--THE CORPORATION OF THE TOWN OF KAPUSKASING BY-LAW NO. 4686 Being a by-law to designate community safety zones and school zones on highways under their jurisdiction and to establish a reduced speed limit of 40 kmlhr on designated highways and roadways within the Municipality and to repeal by-law 2772 as amended. WHEREAS sections 128 and 214.1 of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, authorize municipalities to regulate speed limitsand designate Community Safety Zones and School Zones on highways under theirjurisdiction; WHEREAS it is desirable that reduced rates of speed be established for motor vehicles driven on highways in school zones; NOW THEREFORE THE MUNICIPALCOUNCIL OF THE CORPORATION OF THE TOWN OF KAPUSKASING ENACTS AS FOLLOWS: 1. DEFINITIONS Community Safety Zone means a designated area where increased penalties apply for certain offences under the Highway Traffic Act. School Zone means a designated area adjacent to, or in close proximity to, a school property intended to enhance the safety of school children. Highway has the same meaning as defined in the Highway Traffic Act Municipality means the Corporation of the Town of Kapuskasing. 2. DESIGNATION OF COMMUNITYSAFETY ZONES 2.1 The highways or portions of highways identified in Schedule "A"are hereby designated as Community Safety Zones. 2.2 Community Safety Zones shall be in effect at all times 3. DESIGNATION OF SCHOOL ZONE 3.1 The highways or portions of highways identified in Schedule "B"are hereby designated as School Zones. 3.2 School Zones shall be in effect on days when school is regularly held, between the hours of 8:00 am. and 5:00 pm. or as othenlvise indicated by authorized signage erected in accordance with the Highway Traffic Act. 4. REDUCED SPEED LIMIT -- 40 KMIHR 4.1 No person shall operate a motor vehicle at a rate of speed greater than forty (40) kilometres per hour on any highway or portion thereof designated as a Community Safety Zone or School Zone under this By-law. 4.2 The reduced speed limitshall apply only where authorized regulatory signage has been erected in accordance with the Highway Traffic Act. 5. SIGNAGE 5.1 The Municipality shall erect and maintain signage indicating the commencement and termination of each Community Safety Zone and School Zone, in accordance with the Highway Traffic Act and its regulations. 6. ENFORCEMENT 6.1 This By--lawshall be enforced by the Ontario Provincial Police and any other officers authorized under the Highway Traffic Act. 7. EFFECTIVE DATE 7.1 This By-law shall come into force and take effect on the date of its passing ENACTED AND PASSED THIS 9THDAY OF MARCH 2026.
