THE CORPORATION OF THE CITY OF GUELPH By-law Number (1971)-7622 A by-law relating to the operation of motorized snow vehicles. The Council of The Corporation of the City of Guelph ENACTS AS FOLLOWS:- 1. (a) "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designated and intended for, or used by, general public for the passage of vehicles. (b) "Motorized snow vehicle" means a self-propelled vehicle designed to be driven exclusively on snow or ice or both. (c) "Operate" means the motor of a motorized snow vehicle is running, whether the vehicle is moving or not. (d) "Sidewalk" means and includes footpath, footway which has been designed for and/or used by pedestrians. (e) "Street or road allowance" means that portion of land set aside between front lot lines and which allowance is vested in the municipality. 2. No person shall operate a motorized snow vehicle within the limits of the City of Guelph, including on any street or road allowance, or highway except as provided herein. 3. Section 2 shall not apply to - (i) The operation of a motorized snow vehicle on private property with the owner's permission. (ii) The driver of a motorized snow vehicle may cross a sidewalk or highway. (iii) The operation of motorized snow vehicles on municipally owned lands, where such lands have been designated, by the controlling authority for the operation of such vehicles, either by resolution or by-law. 4. No person shall operate a motorized snow vehicle within the corporate limits of the City of Guelph between the hours of 10:00 o'clock p.m. and 8:00 o'clock a.m. of the next following day on Sunday, Monday, Tuesday, Wednesday or Thursday of any week and between the hours of 11:00 o'clock p.m. and 8:00 o'clock a.m. of the next following day on Friday and Saturday of each week. 5. Nothing in this by-law applies to prohibit the operation of a motorized snow vehicle - (a) Used and equipped for the removal of snow. (b) By a member of the Guelph Police Department while engaged in the performance of his duty. (c) By an employee of the City of Guelph or of any of its local boards or commissions while engaged in the performance of his duty as such employee. 6. Any person contravening any provision of this by-law, shall be guilty of an offence and shall be liable upon conviction to a fine not exceeding $300 exclusive of costs, in the discretion of the convicting Judge. 7.
