THE CORPORATION OF THE
TOWNSHIP OF EAST ZORRA-TAVISTOCK
COUNTY OF OXFORD
BY-LAW # 2025-37
BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING
WHEREAS section 27 of the Municipal Act, 2001, S.O. 2001, c.25, authorizes
the Corporation of the Township of East Zorra-Tavistock to pass By-laws in
respect to highways under its sole or joint jurisdiction;
AND WHEREAS section 102 of the Municipal Act, 2001, S.O. 2001, c.25 and
Part III of the Highway Traffic Act, R.S.O. 1990, c. H.8 allows the Corporation of
the Township of East Zorra-Tavistock to pass By-laws in respect to parking for
persons with disabilities;
AND WHEREAS the Provincial Offences Act, R.S.O. 1990, c. P.33 allows the
Corporation of the Township of East Zorra-Tavistock to establish authorized
words, expressions and set fines under its provisions;
AND WHEREAS the Council of the Corporation of the Township of East Zorra-
Tavistock deems it appropriate to regulate traffic and parking;
NOW THEREFORE the Council of the Corporation of the Township of East
Zorra-Tavistock enacts as follows:
Part I - DEFINTIONS AND INTERPRETATIONS
1. DEFINITIONS
For the purposes of this By-law the following definitions apply:
1.1.
"Agricultural Purposes" means land where animals or birds are kept for
grazing, breeding, raising, boarding, training, or for the tillage of soil,
rowing, harvesting of vegetables, fruits, field crops or landscaping
materials;
1.2.
"Authorized Emergency Vehicle" means:
1.2.1. Any vehicle owned or operated by the Township of East
Zorra-Tavistock;

1.2.2. Any vehicle owned or operated by a Police Service, Fire
Department, Ambulance Service or Ministry of the Province;
1.2.3. Any service vehicle owned or operated by an accredited
roadside service agency or automobile club or a licensed
towing agency while the operator is providing a towing or
other roadside service;
1.2.4. Any armoured vehicle, while the operator is actively engaged
in the performance of their duties, and any escort vehicle
providing security services for an armoured vehicle while the
operator is actively engaged in the performance of his or her
duties; and,
1.2.5. Any vehicle owned or operated by a public utility including by
not limited to vehicles owned or operated by Canada Post, a
telephone company, a natural gas utility, a hydro electric
power provider, a telecommunications company and any
other public utility provided that such vehicles are each
clearly identified by a crest or other marking and provided
the operator is actively engaged in the provision of the
services offered by the utility;
1.3.
"Axle" means an assembly of two or more wheels whose centres are in
one transverse vertical plane and which are transmitting weight to the
highway;
1.4.
"Boulevard" means that area located between the roadway and
sidewalk;
1.5.
"By-law" refers to this By-law;
1.6.
"By-law Enforcement Officer(s)" means a person or persons
empowered by the Council of the Corporation of the Township of East
Zorra-Tavistock to enforce the various By-laws of the Corporation;
1.7.
"Community Safety Zone" means a highway or a portion of a highway
designated as such under this By-law and signed pursuant to the
regulations of the Highway Traffic Act;
1.8.
"Corporation" means the Corporation of the Township of East Zorra-
Tavistock;
1.9.
"Council" means the Council of the Corporation of the Township of
East Zorra-Tavistock;

1.10. "Crosswalk" means:
1.10.1. That part of a highway at an intersection that is included
within the connections of the lateral lines of the sidewalks
on opposite sides of the highway measured from the curbs
or, in the absence of curbs, from the edges of the roadway;
1.10.2. Any portion of a roadway at an intersection or elsewhere
distinctly indicated for pedestrian crossing by signs or by
lines or other markings on the surface;
1.11. "Curb" means a structure composed of concrete or other suitable
material erected to define the edge of the roadway;
1.12. "Designated Accessible Parking Space" means a parking space
designated under this By-law for the exclusive use of a vehicle
displaying an Accessible Parking Permit in accordance with the
requirements of the Highway Traffic Act, the regulations made there
under and this By-law;
1.13. "Accessible Parking Permit" means:
1.13.1. An accessible parking permit issued under the Highway
Traffic Act; or,
1.13.2. A permit, number plate or other number or device issued
by another jurisdiction and recognized under the Highway
Traffic Act;
1.14. "Driveway" means a part of a highway improved to provide vehicular
access from the roadway to a laneway or a parking area on adjacent
land;
1.15. "Dual Axle" means any two consecutive axles whose centres are more
than one metre apart and that are:
1.15.1. Articulated from a common attachment to the vehicle; or,
1.15.2. Designed to automatically equalize the load between the two
axles;
1.16. "Emergency Situation" means a situation brought about by weather,
accident or natural or human-made disasters that could affect the
safety and security of people and property;
1.17. "Fire Route" shall mean a fire route as set out in By-law #1996-32;

1.18. "Gross Vehicle Weight" means the total weight in kilograms transmitted
to the highway by a vehicle, or combination of vehicles, and load;
1.19. "Hickson" refers to the former Hamlet of Hickson;
1.20. "Highway" includes a common and public highway, street, avenue,
parkway, driveway, square, place, bridge, viaduct or trestle, any part of
which is intended for or used by the general public for the passage of
vehicles and includes the area between the lateral property lines
thereof;
1.21. "Highway Traffic Act" means the Highway Traffic Act, R.S.O. 1990, c.
H.8, and amendments thereto;
1.22. "Innerkip" refers to the former Hamlet of Innerkip;
1.23. "Intersection" means the area embraced within the prolongation or
connection of the lateral curb lines or, if none, then of the lateral
boundary lines of two or more highways that join one another at an
angle, whether or not one highway crosses the other;
1.24. "Loading Zone" means that part of a highway set apart for the
exclusive purpose of parking or stopping a vehicle to load or unload
goods, wares, merchandise or persons;
1.25. "Minister" means the Minister of Transportation of Ontario;
1.26. "Ministry" means the Ministry of Transportation of Ontario;
1.27. "Motor Vehicle" includes an automobile, motorcycle, motor assisted
bicycle, and any other vehicle propelled or driven otherwise than by
muscular power;
1.28. "Official Sign" means a sign approved by the Ministry;
1.29. "One-way Highway" refers to a highway upon which the movement of
vehicular traffic is limited to one direction;
1.30. "Park" or "Parking" when prohibited, means the standing of a vehicle,
whether occupied or not, except when standing temporarily for the
purpose of and while actually engaged in loading or unloading of
merchandise or passengers;
1.31. "Pedestrian Crosswalk" means any portion of a roadway, at an
intersection or elsewhere, designated by this By-law and distinctly
indicated for pedestrian crossing by signs on the highway and lines or
other markings on the surface of the highway as prescribed by the
Highway Traffic Act;

1.32. "Police Officer" means a member of the Ontario Provincial Police;
1.33. "Private Roadway or Driveway" means every way or place in private
ownership and used for vehicle traffic by the owner and those having
expressed or implied permission given from the owner but not by other
persons;
1.34. "Provincial Offences Act" means the Provincial Offences Act, R.S.O.
1990, and amendments thereto;
1.35. "Public Works Manager" means the Roads/Public Works Manager for
the Township of East Zorra-Tavistock;
1.36. "Roadway" means that part of the highway that is improved, designed
or ordinarily used for vehicular traffic, but does not include the
shoulder, and where a highway includes two or more separate
roadways the term "roadway" refers to any one roadway separately
and not all of the roadways collectively;
1.37. "School bus" means a bus that:
1.37.1. Is painted chrome yellow; and,
1.37.2. Displays on the front and rear thereof the words "SCHOOL
BUS" and on the rear thereof the words "DO NOT PASS
WHEN SIGNALS FLASHING";
1.38. "School Crosswalk" means a crosswalk which is established and
specifically designated by signs to facilitate the crossing of a highway
by school children and is normally supervised by a school crossing
guard during those times when children are likely to be walking to or
from a local school;
1.39. "Shoulder" means that part of the highway immediately adjacent to the
travelled portion of the roadway and having a surface, which has been
improved;
1.40. "Sidewalk" means any municipal walkway, or that portion of a street
between the curb line or the lateral line of a roadway and the adjacent
property line, primarily intended for the use of pedestrians;
1.41. "Stand" or "Standing", when prohibited, means the halting of a vehicle,
whether occupied or not, except for the purpose of and while actually
engaged in receiving or discharging passengers;

1.42. "Stop" or "Stopping", when prohibited, means the halting of a vehicle,
even momentarily, whether occupied or not, except when necessary to
avoid conflict with other traffic or in compliance with the directions of a
police officer or a traffic control sign or signal;
1.43. "Tank Truck" means a commercial vehicle to which there is attached,
or upon which there has been placed, either permanently or otherwise,
a closed tank having a capacity of 2.3 kilolitres or more;
1.44. "Tavistock" refers to the former Village of Tavistock;
1.45. "Township" means the Township of East Zorra-Tavistock;
1.46. "Tractor" shall mean a farm tractor, or any type of crawler type
machinery;
1.47. "Traffic" includes pedestrians, vehicles, animals which are led, ridden
or herded and other conveyances using a highway for the purpose of
travel;
1.48. "Traffic Control Signal" means any device, manually, electronically or
mechanically operated for the regulation or control of traffic;
1.49. "U-turn" means the turning of a vehicle within a highway so as to
proceed in the opposite direction;
1.50. "Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor,
road-building machine, bicycle and any vehicle drawn, propelled or
driven by any kind of power, including muscular power, but does not
include a motorized snow vehicle or a street car.
2. INTERPRETATION
2.1.
In this By-law:
2.1.1. Words imparting the singular number or the masculine
gender, are deemed to include more than one person or
thing of the same kind, and females as well as males, and
the converse;
2.1.2. A word interpreted in the singular number has a
corresponding meaning when used in the plural tense;
2.1.3. "May" shall be construed as permissive;
2.1.4. "Shall" shall be construed as imperative;

2.1.5. "Subsection" when used without reference to another
section, refers to a subsection contained in the same section
in which the phrase is used; and,
2.1.6. "Vehicle", when used as part of a prohibition of parking,
stopping or standing includes any part thereof.
2.2.
During any period of the year when what is commonly known as
Daylight Saving Time has been generally adopted in the Township
under any Act, By-law, resolution or proclamation, whether the same is
effective in law or not, all references to time in this By-law shall be
deemed to be references to such Daylight Saving Time.
2.3.
Where a distance is used in this By-law as part of a prohibition of
parking or stopping within a specified distance of an object, structure,
land or a part of a highway, such distance shall be measured:
2.3.1. Along the curb or edge of the roadway from a point in such
curb or edge of roadway opposite such object, structure,
land or part of a highway, unless the context otherwise
requires; and,
2.3.2. From such point in the curb or edge of roadway in all
directions.
2.4.
The following abbreviations, definitions and symbols stand for the
words respectively set forth opposite thereto as follows:

3. ENFORCEMENT
3.1.
It shall be the responsibility of the Ontario Provincial Police to enforce
all provisions of this By-law except Sections 19 and 20.
3.2.
A By-law Enforcement Officer may enforce all provisions of this By-law.
4. EXEMPTION
4.1.
The provisions of this By-law respecting parking, stopping or standing
of vehicles shall not apply to authorized emergency vehicles where the
operator is engaged in the performance of their duties.
4.2.
The provisions of this By-law respecting parking, stopping or standing
may be restricted or prohibited by the Detachment Commander,
Township Fire Chief or Public Works Manager, or designate in the
case of a fire, a parade, an assembly of persons, a congestion of
traffic, a construction project or an emergency situation, and no person
shall park, stop or stand a vehicle in contravention of such restrictions
or prohibitions.

4.3.
The provisions of this By-law are subject to By-law #2003-004, which
vests authority with the Public Works Manager to temporarily close any
highway or portion of a highway to vehicular traffic in an emergency
situation.
5. SCHEDULES
5.1.
Schedules referred to in this By-law shall form part of this By-law and
each entry in a column of such a schedule shall be read in conjunction
with the entry or entries across there from, and not otherwise.
6. SEVERABILITY
6.1.
The various prohibitions of this By-law are cumulative and not mutually
self-exclusive.
6.2.
Should a court of competent jurisdiction declare a part or the whole of
any provision of this By-law to be invalid or of no force or effect, the
provision or part is deemed severable from this By-law, and Council
intends that the remainder survive and be applied and enforced per its
terms and to the extent possible under the law.
PART II - PARKING & STOPPING REGULATIONS
7. GENERAL PARKING AND STOPPING REGULATIONS
7.1.
No person shall park or stop any vehicle on any highway or portion
thereof except as follows:
7.1.1. Where there is a raised curb on the right side of the
roadway, having regard to the direction such vehicle was
proceeding, with its right front and rear wheels parallel to and
not more than 300 mm out from the curb. In no
circumstances shall a vehicle mount the raised curb and
park or stop to the right of the raised curb; or,
7.1.2. Where there is no curb or a rolled curb, with the right front
and rear wheels parallel to and as near to the right-hand limit
of the highway as is practicable without stopping or parking
on a sidewalk or footpath or on any part of the highway
which is not intended for the use of vehicles.
7.2.
Subject to subsection 7.1, where parking is permitted on the left side of
a highway designated for one-way traffic, no person shall park or stop
any vehicle or permit a vehicle to remain parked or stopped on the left
side of a highway designated for one-way traffic except as follows:

7.2.1. Where there is a raised curb, on the left side of the travelled
portion of the highway having regard to the direction in which
the vehicle was travelling, with its left front and rear wheels
parallel to and not more than 300 mm out from such curb; or
7.2.2. Where there is no curb or a rolled curb, on the left side of the
highway having regard to the direction in which the vehicle
was travelling, with the left front and rear wheels parallel to
and as near to the left-hand limit of the highway as is
practicable without stopping over any part of a highway
which is not intended for the use of vehicles.
7.3.
Subsections 7.1 and 7.2 do not apply where angle parking is permitted
under this By-law.
7.4.
No person shall on a highway park or stop a vehicle in any of the
following places:
7.4.1.
On or over a sidewalk;
7.4.2.
Within a crosswalk;
7.4.3.
Within an intersection;
7.4.4.
Adjacent to or across the highway from any excavation or
obstruction in the roadway when the free flow of traffic
would thereby be impeded;
7.4.5.
On a highway adjacent to any stopped or parked vehicle.
7.5.
No person shall on a highway park a vehicle in any of the following
places:
7.5.1.
Within 3 metres of a fire hydrant;
7.5.2.
Within 9 metres of an intersecting highway;
7.5.3.
Within 15 metres of any level crossing or a railway;
7.5.4.
Adjacent to the tracks of any railway;
7.5.5.
In front of a driveway or laneway or so as to obstruct
vehicles in the use of a driveway or laneway;
7.5.6.
In front of an entrance to or exit from any building or
enclosed space in which persons may be expected to
congregate in large numbers;

7.5.7.
In front of the entrance to any place where goods or
merchandise are regularly delivered or removed; and,
7.5.8.
In such a position as will prevent the removal of any other
vehicle previously parked.
7.6.
Where official signs are erected and on display, no person shall on any
highway park any vehicle:
7.6.1. Within 15 metres of an intersection;
7.6.2. Within 30 metres of an intersection controlled by traffic
signals;
7.6.3. Within 25 metres of any point designated as a bus or coach
stop;
7.6.4. Within 7.5 metres of any fire hall on the side of the highway
on which the fire hall is located or within 30 metres of such
fire hall on the opposite side of the highway.
7.7.
Section 7 is subject to the provisions set out in Sections 8-15 below.
8. ANGLE PARKING
8.1.
Where angle parking is permitted on a highway, no person shall stop,
stand or park a vehicle or permit a vehicle to remain parked or standing
except at the angle designated by signs or markings on the roadway.
8.2.
Where angle parking on a highway other than at an angle of 90
degrees to the curb or edge of roadway is permitted, no person shall
park a vehicle or permit a vehicle to remain parked on such highway
except with the front end of the vehicle at the curb or edge of the
roadway.
8.3.
No person shall park a vehicle or permit a vehicle to remain parked at
an angle on any highway or portion of highway except on the highways
described in Column 1 of Schedule A to this By-law, at the side(s) of
the highway set out in Column 2 and between the limits set out in
Column 3 and Column 4 of the said Schedule.
9. NO PARKING AT ANY TIME
9.1.
No person shall park a vehicle where official signs prohibiting the
parking of a vehicle are displayed on any highway described in Column
1 of Schedule B to this By-law, at the side(s) of the highway set out in
Column 2, between the limits set out in Column 3 and Column 4 of the
said Schedule.

10. PARKING PROHIBITIONS
10.1. RESTRICTED PARKING
10.1.1. No person shall park a vehicle where official signs
prohibiting the parking vehicles are displayed on any
highway described in Column 1 of Schedule C to this By-
law, at the side(s) of the highway set out in Column 2,
between the limits set out in Column 3 and Column 4 and
for a period no longer than that set out in Column 5 of the
said Schedule.
10.2. SNOWPLOW ROUTES
10.2.1. Where official signs are erected and on display no person
shall from the 1st day of November to the 15th day of April
inclusive park a vehicle on any highway under the sole or
joint jurisdiction of the Township between the hours of 1:30
a.m. and 6:00 a.m.
10.3. NIGHTTIME PARKING
10.3.1. Where official signs are erected and are on display no
person shall park a vehicle in Innerkip between the hours
of 2:00 a.m. and 8:00 a.m. on Blandford St. (County Rd.
#4).
10.3.2. Where official signs are erected and are on display no
person shall park a vehicle in Tavistock between the hours
of 1:30 a.m. and 6:00 a.m. on Woodstock Street North,
Woodstock Street South, Hope Street East, and Hope
Street West.
10.4. PARALLEL PARKING ONLY
10.4.1. Where official signs are erected and on display no person
shall park a vehicle other than in a parallel position on the
shoulder of County Road 8 in Hickson, from Lot 69 and 70
(Plan 820) to the East half of Lot 71 (Plan 820).
10.5. FIRE ROUTES
10.5.1. No person shall park in a Fire Route as designated by By-
law #1996-46.

10.6. ACCESSIBLE PARKING
10.6.1. A designated accessible parking space shall be distinctly
indicated in accordance with the requirements of the
Highway Traffic Act.
10.6.2. An accessible parking permit shall be displayed on or in
the vehicle in accordance with the requirements of the
Highway Traffic Act.
10.6.3. Designated accessible parking spaces, for the purpose of
this By-law, means parking spaces as outlined in Column 1
of Schedule D to this By-law, between the limits set out in
Column 2 and Column 3 of the said Schedule.
10.6.4. Subject to subsection 10.6.5 below, no person or
organization shall:
10.6.4.1. Park, stop or leave a vehicle displaying an
accessible parking permit in a designated
accessible parking space at any time unless that
vehicle is transporting or picking up a person that is
a holder of an accessible parking permit at that time;
and,
10.6.4.2. Be entitled to the benefit of an exemption under this
By-law, unless an accessible parking permit has
been issued to that person, organization or to a
passenger being picked-up or transported in the
vehicle;
10.6.5.
Subsection 10.6.4 of this By-law does not apply if there is
an emergency situation and the vehicle is left parked,
standing or stopped there because of the emergency.
10.6.6.
Any person who contravenes this section is guilty of an
offence and upon conviction is liable to a fine as set out
in the Highway Traffic Act.
11. TOWNSHIP FACILITY PARKING
11.1. No person shall park contrary to a posted official sign, marking or curb.
11.2. Designated parking for the Township's facilities, for the purpose of this
By-law, means parking spaces at the Township facility described in
Column 1 of Schedule E to this By-law, the number of parking spaces
set out in Column 2, the location of the parking space set out in
By-law #2025-37

Column 3 and the type of designation set out in Column 4 of the said
Schedule.
12. NO STOPPING
12.1. No person shall stop a vehicle where official signs prohibiting the
stopping of a vehicle are displayed on any highway described in
Column 1 of Schedule F to this By-law, at the side(s) of the highway
set out in Column 2, and between the limits set out in Column 3 and
Column 4 of the said Schedule.
13. LOADING ZONES
13.1. No person shall load or unload a vehicle except where official signs
permitting the loading or unloading of a vehicle are displayed on any
highway described in Column 1 of Schedule G to this By-law, at the
side(s) of the highway set out in Column 2, between the limits set out in
Column 3 and Column 4 and for a period no longer than that set out in
Column 5 of the said Schedule.
14. CROSSWALKS
14.1. PEDESTRIAN CROSSWALK
14.1.1. A driver shall yield the right of way to the pedestrian where
traffic control signals are not in place or not in operation
and a pedestrian is crossing the highway.
14.1.2. No person shall overtake or pass a vehicle that is stopped
at a pedestrian crosswalk or at an intersection to permit a
pedestrian to cross the highway.
14.1.3. No person shall stop or park any vehicle within a
pedestrian crosswalk.
14.1.4. No person shall stop or park within thirty (30) metres of the
approach side of a crosswalk that is controlled by a traffic
control signal and not located at an intersection.
14.1.5. No person shall stop or park within fifteen (15) metres of
the leaving side of a crosswalk that is controlled by a traffic
control signal and not located at an intersection.

14.2. SCHOOL CROSSWALK
14.2.1. No person shall disobey any signals given by a school
crossing guard at a school crosswalk during those times
when children are likely to be walking to or from a local
school.
14.2.2. No person shall overtake or pass a vehicle that is stopped
at a school crosswalk.
14.2.3. No person shall stop or park any vehicle within a school
crosswalk.
14.2.4. No person shall stop or park within thirty (30) metres of the
approach side of a school crosswalk designated by
markings and authorized school crosswalk signs.
14.2.5. No person shall stop or park within fifteen (15) metres of
the leaving side of a school crosswalk designated by
markings and authorized school crosswalk signs.
14.3. Crosswalks, for the purpose of this By-law, means crosswalks on any
highways described in Column 1 of Schedule "H" to this By-law,
between the limit(s) set out in Column 2 and Column 3 and the
designated type outlined in Column 4 of the said Schedule.
15. INTERSECTIONS CONTROLLED BY STOP SIGNS
15.1. No person shall enter an intersection in violation of the official stop
signs at the intersections described in Column 1 of Schedule I and at
the locations described in Column 2 of the said Schedule.
PART III - REGULATED ACTIONS ON HIGHWAYS
16. ONE-WAY HIGHWAYS
16.1. No person shall travel in a direction opposite to that set out by official
signs on any highway described in Column 1 of Schedule J to this By-
law, between the limits set out in Column 2 and Column 3 and in a
direction opposite to that set out in Column 4 of the said Schedule.
17. SPEED LIMITS
17.1. No person shall on the highways described in Column 1 of Schedule K,
between the limits set out in Column 2 and Column 3, that are hereby
designated as highways having speed limits lower that those

prescribed in the Highway Traffic Act, exceed the designated speed
limits set out in Column 4 of the said Schedule.
17.2. No person shall on the highways described in Column 1 of Schedule L,
between the limits set out in Column 2 and Column 3, that are hereby
designated as a Community Safety zones under section 214.1 (1) of
the Highway Traffic Act, exceed the designated speed limit set out in
Column 4 of the said Schedule.
17.3. Every person who commits an offence under section 17 is liable on
conviction to the penalties set out under the Highway Traffic Act.
18. LITTERING
18.1. No person shall throw, deposit or cause to be deposited any glass,
nails, tacks or scraps of metal or any rubbish, refuse, waste or litter
upon, along or adjacent to a highway.
18.2. Section 18.1 does not apply to the following:
18.2.1. Where a person throws, deposits or causes to be
deposited any glass, nails, tacks or scraps of metal or any
rubbish, refuse, waste or litter in a receptacle provided for
this purpose;
18.2.2. Where, in the normal course of garbage collection, a
person deposits litter on a highway;
18.2.3. Where, in the course of using land for agricultural purposes
and in areas zoned for that purpose, a person deposits
sewer waste as fertilizer, manure, straw, grass clippings or
any other plant debris commonly used as compost
material;
18.2.4. Where, in the course of engaging in home composting, a
person deposits grass, tree trimmings and prunings,
garden waste and other vegetable matter in a home
composter;
18.2.5. Where, during the course of construction on a property,
construction materials are stored on that property.
18.3. A person who is guilty of the offence of littering the highway shall be
subject to the penalties under the Highway Traffic Act.

19. OBSTRUCTION OF HIGHWAYS, DITCHES AND CULVERTS
19.1. No person shall obstruct, encumber, or foul any highway under the
jurisdiction of the Township by any means whatsoever.
19.2. No person shall commit any act which could injure the travelled portion
of any highway.
19.3. No person shall drive across road ditches.
19.4. No person shall use any highway as a headland for turning tractors
and farm implements.
19.5. No person shall empty the contents of any implement on any highway.
19.6. No person shall drive or operate tractors and farm implements on any
highway from fields or other private property except from established
laneways or entrances,
19.7. No person shall obstruct ditches or culverts upon any highway. All
deposits of fill or installation of culverts must be approved by the Public
Works Manager. Any installations not authorized by the Public Works
Manager may be removed at the expense of the property owner
without notice. Should the property owner fail to pay the costs
associated with the removal of installations incurred by the Township;
the Township shall have a lien on the land for such costs and the costs
shall be deemed to be municipal taxes and may be collected in the
same manner and with the same priorities as municipal taxes.
19.8. No person shall obstruct the ditches and culverts of a highway by
ploughing or working the soil of the road allowance to the travelled
portion of any highway.
19.9. No person shall build or maintain a fence or deposit firewood or other
thing calculated to obstruct or interfere with public travel on a highway.
The Public Works Manager is authorized to remove any such
obstructions at the expense of the person so placing them.
19.10. No person shall deposit snow or ice onto a highway or bridge.
19.11. No person shall plant, cultivate or maintain any crop on a highway.
19.12. No person shall perform any work on a highway without the written
approval of the Public Works Manager or designate.
19.13. Section 19.12 does not apply to persons authorized to perform work or
repairs under an Act of the Legislature of Ontario.

20. PLANTING, TRIMMING AND REMOVAL OF TREES
20.1. No person shall plant any tree, bush or shrub upon a highway without
the prior approval by resolution of Council.
20.2. The Public Works Manager is hereby authorized to remove any tree,
plant or shrub if considered necessary for public safety. The Public
Works Manager may remove any tree, plant or shrub at the expense of
the person so planting them without notice.
20.3. The Public Works Manager is authorized to remove decayed or
damaged trees which are, in their opinion, a hazard to public safety.
20.4. The Public Works Manager may supervise the following:
20.4.1. The planting of trees upon highways;
20.4.2. The trimming of trees planted upon highways; and,
20.4.3. The trimming of trees planted upon private property where the
branches extend over a highway.
20.5. No person shall attach any handbill, sign, fence or other thing to a tree
located on any highway or public place, except with the consent of the
Public Works Manager notwithstanding that such attachment would not
injure or destroy the tree.
20.6. No person shall remove, cut down or injure any tree growing upon a
highway except with the written permission of the Public Works
Manager.
20.7. No person shall tie or fasten any animal to a tree growing upon the
highway, or allow any animal in their care to injure or destroy such tree.
21. LOAD RESTRICTIONS DURING THE THAW (REDUCED LOAD SEASON)
21.1. The Manager of Public Works has authority to designate the dates on
which a reduced load period shall start and end annually, based on the
Ministry of Transportation Ontario's Reduced Load Period (RLP)
predictive tool that incorporates weather data to determine when
freeze/thaw cycles begin and end. Load restrictions will be
implemented in conjunction with neighbouring Oxford County
municipalities. Typical dates where load restrictions are anticipated are
March 1 to April 30.
21.2. During the reduced load period the provisions of Subsections (1), (2),
(3) and (4) of Section 122 of the Highway Traffic Act R.S.O. 1990,

Chapter H.8 as amended, apply to the roads or portions thereof set out
in Schedule "P" to this By-law, as amended.
21.3. This By-law shall be enforceable when reduced load limit signs have
been erected and are on display COUNCIL GIVES THE RIGHT TO
DECLARE HALF LOAD SEASON TO THE MANAGER OF PUBLIC
WORKS.
21.4. No person shall during the reduced load season, operate a commercial
motor vehicle or trailer where any axle of such commercial vehicle or
trailer transmits to the highway a weight in excess of 5000 kilograms.
21.5. No person shall, during reduced load season, operate a vehicle having
a carrying capacity in excess of 1000 kilograms other than a motor
vehicle or trailer where the weight upon any millimetre in the width of
tire exceeds five kilograms.
21.6. A vehicle operated by or on behalf of a municipality where such vehicle
is engaged in highway maintenance including the carriage and
application of abrasive or chemicals for use on a highway or used
exclusively for the transportation of milk is exempt from the provisions
of subsections 21.4 and 21.5
21.7. Any person who wishes to be exempt from the requirements may apply
for a permit to do so from the Public Works Manager. The Public
Works Manager will specify a maximum axle loading if a permit is
granted. No person shall exceed the axle loading specified in the
permit.
21.8. If the By-law Enforcement Officer or the Public Works Manager has
reasonable and probable grounds to believe that the gross vehicle
weight of a vehicle or combination of vehicles is in excess of the limit
permitted under this By-law or a permit issued for the vehicle or
combination of vehicles may:
21.8.1. Proceed to weigh the vehicle either utilizing portable or
stationary scales;
21.8.2. Require the vehicle or combination of vehicles to be driven
to the nearest weight scales; and,
21.8.3. Require the driver to redistribute or remove so much of the
load as is necessary to ensure compliance with this By-
law.
21.9. No person shall, during reduced load season, operate a dual axle tank
truck, used exclusively for the transportation of liquid or gaseous

heating fuel, and no two-axle truck, used exclusively for the
transportation of livestock feed, on a highway where any axle transmits
to the highway a weight in excess of 7500 kilograms.
22. BRIDGE LOAD RESTRICTIONS
22.1. No person shall operate any vehicle or class thereof passing over a
bridge shown on the concession or lot described in Column 1 of
Schedule "M", between the road allowance set out in Column 2, and
with a gross vehicle weight not to exceed the weight set out in Column
3 of the said Schedule.
22.2. Any person violating the provisions of this section shall be subject to
the penalties provided in Section 106 of the Highway Traffic Act.
PART IV - OFFENCES AND PENALTIES
23. PENALTIES
23.1. Any person who contravenes any provision of this By-law is guilty of an
offence and upon conviction is liable to a fine or penalty for each
offence established pursuant to the Provincial Offences Act and
included within Schedule "N" and "O".
23.2. Any person who is guilty of an offence shall make payment as shown
on the Parking Infraction Notice. Payment shall be made at the
Township office within 15 days and such payment shall be accepted in
full satisfaction of the charge and no further proceedings will be taken.
Failure to remit payment within the stated time may result in the
violation being referred to the Provincial Offences Court.
23.3. The owner of a vehicle that is parked, stopped, or left standing in
contravention of this By-law is guilty of an offence unless the owner
proves to the satisfaction of the court that at the time of the offence, the
vehicle was in the possession of another person without the owner's
consent, express or implied.
23.4. The owner of a vehicle shall incur the penalties provided for any
contravention of this By-law unless at the time of the contravention the
vehicle was in the possession of some person other than the owner or
their chauffeur without the owner's consent, and the driver or operator
of a vehicle not being the owner shall also incur the penalties provided
for any such contravention.

23.5. Each day that a person contravenes any section of this By-law shall be
deemed to constitute a separate and distinct offence.
23.6. In addition to any other penalties provided by this By-law, upon
discovery of any vehicle parked, stopped or standing on any highway
in contravention of any provision of this By-law, a police officer, police
cadet, By-law enforcement officer or an officer appointed for the
carrying out of the provisions of the Highway Traffic Act may cause
such vehicle to be moved or taken to and placed or stored in a suitable
place and all costs and charges for the removing, care and storage
thereof, if any, are a lien upon the vehicle being released and may be
enforced in the manner provided by the Repair and Storage Liens Act,
R.S.O. 1990, c. 25 as amended.
PART V- REPEALS AND ENACTMENT
24. SHORT TITLE
24.1. The short title of this By-law shall be "Comprehensive Roads By-law"
25. GENERAL
25.1. By-law #2024-32 of the Corporation is hereby repealed upon the By-
law coming into full force and effect.
26. ENACTMENT
26.1. This By-law shall come into full force and effect upon approval of the
set fines, contained within this By-law, by a Justice of the Ontario Court
of Justice.
