CORPORATION OF THE TOWN OF GRAND VALLEY
BY-LAW 2019-72
A By-law to provide for the regulation of traffic and parking of motor vehicles in the
Town of Grand Valley.

WHEREAS subsection 10(2) paragraph 7 of the Municipal Act, 2001, S.O. 2001, c. 25,
as amended, provides that a municipality may pass by-laws to provide any service or
thing that the municipality considers necessary or desirable to the public;
AND WHEREAS subsection 5(3) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provides that a municipal power shall be exercised by by-law;
AND WHEREAS subsection 7.1(1) of the Fire Protection and Prevention Act, 1997,
S.O. 1997, c.4, as amended, provides that a council of a municipality may pass by-laws
designating private roads as fire routes along which no parking of vehicles shall be
permitted and providing for the removal and impounding of any vehicle parked or left
along any of the fire routes at the expense of the owner of the vehicle;
AND WHEREAS it is deemed expedient to repeal By-law 2001-24 and replace it with a
new by-law to regulate traffic and the parking of motor vehicles in the Town of Grand
Valley;
NOW THEREFORE The Municipal Council of the Corporation of the Town of
Grand Valley enacts as follows:

Part 1 - Administration
Application
1.
This by-law applies to all highways under the jurisdiction of the Town of Grand Valley.
Definitions
2.
In this By-law, the definitions provided in the Highway Traffic Act, R.S.O. 1990, c. H.8,
as amended, shall extend and apply to this By-law. In the event of any inconsistencies
between the definitions provided in this By-law and those in the Act, the definition set
out in the Act shall prevail.
3. In this By-law, unless a contrary intention appears:
Act means the Highway Traffic Act, R.S.O. 1990 Chapter H.8 as amended;
Authorized Vehicle means
(i)
A vehicle owned or operated by the Town provided that the vehicle is
being used in connection with a service related to the Town business;
(ii)
Any vehicle authorized by the Superintendent;
(iii)
A clearly marked public utility vehicle, owned by a company (other than a
municipal or local board of a municipality) incorporated for the purpose of
supplying a public utility, as defined in the Public Utilities Act, R.S.O.
1990, c. P. 52, as amended from time to time, or any successor thereof;
and
(iv)
Any vehicle that falls within the definition of an emergency vehicle as
defined under the Act.
Bicycle means a device propelled by human power in full or in part, including e-bikes, upon
which a person may ride either on or astride a regular seat attached thereto, including a tricycle
and unicycle, having a wheel or wheels of more than 60 centimetres in diameter;
Boulevard means all parts of the highway save and except any roadway, shoulder or sidewalk,
and
(i) "central boulevard" means that part of the boulevard lying between the
roadways of a divided highway and includes channelizing islands;
(ii) "outer boulevard" means that part of the boulevard lying between any
sidewalk and the roadway or the near edge of the shoulder where such
exists; and,
(iii) "inner boulevard" means that part of the boulevard lying between the property
line and the edge of the sidewalk nearest to the property line, and where
there is no sidewalk, that part of the boulevard lying between the property line
and the roadway or the edge of the shoulder, where such exists, furthest from
the roadway;
Commercial Motor Vehicle means a motor vehicle having permanently attached thereto a
truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses
and tractors used for hauling purposes on the highways;
Community Safety Zone means a highway or part(s) of a highway designated as such by by-
law of the Town where traffic fines have been increased for violations committed, and every
such highway shall be marked by signs as prescribed in regulations under the Act;

Crosswalk means
(i)
That part of a highway at an intersection that is included within the
connections of the lateral lines of the sidewalks on opposite sides of the
highway measured from the curbs, or in the absence of curbs, from the
edges of the roadway, or
(ii)
Any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by signs or by lines or other markings on
the surface of the roadway;
Designated means designated by Town by-law;
Disabled Person means an individual who has been issued a disabled person's parking
permit by the Ministry of Transportation which is valid, and which is used and displayed
in accordance with the regulations under the Act;
Driveway means a part of a highway improved to provide vehicular access from the
roadway to a laneway or a parking area on adjacent land;
Highway includes a common and public highway, street, avenue, parkway, driveway,
square, lane, bridge, viaduct or trestle, any part of which is intended for or used by the
general public for passage of vehicles and includes the area between the lateral property
lines thereof;
Intersection means the area embraced within the prolongation or connection of the
lateral curb lines or, if none, then of the lateral boundary lines of two or more highways
that join one another at an angle, whether or not one highway crosses the other;
Laneway means improved land adjacent to the highway which provides access from the
highway to a parking area on adjacent land;
Motor assisted bicycle means a bicycle
(a)
that is fitted with pedals, which are operable at all times, to propel the bicycle;
(b) that weighs not more than fifty-five (55) kilograms;
(c) that has no hand or foot operated clutch, or gearbox driven by the motor and
transferring power to the driven wheel;
(d) that has an attached motor driven by electricity or having a piston displacement of not
more than fifty (50) cubic centimetres; and(e) that does not have sufficient power to
enable the bicycle to attain a speed greater than fifty (50) kilometres per hour on level
ground within a distance of two (2) kilometres from a standing start;
Motor Vehicle includes an automobile, motorcycle, motor assisted bicycle unless
otherwise indicated in the Act, and any other vehicle propelled or driven otherwise than
by muscular power, but does not include a street car or other motorized vehicles running
only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled
implement of husbandry or road-building machine within the meaning of the Act;
Motorcycle means a self-propelled vehicle having a seat or saddle for the use of the
driver and designed to travel on not more than three wheels in contact with the ground,
and includes a motor scooter but does not include a motor-assisted bicycle;

Municipal Law Enforcement Officer means a person duly appointed by the
Corporation of the Town of Grand Valley for the purpose of enforcing the parking
provisions of this By-law;
Official Sign means any sign or roadway, curb or sidewalk marking, or other device
placed or erected on a highway under the authority of this by-law and specific in the
Ontario Traffic Manual or otherwise approved by Council for the purpose of regulating,
warning and guiding traffic;
Oversized Motor Vehicle means a motor vehicle having a weight when unloaded of
2700 kilograms or more, or when loaded, of 4500 kilograms or more, and/or any motor
vehicle that is more than 2.6 metres high or greater than 6.7 metres in length, but does
not include a passenger vehicle, or an Authorized Vehicle including an ambulance or
any vehicle of a police or fire department;
Park or Parking when prohibited means the standing of a vehicle, whether occupied or
not, except when standing temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers;
Pedestrian includes a person on foot, a person in a wheelchair and a child in a baby
carriage;
Police Officer means a member of the Ontario Provincial Police;
Public Transit Vehicle includes a vehicle so designated by the Superintendent,
designed an operated for the purpose of carrying passengers;
Public Vehicle means a motor vehicle operated on a highway by, for or on behalf of any
person for the transportation for compensation of passengers, or passengers and
express freight that might be carried in a passenger vehicle, but does not include the
cars of electric or steam railways running only upon rails, taxicabs, car pool vehicles, nor
motor vehicles operated solely within the corporate limits of one urban municipality;
Right-of-way means the same as Roadway;
Roadway means that part of the highway that is improved, designed or ordinarily used
for vehicular traffic, but does not include the shoulder, and, where a highway includes
two or more separate roadways, the term "roadway" refers to any one roadway
separately and not to all the roadways collectively;
Roundabout means a circular intersection where two or more roads meet;
School Bus includes a vehicle operated by or designated by a school board, designed
and operated for the purpose of carrying passengers;
School Days means any Monday to Friday inclusive, when school is in session;
Shoulder means that part of the highway immediately adjacent to the roadway and
having a surface which has been improved for the use of vehicles with asphalt, concrete
or gravel;
Sidewalk means those parts of a highway set aside by the Town for the use of
pedestrians;

Special Event includes religious or community gatherings, television or commercial
production filming, sporting or social events, and any other organized event which may
significantly interfere with the movement of traffic;
Stand or Standing when prohibited means the halting of a vehicle, whether occupied or
not, except for the purpose of and while actually engaged in receiving or discharging
passengers;
Stop or Stopping when prohibited means the halting of a vehicle even momentarily,
except when necessary to avoid conflict with other traffic or except in compliance with
the directs of a constable or other police officer or of a traffic control signal or sign;
Superintendent means the Public Works Superintendent for the Town of Grand Valley
or designate;
Town means the municipal Corporation of the Town of Grand Valley;
Through Highway means a highway or part of a highway designated as such by by-law
of a municipality, and every such highway shall be marked by a stop sign or yield right-
of-way sign in compliance with the regulations of the Ministry;
Traffic includes pedestrians, animals which are ridden, led or herded, vehicles, and
other conveyances either singly or together while using a highway for the purposes of
travel
Traffic Control Device means any sign, signal or other roadway, curb or sidewalk
marking, or any other device erected or placed under the authority of this by-law for the
purpose of warning, regulating, guiding or directing traffic
Traffic Control Signal means a signal light traffic control system specified in the Act,
operated manually, electrically, mechanically or electronically for the regulation and
control of both vehicular and pedestrian traffic;
Vehicle includes a motor vehicle, trailer, traction engine, farm tractor, road-building
machine and any vehicle drawn, propelled or driven by any kind of power, including
muscular power, but does not include a motorized snow vehicle or a streetcar.
Interpretation
4.
In this by-law:
a. Words importing the singular number or the masculine gender only, include more
persons, parties or things of the same kind than one and females as well as
males and the converse;
b. A word interpreted in the singular number has a corresponding meaning when
used in the plural;
c. "may" shall be construed as permissive;
d. "shall" shall be construed as imperative;
e. "vehicle," when used as part of the prohibition of parking or stopping, includes
any part thereof; and
f. "subsection," when used without reference to another section, refers to a
subsection contained in the same section in which the phrase is used.

5.
Where a distance is used in this by-law as part of a prohibition of parking or stopping
within a specified distance of an object, structure, land or a part of a highway, such
distance shall be measured:
a. Along the curb or edge of the roadway from a point in such curb or edge of
roadway opposite such object, structure, land or part of a highway, unless the
context otherwise requires; and
b. From such point in the curb or edge of roadway in all directions.
6.
The various prohibitions of this by-law are cumulative and not mutually self-exclusive.
7.
It is declared that if any section, subsection or part or parts thereof be declared by any
court of law to be bad, illegal or ultra vires, such section, subsection or part or parts
shall be deemed to be severable and all parts hereof are declared to be separate and
independent and enacted as such.
8.
Municipal law enforcement officer and municipal by-law enforcement officer have similar
meanings.
9.
The Schedules referred to in this by-law shall form part of this by-law and each entry in
a column of such a Schedule shall be read in conjunction with the entry of entries
across therefrom, and not otherwise.
Standard Time and Daylight Savings Time
10. Where any expression of time occurs or where any hour or other period of time is
stated, the time referred to shall be standard time, provided however, if what is known
as "daylight saving time" has been generally adopted for any period of the year, under
any statute, order-in-council, by-law, resolution or proclamation, whether the same is
effective in law or not, such time shall be the time referred to during such period in any
reference to time in this by-law.
Former By-laws Repealed
11. By-law 2001-24 is hereby repealed.
Transition
12. The repeal of any by-law referred to in Section 11 shall not affect any offence
committed against the provisions of that by-law or any penalty incurred in respect
thereof or any investigative procedure, including but not limited to any prosecution
thereunder.
By-laws Amended
13. By-law 2018-48, Schedule "H" - Public Works is amended to include the provisions of
Schedule B to this by-law.
By-law In Force
14. This by-law shall come into force and take effect at 12:01 a.m. on December 11, 2019.
Enforcement of By-law
15. This By-law shall be enforced by the Municipal Law Enforcement Officer and the
Ontario Provincial Police.
16. The Municipal Law Enforcement Officer and the Ontario Provincial Police are exempt
from complying with the provisions of this by-law while actively engaged in its

enforcement or the parts thereof that they have been appointed to enforce when no
suitable parking is available.
17. The provisions of this by-law shall be enforced pursuant to the provisions set out in
Parts I and III of the Provincial Offences Act. Any person violating any provisions of this
by-law is guilty of an offence and upon conviction shall be subject to a fine, exclusive of
costs and all such fines shall be recoverable under the provisions of Parts I and/or III of
the Provincial Offences Act.
18. Voluntary payment of a fine for an offence committed under the provisions of this by-law
may, upon presentation of the violation tag issued alleging the offence, pay out of Court
within 15 days from the date of issuance of the said violation tag, the set fine described
upon the face of the tag and upon such payment no further proceedings shall be taken
in respect of the alleged offence. Voluntary payment may be made at the Town of
Grand Valley Municipal Office during normal business hours or by mail.
Exemptions
19. The provisions of this by-law shall not, if compliance therewith would be impractical,
apply to:
a. An Authorized Vehicle, including a vehicle registered to a municipal corporation
or registered to a utility, while actually performing work on behalf of a municipal
corporation within the Town, or while responding to an emergency; or,
b. When the driver or operator of a vehicle is in compliance with the direction of a
police officer or a traffic control device.
Short Title
20. This by-law shall be known as the Traffic and Parking By-law.

Part 2 - Rules of the Road
Erection of Signs, Traffic Control Devices, Signals, Etc. - Regulations
21. The Superintendent or designate is authorized to place or erect and to maintain such
official signs and traffic control signals as are required to give effect to the provisions of
this by-law or as required to warn or guide traffic for the safety or convenience of the
public.
22. No person shall place, maintain or display upon or in view of any highway, any sign,
signal, marking or device which purports to be or is an imitation of or resembles an
official sign or traffic control signal or which conceals from view or interferes with the
effectiveness or an official sign or traffic control signal.
23. The Superintendent, the Ontario Provincial Police, and Fire Chief are authorized to
erect emergency No Parking signs;
a. When in their opinion an emergency has arisen marking it desirable to prohibit
parking on a highway;
b. To facilitate the removal of snow, ice, or debris from a highway; and,
c. To facilitate the construction or repair of roads, curbs, gutters, sewers and
watermains.
24. In this section, "Emergency" includes, but is not limited to the following:
a. Construction of a highway where such construction is to commence within 24
hours or posting the sign;
b. Where construction, repair or maintenance of a highway is being undertaken;
c. A spill, pursuant to the Environmental Protection Act or its legislation;
d. A highway traffic accident; or
e. An event which renders the use of a highway, or part of a highway, dangerous to
the travelling public, including pedestrians.
25. Where practical, emergency No Parking signs shall be erected at least one (1) hour
prior to the commencement of the special event or work necessary to address the
Emergency, and shall be removed within one (1) hour of the termination of the special
event or work necessary to address the Emergency.
26. The Superintendent may approve the temporary removal of No Parking and No
Stopping signs for events which in the opinion of the Superintendent are deemed as
special events.
27. Any such sign erected or placed under this section shall be deemed to be a traffic
control device or sign for the purposes of this By-law.
Parking and Stopping
Parking Offences
28. Where signs in accordance with the Act are erected and are on display establishing a
No Parking Zone, no person shall park within such zone as designated by Schedule D
to this By-law.
29. No person shall park a vehicle upon a highway less than 1 metre from either edge of a
public or private driveway.
30. No person shall park a vehicle upon a highway in front of the entrance to a driveway so
as to prevent ingress to or egress from such driveway.
31. No person shall park a vehicle upon a highway designated as a Fire Route, where signs
in accordance with the Act are erected and are on display.

32. No person shall park a vehicle upon a highway within 3 metres of a point on the curb or
edge of a highway nearest to a fire hydrant.
33. No person shall park a vehicle within 15 metres of an entrance to or exit from a
roundabout.
34. No person shall park a vehicle upon a highway within a roundabout.
35. No person shall park a vehicle upon a highway with its left wheels or runners as the
case may be adjacent to the curb of the highway or where no curb exists the edge of
the highway unless otherwise permitted by a traffic control device.
36. No person shall park a vehicle upon a highway in a time limited parking zone for a
period of time in excess of the time designated in Schedule "H" to this bylaw.
37. No person shall park a vehicle upon a highway in a time limited parking zone during a
prohibited time as designated in Schedule "H" to this by-law.
38. No person shall park a vehicle upon a highway with the vehicles right side further than
0.30 metres from the curb of the highway or where no curb exists, the edge of the
highway.
39. No person shall park a vehicle upon a highway between the hours of 2 a.m. and 7 a.m.
of any day during the period November 15 to April 15 of any year.
40. No person shall park a vehicle upon a highway where painted guidelines exist for the
purpose of facilitating parking except within such guidelines.
41. No person shall park a vehicle upon a highway where parking is permitted under the
provisions of this by-law for an unreasonable length of time and in no case for a period
longer than 24 consecutive hours.
42. No person shall park a vehicle upon a highway or on a municipal parking lot in a
temporary no parking zone.
a. No offence shall be created if the vehicle described in Section 42 above of this
bylaw was parked in the temporary no parking zone prior to the erection of
temporary no parking signs unless the operator of the vehicle has been
requested to move such vehicle by a police officer or municipal law enforcement
officer and has refused to do so.
43. No person shall park a vehicle on a sidewalk.
44. No person shall park a vehicle on a boulevard.
45. No person shall park a vehicle on a driveway within one half (0.5) metre of a sidewalk,
or if there is no sidewalk, within one and one half (1.5) metres of the roadway, or on a
driveway upon an outer boulevard within one half (0.5) metre of a sidewalk and/or within
one and one half (1.5) metres of the roadway.
46. No person shall park a vehicle on a laneway within one half (0.5) metre of a sidewalk.
47. No person shall park a vehicle upon a highway within an intersection.
48. No person shall park a vehicle upon a highway within 15 metres of an intersection.
49. No person shall park a vehicle upon a highway in a pedestrian crossover.
50. No person shall park a vehicle upon a highway within 15 metres of a pedestrian
crossover.
51. No person shall park a vehicle upon a highway in a crosswalk.
52. No person shall park a vehicle upon a highway within 15 metres of a crosswalk.
53. No person shall park a vehicle upon a roadway in such a manner as to leave available
less than 3 metres of the width of the roadway for free movement of vehicular traffic.
54. No person shall park a vehicle upon a highway on the roadway side of any vehicle
stopped or parked at the edge or curb of the highway (double parking prohibition).
55. No person shall park a vehicle other than a bus upon a highway at a bus stop.
56. No person shall park a vehicle upon a highway or municipal parking lot for the purpose
of repairing, washing or maintenance of the vehicle other than in an emergency.

57. No person shall park a vehicle which does not bear valid licence plates on any highway
or municipal parking lot.
58. No person shall park a vehicle upon a bridge or other elevated structure upon a
highway unless otherwise permitted by a traffic control device.
59. No person shall park a vehicle upon a highway or on a municipal parking lot so as to
obstruct an access ramp provided for the use of disabled persons.
60. No person shall park a vehicle upon a highway or on a municipal parking lot or on
private property in a disabled person parking space unless that vehicle is transporting a
disabled person or persons and also displays a valid disabled person parking permit
issued by the Ontario Ministry of Transportation.
61. No person shall park a commercial motor vehicle or oversized motor vehicle upon a
highway between the hours of 1:00 a.m. and 6:00 a.m. of the same day for a period of
time longer than one hour other than upon a section of highway which is under
construction.
62. No person shall park a commercial motor vehicle or oversized motor vehicle on a
municipal parking lot unless otherwise permitted by a traffic control device.
63. No person shall park a vehicle upon a highway in such a manner as to interfere with the
movement of traffic or the clearing of snow from the highway or the cleaning of a
highway, including sweeping.
64. No person shall park a vehicle on a highway designated as a one-way street other than
with the vehicle facing in the direction in which it is permitted to proceed.
a. Where parking is permitted on either or both sides of a highway designated as a
one way street, the vehicle operator shall park the vehicle with its wheels or
runners as the case may be no further than 0.30 metres from the curb of the
highway or where no curb exists the edge of the highway.
65. No person shall park a vehicle upon a highway or municipal parking lot for the purposes
of displaying it for sale or for the advertising or the selling of goods.
66. Where signs in accordance with the Act or this by-law are erected and are on display,
no person shall, on any highway, park any vehicle
a. Within 15 metres upon the approach to any flashing beacon, stop sign, yield sign
or traffic control signal located at the side of the roadway;
b. Within 8 metres of any fire hall on the side of the highway on which the fire hall is
located or within 30 metres of such fire hall on the opposite side of the roadway;
c. Within a turning basin.
Stopping Offences
67. No person shall stop a vehicle upon a highway in a no stopping zone.
68. No person shall stop a vehicle upon a highway on the roadway side of any vehicle
stopped or parked at the edge or curb of that highway.
69. No person shall stop a vehicle other than a bus upon a highway at a bus stop.
70. No person shall stop a vehicle, other than a school bus, upon a highway in a school bus
loading zone.
71. No person shall stop a vehicle upon a highway with its left wheels or runners as the
case may be adjacent to the curb of the highway or where no curb exists the edge of
the highway unless otherwise permitted by a traffic control device.
72. No person shall stop a vehicle upon a highway within a roundabout.
73. No person shall stop a vehicle upon a highway for the purposes of unloading or
transferring materials of any kind except in cases of emergency.
74. No person shall stop a vehicle which does not bear valid licence plates upon a highway.

Traffic Movement and Lanes
75. Despite any provisions of this by-law to the contrary, a police officer or the Public Works
Superintendent may, during any emergency or special circumstance, by the erection of
appropriate signs or signals, prohibit or regulate the movement of vehicles on any
highway or part of a highway and no person shall drive or operate a vehicle in
contravention of any such sign or signal.
76. Where a U-turn is not otherwise prohibited under this by-law or the Act, no person shall
make such a turn when it cannot be made in safety or without interfering with other
traffic.
77. No person shall drive a vehicle in any intersection or on part of any highway or on
property proceeding in a direction that is contrary to an official or authorized sign.
a. Section 76 does not apply to a vehicle for which an exception has been granted
and such exception is identified by an official or authorized sign.
78. No person operating a vehicle shall pass on the right side of a stopped school purposes
vehicle that is loading or unloading passengers, unless the loading/unloading
passenger area is separated from passing vehicles.
79. No person shall drive a vehicle on a one-way highway in a direction contrary to an
official or authorized sign.
80. No person shall drive any vehicle or ride any animal otherwise than counter-clockwise
direction in any roundabout:
a. While approaching a roundabout, a driver shall obey any authorized signs, to
guide their desired entrance and exit;
b. While approaching a roundabout, a driver shall stop for any pedestrians
approaching or crossing at the crossover;
c. A driver shall enter the roundabout only once there is an acceptable gap in traffic
and it is safe to do so;
d. Upon exiting the roundabout, a driver shall stop for any pedestrians approaching
or crossing at the crossover;
e. A driver shall proceed to the edge of the circulatory roadway and yield to vehicles
in all lanes approaching from their immediate left before entering the roundabout;
f. Unless signs or road markings indicate otherwise, a driver shall enter in the land
appropriate for the desired exit and follow the lane around the roundabout in
order to depart the roundabout at that exit.
g. A driver shall give space to any large vehicle within a roundabout such as
commercial vehicles, snowplows or emergency vehicles as they may take up
more than one entry lane and the entire circulatory roadway;
h. When in a roundabout while an emergency vehicle is approaching, a driver shall
take the immediate exit and proceed to a point beyond the splitter island and pull
over as far to the right as possible to allow emergency vehicles to pass;
i.
A driver who has not yet entered the roundabout shall pull over as far to the right
as possible and wait until the emergency vehicle has passed before proceeding;
j.
A driver of a large vehicle is permitted to use the inner or outer truck aprons
where available to help maneuver around the roundabout;
k. In the absence of a pedestrian crossover, pedestrians shall cross at the marked
location waiting for an acceptable gap in traffic and crossing when safe to do so;
l.
Bicyclists may position their vehicle in such a manner as to "claim" the driving
lane that they are using.

Fire Routes
81. In this part, "official sign" means a fire route sign in the form set out in Schedule "I" to
this by-law.
82. Fire route signs in accordance with Schedule "I" to this by-law shall be deemed to be
official signs pursuant to this By-law, so long as they were in place on the date of the
passage of this By-law.
83. All signs shall be in the form set out in Schedule "I" to this by-law.
84. A private roadway along which approval has been given by the Town for the erection of
official signs is a fire route.
85. If, after inspection of any building, the Fire Chief is satisfied that, in order to suppress
and prevent the spread of fires, a fire route is warranted in respect of any building,
he/she may serve or cause to be serviced by personal service or by prepaid registered
mail to the owner of the building shown on the records of the Land Registry Office, an
order requiring the owner to comply with the provisions of the Fire Code and/or Building
Code regulations, and every owner shall comply with such order within sixty days of the
date of its service upon him or its mailing to him.
86. The Town and the owner of a private roadway may enter into an agreement in the form
set out in Schedule "I" of this by-law or in a development agreement pursuant to the site
plan approval process providing for the designation of the roadway as a fire route.
87. No person shall move, remove or interfere with an official sign along a fire route or
obstruct a view of an official sign along a fire route.
88. No person shall erect or maintain along a fire route any sign which may conflict or be
confused with an official sign.
89. No person shall erect or maintain a facsimile of an official sign along any private
roadway whether a fire route or not.
90. No person shall park a motor vehicle along a fire route or so that any part of a vehicle is
located within the fire route.
Speed Regulations and Community Safety Zones
91. No person shall drive, move or operate any vehicle on a highway, bridge at a greater
rate of speed than the rate of speed identified on official or authorized signs.
92. When official or authorized signs have not been erected, no person shall drive, move or
operate any vehicle on a highway or bridge at a greater rate of speed than the default
rate of speed prescribed in the Act.
93. The highway or portions of highway set out in Column 1 of Schedule "C" of this by-law,
between the limits set out in Columns 2 and 3 during the times or days set out in
Column 4 of said schedule, are designated Community Safety Zones.
94. Every person who is convicted of an offence under this section pursuant to the Act is
subject to an increased fine as provided by that Act.
Obstructing Roads
95. No person shall deposit snow or ice on a highway.
Oversized Motor Vehicle
96. No person shall park an oversized motor vehicle on any highway for a period of time
longer than 1 hour, other than upon a section of highway under construction, and
except when otherwise prohibited under this By-law.

Signs
97. The Public Works Superintendent may erect, place and maintain such official and
authorized signs as are required to give effect to the provisions of this by-law.
98. No person shall place, maintain or display upon any highway any sign, signal, marking
or device which:
a. Conceals a traffic control device or traffic control signal from view;
b. Interferes with the effectiveness of a traffic control device or traffic control signal;
or,
c. Purports to be or is an imitation of or resembles any official or authorized sign,
traffic control signal or traffic control device.
99. No person shall move, remove, deface or in any manner interfere with any authorized or
official sign, traffic control signal, marking or other traffic control device placed, erected
or maintained under this by-law.
100. No person shall drive any vehicle over any marking on the roadway where markers are
in place to indicate that the marking material has been freshly applied.
101. No person shall drive any vehicle into or over any marker placed on the roadway.
Exemptions
102. The provisions for parking and stopping shall not, if compliance therewith would be
impractical, apply to:
a. An Authorized Vehicle, including a vehicle registered to a municipal corporation
or registered to a utility, while actually performing work on behalf of a municipal
corporation within the Town, or while responding to an emergency; or,
b. When the driver or operator of a vehicle is in compliance with the direction of a
police officer or a traffic control device.

Part 3 - Parking on Municipal Parking Lots
Definitions
103. The following definitions apply to this Part:
a. "Municipal parking lot" means any property of the Town that:
i. Is operated through the Public Works Superintendent as a municipal
parking lot; and
ii. Bears signs identifying the lot as "Public Parking" which may include the
hours of operation of the lot, and the rates for parking motor vehicles (if
any).
Interpretation
104. Where the Town has posted signs stating conditions on which a motor vehicle may be
parked or left on the municipal parking lot or prohibiting the parking or leaving of a
motor vehicle on the municipal parking lot, a motor vehicle parked or left on the property
contrary to such conditions or prohibitions shall be deemed to have been parked or left
without consent.
Manner of Parking
105. No person shall park an oversize motor vehicle, trailer unit or recreational vehicle in a
municipal parking lot, except where posted signage permits.
106. No person shall park a motor vehicle or permit a motor vehicle to remain parked at a
parking space on a municipal parking lot unless such motor vehicle is parked entirely
within an area designated as a parking space, where such spaces are marked.
a. Despite section 105, where the motor vehicle is of such a length as to render it
impossible to park it in one space, the adjoining parking space or spaces may be
used.
107. No person shall park a motor vehicle or permit a motor vehicle to remain parked on a
municipal parking lot in an area that is not designated as a parking space or is
designated by sign as an area in which parking is prohibited.
108. No person shall park a motor vehicle or permit a motor vehicle to remain parked in an
electric vehicle parking space on a municipal parking lot unless the vehicle is being
charged and the front or rear of the motor vehicle is opposite or as close as is
practicable to the charging station provided for such as space.
109. No person shall park a motor vehicle or permit a motor vehicle to remain parked on a
municipal parking lot:
a. So as to obstruct a motor vehicle in the use of any aisle or laneway;
b. In such a position that will prevent the convenient removal of any other motor
vehicle previously parked or standing;
c. So as to prevent or impede the ingress to or egress from a parking space, or
d. In an area that is a pedestrian walkway.
110. No person shall park a motor vehicle or permit a motor vehicle to remain parked on a
municipal parking lot where an area is by sign designated as reserved unless the area
is reserved for such person.
Damage
111. No person shall damage, deface or tamper with any parking equipment or signs or
otherwise impair its usefulness on a municipal parking lot.

112. No person shall damage, deface or tamper with, break or destroy any electric vehicle
charging station or part thereof or otherwise impair its full usefulness on a municipal
parking lot.
113. No person shall deposit or place any article, receptacle or object on a municipal parking
lot without being authorized by the Town to do so.
114. No person shall place or leave a bicycle on a municipal parking lot other than in a
bicycle rack where provided for that purpose.

Part 4 - Road Occupancy Permitting
115. No person shall occupy the municipal right of way without prior written approval from
the Superintendent.
116. No person shall remove or permit the removal of a sidewalk, or part of a sidewalk,
without prior written approval from the Superintendent.
117. No person shall open cut or permit an open cut on a highway without prior written
approval from the Superintendent.
118. Written approval from the Superintendent shall be obtained in accordance with
established Road Occupancy Permit processes, forms and policies.
119. A minimum single lane per direction must be maintained during working hours.
120. No person shall store or permit the storage of materials or equipment on a highway
overnight.
121. The Town reserves the right to perform any necessary remedial work caused by the
Permit Holder's operation, subject to the following conditions:
a. At least 24 hours prior, verbal notification will be given to the Permit Holder of
any required remedial work. When this time elapses, the Town will undertake the
repairs. All costs associated with this action plus an administration fee will be
charged to the Permit Holder.
b. When it is deemed a public safety or an emergency situation, the Town will
perform immediate repairs. All costs associated with this action plus an
administration fee will be charged to the Permit Holder.
122. Pursuant to section 120, the administration fee shall be as set forth in Schedule B of
this By-law.

Part 5 - Other Requirements
Decorative Stones, Curbing, etc.
123. All decorative stones, curbing that have been on the boulevard in non-winter months
must be moved by the owner at least four feet from the curb or roadside by November
15 to facilitate snow plowing and removal.
124. Where sidewalks are cleared by the Town, all decorative stones, curbing, etc. shall be
moved at least 0.5 metre back from the edge of the sidewalk to allow the equipment to
complete the snow clearing operations.
125. If curbing installed by the property owner is permanent, the Town requires that it be
marked visibly to warn the snow removal operator once the curbing is covered with
snow.
126. The property owner may be liable for damages to municipal equipment if any
unauthorized objects cause damage.

Part 6 - Offences and Penalties
127. Every person who contravenes any of the provisions of this By-law is guilty of an
offence and on conviction is liable to a fine as provided for in the Provincial Offences
Act, R.S.O. 1990, Chap. P.33, as amended.
128. The owner or operator of a motor vehicle to which any parking infraction notice is
attached for any alleged offence under the By-law may report to the Municipal Office
and pay the early payment fine or the set fine, as applicable, which shall be accepted as
payment in full of the penalty in satisfaction of the alleged offence and no further action
shall be taken for such offence.
129. The owner of a vehicle shall incur the penalties provided for any contravention of this
by-law unless at the time of the contravention the vehicle was in the possession of
some person other than the owner or his or her chauffeur without the owner's consent,
and the driver or operator of a vehicle not being the owner shall also incur the penalties
provided for any such contravention.
130. The owner of a vehicle that is parked, stopped or left standing in contravention to this
by-law is guilty of an offence unless the owner proves to the satisfaction of the court
that at the time of the offence the vehicle was in the possession of another person
without the owner's consent, express or implied.
131. Whenever a motor vehicle is parked in contravention of the provisions of this By-law, a
police officer, municipal by-law enforcement officer or an officer appointed for the
carrying out of the provisions of subsection 170(15) of the Act, may cause the said
motor vehicle to be removed or taken to and placed or stored in a suitable place and all
costs and charges for removing, care and storage thereof, if any, shall be paid by the
owner of said motor vehicle and such costs and charges shall be a lien upon the said
motor vehicle which may be enforced in the manner proved by the Repair and Storage
Liens Act, R.S.O. 1990, c.25 as amended.

EXEMPTIONS
Enforcement of the maximum period allowed on Amaranth Street West and Mill Street
West shall not apply to auto repair shop client vehicles, providing that:
a. The vehicle is owned by a client of Silverdale Motors or Hillside Auto;
b. The vehicle is clearly marked with an exemption certificate (sticker, tag, card) so as
to allow the Town to easily recognize client vehicles; and,
c. A maximum of 5 cars per auto repair shop business shall be exempt at any given
time.
Exemptions shall not apply:
a. Between the overnight hours of 1800 - 0600 hours.
b. Outside of the posted business hours for the auto repair shop named on the
exemption certificate

Ministry of Transportation at the time of installation.

Fire Route Agreement:

This AGREEMENT made in duplicate this ______ day of _______________, 20_____.
BETWEEN:
The Corporation of the Town of Grand Valley
(hereinafter called the "Town")
Of the FIRST PART
AND:

(hereinafter called the "Owner")
Of the SECOND PART.
WHEREAS the Owner is the registered owner of the lands and premises in the Town, known for
municipal purposes as (address)________________________________________ upon which
have ben laid out certain private roadways identified in the schedule hereto, which the Owner
has requested to be designated and administered by the Town as Fire Routes pursuant to By-
law 2019-____;
NOW THEREFORE THIS AGREEMENT WITNESSETH that for good and valuable
consideration now paid to the Town by the Owner, the receipt and sufficiency of which is here
by acknowledged by the Owner:
1. The Owner consents during the term of this agreement to the designation by the Town of
the private roadways identified in the schedule hereto as Fire Routes pursuant to By-law
2019-______, and to the full and free administration and enforcement with respect to
such private roadways of by-laws pertaining to the fire routes including, but without
restricting the generality of the foregoing, the right of free and unhindered entry and re-
entry at all times upon the Owner's lands and premises by the Town's employees,
servants and agents and by municipal law enforcement officers, constables and officers
appointed for the carrying out of the provisions of the Highway Traffic Act for the
purposes of erecting, maintaining and removing official signs, prohibiting parking, and
ticketing, removing and impounding vehicles parked or left along the fire routes.
2. The Owner covenants and agrees that:
a. The Town shall be responsible for initially erecting official signs and standards for
which the Owner shall pay the Town at the time of application to cover the
material and labour costs of the Town of erecting the official signs and standards
in accordance with its Municipal Maintenance Management System;
b. Once official signs are erected, the Owner shall be responsible for their
maintenance at the Owner's expense in accordance with Town standards;
c. The Town shall have the right to remove or re-erect official signs;
d. The Town shall have the right to remove any signs which may conflict or may be
confused with official signs;

e. The Owner shall not permit anything to be done which obstructs the plain view of
any official sign by the driver of a vehicle along a fire route;
f. The Owner shall at all times keep the Fire Route in good repair, free and clear of
any obstruction, excavation, object or thing likely to hinder, obstruct or interfere
with the movement of a fire truck or emergency vehicle along the Fire Route.
3. The Owner releases the Town from all manner of debts, claims, demands, causes of
action or suits which the Owner may now or hereafter have against the Town, its
employees, servants or agents in respect of any matter contained in or arising from this
agreement.
4. The Owner agrees that this agreement shall continue in full force and effect from the
date hereof until terminated by the Town upon one month's prior written notice delivered
personally or sent by First Class Mail to the Owner at the Owner's last known address.
5. This agreement shall enure to the benefit of and be binding upon the Town and the
Owner, and their respective heirs, executors, administrators, successors and assigns, as
the case may be.
IN WITNESS WHEREOF the Owner has hereunto set their hand and seal or affixed its
corporate seal attested to by the hands of its proper officers duly authorized in that behalf, as
the case may be.
