THE CORPORATION OF THE
MUNICIPALITY OF KILLARNEY
BY-LAW NO. 2014-03
BEING A BY-LAW TO REGULATE THE RATE OF SPEED
ON HARTLEY BAY ROAD
WHEREAS the Municipal Act, S.O. 2001 c. 25, as amended, Section 28 (1),
provides that a municipality has jurisdiction over all highways within the
municipality;
AND WHEREAS Hartley Bay Road is a roadway under the jurisdiction of the
Municipality of Killarney;
AND WHEREAS Section 128 (2) of the Highway Traffic Act, R.S.O. 1990, c.
H.8 allows the council of a municipality by by-law to prescribe a rate of speed for
motor vehicles driven on a highway or portion of a highway under its jurisdiction;
AND WHEREAS Council deems it desirable to enact a by-law to reduce the rate
of speed on Hartley Bay Road to 60 kilometres per hour;
NOW THEREFORE the Council of the Corporation of the Municipality of
Killarney hereby enacts as follows:
1.
That the rate of speed on Hartley Bay Road shall be set at 60 kilometres
per hour. A driver shall not drive a vehicle at a greater speed than 60
kilometres per hour on this road.
2.
That all minimum roadway service standards will continue to apply to
Hartley Bay Road;
3.
That this by-law shall come into force and take effect on the date of its final
passing.
