THE CORPORATION OF THE TOWN OF GEORGINA INTHE REGIONAL MUNICIPALITY OF YORK BY-LAW NUMBER 2003-0077 (REG-1) BEING A BY-LAW TO REGULATE THE REMOVAL OF SNOW AND ICE FROM BUILDING ROOFS AND APPURTENANCES WHEREAS the Municipal Act, 2001 as amended authorizes a municipality to pass by-laws to require the owners or occupants of buildings to remove snow and ice from the roofs of the buildings and may regulate when and how the removal shall be undertaken. NOW THERFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF GEORGINA ENACTS AS FOLLOWS: 1. DEFINITIONS: In this by-law, (a) "building" means any structure with walls and a roof; (b) "occupant" means any person over the age of eighteen (18) years who is in possession of the building or property; (c) "owner" means any person managing or receiving the rent for the premises whether on that persons own behalf or on behalf of another and includes a lessee or occupant of the property; (d) "roof" includes, but not be limited to, gutters, eavestroughs including downpipes, soffits, fascias, chimneys, antennas and aerials or any attachment to the aforementioned. 2. GENERAL PROHIBITIONS: (a) Every owner or occupant of a building shall remove from the roof thereof all snow and ice forthwith that may or is likely to fall onto the street, sidewalk or walkway below whether it be on public or private property. (b) No person shall remove snow and ice from a roof without providing adequate warning to or protection for persons passing below. (c) Every owner or occupant of a building shall ensure that the removal of snow and ice pursuant to section 2 (a) has been completed by 12:00 o'clock midnight of the first day following its accumulation excluding Sunday and shall dispose of the snow and ice in such a manner so as not to obstruct any portion of a pedestrian right of way on both public and private property. 3. -2- ENFORCEMENT: The provisions of this by-law may be enforced by a Police Officer or a Municipal Law Enforcement Officer. 4. PENALTY: Every person who contravenes any of the provisions of this by-law, upon conviction, is guilty of an offence and is liable to a fine pursuant to the Provincial Offences Act, as amended. 5. REPEALS: By-law 87-177 (PBE-1) is hereby repealed. READ a first, second and third time and passed on this 9th day of June, 2003. Roland Chenier, Town Clerk
