The Corporation of the Township of Guelph/Eramosa
By-law Number 57/2021

A By-law to prescribe and authorize rates of speed
within the Township of Guelph/Eramosa
WHEREAS subsection 1 of section 128 of The Highway Traffic Act (R.S.O. 1990, c.H.8),
prescribes the rate of speed for motor vehicles; and
WHEREAS in accordance with subsection 2 of section 128 of The Highway Traffic Act
(R.S.O. 1990, c.H.8), the council of a municipality may, for motor vehicles driven on a
highway or portion of a highway under its jurisdiction, by by-law prescribe a rate of speed
different from the rate set out in subsection (1) that is not greater than 100 kilometres per
hour and may prescribe different rates of speed for different times of day; and
WHEREAS it is deemed expedient that the speed of motor vehicles on certain highways
within the Township of Guelph/Eramosa be identified through a Township-wide,
Comprehensive Speed By-law;
NOW THEREFORE, the Council of the Corporation of the Township of Guelph/Eramosa
enacts as follows:
1.
THAT In keeping with Section 128 1 a) of the Highway Traffic Act no person
shall drive a motor vehicle at a rate of speed greater than 50 kilometres per
hour within a built-up area, unless otherwise further reduced by the attached
as Schedule 'A';
2.
THAT in keeping with Section 128 1 b) of the Highway Traffic Act no person
shall drive a motor vehicle at a rate of speed greater than 80 kilometres per
hour not within a built-up area, unless otherwise further reduced by the
attached as Schedule 'A';
3.
THAT when any highway or portion of highway set out in Schedule A,
appended hereto, is marked in compliance with the regulations under The
Highway Traffic Act, the maximum rate of speed thereon shall be the rate
of speed prescribed in Schedule 'A'
4.
THAT By-laws 33/1996, 10/1997, 35/1997, 46/1998, 38/1999, 18/2000,
60/2000, 62/2000, 14/2001, 76/2001, 40/2008, 62/2009, 63/2009, 15/2010,
16/2010, 21/2013, 13/2013, 71/2016, 72/2016, 73/2016, 56/2018, 40/2020
and all prior by-laws reducing speed limits are hereby repealed.
THIS By-law shall come into force and have effect immediately upon the final passing
thereof.
