intervals not to exceed 25m;
f)
Signs shall be installed to the satisfaction of the Chief Fire Official.
6.7
No person shall Park a Motor Vehicle on or along any part of a designated Fire
Route at any time.
PART 7 MUNICIPAL PARKING AREAS
7.1
No person shall Park a Vehicle in a Municipal Parking Area unless that person
conforms to the provisions of Schedule IV.
7.2
No person shall Park a Vehicle in a Municipal Parking Area unless that person
parks the Vehicle wholly within one (1) Parking Space. If a person cannot so Park
because of the Vehicle's length or width, that person may Park the Vehicle within
more than one Parking Space.
PART 8 STOPPING RESTRICTIONS ON CERTAIN ROADWAYS
8.1
Where Authorized Signs to that effect are displayed, no person shall stop a Vehicle
on a Highway at the side and between the limits set out respectively in 1, 2, 3, 4
and 5 of Schedule V during the prohibited times or days set out in Column 5 of
Schedule V.
PART 9 BUS LOADING ZONES
9.1
Where Authorized Signs to that effect are displayed in accordance with the
regulations made under the Highway Traffic Act, the Highways or portions thereof
set out in Column 1 of Schedule VIII on the side of the Highway set out in Column
2 of Schedule VIII between the limits set out respectively in Columns 3 and 4 of
Schedule VIII, are hereby designated as School Bus Loading Zones.
9.2
No person shall Stop any Vehicle on any Highway, other than a School Purpose
Vehicle, in a School Bus Loading Zone at the prohibited times set out in Column 5
of Schedule VIII.
PART 10 MAX RATE OF SPEED
10.1 When any Highway or portion thereof set out in Columns 1, 3 and 4 of Schedule
IX is signed in compliance with the regulations under the Highway Traffic Act; the
maximum rate of speed thereon shall be the rate of speed prescribed in km/h as
set out in Column 2 of Schedule IX.
PART 11 STOP CONTROLLED INTERSECTION
11.1 The erection of stop Signs is hereby authorized at each of the Intersections set out
in Column 1 of Schedule X at the stop conditions set out in Column 2 facing traffic
travelling as set out in Column 3 of Schedule X.
PART 12 YIELD CONTROLLED INTERSECTION
12.1 The erection of yield right-of-way Signs is hereby authorized at each of the
Intersections set out in Column 1 of Schedule XI for the control of traffic entering
the Intersection from the Highway or portion of Highway set out in Column 2 of
Schedule XI.
PART 13 THROUGH HIGHWAYS
13.1 The Highways set out Column 1 of Schedule XII, between the limits set out in
Column 2 and 3 of Schedule XII, are, except as provided in subsection 13.2,
hereby designated as Through Highways for the purpose of the Highway Traffic
Act, as amended.
13.2 The designation in subsection 13.1 of a Highway or portion of Highway as a
Through Highway shall not include any Intersection thereon where the Highway
intersected is a King's Highway or a Regional Road forming part of the Regional
Road System of the Regional Municipality of York.
PART 14 HEAVY TRAFFIC PROHIBITED

14.1 Where Authorized Signs to that effect are displayed, Heavy Vehicles are prohibited
on all Town roads except the Highway or part thereof set out in Column 1 of
Schedule XIII between the limits set out in Column 2 and 3 of Schedule XIII.
14.2 The provisions of section 14.3 shall not extend to the use of the Highway or part
thereof for deliveries to or removals from any premises abutting such Highway.
14.3 Where Authorized Signs advising of a reduced load restriction are on display, and
subject to Section 110 of the Highway Traffic Act, no person shall operate or draw
any Vehicle on that Highway having a weight which is in contravention of Section
122 of the Highway Traffic Act.
PART 15 SEASONAL LOAD RESTRICTIONS
15.1 For the purposes of subsections 122(1), (2) and (3) of the Highway Traffic Act,
the reduced load period shall be that period commencing on February 1st of
each year and ending on June 15th of each year or as authorized by the
General Manager, CIES to suit road conditions.
15.2 Except as provided in Section 14.3, when Authorized Signs to that effect are
displayed, no person shall move, drive, operate or Park a Heavy Truck on the
Highways or parts of Highways, as set out in Column 1 of Schedule XIV,
between the limits set out in Column 2 and 3 of Schedule XIV.
15.3 Section 15.2, shall not apply to any Vehicle engaged in making a delivery to or a
collection from property or premises which cannot be reached except by way of a
Highway or portion of Highway or to prohibit the use of Vehicles for those
purposes, provided that in making the delivery or collection the Highway or portion
of Highway is traveled only insofar as is unavoidable in getting to and from such
property or premises. This exemption does not apply to Vehicles making deliveries
of fill as defined in the Town's Fill By-law, as amended, or any successor
legislation thereto.
PART 16 TURNING PROHIBITIONS
16.1 No person shall turn a Vehicle at an Intersection or portion of a Highway on which
Authorized Signs have been erected and are on display that restricts such turns.
16.2 The Intersections or portions of Highways set out in Column 1 of Schedule XV are
hereby designated as locations prohibiting a Vehicle during the times or on days
set out in Column 5 from making turns as set out in Column 6 of Schedule XV.
PART 17 ONE WAY STREET
17.1 The Highways set out in Column 1 of Schedule XVI between the limits set out in
Column 3 and 4 of Schedule XVI, during the times or days set out in Column 5 of
Schedule XVI, are hereby designated for one-way vehicular traffic only in the
direction set out in Column 2 of Schedule XVI.
PART 18 COMMUNITY SAFETY ZONE
18.1 Where Authorized Signs to that effect are displayed in accordance with the
regulations made under the Highway Traffic Act, the Highways or portions thereof
set out in Column 1 of Schedule XVII between the limits set out in Column 2 and 3
of Schedule XVII are hereby designated as Community Safety Zones.
PART 19 PEDESTRIAN CROSSING
19.1 The Highways set out in Column 1 of Schedule XVIII, at the locations set out in
Columns 2 and 3 of Schedule XVIII, are designated as Pedestrian Crossings as
set out in Column 4 and shall be indicated as such as prescribed by the regulations
made under the Highway Traffic Act.
PART 20 BICYCLE LANES
20.1 The Highways or portions of Highways set out in Column 1 of Schedule XIX on the
side of the Highway set out in Column 2 of Schedule XIX and between the limits
set out in Columns 3 and 4 of Schedule XIX are hereby designated as Bicycle
Lanes.
20.2 When Authorized Signs have been erected, no person shall:
a)
drive or be permitted to drive any Vehicle, other than a Bicycle, or Motor
Assisted Bicycle on any lane or part of lane established as a reserved lane;

b)
Park any Vehicle on any lane or part of lane established as a Bicycle Lane.
20.3 Subsection 20.1 shall not apply to prevent:
a)
a Vehicle making a right-hand turn, or a left hand turn from a one-way
Roadway, provided the Vehicle does not enter the Bicycle Lane at a point
farther from the point of making the right-hand turn or left-hand turn than the
distance set out in Schedule XIX opposite such Bicycle Lane;
b)
the driver of any Vehicle from Stopping for a period of not more that forty-five
(45) seconds for the purpose of and while in the process of receiving or
discharging passengers or goods, provided that such Vehicle shall not be
stopped in a Bicycle Lane in such a manner as to interfere with the movement
of a Bicycle;
c)
the Stopping of a Motor Vehicle for the purpose of and while actually engaged
in receiving or discharging a physically disabled person, provided that:
(i)
such Vehicle has a valid Accessible Parking Permit displayed upon
its dashboard or on the sun visor in accordance with the provisions
of the Highway Traffic Act; or
(ii)
a public transit Vehicle or designated School Purpose Vehicle from
load or off-loading of passengers.
d)
a Vehicle pulled over for emergency purpose or repairs.
PART 21 SIGNALIZED INTERSECTIONS
21.1 The erection and operation of Traffic Control Signal systems in accordance with
the Highway Traffic Act, as amended, and the regulations made there under at the
locations set out in Column 1 of Schedule XX is hereby authorized.
PART 22 LANE DESIGNATION
22.1 On the Highways or portions of the Highways listed in Column 1 of Schedule XXI,
having been divided into clearly marked lanes between the limits set out in Column
2 and 3 of Schedule XXI, and each of the lanes designated for traffic moving only
in the direction indicated in Column 4 of Schedule XXI.
PART 23 LOAD ON BRIDGES
23.1 Pursuant to the Highway Traffic Act, as amended, when Authorized Signs are on
display, no person shall drive a Vehicle with a load in excess of 5,000 kilograms (5
tonnes), per axle on any Highway or part thereof described in Column 3 of
Schedule XXII.
PART 24 CROSSING GUARD
24.1 The Highways set out in Column 1 of Schedule XVIII, at the locations set out in
Column 2 of Schedule XVIII, are designated as Crosswalks and shall be indicated
as such as prescribed by the regulations made under the Highway Traffic Act.
PART 25 SCHEDULES
25.1 The Schedules referred to in this By-law shall form part of this By-law. Each entry
in a column of a schedule shall be read in conjunction with the entries across from
that entry and not otherwise.
PART 26 TAXI STANDS
26.1 Where a Sign is erected designating a Taxi Stand, no person shall Park or Stand
a Vehicle in the Taxi Stand unless the Vehicle is a Town licenced Taxicab while it
is waiting for, or picking up, goods or passengers for the purposes of collecting
fares.
PART 27 ENFORCEMENT PROCEDURES
27.1 Where an Officer finds a Vehicle Parked, Stopped, left or Standing in violation of
the provisions of this By-law, the Officer shall issue a summons or attach a Parking
Infraction Notice to the Vehicle. The notice shall be in the form of serially
numbered notice and shall set out:
a) the license number; and

b) the date, time, place, and nature of alleged offence;
c) notice to state that the Vehicle is unlawfully Parked, Stopped, left, or
Standing.
27.2 The Officer may prepare the Parking Infraction Notice in duplicate or triplicate.
Where he/she prepares the notice in duplicate, the Officer shall attach one copy
to the Vehicle and deliver one copy to the Town By-law Branch.
27.3 If a payment is not made the penalty shall be recoverable under the Provincial
Offences Act.
PART 28 PENALTY SECTION
28.1 Every person who contravenes any provision of this By-law is guilty of an offence
and upon conviction is liable to a fine as provided for in the Provincial Offences
Act.
28.2 The owner of a Vehicle involved in the contravention of this By-law,
notwithstanding that he or she was not the driver of the Vehicle at the time of the
contravention, is guilty of an offence and is liable to the fine prescribed pursuant to
the By-law unless, at the time of the offence, the said Vehicle was in the possession
of some person other than the owner without the owner's consent.
28.3 Any person who contravenes the provisions of this By-law may make voluntary
payment of the set fine amount as shown on the Parking Infraction Notice, provided
that such payment is made within seven (7) days from the date of issuance of the
Parking Infraction Notice. Once a person has paid the set fine, no further
proceedings shall be taken against that person in respect of the offence alleged in
the Parking Infraction Notice.
28.4 If voluntary payment is not made pursuant to subsection 27.3, the Provincial
Offences Act, as amended, shall apply and the penalty shall be recoverable under
the Act.
28.5 Notwithstanding any other provisions of penalties contained in this By-law, an
Officer upon discovery of any Vehicle parked or standing in contravention of this
By-law may cause it to be moved or taken to and placed or stored in a suitable
place, at the owner's expense, and all cost and charges for removing, care and
storage thereof, if any, are a lien upon the Vehicle, which may be enforced in the
manner provided by the Repair and Storage Liens Act, as amended.
28.6 Any Vehicle parked or left standing on any Highway for a period exceeding 24
hours shall be considered to be abandoned, and upon discovery of such
abandonment, an Officer may cause it to be moved to, or stored in a suitable place,
and all costs and charges for removing, care and storage thereof, if any, are a lien
upon the Vehicle, which may be enforced in the manner provided by the Repair
and Storage Liens Act, as amended.
28.7 Every person who contravenes any provision of this By-law is guilty of an offence
and is liable upon conviction to a fine of not more than $2000.00 exclusive of costs.
28.8 Every person who contravenes any provision of the By-law is guilty of an offence
and, where a penalty for the contravention thereof has not otherwise been provided
for, is liable, upon conviction to a fine of not less than $50.00 and not more than
$2000.00, exclusive of costs.
28.9 If this By-law is contravened and a conviction entered, the court in which the
conviction has been entered and any court of competent jurisdiction thereafter
may, in addition to any other remedy and to any penalty that is imposed, make an
order prohibiting the continuation or repetition of the offence by the person
convicted.
28.10 If compliance therewith would be impractical, the provisions of the sections and
subsections of this By-law shall not apply to ambulances, Police and Fire
Department Vehicles and any Vehicles while actually engaged in works
undertaken for or on behalf of the Corporation of the Town of East Gwillimbury, the
Region of York, the federal or provincial government, or any utility.
28.11 This By-law shall come into force on the date when a set fine Order is obtained
from the Chief Justice of the Ontario Court Provincial Division for offences created

by this By-law for the purpose of proceedings commenced under Part II of the
Provincial Offences Act, as amended.
PART 29 ADMINISTRATIVE PENALTIES
29.1 Instead of laying a charge under the Provincial Offences Act, as amended, for
breach of any provision of this By-law, an Officer may issue an administrative
penalty to the person who has contravened this by-law.
29.2 The Officer has the discretion to either proceed by way of an administrative penalty
or a charge laid under the Provincial Offences Act. If an administrative penalty is
issued to a Person for the breach, no charge shall be laid against that same Person
for the same breach.
29.3 The amount of the administrative penalty for a breach of a provision of this By-law,
issued under this By-law, is fixed as set out in an Administrative Penalty By-law as
amended, or any successor by-law.
29.4 A Person who is issued an administrative penalty shall be subject to the
procedures as provided for in an Administrative Penalty By-law, as amended, or
any successor by-law.
29.5 An administrative penalty imposed on a Person pursuant to this by-law that is not
paid within 15 days after the day it becomes due and payable, constitutes a debt
of the Person to the Municipality and may be added to a municipal tax roll and
collected in the same manner as municipal taxes.
PART 30 COLLECTION OF UNPAID FINES
30.1 Where a fine is in default, the Municipality may proceed with civil enforcement
against the Person upon whom the fine has been imposed, pursuant to the
Provincial Offences Act.
30.2 The Municipality may make a request to the treasurer of a local municipality to add
any part of a fine that is in default to the tax roll for any Property in the local
municipality for which all the Owners are responsible for paying the fine, and collect
it in the same manner as municipal taxes.
PART 31 REPEALING SECTION
31.1 That By-laws 2003-024 and 2014-048, as amended are hereby repealed.
PART 32 FEES
32.1 Every person applying for a parking permit shall submit all required application
information and shall pay the applicable fee as set out below:
a) On-Street Overnight Parking Permit:
I.
Parking on a highway between 2 and 6 a.m. and relief from 3-hour
parking: $14 per permit;
b) Overnight Parking Permit - Town Facilities and Parks:
I.
Parking between 5 p.m. and 7 a.m. the following day in a designated
parking space within a Town-owned facility or park:
1. One (1) Day Permit - $10;
2. Three (3) Day Permit - $25;
3. Seven (7) Day Permit - $50;
4. Thirty (30) Day Permit - $100;
