## Corporation of the Township of Havelock-Belmont-Methuen By-law Number 2022 - 018 Being a by-law to Regulate the Sale and Setting Off of Fireworks within the Township of Havelock-Belmont-Methuen WHEREAS Section 121(a) of the Municipal Act, Chapter 25, S.O. 2001, provides that a local municipality may prohibit and regulate the sale of fireworks, and the setting off of fireworks; AND WHEREAS Section 121(b) of the Municipal Act, Chapter 25, S.O. 2001, provides that a local municipality may prohibit the activities described in Section 121(a) unless a permit is obtained from the Township for those activities and may impose conditions for obtaining, continuing to hold and renewing the permit, including requiring the submission of plans; AND WHEREAS under Section 5 (3) of the Municipal Act, a municipal power shall be exercised by by-law; AND WHEREAS under Section 434.1 (1) of the Municipal Act, Chapter 25, S.O. 2001, provides that a municipality may require a person, subject to such conditions as the municipality considers appropriate, to pay an administrative penalty if the municipality is satisfied that the person has failed to comply with a by-law of the municipality passed under this Act; AND WHEREAS under Section 434.2 (2) of the Municipal Act, Chapter 25, S.O. 2001, provides that if an administrative penalty imposed under section 434.1 is not paid within 15 days after the day that it becomes due and payable, the treasurer of a local municipality may, and upon the request of its upper-tier municipality, if any, shall, add the administrative penalty to the tax roll for any property in the local municipality for which all of the owners are responsible for paying the administrative penalty, and collect it in the same manner as municipal taxes; NOW THEREFORE the Council of the Corporation of the Township of Havelock-Belmont-Methuen hereby enacts as follows: ## 1.0 Definitions In this by-law: - 1.1 Act means the Explosives Act, Revised Statutes of Canada, 1985, Chapter E17, and the Regulations enacted thereunder as amended from time to time or any Act and Regulations enacted in substitutions therefore. - 1.2 Consumer Fireworks means an outdoor, low hazard, firework that is designed for recreational use that is classed as a 7.2.1/F.1 firework under the Act, and includes items such as showers, golden rain, roman candles, sparklers, multi-shot cakes, volcanoes, and snakes. - 1.3 Chief Building Official means the Chief Building Official appointed by the Township. - 1.4 Council means the Council of The Corporation of The Township of Havelock-BelmontMethuen. - 1.5 Display Fireworks means an outdoor, high hazard, firework that is designed for professional use only. This firework is classed as a 7.2.2/F.2 firework under the Act. This includes items such as aerial shells, cakes, roman candles, waterfalls, lances, and wheels. Display fireworks are strictly regulated by federal law. - 1.6 Fire Ban means temporary measures put in place by the Township or Ministry of Northern Development, Mines, Natural Resources and Forestry to restrict open air burning when extreme fire conditions may exist. - 1.7 Fireworks means Consumer Fireworks, Display Fireworks and Special Effects Pyrotechnics. - 1.8 Flying Lantern means a small hot air balloon made of paper, with an opening at the bottom where a small fire is suspended. Also known as sky lanterns. - 1.9 Magazine means an isolated, secure, locked storage unit or structure that is lined with nonsparking material and is marked "FIREWORKS" - 1.10 Occupant means the person or persons residing in the premises which he/she does not own; - 1.11 Officer means a person appointed by Council as a Municipal Law Enforcement Officer, a Police Officer, Fire Chief or other individual appointed to enforce this By-law; - 1.12 Owner means a person or persons listed as the landowner on the most current Property Tax Assessment Roll; - 1.13 Person means and shall include an individual human being, an individual company, partnership, corporation or limited company. - 1.14 Permit means written permission to hold a Fireworks display issued by the Municipality pursuant to this By-law and signed by the Fire Chief or designate. - 1.15 Premises means a piece of land and any buildings and structures on it, and includes a place of business, road, and any other location or place. - 1.16 Public Fireworks Display means an exhibition of Fireworks in an open-air assembly, occupancy to which the public is invited, attends or is admitted, with or without a fee being charged. - 1.17 Pyrotechnician means a person who has successfully completed the special effects pyrotechnics safety and legal awareness course offered by the Explosives Regulatory Division, Natural Resources Canada or a course certified as equivalent by the Minister. This term is also used as a generic term to refer to all classes of pyrotechnicians as set out in the regulations of the Act including special effect pyrotechnics technicians, lead pyrotechnicians, lead technicians, special effects coordinators (SEC), and similar terms. - 1.18 Sell includes Offer for Sale, cause or permit to be sold and to possess for the purpose of sale, and the words "selling" and "sold" have a similar meaning. - 1.19 Setting Off means to fire, discharge, ignite or explode, or set off or cause to be fired, ignited, exploded or set off and the words "discharged" and "discharging" have a similar meaning. - 1.20 Special Effect Pyrotechnics are high-hazard pyrotechnic articles and are designed for professional use. This firework is typically classed as a 7.2.5/F.3 firework under the Act. This includes items such as bullet effects, flash powders, smoke compositions, gerbs, lances, saxons as well as special purpose pyrotechnics made for live stage performances and the film and television industry. Pyrotechnics are strictly regulated by federal law. - 1.21 Tenant means a person(s) renting premises; - 1.22 Township means the Corporation of the Township of Havelock-Belmont-Methuen or the Geographical area of the Township of Havelock-Belmont-Methuen as the context requires. - 1.23 Vendor also known as a supplier, is an individual or company that sells goods or services to someone else in exchange for money. - 1.24 Weekend the period from Friday at 6:00 p.m. through Sunday at 12:59 p.m. ## 2.0 General Prohibitions - 2.1 Flying Lantern Discharge: No person shall ignite, release or set off into the air an ignited Flying Lantern within the Township of Havelock-Belmont-Methuen. - 2.2 Flying Lantern Sale: No person within the Township of Havelock-Belmont-Methuen shall possess, offer for sale, cause or permit to be sold, or sell any Flying Lantern. - 2.3 No person shall possess, offer for sale, cause or permit to be sold, or sell any Firecrackers or Prohibited Fireworks in the Township of Havelock-Belmont-Methuen. - 2.4 No person shall set off any Fireworks, cause, or permit any Fireworks to be set off except as provided in this by-law. - 2.5 No person shall set off any Fireworks from any property that abuts the King's Highway 7 within the boundaries of the Township of Havelock-Belmont-Methuen unless approval has been granted by the Fire Chief or designate. - 2.6 Notwithstanding Subsection 3.1, no person shall set off any Fireworks when there is a Fire Ban or restriction in effect or when open air burning is prohibited. ## 3.0 Setting Off Fireworks - 3.1 No person shall discharge any Fireworks unless they have received a Permit from the Fire Chief or Designate. - 3.2 No person shall set off Fireworks within the Township of Havelock-Belmont-Methuen at any time except as follows: - a) New Year's Eve - between 7:00 p.m. and 1:00 a.m. the following day; - b) Victoria Day - between 7:00 p.m. and 11:00 p.m. on the weekend preceding and including the statutory holiday; - c) Canada Day - between 7:00 p.m. and 11:00 p.m. on the weekend prior to Canada Day, the weekend directly following Canada Day or on July 1st; - d) Civic Holiday - between 7:00 p.m. and 11:00 p.m. on the weekend preceding and including the statutory holiday; - e) Labour Day - between 7:00 p.m. and 11:00 p.m. on the weekend preceding and including the statutory holiday; - f) No Fireworks are permitted when there is a burn ban in place with the exception of special events permitted with the approval from the Fire Chief or designate. 7. 3.3 No person shall discharge Fireworks except between 7:00 p.m. and 11:00 p.m. on the day of, or the day immediately following the cultural or religious holiday for which a Permit has been applied for and issued by the Fire Chief. 8. 3.4 No person shall set off any Fireworks in, on or onto any building, highway, sidewalk, Township Park or Township property, unless written approval has been first obtained by Council 9. 3.5 Any expenses related to property damage or injury or harm to persons, livestock or domesticated animals as a result off the discharge of Fireworks shall be the responsibility of the person and/or organization and/or property owner/tenant setting off the Fireworks. 10. 3.6 A Display Fireworks event is exempt from Section 3.1 providing a valid permit as outlined in Section 7 has been obtained from the Fire Chief or designate of the Corporation of the Township of Havelock-Belmont-Methuen. 11. 3.7 Consumer Fireworks, that take place outside of the permitted times listed in Section 3.1 may be granted special permission for Religious, Cultural or a special event upon approval from the Fire Chief or Designate. 12. 3.8 Community events using Consumer Fireworks that take place outside the permitted times listed in Section 3.1 may be granted special permission by Council. 13. 3.9 No person shall set off Fireworks in or on any public highway, street, lane, square or other public place which members of the public use or may use at any time, without prior written approval from the Fire Chief or Designate. 14. 3.10 Fireworks may be set off on private property by the owner or occupant of such residence provided that: - a) The location is clear of any overhead obstacles such as trees and power lines; - b) The location has a minimum size of thirty (30) by thirty (30) metres (or one hundred (100) by one hundred (100) feet); and - c) The location is a minimum of ten (10) metres (or thirty-two (32) feet, ten (10) inches) from the nearest building; and - d) A permit has been obtained from the Fire Chief or Designate. 5. 3.11 No person under the age of eighteen (18) years shall set off any Fireworks except under the direct supervision and control of a person eighteen (18) years of age or older who shall, at all times, remain physically present in the immediate area where the Fireworks are being set off. 6. 3.12 No person shall set off or hold a display of Fireworks on any land that is not owned or occupied by him or her, unless written permission for the setting off or the holding of a display of Fireworks on a date clearly specified in the written permission has been obtained from the owner or person in charge of the land. 7. 3.13 The person responsible for setting off Fireworks shall provide and maintain fully operational fire extinguishing equipment ready for immediate use which shall be present at all times while Fireworks are being set off and for a reasonable period thereafter, at the location of the setting off or holding of a display of Fireworks. 8. 3.14 No person shall discharge Fireworks into, inside of, or on any building, accessory building, structure, or motor vehicle. 9. 3.15 No person shall discharge Fireworks closer than thirty (30) metres to any structure or property line, or the distance recommended from the manufacturer, whichever is greater. 10. 3.16 No person shall discharge Fireworks closer than one hundred (100) metres to a church, school, residential care facility, hospital or home for the aged unless the consent in writing of the owner of such establishment, or of an authorized agent or representative of such owner, is first obtained in writing. 11. 3.17 No person shall discharge Fireworks within three hundred (300) metres of any place where explosives, gasoline or other highly inflammable substances are manufactured or stored in bulk. 12. 3.18 No person shall discharge Fireworks closer than three hundred (300) metres of any property line that houses livestock or kennel. 13. 3.19 No person shall set off Fireworks in a manner that creates or may create a nuisance, an unsafe condition, danger from fire, injury or damage to or in respect of any person, livestock, property or thing. ## 4.0 Vendor Selling Consumer Fireworks - 4.1 Every Vendor selling Fireworks within the Township must post a Notice of Regulations as provided by the Township in a conspicuous place upon the premises, near where the Fireworks are sold. - 4.2 No person shall offer for sale, cause or permit to be sold, sell or possess Consumer Fireworks unless such Fireworks are included in the most recent list of authorized explosives as published from time to time by the Explosives Regulatory Division of Natural Resources Canada, or its successor. - 4.3 No person shall offer for sale, cause or permit to be sold, sell or possess Consumer Fireworks unless such Fireworks are displayed in lots that do not exceed 25 kilograms each in gross weight. - 4.4 No person shall offer for sale, cause or permit to be sold, sell or possess Consumer Fireworks to any person under the age of eighteen (18) years. - 4.5 Fireworks are displayed in a place where they are not exposed to the rays of the sun or to excess heat. ## 5.0 Vendor Selling Display Fireworks - 5.1 Every Vendor selling Fireworks within the Township must post a Notice of Regulations (this by-law) as provided by the Township in a conspicuous place upon the premises, near where the Fireworks are sold. - 5.2 No person shall offer for sale, cause or permit to be sold, sell or possess Display Fireworks unless such Fireworks are included on the most recent list of authorized explosives as published from time to time by the Explosives Regulatory Division of Natural Resources Canada, or its successor. - 5.3 No person shall exhibit, display, offer for sale, cause or permit to be sold or sell Display Fireworks unless, prior to the sale, such Fireworks are kept and maintained in a magazine (storage unit) licenced by the Explosives Regulatory Division of Natural Resources Canada, or its successor. - 5.4 No person shall give, offer for sale, cause or permit to be sold or sell Display Fireworks to any person unless that person: - a) Is eighteen (18) years of age or older; - b) Holds a valid Fireworks Operator Certificate with the appropriate certification level; and - c) Holds a valid Display Fireworks Permit issued by the Township. ## 6.0 Permits for Consumer Fireworks - 6.1 No person shall set off or hold a display of Consumer Fireworks in the Township of HavelockBelmont-Methuen without a Permit issued by the Township and signed by the Fire Chief or Designate. - 6.2 Consumer Fireworks Permits shall specify the location where such Fireworks are to be set off, the type and kind of Fireworks which may be set off, the methods and means which may be used to set off the Fireworks, the manner and means of restraining unauthorized persons from attending too near the location where the Consumer Fireworks are being set off, the manner in which unused Fireworks are to be disposed of, and the number of persons handling and setting off the Fireworks, all of whom shall be responsible and competent individuals at least eighteen years of age. - 6.3 Every Consumer Fireworks Permit application shall include a description of the site to be used for the setting off the Consumer Fireworks that is sufficient to identify and locate the site in the case of an emergency. - 6.4 Every Consumer Fireworks Permit shall specify the name of the applicant, the date and time of the display and the name of the person(s) under whose supervision the display is to be held. - 6.5 No person shall set off or hold a display of Consumer Fireworks without the written permission of the owner of the site upon which the setting off or display of Consumer Fireworks is to be held or an authorized representative thereof, or without the written permission of the owner of all neighbouring lands upon which debris may be reasonably expected to fall. - 6.6 All expenses relating to property damage or injury to persons, domesticated animals and livestock as a result of the discharge of Consumer Fireworks shall be the responsibility of the person and/or organization and/or property owner/tenant setting off the Consumer Fireworks. - 6.7 In addition to all requirements set out in Section 6.0 of this by-law, all requirements and conditions set out in Section 3.0 of this by-law regarding the setting off of fireworks must be met and adhered to at all times. ## 7.0 Permits for Display Fireworks - 7.1 Only persons who hold a valid Display Supervisor Certificate, issued by the Explosives Regulatory Division (ERD) of Natural Resources Canada are eligible to apply for a permit to set off Display Fireworks or Pyrotechnics Special Effects. - 7.2 Display Fireworks Permits shall specify the location where such Fireworks are to be set off, the type and kind of Fireworks which may be set off, the methods and means which may be used to set off the Fireworks, the manner and means of restraining unauthorized persons from attending too near the location where the Display Fireworks are being set off, the manner in which unused Fireworks are to be disposed of, and the number of persons handling and setting off the Fireworks, all of whom shall be responsible and competent individuals at least eighteen years of age. - 7.3 An application package as prescribed under the Act must be submitted to the Fire Chief or Designate for approval. - 7.4 The application package shall contain at a minimum, the following requirements as found in the Natural Resources Canada (NRCAN) Fireworks Display Manual: - a) Section 3.7 - Basic requirements for event approval; - b) Section 3.8 - Site plan, event description and special circumstances; and - c) Section 3.10 - Display Fireworks event approval form. The completed application must be submitted no less than fourteen (14) businesses days prior to the proposed event. - 7.5 Filed with the application form shall be a Certificate of Liability Insurance certifying the permit being applied for is insured against general liability and property damage claims, in the minimum amount of Five Million Dollars ($5,000,000.00) inclusive per occurrence for bodily injury, death and damage to property including loss thereof. Such insurance shall be in the name of the Applicant and shall name the Corporation of the Township of Havelock-BelmontMethuen as an additional insured thereunder. - 7.6 Notwithstanding the foregoing sections, the Fire Chief or designate may require any additional information of the applicant to ensure the public's safety and may impose additional conditions on the issuance of a Permit as they deem advisable in the particular circumstances of the application. - 7.7 If Display Fireworks are to be held in or on any public highway, street, lane, square or other public place which members of the public use or may use at any time, the written approval from the Fire Chief or Designate must be obtained during the Permit process. - 7.8 The Display Fireworks shall only be set off by a certified Fireworks Operator, who is certified by the Explosion Regulatory Division of Natural Resources of Canada, at the level of Supervisor or Display Supervisor with Endorsements. - 7.9 No person shall set off or hold a display of Display Fireworks at a date, time or site other than that specified in the Permit, and in accordance with the conditions of the Permit. - 7.10 The Permit holder must ensure that all unused fireworks and all debris are removed. - 7.11 No person shall set off or hold a display of Display Fireworks without the written permission of the owner of the site upon which the setting off or display of Display Fireworks is to be held or an authorized representative thereof, or without the written permission of the owner of all neighbouring lands upon which debris may be reasonably expected to fall or an authorized representative thereof. - 7.12 Every person to whom a Display Fireworks Permit is issued shall permit the inspection of the Display Fireworks, any equipment to be used in connection with the same, and any site where the Display Fireworks are stored, set off or displayed by anyone authorized to enforce this by-law immediately upon demand. - 7.13 The Permit may be suspended or revoked by the Fire Chief or Designate if the conditions of the Permit are not being met or it would be unsafe to allow the Display Fireworks or in the case of a Fire Ban. - 7.14 The Fireworks Supervisor who is named on the Permit application shall be personally present at the display at all times during which the display is being set up, fired or cleaned up, and shall preform test firing as required by the Fire Chief. - 7.15 Property damage or injury to persons, domesticated animals and livestock as a result of the discharge of Display Fireworks shall be the responsibility of the person and/or organization setting off the Display Fireworks. - 7.16 In addition to all requirements set out in Section 7.0 of this by-law, all requirements and conditions set out in Section 3.0 of this by-law regarding the setting off of fireworks must be met and adhered to at all times. ## 8.0 Permits for Special Effects Pyrotechnics - 8.1 No person shall discharge or hold a display of Special Effect Pyrotechnics in the Township without first having obtained a Permit to do so issued by the Fire Chief. - 8.2 Every application for a Permit pursuant to Section 8.0 shall be made to the Fire Chief a minimum of fifteen (15) calendar days prior to the event where the proposed discharge of Special Effect Pyrotechnics is to occur, and shall contain: - a) description of the event, including, - i. a site plan of the premises where the event is to take place, the stage and the Special Effect Pyrotechnics storage and handling area; - ill. the location of all Special Effect Pyrotechnics; - ii. a list of all Special Effect Pyrotechnics to be employed; - iv. the height, range of effect, fallout and duration of the display of Special Effect Pyrotechnics; - v. the sequence of firing; - vi. the location of the audience and all exits; - vii. the date and time of the proposed event; and - viii. the number of authorized persons on site during the event to handle and discharge the Special Effect Pyrotechnics. - b) description of fire emergency procedures and the methods to control a fire emergency; - c) the name and address of the applicant (pyrotechnician) and the sponsoring business or organization, if applicable and the names, addresses and telephone numbers of persons to be contacted in case of fire during non-operating hours; - d) proof of certification of the applicant as a Pyrotechnician; - e) Certificate of Liability Insurance certifying the permit being applied for is insured against general liability and property damage claims, in the minimum amount of Five Million Dollars ($5,000,000.00) inclusive per occurrence for bodily injury, death and damage to property including loss thereof. Such insurance shall be in the name of the Applicant and shall name the Corporation of the Township of Havelock-Belmont-Methuen as an additional insured thereunder; - 1) Written permission of the owner of the site upon which the display is to be held or an authorized representative thereof; and - g) Such other information as required by the Fire Chief. 5. 8.3 A Special Effect Pyrotechnics Permit shall not be issued if: - a) The application is incomplete; - b) The applicant is not a Pyrotechnician under the Act; or - c) There are reasonable grounds for believing that the holding of a Special Effect Pyrotechnics display will result in a breach of this or another by-law, the Fire Protection and Prevention Act (FPPA) or the Act. 9. 8.4 Notwithstanding the foregoing sections, the Fire Chief or designate may require any additional information of the applicant to ensure the public's safety and may impose additional conditions on the issuance of a Permit as they deem advisable in the particular circumstances of the application. 10. 8.5 The Permit holder shall comply at all times with the requirements of the Act, the Fire Protection and Prevention Act (FFPA) and the Pyrotechnics Special Effects Manual published by the Natural Resources Canada or any successor publication. 11. 8.6 If Special Effect Pyrotechnics are to be held in or on any public highway, street, lane, square or other public place which members of the public use or may use at any time, the written approval from the Fire Chief or Designate must be obtained during the Permit process. 12. 8.7 The Special Effect Pyrotechnics shall only be set off by a person currently certified as a Pyrotechnician by the Explosion Regulatory Division of the Natural Resources of Canada. 13. 8.8 No person shall set off or hold a display of Special Effect Pyrotechnics at a date, time or site other than that specified in the Permit, and in accordance with the conditions of the Permit. 14. 8.9 The Permit holder must ensure that all unused fireworks and all debris are removed. 15. 8.10 No person shall set off or hold a display of Special Effect Pyrotechnics without the written permission of the owner of the site upon which the setting off or display of Special Effect Pyrotechnics is to be held or an authorized representative thereof, or without the written permission of the owner of all neighbouring lands upon which debris may be reasonably expected to fall or an authorized representative thereof. - 8.11 Every person to whom a Special Effect Pyrotechnics Permit is issued shall permit the inspection of the Special Effect Pyrotechnic Fireworks, any equipment to be used in connection with the same, and any site where the Special Effect Pyrotechnics are stored, set off or displayed by anyone authorized to enforce this by-law immediately upon demand. - 8.12 The Permit may be suspended or revoked by the Fire Chief or Designate if the conditions of the Permit are not being met or it would be unsafe to allow the Special Effect Pyrotechnics or in the case of a Fire Ban. - 8.13 The Pyrotechnician who is named on the Permit application shall be personally present at the display at all times during which the display is being set up, fired or cleaned up, and shall preform test firing as required by the Fire Chief. - 8.14 Property damage or injury to persons, domesticated animals and livestock as a result of the discharge of Special Effect Pyrotechnics shall be the responsibility of the person and/or organization setting off the Special Effect Pyrotechnics. - 8.15 In addition to all requirements set out in Section 8.0 of this by-law, all requirements and conditions set out in Section 3.0 of this by-law regarding the setting off of fireworks must be met and adhered to at all times. ## 9.0 Indemnification - 9.1 The Applicant shall indemnify and save harmless the Township of Havelock-BelmontMethuen from any and all claims, demands, cause of action, loss costs, or damages that the Township of Havelock-Belmont-Methuen may suffer, incur or be liable for resulting from the performance of the Applicant as set out in the by-law whether with or without negligence on the part of the Applicant, the Applicant's employees, directors, contractors and agents. ## 10.0 Powers of Entry - 10.1 An Officer may enter on land at any reasonable time for the purpose of carrying out an inspection to determine compliance under this By-law. - 10.2 Every holder of a Consumer Firework, Display Firework or Pyrotechnic Special Effect Permit shall provide his or her Permit upon being directed to do so by the Fire Chief or Designate. - 10.3 No person shall hinder or obstruct, or attempt to hinder or obstruct, an Officer or other duly appointed person who is exercising a power or performing duty under this By-law. ## 11.0 Enforcement - 11.1 This by-law may be enforced by a police officer, a municipal By-law Enforcement Officer, a member of the municipal Fire and Emergency Services Department, and any other duly appointed person by Council to enforce this by-law. Such persons enforcing this by-law may enter upon land and into any structures at any reasonable time to inspect the land and structures to determine whether the by-law is being complied with. ## 12.0 Administrative Penalties - 12.1 An Officer who finds that a person has contravened any provision of this By-law may issue an invoice with a penalty addressed to that person. - 12.2 Any person who contravenes any provision of this By-law shall, upon issuance of a penalty notice and invoice issued pursuant to Section 12.3 shall be liable to pay to the Township on a first offence an educational warning with possible fines up to $500.00, second offence fine of $1,000.00, third offence fine of $1,000.00 and suspension of setting off fireworks up to two years starting on the date and time the third offence at the address that all three contraventions took place. - 12.3 The penalty notice containing an invoice shall be delivered personally to the property owner where the contravention took place or mailed by prepaid registered mail to the address of the owner as shown on the last revised assessment roll. - 12.4 Every notice issued shall identify the involved property; the particulars of the contravention; the amount of the administrative penalty; an invoice payable to the Township; information statement advising that an administrative penalty will constitute a debt to the Township and can charged to a property owners property tax. ## 13.0 Offences and Penalties - 13.1 Every person who contravenes any provision of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990, c.P.33, as amended, and to any other applicable penalty. - 13.2 If a court of competent jurisdiction declares any provision, or any part of a provision of this by-law to be invalid, or to be of no force and effect, it is the intention of the Council enacting this by-law, that each and every other provision of this by-law be applied and enforced with its terms to the extent possible according to law. - 13.3 Penalties as set out herein will apply to the owner/tenant/occupant of the property on which the Fireworks were set off. ## 14.0 Repeal - 14.1 That By-law No. 2008-84 and all previous by-laws and provisions pertaining to the setting off of fireworks is hereby repealed.
