THE CORPORATION OF THE TOWN OF GODERICH BY-LAW NO. 23 OF 1994 A by-law to prohibit the obstruction of streets and boulevards with snow in the said Town. WHEREAS pursuant to the Provisions of Section 102 of the Municipal Act R.S.O. 1990, Chapter M45, the Council of every municipality may pass by-laws and make such regulations for the health, safety, morality and welfare of the inhabitants of the municipalities in matters not specifically provided for by the Municipal Act and as may be expedient and are not contrary to law. AND WHEREAS it is deemed expedient to pass a by-law prohibit- ing the obstructions of streets and boulevards. NOW, THEREFORE, THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF GODERICH ENACTS AS FOLLOWS: 1. For the purpose of this by-law (a) Street street, viaduct general or Highway includes a common and public highway, avenue, parkway, driveway, square, place, bridge, or trestle, designed and intended for, or used by, the public for the passage of vehicles. (b) Boulevard shall mean the portion of the street allowance lying between the sidewalk and the roadway and on streets where there are no sidewalks it shall mean a portion of the road allowance lying between the travelled portion of the road and the limit of the allowance. 2. No person shall remove or cause to be removed snow from his own premises to the street, boulevard or highway in front of his said premises or to the street, highway or boulevard adjacent to his said premises or opposite to his said prem- ises. 3. No person shall remove or cause to be removed snow from the street, boulevard or highway in front of his said premises on to the street, boulevard or highway adjacent thereto or opposite therefrom. 4. PENALTY Every person who breaches a section of this by-law is guilty of an offence and subject to a penalty under the "Provincial Offences Act." 5. That this by-law hereby repeals By-Law No. 38 of 1960 and any amendments thereto.
