THE CORPORATION OF THE TOWN OF HUNTSVILLE
BY-LAW NUMBER 2025-107
Being a By-law to Regulate and Control Traffic
in the Town of Huntsville
WHEREAS by motion GC80-25 the Council of the Corporation of the Town of Huntsville deems
it expedient to pass a By-law to regulate and control vehicular traffic with the Town of Huntsville;
AND WHEREAS Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the
"Municipal Act") provides that the powers of a municipality under the Municipal Act or any other
Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the
municipality to govern its affairs as it considers appropriate and to enhance the municipality's
ability to respond to municipal issues;
AND WHEREAS Section 9 of the Municipal Act provides that a municipality has the capacity,
rights, powers and privileges of a natural person for the purpose of exercising its authority under
the Municipal Act or any other Act;
AND WHEREAS Section 11 of the Municipal Act provides that a lower-tier municipality may
pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter
alia, traffic on highways;
AND WHEREAS Section 128(2) of the Highway Traffic Act, R.S.O. 1990, provides that the
council of a municipality may, for motor vehicles driven on a highway or portion of a highway
under its jurisdiction, by by-law prescribe a rate of speed different from the rate set out in
subsection (1) that is not greater than 100 kilometres per hour and may prescribe different rates
of speed for different times of day;
AND WHEREAS Section 137 of the Highway Traffic Act, R.S.O. 1990, provides that in addition
to stop signs required at intersections on through highways the council of a municipality may by
by-law provide for the erection of stop signs at intersections on highways under its jurisdiction;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
HUNTSVILLE ENACTS AS FOLLOWS:
1.0
Definitions
In this By-law:
1.1
"Highway" includes a common and public highway, street avenue, parkway, driveway,
square, place, bridge, viaduct or trestle, any part of which is intended for or used by the
general public for the passage of vehicle and includes the area between the lateral
property lines thereof;
1.2
"By- Law Enforcement Officer" means the person or persons appointed by the Council
to enforce bylaws enacted and passed by Council

1.3
"Official Sign" means a sign in conformity with the Highway Traffic Act regulations or
approved by the Ministry of Transportation or approved by Council
1.4
"Owner" means a person who is registered as the owner of a motor vehicle in the
Licensing and Control Branch of the Ministry of Transportation or a person who is in
possession of an Ownership Certificate duly signed by a person so registered;

"Operator" means a person who operates a motor vehicle on a highway.
1.6
"Person" means any human being, association, firm, partnership, incorporated
company, corporation, agent or trustee, and the heirs, executors or other legal
representatives of a Person to whom the context can apply, according to law;
1.7
"Director" means the Director of Operations or designate, who is employed by the Town
and is responsible for overseeing the maintenance of municipal roads and infrastructure
or their designate.
1.8
"Council" means the Council of The Corporation of the Town of Huntsville;
1.9
"Town" means the Corporation of the Town of Huntsville;
2.0
Traffic Control
2.1
Speed Limits
When the highways set out in Schedule C in Column 1 between the limits set out in
Column 2 are marked in compliance with the regulations under the Highway Traffic Act,
the maximum rate of speed thereon shall be the rate of speed set out in Column 3.
2.2
One Way Streets
The highways set out in Schedule D in Column 1 between the limits set out in Column 2
and 3, are hereby designated for one way traffic only in the direction set out in Column 4.
2.3.
Not a Through Street (Local Traffic Only)
The highways or parts of highways listed in Schedule G under the jurisdiction of the
Town of Huntsville are designated "Not a Through Street" - local traffic
2.4
Yield Signs
Any intersection on a highway set out in Schedule "A" (Yield Signs) is designated as an
intersection where yield right-of-way signs are erected at the intersection prescribed in
Column 2 of the schedule.
2.5
Stop Signs
The intersections on highways as set out in Column 1 of Schedule B are designated as
intersections where official stop signs shall be erected at the locations as shown in
Column 2 of the Schedule.

Where official signs are on display no person shall enter the area listed in Column 1 from
the Highway in Column 2 of Schedule E.
2.7
School Zones
When any highway or portion of highway set out in Schedule "F" (School Zones) is
marked as a school zone, the maximum rate of speed thereon shall be the rate of speed
prescribed in the schedule.
2.8
Axle Weight Restrictions
During a reduced load restriction period, no commercial motor vehicle or trailer, other
than a public vehicle shall be operated or drawn upon a highway or portion thereof that
is part of the Town's road system where the weight upon an axle exceeds 5 tonnes.
The provisions of this section do not extend to the use of a highway or a part of a
highway by an ambulance, police vehicle, fire department vehicle, waste removal
vehicle, public utility emergency vehicle, or to a vehicle engaged in works undertaken for
or on behalf of the Town.
Any person who contravenes any of the provisions of this section is guilty of an offence
and upon conviction is liable to a fine as provided pursuant to Section 110 of the Act and
all such penalties shall be recoverable under the Provincial Offenses Act. R.S.O. 1990.

2.9
Obstructions of Highways, Ditches and Culverts
1. No person shall obstruct, encumber, or foul a highway under the jurisdiction of the
Town by any means whatsoever.
2. Without limiting the generality of subsection (1) the obstruction or fouling of a highway
includes:
a) the building or maintaining of a fence on a highway;
b) the depositing of snow or ice on a highway;
c) the depositing of large refuse containers or bulk containers on a highway;
d) the depositing of construction or landscaping materials on a highway.
3. No person shall obstruct a ditch or culvert which is under the jurisdiction of the Town.
4. No person shall throw, place, deposit or permit to be blown or escape from premises
occupied by them or dropped from a vehicle, paper, hand-bills, garbage, ashes,
rubbish, tires, appliances, soil, construction material, the carcass of an animal, or any
other refuse or waste material on a highway under the jurisdiction of the Town
5. Any person employing or using a vehicle in making excavations for building purposes,
and in conveying earth, rubbish or other material from such excavations or from any
other place along a public highway of the Town, or in any operation involving the
passage of such a vehicle to and from any site, whether for building purposes or
otherwise, shall at once remove from pavements and sidewalks, or from any public
place where the same may be deposited, all earth, rubbish or other material that may
fall from the wheels of or from such truck, grader or loader, and shall employ and keep
employed a sufficient number of sweepers or workmen or use such means as may be

necessary to keep all such pavements and sidewalks in a clean condition and free from
earth or other material.
6. The Director may give to any person found to have obstructed or fouled a highway
contrary to the provisions of this by-law, a notice in writing requiring the removal from
such highway any and all refuse, articles or materials.
7. In the event that such person does not comply with the direction in the said notice, the
Town may perform the work, or cause the work to be done, and the cost thereof may
be recovered from such person by court action.
2.10
Community Safety Zones
Where a sign is erected or placed on a highway in accordance with the Highway Traffic
Act, the highways set out in Column 1 of Schedule I of this by-law and limits as defined
in Column 2 of said Schedule H shall be designated as Community Safety Zones during
the prohibited times or days as set out in Column 3 of said Schedule.
3.0
Penalties
Any person who contravenes any provision of this By-law is guilty of an offence and,
upon conviction, is liable to a fine as provided for in the Municipal Act, 2001 or the
Provincial Offences Act.
4.0
Short Title
4.1
This By-law shall be known as the "Traffic By-Law".

Force and Effect
6.1
This By-law shall come into force and effect as of the final passing thereof.
