THE CORPORATION OF THE MUNICIPALITY OF HURON SHORES
BY-LAW #15-39
BEING A BY-LAW TO PERMIT THE OPERATION OF OFF-ROAD
VEHICLES
ON
HIGHWAYS
WITHIN
AND
UNDER
THE
JURISDICTION OF THE MUNICIPALITY OF HURON SHORES
WHEREAS the Municipal Act, S.O. 2001 C. 25, Section 8, as amended,
confers
broad
authority
upon
municipalities
and
provides
that
a
municipal power shall be exercised by by-law;
AND WHEREAS the Municipal Act, S.O. 2001 as amended, C. 25,
provides that a municipality may pass by-laws to provide a service or
thing that the municipality considers necessary or desirable;
AND WHEREAS the Highway Traffic Act, R.S.O. 1990 as amended c.

OFF-ROAD
VEHICLES,
authorizes
the
council
of
a
municipality
to
pass
by-laws
permitting
the
operation
of
off-road
vehicles on highways or any parts of highways within and under the
jurisdiction of the Municipality and Provincial Regulations associated
therewith regulates off-road vehicles permitted on highways;
AND WHEREAS the Off-Road Vehicle Act R.S.O. 1990, c. O.4 as
amended from time to time, and associated Regulations, establishes
legislation and regulation for the operation of Off-Road Vehicles on
highways;
AND WHEREAS the Council of the Corporation of the Municipality of
Huron Shores deems it advisable to permit the operation of Off-Road
Vehicles, as provided for and permitted under the Ontario Highway
Traffic Act, the Ontario Off-Road Vehicle Act and Associated Ontario
Regulations, on any highway or any part or parts of any highway within
the jurisdiction of the Municipality;
NOW THEREFORE, The Council of the Corporation of the Municipality
of Huron Shores ENACTS AS FOLLOWS:
1. All Off-Road Vehicles, as defined and allowed for in accordance
with the Ontario Highway Traffic Act, the Off-Road Vehicle Act and
associated
Ontario
Regulations,
are
hereby
permitted
to
be
operated on any highway or on any part or parts of any highway
within the jurisdiction of the Municipality of Huron Shores.
2. Any person operating any Off-Road Vehicle in contravention of
this by-law is subject to the penalties applicable by law.
3. This by-law shall become effective upon the passing thereof.
4. By-law #03-45 is hereby rescinded.
Read a first, second and third time and passed in open Council this 24th
day of June, 2015.
