## THE CORPORATION OF THE TOWNSHIP OF HORNEPAYNE
BY-LAW NO. 1869
Being a By-Law to regulate the speed of vehicular traffic on Becker Road east of the Highway 631 North intersection
WHEREAS Section 28 of the Municipal Act 2001 states that:
"Except as otherwise provided in this Act or under section 8 of the Public Transportation and Highway Improvement Act or in a by-law passed under this Act, a municipality has jurisdiction or joint jurisdiction, as the case may be, over the following highways:
1. All highways over which it had jurisdiction or joint jurisdiction on December 31, 2002.
2. All highways established by by-law of the municipality on or after January 1, 2003.
3. All highways transferred to the municipality under this Act, the Public Transportation and Highway Improvement Act or any other Act. 2001, c. 25, s.28 (1)."; and,
WHEREAS, the speed on Becker Road east of the Highway 631 North intersection would default to the Provincial speed limit of 80 kilometres per hour, unless otherwise posted, for secondary roads; and,
WHEREAS, on December 21, 2016 the Council of the Corporation of the Township of Hornepayne deemed it necessary to restrict the speed of vehicular traffic on Becker Road east of the Highway 631 North intersection by adopting By-Law Number 1538 to set the speed on Becker Road east of the Highway 631 North to a speed limit of 70 kilometres per hour; and,
WHEREAS, the Township has received several complaints of speeding traffic causing concern for citizen safety; and,
WHEREAS the Council of the Corporation deems it necessary to reduce the speed of vehicular traffic on this section of roadway in order to protect citizens and provide a safer environment for both pedestrians and vehicles;
THEREFORE, the Council of the Corporation of the Township of Hornepayne enacts as follows:
1. The maximum posted speed shall be 60 kilometres per hour on Becker Road beginning at a point situate 1,300 metres east of the intersection of Becker Road and Highway 631.
2. The penalties provided in subsection 14 of Section 128 of the Highway Traffic Act shall apply to offences against this By-law.
This By-Law comes into effect following erection of speed signs.
By-Law No. 1538 is hereby rescinded
