THE CORPORATION OF THE TOWN OF GODERICH
BY-LAW NO. 63 OF 2017
BEINGA BY-LAW TO REGULATE ANIMAL CARE AND CONTROL WITHIN THE
TOWN OF GODERICH
WHEREAS Section 9 of the Municipal Act, 2001, c. 25 provides that a Municipality has the
capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority;
AND WHEREAS Section 11(1) of the Municipal Act, 2001, S.O. 2001 c. 25 authorizes a lower-tier
municipality to provide any service or thing that the municipality considers necessary or desirable
for the public, subject to the rules set out in Subsection (4) of the Act;
AND WHEREAS Section 11(3) of the Municipal Act, 2001, S.O. 2001 c. 25 authorizes a lower-tier
municipality to pass by-laws respecting animals;
AND WHEREAS Section 103(1) of the Municipal Act, 2001, S.O. 2001 c. 25 provides that
municipalities may pass a by-law regulating or prohibiting with respect to the being at large or
trespassing of animals and may provide for the seizure, impounding and sale of such animals being
at large or trespassing contrary to the by-law;
AND WHEREAS Section 105 of the Municipal Act, 2001, S.O. 2001 c.25 provides that a
municipality shall, upon the request of the owner of the dog, hold a hearing comprised of Goderich
Town Council, to determine whether or not to exempt the owner in whole or in part from the
requirement to muzzle a dog;
AND WHEREAS Section 151 of the Municipal Act, 2001, S.O. 2001, c. 25 authorizes a
municipality to provide for a system of licences with respect to a business;
AND WHEREAS Section 391 of the Municipal Act, 2001, S.O. 2001 c.25 authorizes a
municipality to impose fees or charges on persons for services or activities provided or done by or
behalf of it;
AND WHEREAS Section 12 of the Dog Owner's Liability Act, R.S.O. 1990, c. d.16 designates a
Municipal Law Enforcement Officer as a Peace Officer for the purposes of enforcing the Act;
AND WHEREAS the Municipality may use its discretionary authority in Section 398(2) (2) of the
Municipal Act, S.O. 2001, c.25 to add dog licence fees plus penalty, to the property tax roll if the
dog owner owns property in the Municipality, but nothing in this section shall preclude the dog
owner from paying the dog licence fee directly to the Animal Control Officer or to the Municipal
Office.
AND WHEREAS the Corporation of the Town of Goderich deems it desirable to pass a by-law
with respect to the control of animals and prohibited animals;
AND WHEREAS Council deems it necessary and advisable to create set fines for violation of
$125.00 and $200.00;
AND WHEREAS for the purpose of proceedings under Part 1 of the Provincial Offences Act, the
amount of fine set by the court for an offence is such amount as may be set by the Chief Judge of
the Ontario Court (Provincial Division);
AND WHEREAS a copy of the Judge's approved set fine schedule will be attached to this By-Law.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
GODERICH ENACTS AS FOLLOWS;
PART 1-DEFINITIONS
In this By-Law:
1.1
This By-Law may be cited as the "Animal Control By-Law."
1.2
"Act" means the Municipal Act, 2001 R.S.O. 2001, Chapter 25, as amended from time to
time.
1.3
"Adult" shall mean a person over the age of 18 (eighteen) years.
1.4
"Animal" shall mean any member of the animal kingdom, other than a human being.
1.5
"Animal Control Officer(s)" shall mean the person(s) appointed by Council by By-Law to
carry out, enforce and implement the provisions of this By-Law.
1.6
"Beach" means a landform along a body of water usually consisting of loose particles of
rock, sand, gravel, shingle, pebble or cobble.
1.7
"Boardwalk" means the path or walkway made up of wooden or composite boards along the
beach
1.8
"Cat" means any cat, male or female, spayed or neutered, over the age of eight (8) weeks.
1.9
"Clerk" means the Clerk appointed by the Council of the Corporation of the Town of
Goderich pursuant to the Act.
1.10 "Council" means the Council of the Corporation of the Town of Goderich.
1.11 "Dog" means for licensing purposes, any dog-male or female; neutered male; spayed female
over the age of eight (8) weeks.
1.12 "Dog Tag" means an identification tag bearing a serial number and the current year in which
it was issued by the Clerk, his/her designate, or the Animal Control Officer.
1.13 "Domesticated" means an animal of a species that has been domesticated by humans so as
to live and breed in a tame condition and depend on humankind for survival.
1.14 "Dwelling Unit" means one or more habitable rooms constituting self-contained living
quarters for use by one or more individuals including the provision of kitchen and sanitary
facilities and sleeping accommodation for the exclusive use of such individual or
individuals, and having a private entrance from outside the building or from a common
hallway or stairway inside the building, and the land on which it is located.
1.15 "Grandfather" means a grandfather clause allowing animals owned prior to the passage of
this By-Law, to be kept by their owners provided the pet was microchipped and licensed.
1.16 "Harbour" means any person who possesses or has custody of an animal but does not
include providing shelter to a dog for a period of time of less than seven (7) days, provided
that the dog is owned by someone other than the Household Group normally a resident in
the Dwelling Unit and can provide proof of a permanent address.
1.17 "Fouling" shall be deemed to be animal excrement.

1.18 "Fowl" without restricting the generality thereof for the purpose of this By-Law domestic
fowl shall include hens, chickens, roosters, pullets, chicks, ducks, geese, turkeys and guinea
fowl, etc. (wild fowl, pheasants and peacocks)
1.19 "Kennel" means a place where dogs and other domestic animals other than livestock are
bred and raised, and are sold or kept for sale or boarded.
1.20 "Licence" means a licence issued by the Municipality pursuant to the Act and this By-Law.
1.21 "Microchip" means an encoded identification device meeting the Canadian standard of the
National Companion Animal Coalition and implanted into an animal, which contains a
unique code that permits or facilitates access to owner information, including the name and
address of the owner, which is stored in a central data base.
1.22 "Municipality" means the Corporation of the Town of Goderich
1.23 "Municipal Law Enforcement Officer" means a By-law Enforcement Officer or Peace
Officer, interim or full time, as appointed by Council for the Corporation of the Town of
Goderich.
1.24 "Muzzle" means a humane fastening or covering device of adequate strength placed over
the mouth of an animal to prevent it from biting and word "muzzled" and or "muzzling"
have a similar meaning.
1.25 "OSPCA" means the Ontario Society for the Prevention of Cruelty to Animals.
1.26 "Owner" means a person who owns an animal or a person who possesses, keeps, or
harbours an animal for any period of time, and where the owner if a minor, the person
responsible for the custody of the minor.
1.27 "Park or Recreation Area" means an area of natural, semi-natural or planted public space set
aside for human enjoyment or recreation or for the protection of wildlife or natural habitat.
1.28 "Peace Officer" means the Animal Control Officer and/or a Provincial Offences Officer with
the meaning of the Provincial Offences Act, R.S.O. 1990, Chapter P. 33.
1.29 "Pit Bull":
-
A pit bull terrier (not a breed)
-
A Staffordshire Bull Terrier
-
An American Staffordshire Terrier;
-
An American Pit Bull Terrier
-
A dog that has the appearance and physical characteristics that are substantially
similar to those listed above.
1.30 "Pound" means the place which is used for the temporary housing and care of animals that
have been impounded pursuant to this by-law and so designated by the Council.
1.31 "Pound Keeper" means the person or agency designated for the Municipality to oversee and
operate the pound.
1.32 "Prohibited Animal" means an animal of which the keeping is prohibited within the
Corporation of the Town of Goderich as described in Schedule "A" of this by-law.
1.33 "Protective care" means the temporary, time-limited keeping of an animal by the
Municipality as a result of an eviction, incarceration, fire or medical emergency.

1.34 "Running at large" means to be found in any place other than the premises of the owner of
the animal and not under any control of any person and not on a leash and under the control
of any person. Said leash not to be longer than 1.8 meters in length.
1.35 "Service Dog" means an assistance dog specifically trained to help people who have
disabilities including but not limited to, visual impairment, hearing impairment, mental
illnesses, seizure disorders, mobility impairment and diabetes.
1.36 "Vermin" means various small animals, such as rats or cockroaches, that are destructive,
annoying, or injurious to health.
1.37 "Vicious Dog" means a dog which has without provocation attacked or bitten a person or
another animal or communicated by its actions or intention, habit, tendency or has
demonstrated a propensity to do so. That in instances where, in the opinion of the Animal
Control Officer, a dog should be restricted on an owner's property, the following shall apply:
A dog must be tied or in a chained or fenced area but which shall not be within .9 meters of
the property line.
PART 2-ANIMAL CONTROL
2.1
No owner or person shall allow, permit or cause an animal to run at large.
2.2
Every person who keeps an animal within the Town of Goderich shall ensure that such
animal is provided with:
(a) A clean and sanitary environment free from an accumulation of fecal matter, odor,
insect infestations or rodent attractants that disturb or are likely to disturb the enjoyment,
comfort, convenience of a person or may endanger the health of any person or animal;
and,
(b) Adequate and appropriate care, food, water, shelter, and opportunity for physical
activity.
2.3
No owner or other person who has an animal under his/her care and control by means of a
leash, shall permit the animal to enter upon private property without the consent of the
owner of that property.
2.4
Any animal found or seen to be running at large by a Peace Officer may be seized and
impounded.
2.5
Domestic cats do not have to be leashed to be considered under the control of the owner.
2.6
If a dog is tied or in a pen, it shall be a minimum 3 feet (0.9 metres) of any property line.
PART 3-LICENSINGAND REGISTRATION OF DOGS
3.1
Every owner of a dog in the Town of Goderich shall within fifteen (15) days after becoming
such owner, cause such a dog to be licensed in the office of the Town Clerk for a period
which will expire on the last day of December in the current year, and shall thereafter
annually on or before the last day of February each year cause such dog to be again licensed
for one year from the said 1st day of January. Every owner shall pay the license fees as
referenced in the Town of Goderich Fee By-Law.
Late Penalty for Non-Renewal: Any person who fails to renew a dog licence on or before
the last business day of February shall be subject to a penalty as set out in the Town of
Goderich Fee By-Law.

3.2
Except as provided herein, no person shall harbour a dog or dogs within the boundaries of
the Municipality unless such dog has affixed to it a current dog tag issued under this By-
Law.
3.3
No female dog shall be licensed as a spayed female dog and no male dog shall be licensed
as a neutered male dog unless a certificate in writing by a Doctor of Veterinary Medicine is
produced certifying that such female dog has been spayed or that such male dog has been
neutered. If a certificate is not available, then certification of information is acceptable and
the Animal Control Officer or Peace Officer will determine what other information shall be
required.
3.4
On payment of the license fee referred to in 3.1 the owner shall be provided with a tag. The
tag shall bear a serial number and the year to which it applies, and a record shall be kept by
the municipality showing the name and address of the owner, dog description and serial
number of the tag.
3.5
The Clerk of the Municipality or such other person duly authorized on his/her behalf shall
keep a record of each dog registered showing the license tag number, the owner's name and
address and description of the dog licensed.
3.6
Every owner of a dog shall purchase a tag for each dog they own and shall keep the tag
affixed on the dog at all times during the year for which the tag applies.
3.7
Notwithstanding Section 3.1 hereof, the fees to license and register a Service Dog shall be
waived with appropriate documentation. Service Dogs are exempt from the Animal Control
By-Law.
3.8
No owner of a dog shall use a tag upon a dog other than for which the tag was issued.
3.9
The owner of a dog shall notify the Municipality of the change in ownership of the dog or of
the death of the dog.
3.10 No refund or part of a refund will be provided for a dog Licence in the event that the dog
dies or if the owner is no longer in possession of the dog.
3.11 Transfer-prohibited
Every licence for a dog issued hereunder is personal to the owner thereof and may not be
assigned or transferred.
PART 4-IMPOUNDING OFANIMALS
4.1
Animal Control Officer(s)-authority
An Animal Control Officer(s) may seize and impound any animal found running at large or
contravening any section of this By-Law.
4.2
The Pound Keeper shall keep a record of every animal impounded or seized, including the
date it was impounded, a description of the animal, the licence and tag number, if applicable,
and the date of disposition and the disposition made.
4.3
An animal which is impounded under the provisions of this By-Law may be seized and
impounded by the Animal Control Officer(s), at the owner's expense.
4.4
An animal so impounded shall be held for a period of three (3) days, exclusive of the day
when such an animal was impounded, Sundays, and statutory holidays, and if not claimed
and released to the owner within such a period, such animal may then be destroyed or given

to new owner, example: Humane Society. Possession of the animal may be restored to the
owner if the owner claims possession of the animal within three (3) days (exclusive of
public holidays and Sundays) after the date of seizure or impounding subject to section 4.5.
4.5
An animal so impounded shall not be released until the owner thereof, has paid the pound
fees and Municipal Administration charge. No animal shall be released from the Pound on
Sundays or statutory holidays.
4.6
Where an Animal Control Officer(s) or Peace Officer finds an animal "Running At Large"
contrary to this By-Law and it is believed that before the animal can be seized, it may attack
a human being, a member of the Ontario Provincial Police and/or Animal Control Officer
may destroy it.
4.7
Where an animal is found running at large, contrary to the provisions of this By-Law, the
Animal Control Officer(s), finding or becoming aware of such running at large, may deliver
to the address of the owner of such animal in the prescribed form an offence notice stating;
(1)
the name and address of the owner;
(2)
the tag number, if any, and a description of the animal;
(3)
that the animal was found running at large;
(4)
the date, time and location of the alleged offence;
4.9
The owner pays to the Municipality/Pound Keeper any seizure/pound fee and boarding fee
per day for each day the animal has been in the pound, commencing the day the animal is
seized and including the day the animal is removed from the pound and a Municipal
administration fee as described in the Town of Goderich Fee By-Law, by the Owner.
PART 5-RABIES CONTROL
5.1
Where an animal is known to have bitten a person, the Public Health Inspector at the Huron
County Health Unit may order the animal to be kept under a supervised quarantine for a
period of 10 days, from the date of the biting incident. The municipality shall be held
responsible for the cost of such quarantine when the owner of the animal is not known.
PART 6-FOULING ON LANDS WITHIN THE TOWN OF GODERICH (ANIMAL
EXCREMENT)
6.1
An owner or other person who has an animal under his/her care and control of an animal
shall remove forthwith excrement left by the dog anywhere in the municipality.
PART 7-VICIOUS DOGS
The following requirements apply to vicious dogs as defined in this By-Law:
7.1
Vicious dog-insurance-required.
An owner of a vicious dog shall obtain and maintain in force a policy of public liability
insurance issued by an insurer licensed by the Province of Ontario providing third party
liability coverage in an amount of not less than Five Hundred Thousand Dollars
($500,000.00) for any damage or injury caused by the said vicious dog and must provide
proof of the liability insurance to the Corporation of the Town of Goderich.

7.2 Vicious Dog-Insurance-Expiry Notice Required
The policy, as set out in Section 7.2, shall contain a provision requiring the insurer to
immediately notify the Town should the policy expire, be cancelled or terminated for any
reason.
7.3 Vicious dog-signs-warning of vicious dog on property.
An owner of a vicious dog shall post or cause to be posted signs on the perimeters of the
property which shall clearly notify persons that vicious dog(s) are on the property.
7.4 Vicious dog-confined-at all times.
An owner of a vicious dog shall, at all times, when the vicious dog is on the lands and
premises of the owner:
(a)
keep such dog confined within the premises; or
(b)
keep such dog confined in an enclosed pen of sufficient dimension and construction
to provide humane shelter for the dog while preventing it from escaping therefrom
and preventing the entry therein of unsupervised children.
7.5 Vicious dog-walking-muzzled.
No person shall walk a vicious dog without a muzzle. All owners of a vicious dog shall
ensure that the dog is walked by an adult and that all conditions stated in this by-law are
complied with.
7.6 An owner of a Vicious Dog shall have a Microchip implanted in the dog, by a veterinary clinic
or OSPCA
PART 8-PITBULLS
8.1
In this by-law, "pit bull" includes,
(a)
a pit bull terrier (not a breed)
(b)
a Staffordshire bull terrier
(c)
an American Staffordshire terrier
(d)
an American pit bull terrier
(e)
a dog that has an appearance and physical characteristics that are substantially
similar to those of dogs referred to in any of clauses (a) to (d); ("pit-bull").
8.2
Pit bulls and Pit bull crosses shall have a special licence fee as set out in the Town of
Goderich Fee by-law.
8.3
No person shall walk a Pit bull and/or Pit bull crosses, unless they are muzzled and leashed
and shall ensure that they comply with all other aspects and conditions as stated in this by
law and also Ontario Regulation 157/05 Pit Bull Controls.

PART 9-PROHIBITING THE KEEPING OF MORE THAN A TOTAL OF FOUR PETS IN
A DWELLING UNIT- TWO BEING DOGS
9.1
Except as hereinafter provided, no person shall permit more than a total of four (4) dogs and
cats to be kept in any one (1) dwelling unit in the Town of Goderich, two (2) being dogs and
cats. (Example-two (2) dogs and two (2) cats, or one (1) dog and three (3) cats being a total
of four (4) is the maximum allowed in that dwelling unit).
9.2
Part 9 of this By-Law does not apply to the locations listed in Schedule "B".
PART 10-PROHIBITING THE KEEPING OF CERTAIN KINDS OFANIMALS
10.1 Except as herein after provided, no person shall keep an animal of the kind listed in
Schedule "A" of this By-Law for sale, for exhibition, as a pet or for any other purpose is
hereby prohibited in the Town of Goderich.
10.2 Part 10 of this By-Law does not apply to the location listed in Schedule "B".
10.3 The provisions of this Part shall not be construed as prohibiting the keeping of any of the
animals referred to in the preceding Section hereof if such animal was actually kept within
the Corporate limits of the Town of Goderich as at the date of enactment of hereof, the onus
of proof of which shall be upon the person keeping such animal.
10.4 No person shall permit a prohibited animal, as described in Schedule "A", to be at large
within the boundaries of the Municipality.
PART 11- KEEPING OF DOMESTIC BIRDS AND ANIMALS
11.1 No person shall possess or harbour any domestic fowl, cattle, goats, swine, horses, mink,
domestic bees or foxes within the municipality.
11.2 No person shall possess or harbour, within the geographic limits of the Town of Goderich,
more than a total number of 10 pigeons per dwelling unit.
11.3 No person shall possess or harbour, within the limits of the Town of Goderich, more than a
total of five (5) rabbits, rats, mice or ferrets or combination thereof per dwelling unit for the
purpose of a pet(s), a maximum of two (2) being ferrets. The total number of rabbits, rats or
mice or combination thereof shall be limited to a total of five (5) per dwelling unit for the
purpose of a pet, and shall not be bred for commercial purpose.
11.4 No person shall possess or harbour within the limits of the Town of Goderich, rabbits, rats,
mice or ferrets for the purpose of breeding for commercial use.
11.5 Kennels shall not be allowed within the Corporation of the Town of Goderich except with
the approval of Council, subject to the Town of Goderich's Comprehensive Zoning By-Law
provisions and any other applicable laws and other regulations.
PART 12-ANIMALS AND MUNICIPAL PARKS
12.1 No person shall permit any domestic animal of which he/she is the owner of or has custody
of to be at large in a park or recreation area or do any damage therein or thereto. No person
shall lead a dog or permit a dog to be led on a leash longer than 1.8 meters in any park or
recreational area. Leashes are not required on the beach commencing south of the gate
located at the south limit of Cove Road.

12.2 No person shall permit animals, including dogs, on beaches, in any park except on the beach
commencing south of the gate located at the south limit of Cove Road and on the beach
between the two picnic pavilions at St. Christopher's Beach as indicated by signs. Leashes
are required on the beach between the two picnic pavilions at St. Christopher's Beach.
12.3 No person shall permit an animal(s) on the Boardwalk.
12.5 No person shall feed any bird in any park.
12.6 No person shall kill, maim or in any way molest, injure or disturb any bird or animal whose
habitat is a park. This does not apply to vermin, as defined by this by-law.
PART 13-NOISE
13.1
No person shall permit persistent barking, calling or whining or other similar persistent
noise making by any domestic pet at any time.
PART 14-PENALTIES
14.1 Every person who contravenes any provision of this By-Law is guilty of an offence and on a
conviction, is liable to a fine as provided in Section 61 of the Provincial Offences Act,
R.S.O. 1990, c. 33, as amended, or as otherwise imposed by the presiding Justice.
PART 15-OFFENCE NOTICE AND/OR SUMMONS
15.1 Where an Animal Control Officer(s) believes that a person has committed an offence under
this By-Law, the Officer may issue an Offence Notice and/or Summons in accordance with
The Provincial Offences Act.
PART 16-SEVERABILITY
16.1 Each and every provision of this By-Law is severable and if any provisions of this By-Law
should for any reason be declared invalid by any Court, it is the intention and desire of this
Council that each and every of the then remaining provisions hereof shall remain in full
force and effect.
PART 17-ENFORCEMENT
17.1 The Animal Control Officer(s) of the Town of Goderich shall be responsible for the
enforcement of the provisions of this By-Law.
17.2 The Animal Control Officer(s) may at any time request the assistance of the Ontario
Provincial Police in enforcing any provision of this By-Law.
PART 18-ENACTMENT
18.1 That By-Laws 93 of 2008, 47 of 2001 and 16 of 1969 be hereby repealed and any other by
law, motion or resolution inconsistent with the provisions hereof are hereby repealed upon
coming into effect upon date of its passing, this By-Law, being By-Law 63 of 2017, subject
to approval of the Provincial Offences Act (short form wordings and set fines).
18.2 The set fines for violations not otherwise provided by provincial statute shall be $125.00.

18.3

Being a list of animals the keeping of which is prohibited to be domesticated or considered pets
within the Town of Goderich.
1)
All marsupials (such as kangaroos and opossums)
2)
All non-human primates (such as gorillas and monkeys)
3)
All felids, except the domestic cat
4)
All canids, except the domestic dog
5)
All viverrids (such as mongooses, civets and genets)
6)
All mustelids (such as skunks, weasels, otters, badgers, except a maximum of two of the
domestic ferret)
7)
All urside (bears)
8)
All artiodactylous ungulates
9)
All procyonide (such as racoons, coatis and cacomistiles)
10)
All hyaenas
11)
All perissodactylus ungulates (horses)
12)
All elephants
13)
All pinnipeds (such as seals, fur seals and walruses)
14)
All snakes of the families Pythonidae and Boidae
15)
All venomous reptiles including snakes
16)
All ratite birds (such as ostriches, rheas, cassowaries)
17)
All diurnal and nocturnal raptors (such as eagles, hawks and owls)
18)
All edentates (such as anteaters, sloths, hedgehogs and armadillos)
19)
All bats
20)
All crocodilians (such as alligators and crocodiles)
21)
All venomous arachnids (such as scorpions and tarantulas)
22)
All rats - see Section 10.2
23)
Domestic Bees
Examples of animals of a particular prohibited group are given in parentheses. They are examples
only and shall not be construed as limiting one generality of the group.

SCHEDULE "B" TO BY-LAW 63 OF 2017
Being a list of places or circumstances which are exempt from the application of this By-Law.
1)
On the premises of a zoo or animal display operated by or on behalf of or approved by the
Corporation of the Town of Goderich.
2)
On the premises of the Ontario Humane Society.
3)
In a veterinary hospital under the care of a licensed veterinarian.
4)
On the premises of a university or community college where such animals are being kept for
research, study or teaching purposes, or on premises registered as research facilities under
the Animals for Research Act.
5)
By anyone holding a licence under any statute of the Legislature of Ontario or the
Government of Canada, which permits the keeping of animals under stated conditions.
6)
On the premises of any media outlet where such animals are being kept temporarily for the
purpose of a media production.
7)
During the transportation of such animals between the places or circumstances listed herein.
8)
Premises which are temporarily used for travelling shows such as circus or other like shows.
9)
Liability Insurance is required in the amount of two million dollars ($2,000,000.00) with a
minimum five-thousand-dollar ($5,000.00) deductible for all of the premises mentioned in
Schedule B.
10)
Must comply with the Town of Goderich Zoning By-Law.
