<!-- image --> BY-LAW # 06-20 ## A BY-LAW TO REGULATE AND CONTROL THE PARKING OF VEHICLES IN THE TOWNSHIP OF FRONT OF YONGE WHEREAS pursuant to the Municipal Act 2001, as amended, Councils of local municipalities may pass by-laws to regulate and control the parking of vehicles; AND WHEREAS various provisions of the Highway Traffic Act, 1990, as amended, apply to bylaws passed by the Councils of local municipalities respecting the prohibition, regulating and controlling of the parking, standing and stopping of vehicles on highways; AND WHEREAS the Council of the Corporation of the Township of Front of Yonge deems it expedient to regulate and control the parking of vehicles in the Township of Front of Yonge. NOW THEREFORE the Council of the Corporation of the Township of Front of Yonge enacts as follows: ## 1. DEFINITIONS Unless specifically modified or changed herein, words or expressions used in this bylaw have the same meaning as given or used in the Highway Traffic Act, 1990, as amended. For the purpose of this by-law the following definitions shall apply: - "Accessible Parking Permit" means a permit, plate or other marker or device issued by a provincial agency or similar jurisdiction depicting the international symbol for persons with a disability as recognized in the Highway Traffic Act. - b) "Accessible Parking Space" means a designated parking space as described in section 19.2 of this by-law and reserved for the use of persons with a disability. - c) "Authorized Emergency Vehicle" means: - a vehicle while used by a person in the lawful performance of his duties as a police officer or firefighter; - i) a fire fighting vehicle while proceeding to or returning from a fire or emergency call; - iii) an ambulance or cardiac arrest emergency vehicle while responding to an emergency call or being used to transport a patient or injured person in an emergency situation; or - iv) an emergency vehicle of a public or private utility, or Federal, Provincial or Municipal Department when such a vehicle is being used in the performance of emergency duties. - d) "Authorized Sign" means any parking or traffic control device or traffic signal placed or erected on a highway under the authority of this by-law for the purpose of regulating, warning or guiding traffic and includes such signs as described in the Regulations made pursuant to the Highway Traffic Act, 1990 as amended. - e). "Bike Lane" means a designated portion of the highway or highway shoulder designated by striping, signage, and pavement markings for the preferential or exclusive use of bicyclists. May have two way rraffic. - f) "By-Law Enforcement Officer" means a By-Law Enforcement Officer of the Township ofFront of Yonge and any other officer authorized by the Township of Front of Yonge for the enforcement of by-laws in the Township of Front of - "Commercial Motor Vehicle" means a motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, fire apparatus, and tractors used for hauling purposes on the highway. - h) "Controlled Parking Lot" means an area of land which has been arranged, laid out or improved to provide for the parking of vehicles and which is controlled or regulated by the use of a parking permit dispenser or persons engaged to manage access to the parking lot. - i) "Corner" means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic. - j) "Council" means the Council of the Corporation of the Township of Front of Front of Yonge. - k) "Crosswalk" means: - i) that part of the highway at an intersection that is included within the confines of the lateral lines ofthe sidewalk on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or - i) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossings by signs or by lines or other markings on the surface. - 1) "Cul-de-sac" means a highway terminating in a tum around. - m) "Curb" shall include the edge of the traveled portion of the highway. - n) "Curb Line" means: - i) where a curb has been constructed the line of the curb; or - ii) where no curb has been constructed the edge of the roadway. - 0) "Designated Parking Space" shall mean a parking space designated by the Township for the sole use of disabled persons. - p) "Designated Public Building" means an apartment building, church, hospital, hotel, motel, shopping centre, row house, industrial building and municipal facility and any other structure which is used for the accommodation of public or for the gathering or assembling of people. Definitions contained in the Zoning By-Law of the Township shall apply equally to this by-law. - 9) "Driver" means a person who drives a vehicle on a highway. - r) "Driveway" means the improved land on a highway which provides vehicular access from the roadway to adjacent land. - s) "Fire Access Route" means any road, driveway, lane, ramp or other mean of vehicular access or egress and shall conform to the requirements of the Ontario Fire Code Act and Regulations thereto, as amended. - t) "Fire Chief' means the Chief Fire Official of the Township of Front of Yonge or his/her designate. - u) "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof. - v) "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other. - W) "Island" means a portion of a highway so constructed or designed as to separate or direct vehicular traffic onto specific portions of the highway. - x) "Issuing Officer" means a Police Officer, By-Law Enforcement Officer or a Provincial Offences Officer authorized pursuant to the Provincial Offences Act to issue a Parking Infraction Notice. 4. У) "Median Strip" means that portion of a highway so constructed to separate traffic traveling in one direction from traffic traveling in the opposite direction by a physical barrier or a raised or depressed paved or unpaved separation area that is not intended to allow crossing vehicular movement. - z) "Motor Vehicle" includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Highway Traffic Act, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car, or other motor vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self propelled implement of husbandry or road building machine within the meaning of the Highway Traffic Act. "Vehicle" shall have a like meaning. 6. aa) "Township" means the Corporation of Front of Yonge 7. bb) "One Way Highway" means a highway upon which the movement vehicular traffic is designated by by-law for movement in one direction only. 8. cc) "Park or Parking" when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. 9. dd) "Parking Lot" means an area of land which has been arranged, laid out or improved to provide for the parking of motor vehicles. 10. ee) "Parking Permit" means a device, provided by the Township which allows the parking of vehicles in controlled parking areas at no charge or fee or at a fee other than that established by this by-law. 11. ff) "Parking Permit Dispenser" means a mechanical or electronic device, other than a parking meter, used for the control and regulation of the parking of vehicles measuring and indicating the parking time for which payment has been made. Such device will, when the proper coin is inserted, dispense a numbered parking permit indicating the date, month and time that the permit was issued together with such information required to inform the purchaser as to its proper use. - 88) "Parking Space" means a part of the highway, the use of which is designated by signs or posts, or lines or other markings on the highway or any other area used for the purpose of parking a vehicle. 13. hh) "Person" means a person, firm or corporation used in the normal context of the word. 14. ii) "Police Officer" means a member of the Ontario Provincial Police. 15. ii) "Provincial Offences Officer" means a Police Officer, Peace Officer or other person lawfully appointed, pursuant to the Provincial Offences Act, to enforce the by-laws of the Corporation. - kk) "Roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively. - 11) "Sidewalk" means that portion of a highway between the curb lines and the property line of the lot abutting the highway and which is intended for the use of pedestrians. - mm) "Shoulder" means that part of the highway lying adjacent to the roadway where there is no barrier curb, and which is improved with granular or paved surface which extends for a maximum distance of 3 metres. - nn) "Stand or Standing" where prohibited, means the halting of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer or of a traffic control sign or signal. For the purpose of this by-law, "Stop or Stopping" shall be interchangeable and have the same meaning as "Stand or Standing" - 00) "Stop or Stopping" shall be interchangeable and have the same meaning as "Stand or Standing" - pp) "Trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn. - 99) "Vehicle" shall have a like meaning as "Motor Vehicle" described above. ## 2. SCHEDULES AND SEVERABILITY - 2.1 The schedules "A", 'B", 'C", "D", "E", "F", "G", and "H" attached to this bylaw shall be read with and form part of this by-law. All measurements contained in the attached schedules are referenced from the nearest intersecting highway limit unless otherwise specified therein. - 22 Should any part, section, subsection or portion of this by-law be repealed or declared by a court of competent iurisdiction to be illegal the same shall not affect the validity of the by-law as a whole or in part thereof, except for that which was declared to be invalid. ## 3. METHOD OF PARKING ## 3.1 PARALLEL - 3.1.1 No person shali park a vehicle ortrailer on any highway, other than a one way highway, unless on the right-hand side of the highway having regard for the direction in which the vehicle had been proceeding and unless the right front and right rear wheels or runners of the vehicle are parallel to and distant respectively not more than 15 cm from the edge of the roadway. - 3.1.2 Parallel parking is hereby authorized on all highways in the Township of Front of Yonge upon which no specific parking restrictions have been imposed pursuant to this by-law. ## 3.2 ONE WAY HIGHWAYS Where parking is permitted on a one way highway, a person shall park a vehicle or trailer facing only in the direction in which it was proceeding and with the right front and right rear wheels parallel to and not more than 15 cm. from the edge of the roadway, providing that this provision shall not apply where parking on the left-hand side of one way highway is specifically authorized by by-law. ## 3.3 WITHIN PARKING SPACE Individual parking spaces may be defined by the Township by painted lines or other suitable marks on the surface of the parking lot or roadway. Where such parking spaces are so defined, it shall be unlawful to park a vehicle or trailer other than within the confines of the parking space so defined. - 3.4 It shall be unlawful for any person to cause or permit any vehicle or trailer registered in his or her name to be parked in any parking lot or roadway, in other. than a parking space, whether or not a valid parking permit or disabled person parking permit is displayed in the vehicle as prescribed herein. ## 4. PARKING PROHIBITED AT ANY TIME No person shall park or cause to be parked any vehicle or trailer in any of the following places at any time on any day unless such parking is explicitly permitted by painted lines on the pavement, signs or other municipal marker: - i) On or in any sidewalk, crosswalk, boulevard, tum around of a cul-desac, level railway crossing or intersection 2. ii) Adjacent to any island or median strip constructed on the highway 3. ili) In front of a public or private driveway or within 1.5 metres of a public or private driveway 4. iv) Within 9 metres of the nearest curb of any intersecting street - V) On any designated bike lane 6. vi) Within 6 metres of a crosswalk at an intersection 7. vii) Within 6 metres of a level railway crossing 8. vili) On any bridge or within 30 metres of approaches thereto - x) In such a position as to prevent the convenient removal of any other vehicle previously parked or standing 10. ix) On any street in such a manner as to obstruct traffic 11. xi) On any highway within 15 metres of the termination of a dead end highway 12. xiii) On any roadway for a longer period than twenty-four consecutive hours regardless of compliance with any other provision of this by-law 13. хії) In front of the entrance to a, hotel, nursing home, theatre, auditorium or other building utilized for the assemblage of persons 14. xiv) Opposite another vehicle which is already parked, stopped or standing on the other side of the street, where the width of the traveled portion of the street, or the width between curbs is less than 11 metres or where such parking would prevent the free passage of two lanes of traffic 15. xVI) On any highway for the purpose of displaying the vehicle for sale 16. xV) On any Yield Lane or within 5 metres of any Yield Lane 17. xvii) On the traveled portion of the highway where the highway width is 6 metres or less 18. xviii) On any highway for the purpose of greasing or repairing the vehicle except for such repairs necessitated by an emergency ## DESIGNATED "NO PARKING" AREAS - 5.1 Those highways and portions of highways named and described in Schedule "B" hereto shall be designated "No Parking" areas. - 5.2 Where authorized signs to that effect are on display, no person shall park a vehicle or trailer at any time within the highway or portion of highway named or described in Schedule "B" as a "No Parking" area. - 5.3 Where authorized signs to that effect are on display, no person shall park a vehicle or trailer within the highway or portion of highway named or described in Schedule "C" during the time period for which such parking restrictions are in effect, as indicated in the said Schedule. -6- - 5.4 Where such a zone has been established, authorized signs shall be erected at a distance of not more than 30 metres (100 feet) between signs. ## 6. FIRE ACCESS ROUTES - 6.1 Portions of municipally owned highways and the private roadways or portions of parking lots of the designated Public Buildings named and described in Schedule "A" are hereby designated as Fire Access Routes. - 6.2 Where authorized signs to that effect are on display, no person shall park a vehicle or trailer within or so as to obstruct a fire access route. - 6.3 Where a fire access route has been established on public or private property, authorized signs shall be erected at a distance of not more than 30 metres (100 feet) between signs. - 6.4 Section 6.2 shall not apply to an authorized emergency vehicle. ## 7. NO PARKING DURING WINTER MONTHS - 7.1 No person shall park a vehicle or permit a vehicle or trailer to remain parked on a highway or shoulder at anytime between the hours of 11:00 p.m. and 7:00 a.m. of the next following day from December 1st to April 15t. - 7.2 No person shall park a vehicle or permit a vehicle or trailer to remain parked on a highway at anytime in such a manner that interferes with snow clearing operations. - 7.3 Where temporary signs have been posted, no person shall park a vehicle or trailer or permit a vehicle or trailer to remain parked on a highway in such a manner that interferes with snow removal operations. ## 8. DESIGNATED "RESTRICTED PARKING" AREAS - 8.1 Those highways or portions of highways named and described in Schedules "E", "F" and "G" shall be designated as "Restricted Parking" areas. - 8.2 Where authorized signs to that effect are on display, no person shall park a vehicle or trailer within the highway or portion of highway named or described in Schedule "E" for a longer period of time than one hour, during the time, indicated on the said Schedule, for which such parking restrictions are in effect. - 8.3 Where authorized signs to that effect are on display, no person shall park a vehicle or trailer within the highway or portion of highway named or described in Schedule "G" for a longer period of time than 15 minutes, during the time, indicated on the said Schedule, for which such parking restrictions are in effect. ## 9. MAXIMUM PARKING LIMIT - 9.1 This provision of the by-law pertains to the Mallorytown Village area and the hamlet areas of the Township as designated in the Official Plan. - 9.2 Subject to the other provisions of this by-law, no person shall park a vehicle or trailer, or permit a vehicle or trailer to remain parked on a highway or a highway shoulder for a period of time longer than three (3) hours between 7:00 a.m. of one day and 7:00 p.m. of the same day unless previously authorized.. - 9.3 No person shall park a vehicle or trailer or permit a vehicle or trailer to remain parked on a highway within one (1) hour from the time of its removal from a part of highway referred to in subsection 9.2 and within three hundred (300) metres of such part of highway. - 9.4 Subject to subsection 9.5, no person shall park a vehicle or trailer exceeding six and one-half (6.5) metres in length or a school bus or permit a vehicle exceeding six and one-half (6.5) metres in length or school bus to remain parked on a highway at any time between 9:00 p.m. of one day and 7:00 a.m. of the next following day. - 9.5 Subject to the other provisions of this by-law, the provisions of subsection 9.4 shall not apply to vehicles exceeding six and one-half (6.5) metres in length or school buses parked on designated truck routes. ## 10. COMMERCIAL LOADING ZONES - 10.1 Where authorized signs have been erected and are on display, no person shall stand or park any vehicle or trailer, other than a commercial motor vehicle or authorized emergency vehicle, in any area designated as a loading zone. No person shall park a commercial motor vehicle in a loading zone for a period exceeding the actual time required to load and unload the commercial vehicle or 30 minutes which ever is the shorter. ## 11. PASSENGER LOADING ZONES - 11.1 Where authorized signs have been erected and are on display, no person shall stand or park any vehicle or trailer in any area designated as a passenger loading zone for any purpose other than to load and unload persons from a standard passenger vehicle. While so parked, such passenger vehicle shall display its four-way flashing emergency lights. No person shall park a passenger vehicle in a passenger loading zone for a period exceeding the actual time required to load or unload such persons or five (5) minutes which ever is the shorter. ## 12. SCHOOL BUS LOADING ZONES - 12.I Such School Bus Loading Zone designations shall apply on regular school days between the hours of 6:00 a.m. and 6:00 p.m., Monday to Friday inclusive. The School Bus Loading Zone designation shall be considered an overlay designation imposed in addition to other parking restrictions contained herein. At all other times and days, parking in such designated School Bus Loading Zone shall be in compliance with the provisions of this by-law. - 12.2 Where authorized signs have been erected and are on display, no person shall stand or park any vehicle or trailer, other than a school bus, in any designated area as a School Bus Loading Zone. - 12.3 Council may establish School Bus Loading Zones on highways adjacent to schools or public buildings as required. ## 13. BUSLAYBY - 13.1 Where authorized signs have been erected and are on display, buses, school buses and taxis shall be permitted to enter into the designated area for the sole urpose of loading and discharging passengers. No driver or operator of a bus school bus or taxi shall permit a vehicle to stand, stop or be parked in suck described areas for a period oftime in excess ofthe time actually required to load or discharge passengers. ## 14. PARKING ON PRIVATE LANDS - 14.1 No persons shall park or leave any vehicle or trailer on private property without the consent of the owner or occupant of such property. - 14.2 Where an owner or occupant of property has posted signs stating conditions on which a motor vehicle may be parked or left on the property or prohibiting the parking or leaving of a motor vehicle or trailer on the property, a motor vehicle or trailer parked or left on the property contrary to such conditions or prohibitions shall be deemed to have been parked or left without the owner's or occupant's consent. - 14.3 The Township may appoint a person who is not an employee of the Township as a Municipal By-Law Enforcement Officer under the Police Services Act for enforcing the provisions of this section of the by-law. The Township shall, be responsible to ensure that the person appointed is properly trained to perform the duties arising out of the appointment. - 14.4 The Township may appoint a person who is not an employee of the Township as a Provincial Offences Officer authorized pursuant to the Provincial Offences Act to issue a Parking Infraction. The Township shall, be responsible to ensure that the person appointed is properly trained to perform the duties arising out of the appointment. ## 15. PARKING ON TOWNSHIP OWNED LANDS - 15.1 No person shall park or leave any vehicle or trailer on Township owned or controlled property without the consent of the Township. - 15.2 Vehicle or trailers parked on township owned or controlled lands, in accordance with the provisions of this Section or Section 17 (Controlled Parking Lots) shall be deemed to be parked with the consent of the Township. - 15.3 Where authorized signs have been erected and are on display, no person shall park or leave any vehicle or trailer in the off-street parking lots or vacant lands adjacent to and associated with the following township facilities unless such person is an employee or elected official of the township engaged in township business or such person is, at the time the vehicle or trailer is parked or left, actively participating in the activities currently being provided in or on the township property or engaged by such patron to provide transportation: - 15.4 Notwithstanding Section 15.3 signs may be posted by the Township defining certain parking spaces within the lands associated with the facilities as being reserved for use by certain classes of vehicle or trailers and such use shall be clearly marked on the sign. No person shall park any vehicle or trailer, other than the class of vehicle or trailer marked on the sign, in any parking space so reserved. - 15.5 Vehicle or trailers parked on municipally owned or controlled lands, contrary to the provisions of this Section or Section 17 (Controlled Parking Lots) shall be deemed to be parked without the consent of the Township until written consent is otherwise provided by the Ontario Provincial Police or the ByLaw Enforcement Officer. ## 16. NO STOPPING AREAS - 16.1 Those highways and portions of highways named and described in Schedule "H", in the Township of Front of Yonge are hereby designated as "No Stopping Areas". - 16.2 Where authorized signs to that effect are on display, no person shall stop a vehicle or trailer at any time within the highway or portion of highway named or described in Schedule "H" as a "No Stopping" area. - 16.3 Where such a zone has been established, authorized signs shall be erected at a distance of not more than 30 metres (100 feet) between signs. ## 17. CONTROLLED PARKING LOTS - 17.l Those lands, more particularly described in Schedule "f", owned or leased by the Township of Front of Yonge are hereby designated as controlled parking lots. - 17.2 No person shall park a vehicle or trailer in any parking space in any controlled parking lot for a period longer than designated in Schedule "F". Parking in controlled lots is prohibited between the hours of 11:00 p.m. and 7:00 a.m. of the next following day. - 17.3 All vehicle or trailers shall be properly parked in a parking space in a manner that will not create a hazard or nuisance. - 17.4 Any vehicle or trailer parked in violation of any Part of Section 17 of this bylaw shall be considered as being parked without consent of the Township and be subject to Section 26. ## 18. PARKING PERMITS - 18.1 The Township may, at its discretion, may issue permits for on street parking and in controlled parking lots (as described in Section 17) on a daily, weekly or monthly basis. - 18.2 A valid parking permit shall be displayed prominently so asto be readily visible from the exterior of the vehicle or trailer. Failure by the driver or owner to display the parking permit in this manner shall void all privileges associated with the issuance of the permit. - 18.3 No person shall use an expired permit, nor tamper with said permit in any manner so as to fraudulently present it as a valid permit. Use in this manner shall void all privileges associated with permit use and may cause the vehicle or trailer to be removed in accordance with Section 26. - 18.4 The Township reserves the right to cancel a permit before it expires if there is any evidence of misuse of the permit or if the permit holder fails to abide by the provisions of Section 4 of this by-law. ## 19. ACCESSIBLE PARKING - 19.1 Every owner and operator of a public parking area shall provide reserved parking spaces for the exclusive use of persons with a disability, or persons conveying persons with a disability, to park their motor vehicles, in at least the amount prescribed by the following table: | Capacity of public Parking Area (Number of total spaces) | Minimum number of spaces to be reserved as accessible parking spaces | |------------------------------------------------------------|------------------------------------------------------------------------| | 1-19 | | | 20-99 | 1 | | 100-199 | 2 | |--------------|-----| | 200-299 | 3 | | 300-399 | 4 | | 400-499 | 5 | | 500 and more | 6 | ## PARKING SPACE REQUIREMENTS 19.2 The reserved parking spaces referred to in Section 19.1 shall be: - a) of a width, of 3.66 metres (12 feet) each; - c) hard surfaced; - b) of a length so asto be the same length as the other parking spaces in the same parking facility; - d) level; - e) placed so as to be accessible to persons with a disability whether via ramps, depressed curbs, or other appropriate means, and so placed as to permit easy access by such persons to or from a motor vehicle parked therein; and - f) identified by authorized signs as prescribed in subsection 19.3. ## AUTHORIZED SIGNS - 19.3 Authorized signs for accessible parking spaces shall comply with the signs described under Section 11 of Ontario Regulation 581 made under the Highway Traffic Act. - 19.4 The public parking area owner and operator shall be jointly responsible for the procurement and installation of the authorized signs referred to in paragraph 19.2(f). - 19.5 The public parking area owner and operator shall be jointly responsible: for the maintenance of the authorized signsreferred to in paragraph 19.2(f); and for ensuring that the shape, symbols and colours of the authorized signs referred to in paragraph 19.2 conform to the provisions of subsection 19.3 hereof. ## APPROPRIATE FEE - 19.6 Persons with a disability shall not be required to pay an amount in excess of the normal fee paid by other users of the same public parking facility. ## PROHIBITED PARKING - PROHIBITED USE OF PERMIT - 19.7 (a) No person shall park or leave a motor vehicle or trailer in a public parking area in an accessible parking space and identified by authorized signs as prescribed by subsection 19.3 ofthis by-law, unless a valid accessible parking permit is displayed on its dashboard or on the sun visor in accordance with the provisions of the Highway Traffic Act. - (b) The provisions respecting the placement of a valid accessible parking permit referred to in subsection (a) shall be deemed to be satisfied if a valid accessible parking permit is placed on the dashboard or on the sun visor of the motor vehicle at the request of a constable, a municipal by-law enforcement officer or a public parking area owner or operator. - (C) No public parking area owner or operator shall authorize any person to park or leave a motor vehicle or trailer in an accessible parking space and identified by authorized signs as prescribed by subsection 19.3 of this by-law unless, the driver is a physically disabled person, or a person conveying a physically disabled person; and a valid accessible parking permit is displayed on the dashboard or on the sun visor of said vehicle in accordance with the provisions of the Highway Traffic Act. - (d) No person, other than the person to whom it was issued or a person conveying the person to whom it was issued or a person providing transportation services for a corporation or organization to whom it was issued to provide transportation services primarily to persons with a disability, shall use or display an accessible parking permit issued to a person with a disability to enjoy the privileges or avoid the restrictions set out in subsection (a). - (e) Despite the other provisions of this by-law, a municipal by-law enforcement officer, a police officer or an officer appointed for carrying out the provisions of sec. 14.3 of this by-law does not require a complaint of the public parking area owner or operator to enforce the provisions of subsection (a). - (f) A displayed accessible parking permit shall not be valid when the motor vehicle in or on which it is displayed is not actually being used for the purposes of transporting a person with a disability. ## FREE ACCESS 19.3 of this by-law and each space shall be kept free of snow or otherwise maintained to the same standards as all other parking spaces in the same parking facility. - 19.8 Public parking area owners and operators shall maintain unobstructed access to each accessible parking space identified by authorized signs as prescribed by subsection ## OFFENCES AND FINES - (b) Any person who contravenes the provisions of subsections 19.7(a) or | 9.7(d) is guilty of an offence. - 19.9. (a) Any public parking area owner or operator who contravenes any of the provisions required of him/her by Section 19 of this by-law is guilty of an offence. - (c) Every person who is convicted of an offence is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990, as amended. - (d) Any person who is issued a parking infraction notice for alleged violation of subsection 19.7(a) hereof because a valid disability parking permit was not displayed and who within thirty (30) days (exclusive of Saturdays, Sundays and Public Holidays) from the date of issue of the parking infraction notice obtains a valid disability parking permit, upon presentation of the said notice and the said permit at the Municipal Office, shall not be required to pay the penalty for the alleged violation of the provisions of the said notice. ## 20. MUNICIPAL VEHICLE EXEMPTION Any vehicle or trailer owned by the Township of Front of Yonge, under contract to the Township of Front of Yonge and any authorized emergency vehicle shall be permitted to park in any parking space, metered parking space or controlled parking lot and the operator of such vehicle shall not be required to deposit any coins in the meter adjacent to any such parked vehicle nor display a parking permit, provided always that the said vehicle displays, on the exterior of the vehicle, a recognized symbol of the Township or wording announcing the ownership of the vehicle and is being used in the performance of township duties. - 20.1 Section 20 does not apply to the use of designated accessible parking spaces as described in Section 19. ## 21. EMERGENCY PROHIBITION - 21.1 Notwithstanding anything to the contrary contained herein, the Fire Chief or his designate, Superintendent of Public Works, a Police Officer or By-Law Enforcement Officer, during any emergency or special circumstance may: - prohibit any or all parking on a highway within the area affected by the emergency or special circumstances; - ii) authorize the erection of temporary "No Parking" signs or barricades on any highway or portion of highway; or - ili) declare that any vehicle or trailer already parked is parked illegally regardless of the time permitted for parking such vehicle or trailer under the provisions of this by-law. - 21.2 Where the owner or driver of the vehicle or trailer cannot immediately be located, the said vehicle ortrailer declared to be parked illegally may be removed and impounded forthwith by an order of a Police Officer in accordance with Section 26 of this by- law. Where, in the opinion of the Officer, the vehicle owner has not voluntarily contravened the police directive the costs associated with towing and impounding will be borne by the Township. ## 22. AUTHORIZED SIGNS AND PARKING CONTROL DEVICES - 22.1 The Township shall erect all authorized signs and other parking control devices necessary for the lawful implementation and enforcement of this by-law on Township property. Fire route and disabled signage as required by this by-law which are located on private property shall be erected and maintained by the property owner. - 22.2 No person shall place, maintain or display upon or in view of any highway any sign, signal, marking or device which purports to be or is an imitation or resembles any authorized sign or parking control device. - 22.3 No person shall damage, deface or tamper with any authorized sign, or other parking control device and no unauthorized person shall move, open or attempt to open the same. ## 23. OFFENCES - 23.1 Any person found to be in contravention of this by-law either by doing any act forbidden or by failing to do any act required by this by-law, is guilty of an offence. - 23.2 The owner of the motor vehicle or trailer is liable for any penalty provided under this by-law unless at the time the offence was committed the motor vehicle was in the possession of a person other than the owner without the owner's consent. ## 24. PARKING INFRACTION NOTICE - 24.1 Where a vehicle is found to be in contravention of the parking or stopping provisions of this by-law the Issuing Officer may issue and place on the vehicle a serially numbered Parking Infraction Notice in the form prescribed by the Provincial Offences Act. - 24.2 The Parking Infraction Notice mentioned in Section 24.1 above shall be prepared as required and the Issuing Officer shall attach one copy to the vehicle or trailer and retain the other two copies for further processing in accordance with the Provincial Offences Act, as amended. - 24.3 If payment is not made in accordance with the procedure set out on the Parking Infraction Notice provided for in Section 24.1 above, the Provincial Offences Act, as amended, shall apply. ## 25. PENALTIES - 25.1 Any person violating any of the provisions of this by-law is guilty of an offence and on conviction shall be liable to a penalty pursuant to the Provincial Offences Act, as amended. - 25.2 Set fines may be established for certain offences contained in this by-law. Such set fines shall be established pursuant to the Provincial Offences Act and shall become effective upon the approval of same by the Chief Justice of the Provincial Offences Court. Set fines established in this manner shall be included as schedule "D" of this by-law. ## 26. REMOVAL OF ILLEGALLY PARKED VEHICLE In addition to any other penalties provided by this by-law, upon discovery of any vehicle or trailer parked, stopped or standing on any highway in contravention of this by-law, a By-Law Enforcement Officer, Police Officer, or an officer appointed for the carrying out of the provisions of this by-law, may cause such vehicle to be moved or taken to and placed or stored in a suitable place, and all costs and charges for the removing, care and storage thereof, if any, shall be those of the owner of the vehicle or trailer, and are a lien upon the vehicle or trailer being released and may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O., 1990. ## 27. ENFORCEMENT AND AUTHORITY - 27.1 The provisions of this by-law shall be enforced by the By-Law Enforcement Officers and Police Officers responsible for the Township respectively or by the Provincial Offences Officers authorized pursuant to the Provincial Offences Act to issue a Parking Infraction Notice. ## 28. SHORT TITLE This by-law may be cited as "The Township of Front of Yonge Parking By-Law". ## 29.
