Page 1 of 2 CORPORATION OF THE TOWNSHIP OF HAVELOCK-BELMONT- METHUEN BY-LAW NO. 2007 - 12 __________________________________________________________________ BEING A BY-LAW TO AMEND BY-LAW NO. 8 - 1975 TO REGUALTE THE USE OF THE PUBLIC SEWER SYSTEM IN THE FORMER VILLAGE OF HAVELOCK WHEREAS the Municipal Act 2001, S.O. 2001, Chapter 25 as amended, provides that a municipality may regulate matters not specifically provided for by this Act or any other Act for purposes related to the health, safety, and well being of the inhabitants of the municipality, and WHEREAS it is expedient to prohibit and regulate the discharge of any material into the municipal sewage system in the former Village of Havelock; and WHEREAS the Municipal Act 2001, S.O. 2001, Chapter 25 as amended, Section 87 provides that a municipality may enter on land, at reasonable times, to inspect the discharge of any matter into the sewage system of the municipality or into any other sewage system the contents of which ultimately empty into the municipal sewage system and may conduct tests and take samples for this purpose; and WHEREAS the Municipal Act 2001, S.O. 2001, Chapter 25 as amended, Section 92 provides that a municipality may, in a by-law prohibiting or regulating the discharge of any matter into a sewage system, provide that a person who contravenes the by-law is guilty of an offence and is liable to a fine; NOW THEREFORE, the Council of the Corporation of the Township of Havelock-Belmont- Methuen hereby enacts as follows: 1. No person shall discharge or cause to be discharged any storm water, surface water, ground water, roof runoff, subsurface drainage, pool wastewater, cooling water, treated or non-treated industrial waste or any gaseous, liquid or solid matter into the municipal sewage system. 2. Every person who contravenes any provision of this by-law or by-law 8 - 1975 as amended is guilty of an offence and is liable; a) on a first conviction, to a fine of not more than $10,000; and b) on any subsequent conviction, to a fine of not more than $25,000. Page 2 of 2 3. This by-law comes into force and takes effect upon final passing thereof.
