THE CORPORATION OF THE TOWNSHIP OF GREATER MADAWASKA BY-LAW 71-2020 ___________________________________________________________________________ Being a By-law to regulate the operation of "off-road vehicles" on municipal roads ___________________________________________________________________________ WHEREAS the Highway Traffic Act R.S.O. 1990, c. H.8, section 191.8 (3) and (4) as amended and Ontario Regulation 316/03, s.4 provide that an "off-road vehicle" shall not be driven on a highway or part of the highway that is under the jurisdiction of a municipality unless a municipality permits the use by by-law and certain criteria are met as more particularly set out in s. 4.1; AND WHEREAS the Corporation of the Township of Greater Madawaska deems it expedient to exercise the powers vested in it by the said Regulation 316/03; NOW THEREFORE the Council of the Corporation of the Township of Greater Madawaska, the municipality, hereby enacts as follows: 1. An "off-road vehicle" is as defined by the Off-Road Vehicles Act, R.S.O. 1990, c.O.4 as amended, the Highway Traffic Act R.S.O. 1990 and O.Reg 316/03 and is permitted on a highway within the municipality's jurisdiction provided that at all material times: a) The "off-road vehicle" is compliant with the said Acts and Regulations in all respects and; b) shall not be operated on a municipal highway in excess of the "maximum speed" set out in s.22 of O.Reg 316/03, provided that in the event a municipal by-law further restricts the speed of any vehicle on a highway within the municipality's jurisdiction, the lower speed limit shall apply. 2. By-law 38-2015 is hereby repealed. 3. This by-law comes into effect on October 19, 2020 4. Any person who contravenes this by-law is guilty of an offence and upon conviction is liable for a fine as provided for in the Provincial Offences Act, R.S.O. 1990, c. P. 33.
