THE CORPORATION OF THE TOWN OF GREATER NAPANEE BY-LAW NO. 2014-0032 A by-law made pursuant to the authority granted to the Council of the Corporation of the Town of Greater Napanee under the Municipal Act, 2001, S.O. 2001, c.25, as amended, the Highway Traffic Act, R.S.O. 1990, chapter H.8, as amended and the Fire Protection and Prevention Act, 1997, S.O. 1997, c.4, as amended to: 1. Regulate the use of highways and bridges under the jurisdiction of council including the parking, standing and stopping of vehicles thereon; 2. Create and designate parking spaces on highways and/or on municipal or private property for the exclusive use of vehicles which are displaying a disabled person parking permit; 3. Designate private highways as fire routes along which no parking of vehicles shall be permitted; 4. Prohibit the parking or standing of motor vehicles on private property or property owned or occupied by the Town of Greater Napanee or any local board thereof, without consent; and 5. Provide for the enforcement of the matters set out in this by-law in the manner prescribed by the Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended. PART 1 - DEFINITIONS 1. (a) For the purpose of this by-law, (i) "Abandoned Vehicle" means any vehicle apparently abandoned on a highway, or which is inoperable or which, if a motor vehicle, does not carry proper registration plates; (ii) "Accessible Parking Permit" means a disabled person parking permit issued under the Highway Traffic Act or a permit, number plate or other marker or device issued by another jurisdiction and recognized under that Act; (iii) "Accessible Parking Permit Space" means a parking space designated for the exclusive use of a vehicle displaying an accessible parking permit in accordance with the requirements of the Highway Traffic Act and the regulations made there under and this by-law; (iv) "Authorized Sign" or "Sign" means any sign or highway, curb or sidewalk marking (including yellow paint on curbs) or other device placed or erected on a highway by the municipality or any other government body having jurisdiction for the purpose of regulating, warning or guiding traffic. (v) "Boulevard" means that part of the highway which lies between the shoulder or curb and the property line including any municipal sidewalk; (vi) "Bus Stop Zone" means any portion of a highway indicated by a sign on the highway as a place where buses may stop to pick-up or discharge passengers; (vii) "By-Law Enforcement Officer" means such one or more persons designated as provincial offence officers under the Provincial Offences Act, R.S.O. 1990, c.P.33, as amended, and appointed by the municipality for the purpose of enforcing the provisions of this by-law; (viii) "Clerk" shall mean the Clerk of the municipality or his/her designate; (ix) "County" means the Corporation of the County of Lennox & Addington; (x) "Entranceway" means a private road, driveway, lane or other means of access for vehicles to and from a highway; (xi) "Fire Chief" shall mean the Chief of Emergency Services of the municipality or his/her designate; (xii) "Fire Route" shall mean a private highway or any part thereof designated as a fire route by the posting of fire route signs; (xiii) "Fire Route Sign" means a permanently installed legible sign, approved by the Fire Chief, having a minimum size of 30 x 45 centimetres, placed at intervals as required by the Fire Department of the municipality of not more than 30 metres along the fire route, which shall display the following information by text or symbol: (A) fire route; and (B) parking prohibited; (xiv) "Heavy Vehicle" means a vehicle having a weight, when unloaded, of two (2) tons or more or, when loaded, of three (3) tons or more, but does not include a vehicle designed primarily to carry passengers, an ambulance, or any vehicle of a police or fire department; (xv) "Highway" includes a common or public highway, street, road, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by the general public for the passage of vehicles, and includes the surface, highway, median strip, shoulder, grassed area, boulevard, ditch, berm, gutter and any other portion of the road allowance owned by or under the jurisdiction of the municipality, including all highways owned by the County of Lennox & Addington for which the municipality has been given right-of-way control by agreement with the County; (xvi) "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other; (xvii) "Median Strip" means the portion of a highway so constructed so as to separate traffic travelling in one direction from traffic travelling in the opposite direction by a physical barrier, unpaved strip of ground, or by markings on the surface of the pavement; (xviii) "Motor Vehicle" includes an automobile, motorcycle and any other vehicle propelled or driven otherwise than by muscular power, but does not include a motorized snow vehicle, a motor assisted bicycle, traction engine, farm tractor, self-propelled implement of husbandry or road-building machine; (xix) "Motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor scooter, but does not include a motor assisted bicycle; (xx) "Municipal Property" means any property owned or occupied by the municipality or a local board thereof, other than a highway; (xxi) "Municipality" means The Corporation of the Town of Greater Napanee; (xxii) "No Parking Zone" means any portion of a highway indicated by one or more signs as a place where a vehicle shall not be parked at any time or, if times are stated on the signs, at such times; (xxiii) "No Stopping, No Standing Zone" means any portion of a highway indicated by one or more signs as a place where a vehicle shall not be stopped at any time or, if times are stated on the signs, at such times. (xxiv) "Park" or "Parking" when prohibited, means the parking or standing of a vehicle, whether occupied or not, except when parking or standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; (xxv) "Parking Infraction" means any unlawful parking or stopping of a vehicle contrary to the provisions of this by-law; (xxvi) "Parking Infraction Notice" means a certificate of parking infraction and parking infraction notice in a form prescribed by regulations under the Provincial Offences Act; (xxvii) "Parking Exemption Permit" means a permit issued by the Clerk for a vehicle that allows the vehicle to be parked for a period of time longer than permitted in this by-law (xxviii) "Parking Space" means a portion of a highway designated by markings on the surface of the highway as an area intended for the parking of motor vehicles; (xxix) "Pedestrian" includes a person travelling on foot and in a wheelchair or carriage; (xxx) "Pedestrian Crosswalk" means any portion of a highway, at an intersection or elsewhere, indicated for pedestrian crossing by signs on the highway and lines or other markings on the surface of the highway; (xxxi) "Person" means and includes any person, firm or corporation; (xxxii) "Private Property" shall mean any property that is not municipal property or a highway; (xxxiii) "Private Highway" shall mean any private road, lane, ramp or other means of vehicular access to or egress from a building or structure and it may include part of a parking lot; (xxxiv) "Property Owner" shall mean any person, firm or corporation that owns or occupies a property and includes a tenant or licensee; (xxxv) "Reserved Parking Permit" means a permit issued by the Clerk for a vehicle that permits the vehicle to park in accordance with this by-law on municipal property in a parking space reserved for that vehicle for longer than the time period permitted under this by-law; (xxxvi) "School Bus Loading Zone" means any portion of a highway, municipal property or private property indicated by signs as an area designated for school bus loading; (xxxvii)"Set Fine" means the fine for an offence under this by-law approved by the Regional Senior Justice of the Ontario Court of Justice; (xxxviii) "Shoulder" means that portion of the highway immediately adjacent to the highway and which is not improved, designed or ordinarily used for vehicular traffic; (xxxix)"Sidewalk" means a usually paved walk for pedestrians at the side of a highway; (xl) "Stand" or "Standing", when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers; (xli) "Stop" or "Stopping", when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal; (xlii) "Taxi Cab" means a vehicle available for hire and for which a valid licence to operate as a taxi within the municipality has been issued in accordance with the municipality's by-laws; (xliii) "Taxi Stand" means any portion of a highway indicated by one or more authorized signs as a place where a taxi cab may park; (xliv) "Through Street" means a highway or part of a highway designated by the Minister of Transportation for the Province of Ontario as a connecting link in accordance with the Public Transportation and Highway Improvement Act, or a highway or part of a highway under the jurisdiction of The Corporation of the County of Lennox and Addington, or a highway or part of a highway designated as a through street by this by-law; (xlv) "Time Limited Parking Zone" means any portion of a highway indicated by one or more signs as a place where a vehicle shall not be parked longer than the specified maximum time limits; (xlvi) "Truck Loading Zone" means any portion of a highway indicated by one or more authorized signs as a place where only commercial vehicles may park for the sole purpose of loading or unloading cargo; (xlvii) "Vehicle" includes a motor vehicle, motor assisted bicycle, trailer, traction engine, farm tractor, road building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle. (b) Any expression or term used in this by-law and not specifically defined shall have the same meaning that such expression or term has under the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended. (c) This by-law shall be referred to as the "Parking By-law". (xlvii) "Recreational Vehicle" means any vehicle so constructed that it is no wider than 2.5 metres and is suitable for being attached to a motor vehicle for the purposes of being drawn or is self-propelled, and is capable of being used on a short-term recreational basis for living, sleeping or eating accommodation of persons and includes a motor home, travel trailer, tent trailer or camper. PART II - PARKING INFRACTIONS 2. No person shall park a vehicle on a highway: (a) in front of or within 1.5 metres (5 feet) of an entranceway or so as to obstruct vehicles using the entranceway, except in a parking space; (b) within 3 metres (10 feet) highway nearest a fire hydrant, except in a parking space; (c) within 7.5 metres (25 feet) of an intersection not controlled by traffic signals, except in a parking space; (d) within 30 metres (100 feet) of an intersection controlled by traffic signals, except in a parking space; (e) within 15 metres (50 feet) of the nearest rail of a level railway crossing; (f) on a highway where the highway width is less than 6.0 metres (20 feet); (g) in front of an entrance to or exit from any building or enclosed space in which persons may be expected to congregate in large numbers including, but not limited to a hotel, theatre or auditorium; (h) in a position or place that prevents or is likely to prevent the movement of another vehicle already parked on the highway; (i) in such a manner as to interfere with the clearing of snow, or the cutting of grass, or the removal of weeds on the whole or any part of a highway; (j) for longer than twelve (12) consecutive hours; (k) in a time limited parking zone for longer than the specified maximum time limit; (l) at any time between 1:00 a.m. and 7:00 a.m. on any day between December 1st of one year and March 31st of the following year; (m) in a school bus loading zone during the times stated on the signs designating the zone or, if no times are stated, between 8:00 a.m. and 5:00 p.m. on any day when the school is open for educational purposes (n) in an accessible parking permit space, unless the vehicle clearly displays a valid accessible parking permit and the disabled person is the driver or passenger in such vehicle; (o) for the purpose of displaying the vehicle for sale; (p) for the purpose of washing, greasing or repairing the vehicle, except in the event of an emergency; (q) on a Fire Route; (r) in a No Parking zone; or (s) within 15 metres (50 feet) of the termination of a road. 3. No person shall stop a vehicle on a highway: (a) so as to obstruct a sidewalk pedestrian walkway or an intersection; (b) so as to obstruct, or within 3 metres (10 feet) of, a pedestrian crosswalk; (c) in such a manner as to interfere with the unobstructed use of the highway by other traffic; (d) alongside of any parked vehicle; (e) upon any bridge or within any tunnel or underpass; (f) on any median strip, or adjacent to either side or the end of any median strip; (g) on any boulevard; (h) in a No Stopping or standing zone; (i) in a Bus Stop zone; (j) in a truck loading zone between 6 a.m. and 11 p.m. from Monday to Saturday inclusive, except for the purpose of loading or unloading a commercial vehicle; (k) alongside or across the highway from any excavation or obstruction in the highway when the free flow of traffic would thereby be impeded; or (l) so as to interfere with the formation of a funeral procession. 4. No person shall park or stop any vehicle on any highway or portion thereof except as follows: (a) where there is a raised curb on the right side of the highway, having regard to the direction such vehicle was proceeding, with its right front and right rear wheels of the vehicle parallel to and distance not more than 0.15 metres (6 inches) out from such curb; or (b) where there is no curb or a rolled curb on the right side of the highway, having regard to the direction such vehicle was proceeding, with the right front and right rear wheels parallel to and as near to the right limit of the shoulder as is practicable, without stopping or parking upon a sidewalk or footpath, or any part of the highway where grass is grown or which is not intended for the use of vehicles. 5. No person shall park or stop any vehicle on the left side of the highway except where a highway is designated for one-way traffic and parking is permitted on the left side of the highway. 6. Where parking spaces are designated by lines painted on the highway, no person shall park or stop any vehicle except within the area designated as a parking space. 7. Despite section 6, a person may park or stop a vehicle that is longer than the limits of a single parking space in two or more parking spaces if both ends of the vehicle are within the limits of the parking spaces that the vehicle occupies in whole or part. 8. No person shall park an abandoned vehicle on any highway at any time. 9. No person shall park a heavy vehicle on a highway between 8:00 p.m. of one day and 8:00 a.m. of the following day. 10. Despite subsection 2(k), vehicles that display a valid parking exemption permit issued by the Clerk shall be exempt from the maximum time limit during which a vehicle may be parked in a time limited parking zone. 10.1 Despite subsections 3(a) and 3(g), recreational vehicles that display a valid temporary encroachment permit issued by the Clerk may be parked in a manner that partially encroaches upon a municipal right of way provided that a clear passage for pedestrians is maintained which is either the width of the existing sidewalk or the current minimum width for accessible sidewalks as established in the Accessibility for Ontarians with Disabilities Act, 2005 and Regulations, whichever is less. 11. No person shall park a vehicle except a police vehicle in a parking space designated "Police Only" at any time. 12. No person shall park a vehicle other than a taxi cab at a taxi stand. 13. No person shall park a vehicle in a parking space designated as Town Staff Parking only between the hours of 8 a.m. and 5 p.m. from Monday to Friday inclusive without the consent of the municipality. PART III - PRIVATE & MUNICIPAL PROPERTY PARKING INFRACTIONS 14. In this part, (a) "owner" when used in relation to property shall mean: (i) the registered owner of the property; (ii) the registered owner of a condominium unit whose consent shall extend only to the control of the unit of which he is owner and any parking spaces allotted to him by the condominium corporation, or reserved for his exclusive use in the declaration or description of the property; (iii) the spouse of a person described in subclauses (i) or (ii) above; (iv) where the property is included in a description registered under the Condominium Act, the Board of Directors of the Condominium Corporation; and (v) a person authorized in writing by the property owner defined in subclauses (i), (ii), (iii) or (iv) above, to act on the owner's behalf for requesting enforcement of this by-law. (b) "occupant" shall mean: (i) the tenant of the property or part thereof whose consent shall extend only to the control of the land of which he is tenant and any parking spaces allotted to him under his lease or tenancy agreement; (ii) the spouse of a tenant; (iii) a person or the municipality or a local board thereof having an interest in the property under an easement or right-of-way granted or expropriated by the person, municipality or local board, whose consent shall extend only to the part of the property that is subject to the easement or right-of-way; and (iv) a person authorized in writing by an occupant as defined in clauses (i), (ii) or (v) above, to act on the occupant's behalf for requesting the enforcement of this by-law. 15. No person shall park a motor vehicle: (a) on private property without the consent of the owner or occupant of the private property; or (b) on municipal property without the consent of the municipality or local board that owns or occupies the property. 16. Where an owner or occupant of private property or municipal property has posted signs stating conditions on which motor vehicles may be parked on the property, or prohibiting the parking of motor vehicles on the property, a motor vehicle parked on the property contrary to such conditions or prohibition shall be deemed to have been parked without consent. 17. No person shall park a motor vehicle on municipal property: (a) at any time between 1:00 am and 7:00 am on any day between December 1st of one year and March 31st of the following year without the consent of the municipality; (b) in a space designated for reserved permit parking only unless a valid reserved parking permit for the space has been issued for the vehicle by the Clerk; or (c) for longer than eight (8) consecutive hours without the consent of the municipality. 18. No person shall park a motor vehicle on private property or municipal property: (a) in a school bus loading zone during the times stated on the signs designating the zone or, if no times are stated, between 8:00 a.m. and 5:00 p.m. on any day when the school is open for educational purposes; (b) in an accessible parking permit space, unless the vehicle clearly displays a valid accessible parking permit and the disabled person is the driver or passenger in such vehicle; or (c) on a Fire Route. PART IV - EXEMPTED VEHICLES 19. The provisions of Parts II and III inclusive of this by-law do not apply to ambulance, police department vehicles, fire department vehicles or other emergency vehicles, public utility vehicles engaged in works undertaken for or on behalf of the municipality, armoured vehicles, Military vehicles and Municipal By- law Enforcement Officers' vehicles when being used in the lawful performance of their duties. PART V - DESIGNATION OF ZONES, ACCESSIBLE PARKING AREAS AND FIRE ROUTES 20. Those highways or parts of highways set out in Schedule 1 to this by-law are hereby designated as No Parking Zones at all times. 21. Those highways or parts of highways set out in Schedule 2 to this by-law are hereby designated as No Stopping Zones at all times. 22. Those highways or parts of highways set out on Schedule 3 to this by-law are hereby designated as No Parking Zones during the times indicated. 23. Those highways or parts of highways set out in Schedule 4 to this by-law are hereby designated as Time Limited Parking Zones where parking is limited to the specified maximum time limit. 24. Those highways or parts of highways set out in Schedule 5 to this by-law are hereby designated as Bus Stop and School Bus Loading Zones. 25. Those highways or parts of highways set out in Schedule 6 to this by-law are hereby designated as Taxi Stands. 26. Those highways or parts of highways set out in Schedule 7 to this by-law are hereby designated as Accessible Parking Permit Spaces. 27. Every owner or occupant of private property that has on it an accessible parking permit space shall ensure that the accessible parking permit space is distinctly indicated in accordance with the requirements of the Highway Traffic Act and the regulations made there under. 28. The driver or operator of a vehicle which displays an accessible parking permit shall not be required to pay an amount in excess of the normal fee paid by other users of the same parking lots or other parking facilities to which the public has access. 29. Those highways or parts of highways set out in Schedule 8 to this by-law are hereby designated as Town of Greater Napanee Staff Parking Only Zones. 30. The Fire Chief shall have the authority to designate fire routes on any private highway, municipal property or highway providing access to or egress from an apartment building, hospital, hotel, motel, church, nursing home, shopping centre, townhouse, industrial or commercial building and any other structure used for the accommodation of the public or for the gathering or assembling of people. Fire routes are hereby designated on those properties described in Schedule 9 to this by-law. 31. Upon designation of a fire route, the Fire Chief shall issue a notice to be sent by prepaid mail or personal delivery to the owner or occupant of the property indicating the municipal address of the property and which areas are designated as fire routes. 32. Within thirty (30) days after the date the notice under section 31 is mailed, the property owner or occupant shall erect the prescribed fire route signs. 33. Fire route signs shall be erected along all fire routes and shall: (a) be placed at each limit of the fire route and shall display single-headed arrows pointing in the direction in which the fire route is located and, at intermediate points throughout the fire route, double-headed arrows shall indicate that the fire route exists in each direction; and (b) be installed along the fire route at intervals no greater than 30 metres or with such greater frequency as may be reasonably necessary to identify the fire route. 34. The owner or occupant of private property upon which a fire route has been designated shall maintain the fire route signs in good repair and shall keep such fire route in good repair, clear of snow and ice and free from all obstruction. 35. Where the owner or occupant of private property fails or refuses to erect or maintain a fire route sign or fire route in accordance with this by-law, the Fire Chief or such other employee of the municipality as may be designated by him may enter on the property and erect fire route signs or maintain the fire route in accordance with this by-law at the expense of the property owner and any costs incurred as a result thereof may be recovered in like manner as municipal taxes in accordance with the Municipal Act, 2001. 36. Notwithstanding any other provision of this by-law, the Fire Chief and By-law Enforcement Officers of the municipality are hereby appointed to enter upon private property at any reasonable time to inspect the property to determine whether the fire route provisions of this parking by-law have been complied with and to enforce such provisions in accordance with this by-law. PART VI - ENFORCEMENT - GENERAL 37. Any vehicle parked in contravention of the provisions of this by-law may, on the order of a police officer or by-law enforcement officer be moved or towed to a suitable location at the owner's risk, expense and cost. 38. All costs and charges for the removal, towing, care and storage of a motor vehicle shall form a lien on the motor vehicle and may be enforced in the manner prescribed by s.4 of the Repair and Storage Liens Act, R.S.O. 1990, Chapter R.25, as amended. 39. Every person who contravenes any provision of this by-law other than through the commission of a parking infraction shall, in addition to any other penalty provided for in this by-law, be guilty of an offence and upon conviction is liable to a fine of not more than five thousand dollars ($5,000). 40. Every person who commits a parking infraction is guilty of an offence and upon conviction is liable to a fine of not more than two thousand dollars ($2,000) exclusive of costs. 41. The driver of a vehicle involved in the commission of a parking infraction, not being the owner, is liable to any penalty provided under this by-law, and the owner of the vehicle is also liable to such a penalty unless, at the time the offence was committed, the vehicle was in the possession of a person other than the owner without the owner's consent. 42. For parking infractions of a continuing nature, a parking infraction shall be deemed to have been committed on each day or part thereof upon which such infraction continues. 43. This by-law may be enforced on private property that is used as a parking lot if, a) the owner or occupant of the land has filed with the Clerk written consent to the application of the by-law to the land; and b) a sign is erected at each entrance to the land clearly indicating the regulation or prohibition. PART VII - ENFORCEMENT - PARKING INFRACTION NOTICE 44. Any person who commits a parking infraction that he/she does not wish to dispute may, within seven (7) days of the time when a parking infraction notice was attached to the vehicle, deliver between 8:30 a.m. and 4:30 p.m. from Monday to Friday, exclusive of statutory holidays, the notice and the amount of the voluntary payment set out on the parking infraction notice, or within fifteen (15) days the set fine amount as set out on the parking infraction notice, to the Town Designated Official on duty at the municipal offices in Napanee who is authorized to accept such payment and furnish an official receipt. 45. The amount of the voluntary payment that may be paid in respect of offences under this by-law is as set out in the Set Fine Schedule as approved by the Regional Chief Justice. 46. Any person who is served with a parking infraction notice and wishes to plead not guilty may, within fifteen (15) days of the time when the parking infraction notice was attached to the vehicle, deliver to the Town Designated Official on duty at the municipal offices in Napanee between 8:30 a.m. and 4:30 p.m. from Monday to Friday, exclusive of statutory holidays, the notice with the not guilty plea on the notice signed together with the form on the notice indicating his desire to appear or be represented at trial. 47. Upon failure to either make payment in accordance with paragraph 44 of this by- law or deliver the notice in accordance with paragraph 46 of this by-law within the time prescribed, a person shall become liable to be convicted pursuant to Part II of the Provincial Offences Act or, at the option of the municipality, liable for prosecution pursuant to Part III of the Provincial Offences Act. PART VIII - ADMINISTRATION 48. By-law Enforcement Officers of the municipality shall be responsible for the administration and enforcement of this by-law. 49. The Clerk is authorized to issue parking exemption permits to the owner or operator of any vehicle to be used for the purpose of parking on a highway for longer than the maximum time limit specified for a limited parking zone under this by-law. 50. A parking exemption permit shall not be issued for longer than thirty (30) consecutive days unless issued to a tenant of a municipal property. 51. The cost of a parking exemption permit shall be $15.00 per commercial vehicle per day and must be returned upon expiration of the time period for which it was issued. 51.1 The Clerk is authorized to issue temporary encroachment permits to the owner or operator of a recreational vehicle for the purpose of moving the recreational vehicle in or out of seasonal storage in instances where the residential driveway is not of sufficient length to fully accommodate the recreational vehicle in accordance with Section 4.38 of the Zoning By-law. 51.2 A temporary encroachment permit shall not be issued for longer than forty-eight (48) hours and shall not be issued more than twice in one year to the same address. No temporary encroachment permit shall be issued between November 1st and March 31st. 51.3 The cost of a temporary encroachment permit shall be $15.00 per vehicle per use. 51.4 The issuance of a temporary encroachment permit does not exempt the permit holder from the requirement to ensure the sidewalk remains accessible for public use. Reserved Parking 52. The Clerk is authorized to issue reserved parking permits to the owner or operator of any vehicle to be used for the purpose of parking on municipal property in a parking space reserved exclusively for that vehicle on a daily basis. 53. A reserved parking permit may be issued on a monthly basis for $40.00 per vehicle per month per designated reserved parking space. The fee shall take effect on January 1, 2015. The permit must be returned upon expiration of the time for which it was issued. PART IX - REPEAL OF EXISTING BY-LAWS 54. Upon this by-law coming into force, By-law No. 06-56 and any other by-law of the municipality conflicting with this by-law shall be repealed. 55. This by-law shall come into force and take effect upon approval of the set fine amounts by the Regional Senior Justice.
