Being a by-law to provide for the
regulation of traffic within the City
of Elliot Lake and to repeal By-law
No. 98-21.
The Council of The Corporation of the City of Elliot Lake ENACTS AS FOLLOWS:
1.00
DEFINITIONS
In this by-law,
1.01
"authorized sign" means any highway sign used to regulate traffic which is prescribed by
Regulation made under the Highway Traffic Act or is approved by Council and includes any
marking placed on any roadway, curb, sidewalk or public place, in conformity with this by-law;
1.02
"boulevard" means that part of a street lying between the roadway and sidewalk or where no
sidewalk has been laid, that part between the roadway and the highway boundary;
1.03
"by-law Enforcement Officer" means a By-law Enforcement Officer of the City or other person
appointed to enforce the whole or part of this by-law;
1.04
"OPP" means Ontario Provincial Police;
1.05
"city" means The Corporation of the City of Elliot Lake;
1.06
"commercial vehicle" means a motor vehicle having permanently attached thereto a truck or
delivery body and includes ambulances, hearses, fire apparatus, buses and tractors used for hauling
purposes on the highways;
1.07
"council" means the Council of The Corporation of the City of Elliot Lake;
1.08
"crosswalk" means that part of a highway at an intersection that is included within the connections
of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or
in the absence of curbs, from the edges of the roadway, or any portion of a roadway at an
intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other
markings on the surface;
1.09
"curb" means the protecting rim of a permanent material forming the lateral lines of a highway,
street or roadway;

1.10
"designated parking space" means a space identified by a sign substantially in the form set
out as Figure 1 or by pavement markings which indicates that a parking space is for the sole
use of vehicles on which a Disabled Person Parking Permit is properly displayed. (03-13)
1.11. "driver" means a person who operates a vehicle on a highway;
1.12 "gross weight" means the combined weight of vehicle and load;
1.13 "heavy truck" means a commercial motor vehicle including a bus but not including a school bus as
defined under the Highway Traffic Act, having a gross vehicle weight, as shown on the permit for
the vehicle issued under the Highway Traffic Act, of 3,175 kilograms or greater;
1.14 "highway" includes a common and public highway, street, avenue, parkway, driveway, square,
place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for
the passage of vehicles and includes the area between the lateral property lines thereof;
1.15 "intersection" means the area embraced within the prolongation or connection of the lateral curb
lines or if none, then of the lateral boundary lines of two or more roadways which join one another
at an angle whether or not one crosses the other;
1.16 "lane way " means the paved area used for vehicle access at the rear or side of a commercial or
residential property;
1.17 "motor vehicle" includes an automobile, motorcycle, motor assisted bicycle, and any other vehicle
propelled or driven otherwise than by muscular power, but does not include a street car, or other
motor vehicles running only upon rails, or a motorized snow vehicle, motorized wheelchair or
medical scooter, traction engine, farm tractor, self-propelled implement of husbandry or road-
building machine within the meaning of the Highway Traffic Act;
1.18 "municipal parking area" means an area set aside by the City for the parking of motor vehicles
which is open for public use with or without charge and is more particularly set out in Schedule
"K";
1.19 "overnight parking area" means an area where parking is allowed for no longer than a 24 hour
period and is limited to those areas identified in Schedule "L";
1.20
"park" or "parking", when prohibited, means the standing of a vehicle, whether occupied or not,
except when standing temporarily for the purpose of and while actually engaged in loading or
unloading merchandise or passengers;
1.21
"permit" means a permit to park a motor vehicle of a class specified in Section 25.01 hereof, on
the street, or part of the street, or a municipal parking area, designated on the permit during the
times authorized by this section;
1.22
"police officer" means an OPP Officer or any other police officer, but does not include a special
constable, a First Nations Constable, a municipal law enforcement officer or an auxiliary member
of a police force;

1.23
"private road or private driveway" means any private road, lane, ramp or other means for
vehicular access to and from a lot, building or structure and, may include part of a parking lot;
1.24
"roadway" means that part of the highway that is improved, designed or ordinarily used for
vehicular traffic, but does not include the shoulder, and where a highway includes two or more
separate roadways, the term "roadway" refers to any one roadway separately and not to all of the
roadways collectively;
1.25
"sidewalk" means the untravelled portion of a highway intended for the use of pedestrians;
1.26
"special constable" means a person appointed as such by the Elliot Lake Police Services Board;
1.27
"stand" or "standing", when prohibited, means the halting of a vehicle, whether occupied or not,
except for the purpose of and while actually engaged in receiving or discharging passengers;
1.28
"stop" or "stopping", when prohibited, means the halting of a vehicle, even momentarily, whether
occupied or not, except when necessary to avoid conflict with other traffic or in compliance with
the directions of a police officer or a traffic control sign or signal;
1.29
"through highway" means a highway or part of a highway designated as such by the Minister of
Transportation or by by-law of the City, and, every such highway shall be marked by a stop sign
or yield sign right-of-way sign in compliance with the Regulations of the Ministry;
1.30
"traffic" includes pedestrians, ridden or herded animals, vehicles and other conveyance either
singly or together while using any street for purposes of travel;
1.31
"traffic control signal" means that part of a traffic control system that consists of one set of no less
than three coloured lenses, red, amber and green, mounted on the frame, commonly referred to as
a signal head;
1.32
"vehicle" includes motor vehicle, trailer, traction engine, farm tractor, road-building machine,
bicycle and any vehicle drawn, propelled or driven by any kind of power including muscular
power but does not include a motorized snow vehicle, motorized wheelchairs or medical scooters,
or a street car.
2.00
THROUGH HIGHWAYS
2.01
The highways listed in Schedule "A" are designated as through highways.
2.02
The designations in subsection 2.01 shall not include any intersection in which traffic is controlled
by traffic control signals.
3.00
SIGNS AND TRAFFIC SIGNALS
3.01
The City Engineer shall be responsible for the erection and maintenance of all authorized signs
and traffic control signals under this by-law.
3.02
"Stop" signs shall be erected on all highways intersecting a "through highway".

3.03
"Stop" or "Yield" signs shall be erected at the intersections and locations described in Schedule
"B".
3.04
Traffic control signals shall be erected at the intersections and locations set out in Schedule "C".
3.05
No person shall place, maintain or display upon or in view of any highway any sign, signal
marking or device which imitates or resembles an authorized sign or traffic control signal or which
conceals from view or interferes with an authorized sign or traffic control signal.
3.06 The provisions of Section 122 of the Highway Traffic Act, R.S.O. 1990, c.H.8 with respect to
"Reduced Load Periods" shall be in force within the City of Elliot Lake where authorized
signs are posted.
a) The reduced load period shall occur between the first day of March and the thirty-first day
of May of each year, and shall apply to all Highways within the Municipality where such
authorized signs are posted and shall remain in effect until:
i)
the signs are removed by the Director of Public Works; or
ii)
the thirty-first day of May of the current year has passed;
whichever shall occur first.

4.00
EMERGENCIES
4.01
An OPP Officer may erect emergency no parking signs in the event of fires, emergencies, parades
or large assemblies and shall remove such signs within one hour of the event.
5.00 STOPPING, PARKING AND STANDING
5.01
No person shall stop, park or stand a vehicle on the untravelled portion of a highway or any
portion thereof except,
a)
on the right side of the highway, having regard to the direction in which the vehicle was
proceeding and so that the right side of the vehicle is parallel to and not more than 30
centimeters from the curb or, where there is no curb, so that the left side of the vehicle is
parallel to the edge of the roadway;
b)
where angle parking is permitted by authorized sign or other marking and,
(i)
within a parking space if it is clearly marked so that no part of the vehicle
encroaches on a contiguous parking space;
(ii)
in all other cases, between the authorized signs on the right hand side of the
highway having reference to the direction in which the vehicle has been lawfully
traveling and so that the traveled portion of the highway is to the rear of the vehicle
and, the line formed to the left hand side of the vehicle intersects the pavement
edge line at an angle of not less than 40 degrees, and not greater than 50 degrees.
c)
where there is a lease or license of the untravelled portion of the highway or any portion
thereof.

5.02
The exceptions set out in subsection 5.01 do not apply where a designated sign prohibits any
standing, stopping or parking.
5.03
The provisions of paragraph a), b) and c) of subsection 5.01 shall be deemed to be complied with
where reasonable attempts have been made to meet the provisions of the section even though
accumulation of snow or ice make it impossible for a driver to comply.
6.00
STOPPING
6.01
No person shall stop a vehicle,
a)
on a sidewalk;
b)
on a crosswalk;
c)
on a highway within 30 meters of a road excavation, repair or other road works or
construction;
d)
on a highway along side another vehicle which is stopped, standing or parked except where
such stopping, standing or parking is in compliance with traffic control signals, authorized
signs or other lawful traffic control methods;
e)
opposite a vehicle which is stopped, standing or parked on a highway where the highway is
less than 9 meters in width;
f)
on or adjacent to either side or end of a center strip separating two roadways;
g)
on or within a school bus loading zone unless that vehicle is a school bus while engaged in
the loading or unloading of passengers; or,
h)
across from or adjacent to school property between the hours of 800 to 1800 hours, Monday
to Friday inclusive where authorized signs are displayed;
i)
within 15 meters on all sides of a school crossing;
7.00 PARKING
7.01
No person shall park a vehicle on a highway,
a)
which has a width of 6 meters or less;
b)
in such manner as to obstruct;
i. ) a sidewalk,
ii. ) a crosswalk;
iii. ) a boulevard; or
iv. ) traffic
c) within 1 meter of an entrance on the highway to or from a private road or lane;
d) within 3 meters of a point in the edge of the roadway and nearest a fire hydrant
e) within an intersection or within 2 meters of the end of a curb radius of an intersection
f) in a position or place that prevents or is likely to prevent the removal of any vehicle already
parked on the highway

g) while displaying a sign or other indication that it is for sale, rent or similar use;
h) or portion thereof, unless otherwise provided for by an authorized sign, between the
hours of 12 o'clock midnight and 7:00 AM from the 1st day of November to the 31st day
of March.

7.02
When authorized signs are displayed, no person shall park or stop a vehicle on a highway,
a) within 45 meters of the bus stop sign on the approaching side and within 25 meters of the bus
stop sign on the leaving side;
b) within 30 meters of an entrance to a fire hall;
c) on any shoulder;
d) in or on a public lane;
e) within 15 meters of an intersection not controlled by traffic control signals; or,
f) within 60 meters of an intersection controlled by traffic control signals;
g) within 6 meters of a private driveway or designated fire access route.
7.03
Notwithstanding anything contained elsewhere in this by-law, no person shall park any vehicle on
any highway or in any signed "Overnight Parking Areas" of any municipal parking area in the
City for more than twenty (20) aggregate hours in any twenty-four (24) hour period.

8.00
NO PARKING HEAVY TRUCK
8.01
No person shall park a heavy truck on any highway in a residential zone.
8.02
The provisions of subsection 8.01 do not apply to a motor vehicle carrying passengers and goods
to and from premises which cannot be reached by highway except by way of a highway or portion
thereof referred to in this section and do not apply to a commercial vehicle which attends at a
residential premise within the prohibited area for the purpose of delivering and service and is
parked for a temporary period only.
9.00
LIMITED PARKING IN SPECIFIED LOCATIONS
9.01
When authorized signs have been erected no person shall park a vehicle in the areas designated in
Schedule "D" for a time longer that that set out in Schedule "D.

9.02
When authorized signs have been erected no person shall park a vehicle in the areas designated in
Schedule "E" for a time longer that that set out in Schedule "E"."

10.00 PROHIBITED PARKING IN SPECIFIED LOCATIONS
10.01 When authorized signs have been erected, no person shall park a vehicle in any of the following
places:
a)
on any part of a highway named and described in Schedule "F";

b)
within 12 metres of any intersection on any through highway;
c)
in any lane way.
11.00
LOADING AND UNLOADING COMMERCIAL VEHICLES
11.01
No person engaged in the loading or unloading of a commercial vehicle shall permit his vehicle
to stand for a period of more than fifteen (15) minutes.
11.02
Notwithstanding anything contained elsewhere in this by-law, where a lane is located at the rear
or to the side of premises to or from which the loading or unloading is to be carried out, the
loading or unloading shall be made from the lane.
12.00
SCHOOL BUS LOADING ZONES
12.01
No person shall park a vehicle other than a school bus in an area designated as a school bus
loading zone as set out in Schedule "G".
13.00 COMMERCIAL BUS LOADING AREA
13.01
No person shall park a vehicle other than a bus in an area designated as a bus stop as set out in
Schedule "H".
14.00 PEDESTRIAN CROSSWALKS
14.01
Crosswalks may be designated on those roadways set out in Schedule "I", and designated as
pedestrian crosswalks.
14.02
No driver shall fail to yield to a pedestrian lawfully within a crosswalk.
15.00 MUNICIPAL PARKING AREAS
15.01
No person shall park a vehicle in any municipal parking area designated in Schedule "K",
except in conformity with the markings on the road surface and, in accordance with the
authorized signs placed therein.
15.02
No person shall park a vehicle in a municipal parking area between the hours of 12 o'clock
midnight and 7: 00 A.M. from the 1st day of November to the 31st day of March and for no
longer than three (3) hours between 12 o'clock midnight and 7:00 A.M. at other times of the
year except those areas described in Schedule "L" and signed as an "Overnight Parking Area".
15.03
Notwithstanding anything contained herein, no person shall park a commercial vehicle in any
municipal parking area.
8
16.00 MISCELLANEOUS
16.01
No person shall stand or park a vehicle upon the roadway for any of the following purposes:
a)
displaying it for sale;
b) washing, greasing or repairing such vehicle except repairs necessitated by an emergency;
c) storage.
16.02
No person shall park on any highway or any municipal parking area for the purpose of
advertising or selling unless such parking has been specifically authorized by council.
16.03
a) No pedestrian shall proceed over or under a barrier installed
i) at any place where repairs are being made to a highway or sidewalk;
ii) where any work is in progress with respect to any public utility, sewers or water mains.
b) RESERVED.
(04-51)
c) Except where traffic control signals are in operation or where traffic is being controlled by a
Police Officer, a pedestrian about to enter upon a roadway shall yield the right-of-way to all
vehicles upon the roadway.
d) Where sidewalks are provided upon a highway, pedestrians shall walk upon the sidewalks
and not on the roadway.
e) Where sidewalks are not provided upon a highway, pedestrians walking along the highway
shall walk on the left-side facing oncoming traffic and when walking along the roadway,
shall walk as close to the left-edge thereof as possible.
f) The provisions of subsections (d) and (e) do not apply where, by reason of the accumulation
of snow or ice it is impossible for pedestrians to comply, provided however, that pedestrians
shall at all times comply with these subsections as closely as is possible under the
circumstances.
g) When authorized signs have been erected, no person shall drive a motor vehicle or a
motorized snow vehicle within any of the areas as set out in Schedule "J" attached hereto
and forming part of this by-law.
h) No person shall drive a motor vehicle or a motorized snow vehicle along a sidewalk.
16.04
a) Two or more persons riding bicycles shall not ride abreast or nearly so on any street or
highway, except in the course of overtaking and passing other vehicles.
b) No person shall ride a bicycle, other than a tricycle or sidewalk bicycle, on any sidewalk.
c) No person riding on a bicycle designed for carrying one person only shall carry any other
person.
17.00
PARKING ON PRIVATE PROPERTY
17.01
No person shall park or leave any motor vehicle on private property within the City or on
property owned or occupied by the City or any local Board thereof without first having obtained
authority from the owner or adult occupant of the property. A Police Officer or By-law

Enforcement Officer or Special Constable may direct that the vehicle parked be removed to a
suitable place. All costs incurred for such removal shall be charged to the owner.
17.02 Deleted
17.03
No person shall stand or park a vehicle in any signed tow-away zone located on lands owned or
operated by St. Joseph's General Hospital Elliot Lake, at 70 Spine Road, Elliot Lake. (04-25)
17.04
No person shall stand or park a vehicle in any signed "Doctors Parking" spaces located on lands
owned or operated by St. Joseph's General Hospital Elliot Lake, 70 Spine Road, Elliot Lake,
unless such vehicle has affixed thereto a valid Parking Permit issued by the Hospital.(04-25)
17.05 No person shall stand or park a vehicle in any metered parking space located on lands owned or
operated by St. Joseph's General Hospital Elliot Lake, where the time on the meter has expired.

18.00
DISABLED PERSON PARKING PERMITS
18.01
Disabled Person Parking Permits required to be affixed to the vehicle per section 18.02
shall be affixed in such a manner so they are clearly visible from the exterior of the
vehicle; (03-13) (05-23)
18.02
No person shall park a vehicle in a designated parking space unless such vehicle has affixed
thereto a valid Disabled Person Parking Permit issued by the Ministry of Transportation;

19.00
REMOVAL OF VEHICLES ILLEGALLY PARKED
19.01
In the event that a vehicle is found in violation of any of the provisions of sections 7.00, 8.00,
9.00, 10.00, 11.00, 12.00, 13.00, 15.00, 16.01, 16.02, 17.01 and 18.02, a Police Officer or By-
law Enforcement Officer or Special Constable may take the vehicle into his custody and may
cause it to be taken to and stored in a suitable place and all costs and charges for removal, care
and storage thereof are a lien upon the vehicle, which may be enforced in the manner provided
by the Repair and Storage Liens Act, R.S.O. 1990, c. R.25.

20.00
EXEMPTIONS
20.01 Where compliance herewith would be impracticable, the provisions of sections 5.00, 7.00, 9.00,
10.00, 11.00, 12.00, 13.00, 15.00, 16.05 (h), 17.00 and 18.02, shall not apply to:
a)
ambulance, police or fire department vehicles, public emergency vehicles;
b) vehicles actually engaged in works undertaken for or on behalf of the City. (04-25)

21.00 TIME
21.01
Wherever any hour or period of time is specified or referred to in this by-law, it shall mean
standard time or daylight saving time as may be in current use in the City. All Sections use a 24 hour
clock.
22.00
VIOLATION NOTICE
22.01
Where a vehicle is found parked in contravention of the parking provisions of this by-law, any
Police Officer or By-law Enforcement Officer or Special Constable finding the vehicle shall
attach to the vehicle a Parking Infraction Notice in the form of a serially numbered notice
stating:
a) the permit number and a description of the vehicle;
b) that the vehicle is unlawfully parked;
c) the date, time and place of the alleged offence.

22.02
The Parking Infraction Notice shall be prepared in duplicate and the Police Officer, Special
Constable or By-law Enforcement Officer shall attach one copy to the vehicle and deliver the
other copy to the Treasurer.

23.00
PENALTIES
23.01
Every person who contravenes any provision of this by-law is guilty of an offence and is liable,
upon conviction, to a fine not exceeding Five Thousand ($5,000.00) Dollars exclusive of costs,
for each offence, recoverable under the Provincial Offences Act.
23.02
Every person who contravenes the provision of this by-law relating to parking, stopping or
standing, is guilty of an offence and on conviction liable to a fine of $50.00 exclusive of costs.
Contravention of 18.03 shall include a fine of not more than $75.00 exclusive of costs.
23.03
Any person may upon presentation of a parking infraction notice issued for parking, stopping or
standing offence under this by-law, pay out of court within seven (7) days exclusive of
Saturdays, Sundays and holidays from the date of the issuance of such parking infraction,
notice, the sum of $40.00 and upon payment being made, no further proceedings will be taken
under this by-law in respect of the offence alleged in the parking infraction notice. If payment
is not made in accordance with the procedures set out in this subsection, the fine provided for in
23.02 shall be recoverable under the provisions of the Provincial Offences Act.
23.04
The owner of a motor vehicle may be charged with and convicted of an offence for
contravention of any provision of this by-law for which the driver of the vehicle is subject to be
charged unless, at the time of the offence, the vehicle was in the possession of some person
other than the owner without the owner's consent.

23.05
The owner or operator of the vehicle may, within seven (7) days, exclusive of Saturdays,
Sundays and holidays, after the day when the ticket is attached to the vehicle, report to the
office of the Treasurer or any person designated by him to receive such payments and pay the
sum of Sixty-five ($65.00) Dollars for breach of subsections 18.03.

24.00
AUTHORIZED SIGNS
24.01
Authorized signs other than those under the Highway Traffic Act shall be those set out in
Schedule "M".
25.00
PERMIT PARKING
25.01
The class or classes of motor vehicles for which a permit may be issued under this section are:
(a)
passenger motor vehicles, except motor homes and motorcycles.
(b)
Vans, panel trucks and pickup trucks registered with the province as PUO (personal use
only).
(c)
Vans, panel trucks and pickup trucks commercially registered with the Ministry of
Transportation having a registered gross weight of 3,000 kg or less.
(d)
Vans, panel trucks, transport trucks and pickup trucks commercially registered with the
Ministry of Transportation having a registered gross weight of more than 3,000 kg.
25.02
The By-Law Enforcement Officer is hereby appointed as the officer of the City to issue permits
or designate the use of Physician Parking Permits on behalf of the City pursuant to the
provisions of this section, and any permit or renewal of a permit may be issued on the direction
of the By-Law Enforcement Officer.
25.03
A permit issued or a designated Physicians Parking Permit pursuant to this section authorizes the
vehicle for which the permit is issued to be parked in the municipal parking area at the location
specified in the permit or in a Physicians Parking Space containing authorized signs provided a
valid Physician's Parking Permit is displayed for the vehicle, for any length of time despite the
three hour parking restriction set out in Section 15.02 of this by-law and despite any other
restricted time regulation established by by-law and posted.
25.04
An application for a permit under this section shall contain the following information:
(a)
the name and address of the registered owner of the motor vehicle.
(b)
the license number, colour, make and year of the motor vehicle.
(c)
In the case of a designated Physician Parking Permit, the assigned permit number shall also
be provided. A copy of the application containing the authorizing signature of the By-Law
Enforcement Officer shall be kept in the permit holder's records. (07-67)
25.05
While a vehicle is parked pursuant to a permit issued or a designated Physician Parking Permit
pursuant to this section, the permit form shall be placed on or affixed to the vehicle on the dash
of the driver's side or in the position designated by the By-Law Enforcement Officer.
25.06
Fees for Permit Parking are as follows:

(a)
$3.00 per day
(b)
$20.00 per week
(c) $60.00 per month except as permitted in clause (d) below.
(d) $10.00 per month for one (1) vehicle per dwelling unit, where the dwelling unit is
within the Central Commercial Area shown on Schedule "K" to this by-law. (03-13)
(e) A $1.00 fee will be charged for doctor or physician parking with the use of a valid
Physician Parking Permit designated by the By-Law Enforcement Officer when
parking in parking spaces containing authorized signs only, as indicated on Schedule
"D" to this by-law. The length of time the permit will be in force will be unlimited or
as determined by the By-Law Enforcement Officer. (07-67)
f) Notwithstanding the provisions of this section, an establishment holding a valid liquor
license from the Liquor Control Board of Ontario and located adjacent to a municipal
parking station shall be issued upon request, three complimentary overnight parking
passes for the sole use of their patrons. (10-43)
25.07
The By-Law Enforcement Officer may at any time revoke or cancel any permit issued pursuant
to this section.
