THE CORPORATION OF THE TOWN OF HUNTSVILLE BY-LAW NUMBER 2025-106 Being a By-law to establish Fees or Charges and requiring payment for Information, Services, Activities and use of Town Property WHEREAS Section 391(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes the Council of a local municipality to pass by-laws imposing fees or charges for services or activities provided or done by or on behalf of it; for costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and for the use of its property including property under its control; AND WHEREAS Section 69 of the Planning Act, R.S.O. 1990, c. P. 13, provides that the Council of a municipality may prescribe a tariff of fees for the processing of applications made in respect of planning matters; AND WHEREAS Section 7 of the Building Code Act, 1992, S.O. 1992, c. 23, as amended, authorizes a municipal Council of a municipality to pass a by-law requiring the payment of fees on applications for and issuance of permits and prescribing the amounts thereof; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF HUNTSVILLE HEREBY ENACTS AS FOLLOWS: GENERAL PROVISIONS 1. That the fees set out in the attached Schedules shall be paid for the services or activities listed. All fees are per occasion or request. 2. That Council hereby establishes the fees and charges as set out in Schedules A to O attached hereto that form and deem to be an integral part of this By-law. 3. That this By-law shall be known and may be cited as the "Town of Huntsville Fees and Charges By-law". 4. No request by any person for any information, service, activity or use of Town property will be provided unless and until the person requesting the information, service, activity or use of Town property has paid the applicable fee in the prescribed amount as set out in Schedules A to O. 5. The fees and charges will be subject to Harmonized Sales Tax (HST) and Provincial Sales Tax (PST), where applicable. 6. Unless otherwise noted, all charges listed are non-refundable SEVERABILITY If any provision or part of a provision of this by-law is declared by any court or tribunal of competent jurisdiction to be illegal or inoperative, in whole or in part, or inoperative in particular circumstances, By-law 2025-106 - Fees & Charges By-law Page 2 of 74 the balance of the by-law, or its application in other circumstances, shall not be affected and shall continue to be in full force and effect. CONFLICT WITH ANY OTHER BY-LAW In the event of any conflict between any provisions of this by-law and any other by-law heretofore passed, the provisions of this by-law shall prevail. REPEAL OF PREVIOUS BY-LAWS By-law No. 2024-107 be hereby repealed. EFFECTIVE DATE This by-law shall come into force and effect upon passage. Resident: applies to individuals who reside in and/or pay property taxes to the Town of Huntsville. Commercial: is an organization or individual involved in selling a product or offering a service for profit. Note 1: Additional fees for the following may apply and will be evaluated on a case-by-case basis with each rental: Rehearsal fees Additional staff fees Box office, ticketing, and advertising fees Equipment rental and recovery fees All other licensing/tax fees as required by law Concession/food & beverage/merchandise Special Requests as contracted by Theatre Manager Note 2: Prime hours are 12pm to 11pm, Thursday to Sunday Non-prime is any time outside of prime hours Note 3: Includes access to kitchenette, chairs, tables, and projection equipment. Note 4: HST is calculated on each ticket sold and not on gross ticket sales. Note 5: The Capital Improvement Fund charge supports wear and tear on the facility infrastructure and applies to each ticket (sold and comps) or is charged as a flat fee for non-ticketed events. By-law 2025-106 - Fees & Charges By-law Page 8 of 74 Note 6: Regular: Hourly rate up to and including 8 hours Overtime: Hourly rate over 8 hours Co-Pros: The Algonquin Theatre Manager has the authority to offer 50/50 show revenue/cost sharing contracts for qualified performances, with some conditions: Ticket price must be revenue/expense neutral at half-house sold. Shows may be cancelled by the Theatre Manager as contracted if minimum break-even point is not realized. The Manager, at their discretion, may also enter into profit sharing of co-hosted events with qualified partners, offer discounts or promotional tickets. Each to be quoted individually. Some conditions apply. In-house Programming: Algonquin Theatre Programs can include special courses, lessons, demonstrations, workshops, joint private sector initiatives, art, cultural and historical initiatives etc. The fees set for these programs are based on the actual cost to provide them to the community and therefore fluctuate somewhat on an ongoing basis. Fees for these programs will be as outlined in the current digital Art, Culture and Recreation Guide produced quarterly by the Town and published on the Town of Huntsville website, or as advertised to the public on a per course basis. General Notes: (1) The Town of Huntsville may cancel leisure programs, including shinny, with or without notice. Fees will not be reduced and/or rebated due to cancellations. (2) Individuals aged 90+ can drop-in to programs at the Seniors Active Living Centre at no cost. (3) The Manager, at his or her discretion, may enter into profit sharing of co-hosted events with qualified partners, offer discounts or promotional tickets, each to be quoted individually. Some conditions apply. (4) The fees set for recreation & leisure services programs are based on the actual cost to provide them to the community and therefore fluctuate somewhat on an ongoing basis, and includes programs such as sport, fitness, aquatic and recreation programs, special courses, leadership training, lessons, day camps, workshops, joint private sector initiatives, art, cultural and historical initiatives, etc. Fees for these programs will be provided seasonally through the Town of Huntsville website or as advertised to the public on a per course basis. (5) A 10% non-resident fee applies to all registered programs for those who do not reside or pay property taxes to the Town of Huntsville. Proof of residency may be required at registration. The payment may be different upon agreement. The Chief Building Official shall track the number of eligible residential dwelling units, which have been granted a Rebate and shall report to Council once the maximum number has been reached or at year-end as an annual report.
