THE CORPORATION OF THE TOWNSHIP OF KING
BY-LAW NUMBER 73-54
A BY-LAW TO PROVIDE FOR THE PRESERVING OF TREES AND
FOR PROHIBITING THE INJURING OR DESTROYING OF TREES IN
THE TOWNSHIP OF KING
WHEREAS Section 457 of The Municipal Act, R.S.O. 1970, Chapter 284 authorizes the Council
of every municipality to pass by-laws for preserving trees and for prohibiting the injuring or
destroying of trees,
AND WHEREAS the Council of the Township of King is desirous of preserving, wherever
possible, all existing trees along the Township's road allowances and on Township lands.
NOW THEREFORE, Council of the Township of King enacts as follows:
1. No person shall in any way injure or destroy any trees presently growing on any Township of
King lands or road allowance, whether the road allowance is opened or unopened, unless
approval has been received in writing from the Township of King Engineer/Road
Superintendent which approval may be subject to such conditioned as are deemed
necessary.
2. Section 1 hereof shall not apply to:
a) The Township of King staff or agents carrying out their normal work as laid out by the
Engineer/Road Superintendent.
b) The necessary trimming of trees by Ontario Hydro and Bell Telephone to
accommodate existing or new lines on Township road allowances
c) The trimming or removal of trees that have been damaged by disease, insects, wind,
ice, fire, lightening or other cause when such work is being carried out by the Ontario
Hydro or Bell Telephone Company or their agents.
3. No person shall attach any object or thing to a tree located on any Township road allowance
or Township lands where such attachment may injure or destroy the tree.
4. Any person or organization desirous of planting shade or ornamental trees upon any
Township road allowance shall first obtain approval from the Township's Engineer/Road
Superintendent and all such trees shall become the property of the Township of King and
the Township shall not be liable for any damage to or destruction of such trees.
5. Any person found guilty of an offence in the event of a breach of any of the provisions of this
by-law shall forfeit and pay for each such offence a penalty not exceeding One Thousand
Dollars ($1, 000.00) exclusive of costs.
