## THE CORPORATION OF THE TOWN OF KEARNEY
By-law No. 2023-13
## Being a By-law to Designate Parts of Highways Under the Jurisdiction of the Town of Kearney as Community Safety Zones
WHEREAS pursuant to Section 214.1(1) of The Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended, the Council of a municipality may by By-law designate a part of a highway under its jurisdiction, as a community safety zone if, in the council's opinion, public safety is of special concern on that part of the highway;
AND WHEREAS the Council of the Corporation of the Town of Kearney deems public safety to be of special concern on a part of certain highways to implement such a By-law;
NOW THEREFORE the Council of the Corporation of the Town of Kearney enacts as follows:
## 1.0 INTERPRETATION
- Unless otherwise stated in this By-law, subsection 1 of Section 1 of The Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended from time to time, is hereby adopted in this By-law for the purpose of definition and interpretation.
## 2.0 DEFINITION
- 2.1 Council means the Council of the Corporation of the Town of Kearney;
- Highway means a highway as defined in The Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended from time to time;
- 2.3 Motor Vehicle means a motor vehicle as defined in The Highway Traffi Act, R.S.O. 1990, Chapter H.8, as amended from time to time;
- 2.4 Official Sign means a sign approved by the Ministry of Transportation and placed or erected on a highway or elsewhere pursuant to the provisions of this By-law.
## 3.0 DESIGNATION
- Where official signs are erected or placed on highways in accordance with the regulations of The Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended from time to time, the highways set out in Column 1 and limits as defined in Column 2 and Column 3 of Schedule "A" are hereby designated as Community Safety Zones and shall be enforced during the period of times, days or months as set out in Column 4 to
## 4.0 SEVERABILITY
- 4.1 Should any section, sub-section, clause, paragraph or provision of this By-law including any part of Schedule "A" be declared by a court of competent jurisdiction to be ultra vires, invalid or illegal for any reason, the same shall not affect the validity of
## 5.0 FORCE AND EFFECT
- 5.1 This By-Law shall come into force and take effect on February 16, 2023.
