THE CORPORATION OF THE
TOWNSHIP OF EAST ZORRA-TAVISTOCK
COUNTY OF OXFORD
BY-LAW #16-91
As amended by 2009-41, 2011-44
BEING a by-law respecting the removal of snow and ice from sidewalks in the Township
of East Zorra-Tavistock.
WHEREAS the Council of every municipality may pass by-laws to require the removal
of snow and ice from sidewalks in the municipality as provided by Paragraphs 53 to 56
of Section 210 of The Municipal Act, Chapter 302, R.S.O. 1980.
AND WHEREAS every Council may pass such by-laws and make such regulations for
the health, safety, morality and welfare of the inhabitants of a municipality as may be
deemed expedient as provided by Section 104 of The Municipal Act, Chapter 302,
R.S.O. 1980.
THEREFORE, the Municipal Council of The Corporation of the Township of East Zorra-
Tavistock enacts as follows:
1. In this By-law:
a. "Director of Public Works and Development, or designate" shall mean the
Director of Public Works and Development of the Township of East Zorra-
Tavistock as may be appointed from time to time or his duly authorized
representative.
b. "Corporation" shall mean The Corporation of the Township of East Zorra-
Tavistock.
c. "Sidewalk" shall mean that portion of a street between the curb lines or the
lateral lines of a roadway and the adjacent property lines specifically
provided and intended for the use of pedestrians.
2. Every occupant, and in the case where there is no occupant, the owner of every
property and every person having charge or care of any property, immediately
adjoining the sidewalks on the streets set out in Schedule "A" hereto, shall clear
away and remove, or cause to clear away and remove, all snow and ice from the
sidewalks in front of, along side of, and/or at the rear of such property.
3. The sidewalks referred to in Schedule "A" hereof shall be cleared of snow and ice
prior to ten (10) o'clock in the forenoon on every day in the year, except Sundays
and Statutory Holidays, and as often as necessary to keep the sidewalks cleared of
snow and ice between the hours of ten (10) o'clock in the forenoon and six (6:00)
o'clock in the afternoon during the said days. If ice or hard packed snow cannot be

removed without damage to the sidewalk, the owner or occupant shall spread or
cause to be spread, the same with sand and/or salt, or some other suitable
substance acceptable to the Director of Public Works and Development, or
designate.
4. In case of default of compliance with any of the provisions herein, or where in the
opinion of the Director of Public Works and Development, or designate or the
OPP Detachment Commander, or designate, an emergency situation may exist
that requires immediate action and in that event the Corporation, through the
Director of Public Works and Development, or designate or the OPP Detachment
Commander, or designate, may arrange to clear away such snow or ice from the
sidewalks and sand or salt the sidewalks at the expense of the owner and in the
case of non-payment of such expense, by the owner, the expense may be
recovered in like manner as municipal taxes, with interest as provided by section
325 of The Municipal Act, Chapter 302, R.S.O. 1980, and taking of any such action
or imposition of any such special assessment shall be the responsibility of the Chief
Administrative Officer of the Township of East Zorra-Tavistock.
5. No person shall deposit or cause to be deposited any snow or ice from any private
driveway or other private property owned by any person on or into any sidewalk or
street in any area within The Corporation of the Township of East Zorra-Tavistock.
6. Any person violating any of the provisions of this by-law shall be liable to conviction
under the Provincial Offences Act and subject to a fine of not more than $2,000.00.
Each day a violation of this by-law continues shall constitute a separate and distinct
offence under this by-law.
7. This by-law may be sited and known as "The Snow Removal By-law".
8. By-law #45-85 of the Township of East Zorra-Tavistock shall be repealed on the
date of passage of this by-law.
