CONSOLIDATED BY-LAW
CORPORATION OF THE TOWN OF INGERSOLL
BY-LAW NO.06-4327
A by-law to provide for the governing and regulation of traffic and parking
in the Town of Ingersoll
WHEREAS Sections 27 (1), 42 and 102 of the Municipal Act, 2001 as amended,
the Highway Traffic Act, 1990, Chapter H.8 and regulations, as amended and the
Motorized Snow Vehicles Act, R.S.O. 1990, c. M44 Section 7 (2) and the Public
Transportation & Highway Improvement Act R.S.O. 1990, c.P50 provides for
council to pass a by-law governing, regulating traffic and parking in respect of a
highway within its jurisdiction;
AND WHEREAS the Council of the Town of Ingersoll deems it advisable to pass
a by-law for the highways within the jurisdiction of the municipality;
AND WHEREAS certain highways identified within this By-law are under the
jurisdiction of the Corporation of the County of Oxford; therefore the County of
Oxford's must approve this by-law by resolution.
PART I - DEFINITIONS
Definitions for the purpose of this by-law are:
AUTHORIZED VEHICLES
Means any vehicle owned or operated by the Corporation
of the Town of Ingersoll, emergency services vehicles and
any authorized private vehicle operated by an employee or
elected representative of the Corporation of the Town of
Ingersoll which is designated by a parking permit sticker or
some similar method which from time to time may be
prescribed by the Town.
BICYCLE
Means a bicycle, or tricycle or unicycle having a wheel or
wheels more than 35 centimetres in diameter but does not
include a motor assisted bicycle.
BOULEVARD
Means that portion of every road allowance within the limits
of the Town which is not used as a sidewalk, driveway
access, traveled roadway or shoulder.
BUS
Means a motor vehicle designed for carrying ten or more
passengers and used for the transportation of persons.
BUS STOPS
Means that portion of roadway abutting the curb or portion
of shoulder abutting the roadway, indicated by a posted
authorized sign for the purpose of stopping buses while
picking up or discharging passengers.
COMMERCIAL MOTOR
VEHICLE
CORE AREA
Means any motor vehicle having permanently attached
thereto a truck or delivery body or requiring a commercial
license and includes emergency services vehicles, motor
buses and tractors used for hauling purposes on the
highways.

CROSSWALKS
Means:
(a) That part of a highway at an intersection that is
included within the connections of the lateral lines of
the sidewalks on opposite sides of the highway
measured from the curbs or, in the absence of curbs
from the edges of the roadway, or
(b) Any portion of a roadway at an intersection or
elsewhere distinctly indicated for pedestrian crossing
by signs or by lines or other markings on the surface.
ELECTRIC VEHICLE
Means a vehicle that is propelled by one or more electric
motors, using electrical energy stored in rechargeable
batteries or another energy storage device and is capable
of being plugged into an Electric Vehicle Charging Station,
such as plug-in electric cars and plug-in hybrids
ELECTRIC VEHICLE (EV)
CHARGING STATION"
Means an element in an infrastructure that supplies electric
energy for the recharging of Electric Vehicles.
ELECTRIC VEHICLE (EV)
PARKING SPACE
Means a parking space designated for the use of Electric
Vehicles while plugged into an Electric Vehicle Charging
Station, as indicated by Authorized Signs
EMERGENCY SERVICES
VEHICLES
Means ambulances, hearses, fire apparatus, police vehicles
and utility vehicles.
FIRE LANE
Means that part of a lane or driveway provided for
unrestricted access of fire fighting vehicles and equipment,
and marked by one or more erected or posted official signs.
GROSS WEIGHT
Means the combined weight of vehicle and load.
HEAVY TRUCK
Means a commercial motor vehicle including a bus, having
a gross vehicle weight as shown on the permit for the
vehicle issued under the Highway Traffic Act, of 3,000
kilograms (3 tonnes) or greater; but does not include a
vehicle operated by or on behalf of the Town or a school
bus which is in the course of transporting children or
mentally challenged adults to and from school.
HIGHWAY
Includes a common and public highway, street, avenue,
parkway, driveway, square, place, bridge, viaduct or trestle,
any part of which is intended for or used by the general
public for the passage of vehicles and includes the area
between the lateral property lines thereof.
IDLE
Means the operation of the engine of a vehicle while the
vehicle is not in motion and not being used to operate
auxiliary equipment that is essential to the basic function of
the vehicle and "idling" has a corresponding meaning.
INTERSECTION
Means the area embraced within the prolongation or
connection of the lateral curb lines, or if none, then of the
lateral boundary lines of two or more highways that join one
another at an angle, whether or not one highway crosses
the other.
LAYOVER
Means stopping of a transit vehicle at a point along a transit
route for a maximum of fifteen (15) minutes to allow a transit
vehicle to adjust to service schedules.

LOADING
Means the physical activity of moving merchandise to or
from a property or another vehicle and the physical activity
of passengers entering or departing a vehicle.
MOBILE WORKSHOP
Means:
(a) A vehicle containing equipment that must be
operated inside or in association with the vehicle; or
(b) A
vehicle
serving
as
a
facility
for
taking
measurements
or
making
observations
or
conducting maintenance or construction operated by
or on behalf of a municipality, public utility or police,
fire or ambulance service.
MOTORCYCLE
Means a self-propelled vehicle having a seat or saddle for
the use of the driver and or passenger(s) and designed to
travel on not more than three wheels in contact with the
ground and includes a motor scooter but does not include a
motor assisted bicycle.
MOTORIZED SNOW
VEHICLE
Means a self-propelled vehicle designed to be driven
primarily on snow.
MOTOR VEHICLE
Means an automobile, motorcycle, motor assisted bicycle
unless otherwise indicated in the Highway Traffic Act,
R.S.O. 1990, c. H.8, and any other vehicle propelled or
driven otherwise than by muscular power, but does not
include a street car, or other motor vehicles running only
upon rails, or a motorized snow vehicle, traction engine,
farm tractor, self-propelled implement of husbandry or road-
building machine within the meaning of the Highway
Traffic Act, R.S.O. 1990, c. H.8,
OFFICIAL SIGN
Means a sign approved by the Ministry
ONE-WAY STREET
Means, where an official sign(s) is posted, a street upon
which vehicular traffic is limited to movement in one
direction.
OVERSIZED LOAD
Means a vehicle or combination of vehicles in excess of the
dimensional limits set out in Section 109 of the Highway
Traffic Act, R.S.O. 1990, c. H.8 or the weight limits set out
in Part VIII.
PARATRANSIT VEHICLE
Means a motor vehicle designated to carry a wheel chair
and or ambulatory passengers which displays an
identification sign and is operated under the jurisdiction of
the Town of Ingersoll.
PARK OR PARKING
When prohibited, means the standing of a vehicle, whether
occupied or not.
PARKING PERMIT
Means a Town of Ingersoll issued permit pertaining to
parking, and includes a Free Day Permit; Monthly Overnight
Permit; Monthly Day Permit or an Employee Parking Permit
to be used in the designated areas.
PARKING SPACE
Means a portion of the surface of a street or public space,
the use of which is controlled and regulated by pavement
marking(s) and/or an official sign(s)
PARKING
ENFORCEMENT
OFFICER/PERSON
Means a person authorized by the Town to enforce the
regulations set out by this by-law and amendments thereto
and those members designated by the Fire Chief as
Assistant to the Fire Marshall.

PARKING LOT
Means an off-street parking lot or other parking facility to
which the public has access whether on payment of a fee
or otherwise.
PEDESTRIAN
Means any persons afoot, including a child in a wheeled
carriage and a person in a wheelchair.
POLICE OFFICER
Means a member of the Ontario Provincial Police
RESERVED PARKING
SPACE
Means a parking space designated, posted or marked for
exclusive use by municipal officials
ROAD ALLOWANCE
Means all allowances for roads, except in so far as they
have been stopped up according to law, made by the Crown
surveyors, all highways laid out or established under the
authority of any statute, all roads on which public money has
been expended for opening them or on which statute labour
has been usually performed, all roads dedicated by the
owner of the land to public use, and all alterations and
deviations of all bridges over any such allowance for
highway or road.
SCHOOL BUS
Means a chrome yellow bus that is used for transportation
of:
i)
children, or
ii)
Mentally or physically disabled people to or from
a training centre that bears on the front and rear
of the vehicle thereof the words school bus and
on the rear thereof the words Do not pass when
signals flashing.
SERVICED ROADWAY
Means the part of a highway that is improved, designed or
ordinarily used for vehicular traffic.
SHOULDER
Means that portion of every street which abuts the roadway
and which is designed and intended for passage or stopping
of motor vehicles but which extends no more than 3 metres
in width from the limit of the roadway.
SIDEWALK
Means any town walkway or that portion of a street between
the curb lines or the lateral lines of a roadway and the
adjacent property lines intended for the use of pedestrians.
STAND OR STANDING
Means the halting of a vehicle, whether occupied or not,
except for the purpose of and while actually engaged in
receiving or discharging passengers.
STOP
When required, means a complete cessation of movement
STOPOVER
Means a scheduled delay of a maximum of fifteen minutes
at a transit vehicle terminal to allow transit vehicles to adjust
service schedules.
STOPPING
When prohibited, means the halting of a vehicle, even
momentarily, whether occupied or not, except when
necessary to avoid conflict with other traffic or in compliance
with directions of a police officer or of a traffic control sign
or signal.
STREET

THROUGH HIGHWAY
Means a highway or part of a highway designated as such
by by-law of a municipality, and every such highway shall
be marked by a stop sign or yield of way sign in compliance
with the regulations of the Ministry.

TOWN
Means the Corporation of the Town of Ingersoll and any
other jurisdiction approved/conferred upon by the County of
Oxford.
TRAFFIC
Includes pedestrians, ridden or herded animals, vehicles
and other conveyances either singularly or together while
using any streets for purposes of travel.
TRAILER
Means a vehicle that is at any time drawn upon a highway
by another motor vehicle, except an implement of
husbandry, a mobile home, another motor vehicle or any
device or apparatus not designed to transport persons or
property, temporarily drawn, propelled or moved upon such
highway, and except a side car attached to a motorcycle,
and shall be considered a separate vehicle and not part of
the motor vehicle by which it is drawn.
TRAFFIC CONTROL
DEVICE
Means any sign, marking or signal on a roadway, curb or
sidewalk markings or other device erected or placed for the
purpose of guiding or directing traffic.
TRAFFIC SIGNAL
Means any device manually, electrically or mechanically
operated for the regulation of traffic.
TRANSIT VEHICLE
Means paratransit vehicle, motor coach, bus
U-TURN
Means to turn a vehicle within a highway so as to proceed
in the opposite direction.
VEHICLE
Means a motor vehicle, trailer, traction engine, farm tractor,
road-building machine, bicycle and any vehicle drawn,
propelled or driven by any kind of power, including muscular
power, but does not include a motorized snow vehicle or a
street car.
WHEELCHAIR
Means a chair mounted on wheels driven by muscular or
any other kind of power and used for the carriage of a
person who has a physical defect or disability.
PART II - OBEDIENCE TO TRAFFIC REGULATIONS
1.
ENFORCEMENT OF BY-LAW
The Ontario Provincial Police and/or the Parking Enforcement Officer/Person
shall enforce the provisions of this by-law.
2.
OBEDIENCE TO TRAFFIC SIGNS AND SIGNALS
(a) Every person shall promptly obey all signals given either by a Police Officer
or by a traffic control device or a traffic signal.
(b) An enforcing official, upon discovery of any vehicle parked or standing in
contravention of the provisions of this by-law, may cause it to be moved or
taken to and placed or stored in a suitable place, at the owners expense,
and all costs and charges for removing, care and storage thereof, if any, are
a lien upon the vehicle, which may be enforced in a manner provided by the
Repair and Storage Liens Act 2005, c 26, Schedule A s. 28 (2)..
PART III - PARKING AND STOPPING
1.
METHOD OF PARKING
(a)
Curb and No Curb

On any street where there is a curb on the right side of a roadway,
having regard for the direction such vehicle was proceeding, no
person shall park a vehicle in a manner which is not parallel to such
curb or such that the right side wheels or runners of the vehicle are
more than 0.16 metres from such curb or, in winter, as near the curb
as the conditions of the street permit. On an uncurbed street, no
person shall park a vehicle in a manner which is not parallel to and
as close as circumstances and weather conditions permit to the edge
of the boulevard or sidewalk as the case may be.
Where parking is permitted on the left side of a roadway designated
for one-way traffic, no person shall park or stop any vehicle on the
left side of the roadway or portion thereof except as follows:
(1) Where there is a raised curb on the left side of a roadway, having
regard to the direction such vehicle was proceeding, with its left
front and rear wheels parallel to and nor more than 0.16 metres
out from such curb.
(2) Where there is no curb or rolled curb, with the left front and rear
wheels parallel to and as near to the left limit of a roadway as is
practicable without stopping or parking on a sidewalk or footpath
or on any part of the boulevard where grass is growing which is
not intended for the use of vehicles.
(b)
Angle
Where angle parking is permitted, no person shall park a vehicle
except at the angle indicated by markings or signs and so that the
front end of the vehicle is nearest to the edge of the roadway on any
street, part of street or side of street described in Schedule 'C'.
(c)
Vehicle Parking
No person shall park a vehicle in front of a property zoned Highway
Commercial or General Industrial or operating as a commercial or
industrial use for purposes of loading or unloading if parking space
is located wholly on the property zoned Highway Commercial, or
General Industrial or is operating as a commercial or industrial use;
or if a property zoned Highway Commercial or General Industrial or
operating as a commercial or industrial use has entered into a site
plan agreement requiring loading or unloading to be wholly on their
own property. No person shall park a truck over 6.1 metres in length
in a manner which is not parallel to the curb or the edge of the street.
(e)
Motorcycle(s)
Where a parking space is designated by markings, no more than four
(4) motorcycles shall be parked in one parking space.
2.
PARKING PROHIBITED
(a)
In Specified Places or for Specified Purposes
No person shall park a vehicle in any of the following places or for
any of the following purposes:
(1)
On, over or overhanging a sidewalk or footpath
(2)
On a boulevard
(3)
In front of a public or private driveway
(4)
Within an intersection
(5)
Within three (3) metres of a fire hydrant or where the hydrant
is set back from the edge of the roadway, within three (3)

metres of the point at which the prolongation of the centre line
of the hydrant at right angles to the edge of the roadway
intersects such edge at any time
(6)
On a crosswalk
(7)
Within 9 metres of an intersection not controlled by traffic
signal or traffic control devices
(8)
Within 15 metres of any intersection in which the flow of traffic
is regulated by traffic signals
(9)
On any bridge or in any subway or the approaches thereto.
(10)
On any street in such a manner to obstruct traffic
(11)
In such a position as will prevent the convenient removal of
any other vehicle previously parked or standing
(12)
In any public lane
(13)
In front of the main entrance to or any emergency exit from a
theatre, auditorium or other building where large assemblages
are to be held in such theatre, auditorium, arena or other
building.
(14)
On any roadway or parking lot for a longer period than twenty-
four (24) consecutive hours except when issued a valid
parking permit issued by authorized Town personnel as set
out in Part IV (1) (b)
(15)
For the purpose of displaying a vehicle for sale
(16)
Alongside or across the road from any excavation or
obstruction in the roadway when the free flow of traffic would
thereby be impeded.
(17)
For the purpose of washing, greasing or repairing the vehicle,
except when necessitated by an emergency
(18)
Within 15 metres of any railway track which crosses the
roadway or is adjacent to a roadway
(19)
In front of the entrance to a hotel
(20)
In front of the entrance to a hospital
(21)
In front of Fire Hall doors
(b)
No person shall park a heavy truck on any highway as described in
Schedule 'M'.
(c)
The provisions of Subsection 2(b) do not apply to a motor vehicle
carrying passengers and do not apply to a commercial vehicle which
attends at a residential premise within the prohibited area for the
purpose of delivering or service and is parked for a temporary period
only
3.
BUS STOPS
No person shall park or leave standing a vehicle in any area
designated as a bus top as shown on Schedule 'G' and marked by
an appropriate sign.
4.
PARKING RESTRICTIONS
When appropriate signs have been erected and are on display, no
person shall:
(a)
At any time park a vehicle/trailer on any of the streets, parts
of streets or sides of streets named or described in Schedule
'A' to this by-law.

(b)
Park a vehicle/trailer on the streets, parts of streets or sides
of streets, or on any municipal parking lot, for any period of
time in excess of the period stated on the sign, as are named
or described in Schedules 'B' , 'E' and 'F' to this by-law.
(c)
Park a vehicle/trailer except at the angle indicated by
markings of signs on any of the streets, parts of streets or
sides of streets named or described in Schedule 'C' to this by-
law.
5.
WINTER MONTHS
When appropriate signs have been erected and are on display, no
person shall park a vehicle between the hours of 3:00 a.m. and 6:00
a.m. from the first (1st) day of December of any year to the thirty-first
(31st) day of March in the following year in any parking lot named and
described in Schedule 'F' and on any Town street.
6.
PARKING FOR AUTHORIZED MUNICIPAL VEHICLES AND
OTHERS
(1)
When signs have been erected and are on display, no
vehicle, unless authorized by the Town of Ingersoll, shall be
stopped, standing or parked in the following areas:
(a)
South side of the Town Centre
(b)
West side of the Municipal Building, 130 Oxford Street,
except on Saturdays, Sundays and legal holidays.
(2)
Members of Council shall be provided a Parking Permit to
park only in the Oxford St. North Parking Lot when on
municipal business.
7.
LOADING ZONES
When appropriate signs have been erected and are on display, no
person shall stop, stand or park a vehicle in a loading zone named
or described in Schedule 'D' to this by-law between the hours of 8:00
a.m. and 6:00 p.m. on Monday to Saturday inclusive, proved
that the provisions of this section shall not apply to a delivery vehicle,
used for loading or unloading purposes in a loading zone for a period
of time not in excess of fifteen minutes at any one time.
8.
EMERGENCY ROUTE
When appropriate signs have been erected and are on display, no
person shall stop, stand or park a vehicle in an Emergency Route as
set out in Schedule 'J' to this by-law. Said fire route shall be a width
of 6 meters.
9.
ACCESSIBLE PARKING
9.1 Designated Accessible Parking Spaces
Notwithstanding the provisions of this by-law or any other by-law, no
person shall park, stand, stop or leave a motor vehicle in any
designated parking space set out in Schedule K - Accessible
Parking of this by-law except a motor vehicle,
(a) that is operated by or is transporting an individual certified by a
Accessible Parking Permit Program, and
(b) that is identified by a current original Accessible Parking Permit; and

(c) that is parked entirely within a designated parking space.
9.1.1 Display of Accessible Parking Permit
An Accessible Parking Permit, shall be displayed and clearly visible
on
(a) the dashboard or sun visor of the vehicle when parked in a designated
accessible parking space so that the expiry can be read.
9.1.2
Prohibitions Regarding Permits
No person shall:
(a) Deface or alter any current original Accessible Parking Permit issued
by Ministry of Transportation;
(b) Use or permit the use of a defaced or altered current original accessible
parking
permit
issued
by
the
Ministry
of
Transportation;
(b) Use or permit the use of a current original Accessible Parking Permit
issued except the individual certified by an Accessible Permit Parking
Program to whom the current original Accessible Parking Permit is
issued; or a person transporting such certified person. The permit is
not valid when displayed on a vehicle and the vehicle is not being used
to pick up, drop off or transport the holder of the permit named therein;
(c) Without the authority of the person to whom a current original
identifying marker has been issued, remove a current original
identifying marker issued by Ministry of Transportation from a motor
vehicle.
9.1.3
Official Sign
In this Part, "official sign" means a sign in the form set out in the
attached Figure 1 of this by-law.
9.2
Off - Street Accessible Parking Spaces
9.2.1
Designation of Accessible Parking Spaces
(a) Where in a public parking lot or facility one or more parking spaces are
intended for the sole use of a vehicle of an individual certified by an
Accessible Parking Permit Program, The Town of Ingersoll shall
identify each such parking space by erecting one or more official signs
in such a manner that the official sign or signs shall be visible to the
operator of any vehicle approaching or entering such parking space.
(b) Where the requirements of subsection (a) of this section are complied
with, each such parking space is for the purpose of this by-law a
designated parking space for the sole use of vehicle of individuals
certified by an Accessible Parking Permit Program.
(c) Notwithstanding any provision in this section to the contrary, no
designated parking space shall be located in a fire route as set out in
Section 8, Part III Emergency - Fire Lanes of the Town of Ingersoll's
Consolidated Traffic By-law.
9.2.2
Parking Space for Individuals Certified By an Accessible Parking
Permit Program
No person shall park, stand, stop or leave a motor vehicle in any
designated accessible parking space except a motor vehicle that is
identified by a current original Accessible Parking Permit.

10.
PARKING PROHIBITED FOR SNOW REMOVAL, ROAD REPAIR
AND OTHER PURPOSES
(a)
No person in charge of any vehicle shall park such vehicle on any
street or highway so as to interfere with any of the operation or
carrying out of any necessary municipal work or service including
road repair, snow ploughing, snow removal, where any such work
is being carried on or on any portion of the street or highway is
marked by a sign or signs indicating road repairs, snow ploughing
or snow removal is to be commenced or carried on.
(b)
Notwithstanding any other provision of this by-law, whenever a
sign bearing the words Emergency - No Parking is displayed on
any street or highway, no person shall park any vehicle on the
portion of such highway indicated by such sign.
(c)
When a vehicle is parked contrary to Subsection (a) or (b), the
Ontario Provincial Police, the Engineering Service Coordinator
(or designate), or the Town Superintendent of Public Works may
remove or cause such vehicle to be removed and the Town shall
not be liable for damage to such vehicle arising out of or caused
by such removal and the owner of such vehicle shall be liable to
the Town for the costs of such removal.
11.
HIGHWAY CLOSURES
(a)
The Engineering Coordinator or Superintendent of Public Works
or his designate may temporarily close any highway or any part
of it for any period during the construction, repair or improvement
of it or any works under, over, along across or upon it, where the
construction, repair or improvement is initiated either by the Town
of Ingersoll or a utility company with a statutory right of access or
an access agreement with the Town allowing occupancy of the
highway.
(b)
The Engineering Coordinator or Superintendent of Public Works
may temporarily close any highway or any part of it for any period
where, in the opinion of the Engineering Coordinator or
Superintendent of Public Works, environmental factors such as,
but not limited to, flooding of the roadway, erosion of
the
roadbed, trees or tree limbs fallen across or along the roadway,
or other material lying or being upon the roadway, would present
a hazard to the traveling public.
(c)
The Engineering Coordinator or Superintendent of Public Works
or designate may temporarily close any highway or any part of it
for any period not longer than 21 days during the construction,
repair or improvement of it or any works under, over, along,
across or upon it, where the construction, repair or improvement
is privately initiated by other than a utility company with a right of
access or any access agreement with the Town allowing
occupancy of the highway.
(d)
The Superintendent of Public Works or his designate may
approve a temporary closure of any highway or any part of it to
facilitate
a
social,
recreational,
community,
athletic,
or
cinematographic event or any combination of them.
(e)
For the purpose of Section (d), the organization requesting the
event shall accept the responsibility for establishing suitable
detour roads, erection and removal of associated costs, provide
$2,000,000 liability insurance naming the Town of Ingersoll as an
additional insured and hold the Town harmless from any action
or cause or style of action.

(f)
The Engineering Coordinator or Superintendent of Public Works
may temporarily close to general public travel any highway or any
part of it for any period to facilitate the movement of an oversized
load.
12.
STOPPING PROHIBITED
When appropriate signs have been erected and are on display, no
person shall at any time stop a vehicle in any of the following places:
(a)
On any of the streets, part of streets or sides of streets named or
described in Schedule 'N' to this by-law.
PART IV - PARKING REGULATIONS
1.
LENGTH OF PARKING TIME
(a)
No person shall permit a vehicle to be parked in the same parking
space for a longer period at any one time than the maximum period
allowable for such zone as set out in Schedule 'E' and 'F', excepting
Saturday, Sunday and all statutory holidays.
(b)
No person shall permit a vehicle to be parked in the same parking
space for a longer period at any one time than the maximum period
allowable for such zone as in the by-law provided unless a valid
parking permit is clearly visible and displayed on the rear view mirror
or dashboard. Such period shall be issued in the form and for such
fee as may be from time to time prescribed by the Town. Permits
may be issued to permit day, overnight and monthly parking in any
parking lot under control and management of the Town as set out in
Schedule 'F' - Permit Parking.
(c)
No person shall permit a vehicle to be parked in the same parking
space for a longer period at any one time than the maximum period
allowable for such zone. If the vehicle is re-parked it must move at
least three parking spots in order not to be in violation.
(d)
No person shall permit a vehicle to be parked in an Electric Vehicle
Parking Space while not being an Electric Vehicle that is actively
connected to an Electric Vehicle Charging Station
2.
METHOD OF PARKING
(a)
No person shall park any vehicle in such a manner that it is not wholly
within an area designated as a parking space.
(b)
No person shall park a vehicle whose length is in excess of 6.1
meters in those parking lots as set out in Schedule 'F'.
(c)
No person shall park more than one vehicle, except for motorcycles,
in a parking space.
3.
EXEMPTIONS this section was deleted on November 13, 2017
By-law No. 17-4968
Courtesy Parking shall be granted during the month of December
in each year.
4.
FREE ALL DAY PARKING
That the following Municipal Parking Lots be free parking all day
between 6:00 a.m. and 3:00 a.m. except as set out in Schedule 'F':

5.
UNAUTHORIZED DEVICES
No person shall place or exhibit upon any street or any municipal
parking lot any unauthorized device attempting or purporting to
control or regulate the parking of vehicles.
PART V - OPERATION OF VEHICLES
1.
ROLLERBLADES,
ROLLERSKATES
ETC.
PLAYING
ON
ROADWAYS
No person shall use rollerblades, roller-skates, any skateboards,
sleigh, toy vehicle or similar device on roadway.
2.
FIRE FIGHTING APPARATUS
No motor vehicle operator shall cause or allow any vehicle
whatsoever to drive over or on any hose while in use or about to be
used for the Fire Service.
3.
OBSTRUCTING TRAFFIC
(a)
No owner or operator of a motor vehicle shall obstruct a street with a
motor vehicle which becomes stalled or for any reason cannot be
moved by its ordinary power.
(b)
Any vehicle stopped on any street shall be moved away by the owner
or operator thereof at the direction of a police officer due to traffic
congestion, proximity to a fire or any other condition renders the
removal of such expedient.
(c)
A police officer, police cadet, municipal law enforcement officer or an
officer appointed for carrying out the provisions of the Highway
Traffic Act, upon discovery of any vehicle parked or standing on a
highway in such a manner as to interfere with the movement of traffic
or the clearing of snow from the highway may cause it to be moved
or taken to and placed or stored in a suitable place and all costs and
charges for the removal, care and storage of the vehicle, if any, are
a lien upon the vehicle, which may be enforced in the manner
provided by the Repair and Storage Liens Act. 2005, c. 26,
Schedule A, s. 28 (2).
4.
ONE-WAY STREETS DESIGNATED
When appropriate signs have been erected and are on display, the
streets or the portion thereof indicated in Schedule 'H' to this by-law
are hereby designated as one-way streets.
5.
THROUGH HIGHWAYS
(a)
The streets or portions thereof indicated in Schedule 'I' to this by-law
are hereby designated as "Through Highways".
(b)
The designation in subsection (a) of this section of a street or part of
a street as a through highway shall not include any intersection
thereon where traffic signals or traffic control devices are installed.
6.
STOP SIGNS
The intersections set out in Schedules 'O' and 'P' to this by-law are
designated as intersections where stop signs shall be erected.
7.
YIELD RIGHT OF WAY

When appropriate signs are erected and are on display, the driver or
operator of a vehicle approaching a yield right-of-way sign as set out
in Schedule 'Q' shall slow down to a speed reasonable for the
existing conditions and shall stop, if necessary, and shall yield the
right-of-way to traffic in the intersection or approaching on the
intersecting highway so closely that it constitutes an immediate
hazard and, having so yielded, may proceed with caution.
8.
NO TURNS
Where a sign is erected and on display, no person shall make any
left turn or right turn with a vehicle at any intersection at which such
turn is prohibited in Schedule 'L'.
9.
FUNERAL AND OTHER PROCESSIONS
(a)
No person shall intersect a funeral or other properly authorized
procession while it is in motion except under the direction of a
Police Officer.
(b)
The driver of a vehicle in a funeral or other procession shall drive as
near to the right edge of the roadway as practicable and follow the
vehicle ahead as close as is practicable and safe.
10.
HEAVY TRUCKS
When signs have been erected and are on display, no person shall
operate or drive a heavy truck on any of the streets, parts of streets
or sides of streets indicated in Schedule "M" to this by-law, except
when the person driving or operating the heavy truck is making a
bona fide delivery to, or a collection from a premise or premises that
cannot be reached by any other route other than a street where
heavy trucks are prohibited within this by-law, provided that when
making such a delivery or collection the same street is travelled only
as far as is unavoidable in getting to and from such premise or
premises, and except for ambulances, Police or Fire Service or Town
Public Works vehicles, Emergency Services Vehicles and vehicles
actually engaged in works undertaken for or on behalf of the Town.
11.
MISCELLANEOUS DRIVING RULES
(a)
No driver or operator of a vehicle upon a highway shall turn the
vehicle so as to proceed in the opposite direction when:
(i)
upon a curve where traffic approaching the vehicle from either
direction cannot be seen by the driver of the vehicle within a
distance of 150 metres;
(ii)
on a railway crossing or within 30 metres of a railway crossing;
(iii)
upon an approach to or near the crest of a grade where the
vehicle cannot be seen by the driver of another vehicle
approaching from either direction within 150 metres; or
(iv)
within 150 metres of a bridge, viaduct or tunnel where the driver's
view is obstructed within such distance.
(b)
No person shall drive a motor vehicle, skateboard or bicycle, on a
sidewalk or footpath of a highway except for the purpose of directly
crossing the sidewalk or footpath.
(c)
No person shall drive a motor vehicle over a raised curb except at a
place where there is a ramp.

IDLING

(a)
Prohibited Matters
No person shall cause or permit a vehicle to idle for more than five
(5) consecutive minutes.
(b)
Exceptions
Section 12 (a) does not apply to:
(i)
police, fire or ambulance vehicles while engaged in
operational activities, including training activities except
where idling is substantially for the convenience of the
operator of the vehicle.;
(ii)
vehicles assisting in an emergency activity.;
(iii)
mobile workshops while they are in the course of being used
for their basic function;
(iv)
vehicles where idling is required as part of the repair process
or to prepare a vehicle for servicing;
(v)
armored vehicles where a person remains inside the vehicle
while guarding the contents of the vehicle or while the vehicle
is being loaded or unloaded;
(vi)
vehicles that remain motionless because of an emergency,
traffic or weather conditions or mechanical difficulties over
which the driver has no control;
(vii)
vehicles engaged in a parade or race or any other such event
authorized by Council;
(viii)
transit and passenger vehicles while passengers are
embarking or disembarking en route or at terminals; transit
vehicles while at a layover or stopover location, except where
idling is substantially for the convenience of the operator of
the vehicle;
(ix)
vehicles transporting a person where a medical doctor
certifies in writing that for medical reasons, the person
requires the temperature or humidity be maintained within a
certain range;
(x)
vehicles when the ambient outside temperature is more than
27 degrees Celsius or less than five degrees Celsius.
PART VI - RATE OF SPEED
Unless otherwise posted, no person shall drive a motor vehicle at a rate of
speed greater than 50 kilometres per hour on a highway within the Town of
Ingersoll.
1.
No person shall drive a motor vehicle at a rate of speed greater than
40 kilometres per hour on a highway within an area posted as such
within the Town of Ingersoll.
PART VII - CONSTRUCTION ZONES
1.
The Engineering Services co-ordinator may designate a
construction zone on any street or roadway under the jurisdiction of
the Town as described in Bill 160, the Transportation Statute Law
Amendment Act, 2005.
2.
The Engineering Services Coordinator may reduce the speed
limits in the construction zone.
3.
The reduced speed limit becomes effective once proper signage is
posted. Proper signage shall be erected by the General Contractor

as per Regulation 615 of The Highway Traffic Act and the Ontario
Traffic Manual Book 7.
4.
It shall be the responsibility of the Engineering Coordinator to
ensure that proper documentation is kept detailing when a
construction zone speed is changed.
5.
Speed fines will be doubled in each designated construction zone.
PART VIII - MOTORIZED SNOW VEHICLES
REGULATIONS
1.
No person shall operate a Motorized Snow Vehicle during prohibited
hours.
2.
No person shall operate a Motorized Snow Vehicle within the limits
of the Town of Ingersoll on any sidewalk or boulevard, except for the
purpose of crossing any such sidewalk or boulevard to travel from
private property to a serviced roadway or from a serviced roadway to
private property.
3.
No person shall operate a Motorized Snow Vehicle at any time within
the core area of the Town of Ingersoll which is that portion of the
Town:
Bounded on the south by the south boundary of King Street
Bounded on the north by the north boundaries of Carnegie and
Victoria Streets
Bounded on the west by the west boundary of Duke Street
Bounded on the east by the east boundary of Mill Street
4.
No person shall operate a Motorized Snow Vehicle on any other
serviced roadway within the limits of the Town of Ingersoll, except
for the purpose of directly going to or from any area within or
outside the town in which such operation is permitted.
5.
No person shall operate a Motorized Snow Vehicle within any park
or lands used for park purposes within the limits of the Town of
Ingersoll, except where specifically authorized to do so in advance
by the Recreation and Parks Management of the Town.
PART IX - MISCELLANEOUS, PENALTIES, ETC.
1.
STANDARD TIME AND DAYLIGHT SAVING TIME
Whenever in this by-law a time of day or hour is referred to, the same
shall be construed in accordance with Standard Time or Daylight
Saving Time as may be in current official use in the Town of Ingersoll.
2.
REGULATION FOR BICYCLES
(a)
No person shall ride a bicycle on a roadway except as near as
practicable to the right side of such roadway.
(b)
No person shall ride a bicycle on a roadway except in single file.
(c)
No person shall ride a bicycle on a roadway while carrying any
package, bundle or article which prevents such person from keeping
both hands on the handle bars.
(d)
No person shall park a bicycle on a roadway or sidewalk in such
manner as to obstruct vehicular or pedestrian traffic thereon.
(e)
No person shall ride, on a sidewalk, a bicycle having a wheel or
wheels greater than 35 centimetres in diameter.

(f)
No person, over the age of 13, shall ride a bicycle on any sidewalk.
(g)
A person riding on a sidewalk shall provide a pedestrian(s) with the
right-of-way.
(h)
No person shall ride a bicycle on a sidewalk in the downtown core
area except those having a wheel or wheels fewer than 35
centimetres in diameter.
3.
ILLEGALLY PARKED VEHICLES
(a)
Where a vehicle has been left parked, stopped or left standing in
contravention of this by-law as passed, the owner of the vehicle,
notwithstanding that he was not the driver of the vehicle at the time
of the contravention of the by-law is guilty of an offence and is liable
to the fine prescribed for the offence unless, at the time of the
offence, the vehicle was in possession of some person other than
the owner without the owner's consent.
(b)
No person shall permit a vehicle to be parked or left on Town-owned
or occupied land without the authorization of the Town.
(c)
A Police Officer may cause a vehicle parked or left in contravention
of this By-law to be moved or taken to and placed or stored in a
suitable place and all costs and charges for removing, care and
storage, if any, are a lien against the said vehicle which may be
enforced in the manner provided by the Repair and Storage Liens
Act 2005, c. 26, Schedule A, s. 28 (2)..
4.
VOLUNTARY PAYMENT OF PENALTIES
(a)
Where a vehicle is found in contravention of the parking provisions
of this by-law, a Police Officer or Parking Enforcement Officer, finding
the vehicle shall attach to the vehicle a parking ticket in the form of a
serially numbered notice stating:
(i)
the license number and description of the vehicle;
(ii)
that the vehicle is in contravention of the by-law;
(iii)
the date, time and place of the alleged offence;
(iv)
that the owner or operator thereof may report within seven (7)
days, exclusive of Sundays and holidays, after the day when
the ticket is attached to the vehicle, to the Municipal Offices of
the Town of Ingersoll at 130 Oxford Street, Ingersoll, Ontario
and make voluntary payment of the penalty in the amount so
designated in Subsection (c) of this section.
(v)
that in the event of failure to make such payment, a notice or
information may be issued under the Provincial Offences Act.
(b)
The parking ticket shall be prepared in duplicate and the Police
Officer or Parking Enforcement Officer shall attach one copy to the
vehicle.
(c)
The owner or operator of the vehicle may, within seven (7) days,
exclusive of Sundays and holidays, after the date when the ticket is
attached to the vehicle, report to the Municipal Offices of the Town
of Ingersoll, 130 Oxford St. Ingersoll, ON, and pay the sum of One
Hundred ($100.00) Dollars in the case of a Fire Lane, Emergency
Exit, Hydrant or a Hospital Entrance or the sum of Three Hundred
($300.00) for Accessible Parking violation or the sum of Twenty
($20.00) Dollars in case of any other parking violation; which shall be
accepted as payment of the penalty in full satisfaction in respect to
the offence except as set out in Schedule 'S'.

(a)
Every person who contravenes this by-law is guilty of an offence and
on/or upon conviction, except for Sections 6 and 7 of Part V, is liable
to a fine and all such penalties shall be recoverable under the
Provincial Offences Act and the provisions of this by-law.
(b)
Sections 5 and 6 of Part V of this by-law shall be subject to the
penalties prescribed in the Highway Traffic Act.
(c)
The owner of a vehicle that is parked, stopped, left standing,
operated, driven, being loaded or being unloaded in contravention of
this by-law is guilty of an offence, and on/upon conviction is liable to
a fine and all such penalties shall be recoverable under the Provincial
Offences Act and the provisions of this by-law unless the owner
establishes that, at the time of the offence, the motor vehicle was in
possession of another person without the owner's consent, express
or implied.
(d)
The owner of a Motorized Snow Vehicle may be charged with and
convicted of an offence under this by-law for which the driver of the
Motorized Snow Vehicle is subject to be charged unless, at the time
of the offence, the Motorized Snow Vehicle was in the possession
of a person other than the owner without the owner's consent
and the owner is liable to the penalty prescribed for the offence.
6.
ACT & REGULATIONS TO GOVERN
The provisions of this by-law shall be subject to the provisions of the
Highway
Traffic
Act,
as
amended
and
Regulations,
the
Municipal Act, Repair and Storage Liens Act 2005, and the Motorized
Snow Vehicles Act.
7.
BY-LAW REPEALED
By-law No. 98-3831, By-Law 01-3976 and By-law No. 03-4106, and
amendments, thereto and any other by-law inconsistent with this by-
law are hereby repealed in its' entirety.
8.
COUNTY OF OXFORD APPROVAL
Sections of this by-law shall be subject to the approval of Oxford
County Council where County jurisdiction is applicable pursuant to
the Municipal Act
9.
SHORT TITLE
The short title of this by-law is the "Traffic and Parking By-Law"
10.
EFFECTIVE DATE
That By-Law No. 06-4327 shall come into effect March 5, 2007.
