For more information or to request any of the By-laws noted under "Revision History", please contact the Municipal Governance Department by calling 519-733-2305 or emailing [email protected] THE CORPORATION OF THE TOWN OF KINGSVILLE BY-LAW 21 - 2005 ______________________________________________________________ Being a By-law to Regulate Traffic and Parking on Highways within the Town of Kingsville THE COUNCIL OF THE CORPORATION OF THE TOWN OF KINGSVILLE ENACTS AS A BY-LAW AS FOLLOWS: Definitions 1. For the purpose of this by-law: "authorized municipal vehicle" means any vehicle owned by the Town as well as authorized private vehicles operated by employees, electees or appointed representatives of the Town of Kingsville, a Provincial Court Judge, or a Crown Attorney, whose vehicles are designated by parking permit or some similar method which from time to time may be prescribed by the Director of Municipal Services "bicycle" means any device which as two wheels and is propelled by human power and upon which any person may ride and includes a tricycle having a wheel or wheels with a diameter of 60.0 centimetres or more, but does not include a motor-assisted bicycle or scooter "boulevard" means the portion of the highway other than the roadway "bus" means a motor vehicle designed for carrying ten or more passengers and used for the transportation of persons "bus stop" means a part of a highway designated by a sign where buses will stop to take on or let off passengers "By-law Enforcement Officer" means any person appointed by the Town to assist in the enforcement of this by-law "Chief of Police" means the Commissioner of the Ontario Provincial Police or his/her designate "commercial motor vehicle" means a motor vehicle, whether or not it is licensed for commercial purposes, having temporarily or permanently attached thereto a truck or delivery body and includes any tractor trailer, tow truck, bus, truck trailer combination or portions thereof, but shall not include a conventional pickup truck or van or recreational vehicle (being a vehicle that is mobile, either by itself or when attached to another vehicle, designed to provide temporary accommodation to its inhabitants) "Community Safety Zone" means a highway or portion of a highway designated as such under this by-law and signed pursuant to the regulations of the Highway Traffic Act "connecting link" means between parts of the County Road system or as an extension of the County Road system, to be constructed and maintained by the road authority having jurisdiction over the highway or part of the highway as designated by The Corporation of the County of Essex from time to time "corner" means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic "council" means the Council of The Corporation of the Town of Kingsville "crosswalk" means: (a) the part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides to the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or (b) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface "curb" means where a curb is constructed, the vertical face thereof at the edge of the roadway; where no curb is constructed, it shall be construed to mean the edge of the roadway "designated fire route" means a fire route designated by the Chief of the Fire Department of the Town "designated parking space" means a parking space designated under this by­ law for the exclusive use of a vehicle displaying a permit in accordance with the requirements of the Highway Traffic Act and the regulations made hereunder and this by-law "Director of Infrastructure and Engineering" means the Director of Infrastructure and Engineering of the Town or his/her authorized representative "disable person parking permit" means a valid disabled person parking permit issued in accordance with the provisions of the Highway Traffic Act and the regulations thereto, or other marker or device issued by another jurisdiction and recognized under that Act "double parking" as applied to a vehicle shall mean to allow the same to remain stationary on the same side of the highway alongside of and parallel with, or nearly parallel to another vehicle already parked or standing at the curb or such highway, except in obedience to traffic regulations, signs or signals "driver" means a person who drives and is responsible for the care and control of a vehicle on a highway "driveway" means the part of the highway that is improved, designed and used to provide vehicular access between the roadway and land contiguous to the highway, but does not include any part of the roadway "emergency vehicles" include vehicles driven by Police Officers, firemen, paramedics, municipal employees and municipal contractors in the performance of their duties "farm tractor" means a self-propelled vehicle designed and used primarily as a farm implement for drawing ploughs, mowing machines and other implements of husbandry, and not designed or used for carrying a load "Fire Chief" means the Chief of the Fire Department of the Town or his/her authorized representative "Fire Department" means the Fire Department of the Town "fire route" means any road, lane, ramp or other means of vehicular access to or egress from a building or structure and it may include part of a parking lot "gross weight" means the combined weight of vehicle and load "heavy vehicle" means a vehicle having a gross weight, including vehicle, trailer, drawn wagon, object or contrivance and load, in excess of 5,000 kilograms, but does not include a fire apparatus, vehicles actually engaged in works undertaken for or on behalf of the Town, public utility emergency vehicles, or any bus operated pursuant to a franchise granted by the Town for a public transportation system "highway" means a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles and includes the area between the lateral property lines thereof "highway, one-way" means a highway upon which the movement of vehicular traffic is limited to one direction "Highway Traffic Act" means Highway Traffic Act, R.S.O. 1990, c.H.8, as amended "holiday" includes Sunday, New Year's Day, Good Friday, Easter Monday, Victoria Day, Canada Day, the first Monday in August, Labour Day, Thanksgiving Day (second Monday in October), Remembrance Day, Christmas Day, Boxing Day, any day appointed by proclamation of the Governor General or the Lieutenant Governor as a public holiday, and any day proclaimed by the head of Council of The Corporation of the Town of Kingsville as a Civic Holiday. "in-line skates or roller skates" means a pair of shoes or boots with a set of wheels or rollers attached to the sole (whether motorized or not) (whether in- line or not), and intended to be used for skating over flat surfaces "intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle whether or not one highway crosses the other "loading zone" means a space adjacent to a curb for the exclusive use of vehicles during the loading or unloading of freight "Mayor" means the Mayor of The Corporation of the Town of Kingsville "median strip" means the portion of a highway so constructed as to separate traffic traveling in one direction from traffic traveling in the opposite direction by a physical barrier or an unpaved strip of ground "mobile home" means a vehicle, other than a mobile vehicle, that is designed and used as a residence or working accommodation unit and exceeds 2.6 metres in width or eleven (11) metres in length "motor assisted bicycle" means a bicycle: (a) that is fitted with pedals that are operable at all times to propel the bicycle; (b) that weighs not more than fifty-five (55) kilograms; (c) that has no hand or foot operated clutch or gearbox driven by the motor and transferring power to the driven wheel; (d) that has an attached motor driven by electricity, or having a piston displacement of not more than fifty (50) cubic centimetres; and (e) that does not have sufficient power to enable the bicycle to attain a speed greater than fifty (50) kilometres per hour on level ground within a distance of two (2) kilometres from a standing start "motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor scooter, but does not include a motor-assisted bicycle "motor vehicle" includes an automobile, motorcycle, motor-assisted bicycle unless otherwise indicated in this by-law, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a farm tractor or a self-propelled implement of husbandry "municipal parking lot" means a parking lot owned and operated on behalf of the Town "municipal or private parking area" means any open area or portion of a structure, other than a street or highway, intended for the temporary parking of vehicles and on which there are designated parking spaces, whether their use involves the payment of a fee or otherwise "occupant", when used in relation to property, means: (a) the tenant of the property or part thereof whose consent shall extend only to the control of the land of which he/she is tenant and any parking spaces allotted to him/her under his/her lease or tenancy agreement; (b) the spouse of a tenant; (c) a person or a Corporation, or a local board thereof, having an interest in the property under an easement or right-of-way granted to or expropriated by the person, municipality or local board whose consent shall extend only to the part of the property that is subject to the easement or right-of-way; (d) a person authorized in writing by an occupant as defined in clause (a), (b), or (c) to act on the occupant's behalf for requesting the enforcement of this by-law "official sign" means any sign placed or erected on a highway or other device placed or erected on a fire route or on a municipal or private parking area "owner", when used in relation to property means: (a) the registered owner of the property (as real estate used for parking); (b) the registered owner of a condominium unit, whose consent shall extend only the control of the unit of which he/she is owner and any parking spaces allotted to him/her by the condominium corporation or reserved for his/her exclusive use in the declaration of the property; (c) the spouse of a person described in clause (a) or (b); (d) where the property is included in a description registered under the Condominium Act, the board of directors of the condominium corporation; or (e) a person authorized in writing by the property owner as defined in clause (a), (b), (c), or (d) to act on the owner's behalf for requesting the enforcement of this by-law "park" or "parking", when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers "parking area" means an area to which the public has access for the purpose of parking, whether for payment of a fee or otherwise "parking space" means that the part of the surface of a highway, or other lands owner, leased or controlled by the Town for the purpose of parking a vehicle "Peace Officer" includes a Police Officer, By-law Enforcement Officer, Provincial Offences Officer, or other person employed for the preservation and maintenance of the public peace, or for the service or execution of civil process, or any officer appointed for enforcing or carrying out the provisions of this by-law "pedestrian" means a person on foot or an invalid, child or other person in a wheeled chair or baby carriage "pedestrian crossover" means any portion of a roadway, designed by by-law of a Town, at an intersection or elsewhere, distinctly indicated for pedestrian crossing by signs on the highway and lines or other markings on the surface of the roadway as prescribed by the regulations "permit" means a permit issued to the owner of a motor vehicle with respect to such motor vehicle of which he or she is the owner "person" means every natural person, firm, partnership, association or corporation "personal mobility device" means a device designed for and operated by a person with a disability for the purpose of mobility and which is propelled by muscular power or any kind of power and includes motorized and non- motorized wheelchairs "Police Officer" means a person appointed by the Chief of Police, in accordance with the provisions for policing in the Town at any given time "Provincial Offences Officer" means a Police Officer or a person designated under the Provincial Offences Act, R.S.O. 1990, c.P.33 for the purpose of enforcing the provisions of the Town's by-laws "roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively "school crossing" means any portion of a roadway, at an intersection or elsewhere, distinctly indicated for school children crossing by signs on the highway and lines on the surface of the roadway "School Zone" means the portion of a highway that adjoins the entrance to or exit from an elementary or secondary school and that is within 150 metres along the highway in either direction beyond the limits of the land used for the purposes of the school "scooter" means a two-wheeled device with wheels smaller than 15 centimetres in diameter that is propelled either by human or motorized power "self-propelled implement or husbandry" means a self-propelled vehicle manufactured, designed, redesigned, converted or reconstructed for a specific use in farming "set fines" means the fines for parking and other traffic infractions pursuant to the Provincial Offences Act, R.S.O. 1990, c.P.33 as set by the Chief Judge of the Ontario Court of Justice "shoulder" means that part of the highway immediately adjacent to the roadway and having a surface which has been improved with asphalt, concrete or gravel for the use of vehicles "sidewalk" means and includes all such parts of a highway as are constructed, designed and intended for the use of pedestrians "skateboard" means a platform with rollers or wheels, whether motorized or not, used by a person or persons for transportation or play "stand or standing", when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers "stop or stopping", when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable of other Police Officer or of a traffic control sign or signal "Town" means The Corporation of the Town of Kingsville "through highway" means a highway or part of a highway designated as such by by-law of the Town and intersection on every such highway shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry of Transportation "Town" means The Corporation of the Town of Kingsville "traffic" includes pedestrians, vehicle and other conveyances used singularly or together while using any street for purposes of travel "traffic control device" means any sign, roadway or sidewalk marking, or other device or an official sign or traffic control signal placed or erected on a highway under the authority of this by-law for the purpose of regulating, warning or guiding traffic "traffic control signal" means any device, manually, electrically, or mechanically operated for the regulation or control office traffic "trailer" means any vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designated to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn, unless specified otherwise "u-turn" means the turning of a vehicle within the highway so as to proceed in the opposite direction from that which the vehicle previously faced "vehicle" includes a motor vehicle, bicycle, trailer, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle "vending vehicle" means a vehicle from which goods, wares, merchandise, produce, food or other edible substance or beverages are sold or offered for sale "Veteran's Licence Plate" means a licence plate issued by the Ministry of Transportation of Ontario to a vehicle owned by a Veteran, and in which, at the time parking, was driven by a Veteran or a Veteran was a passenger therein "wheelchair" means a chair mounted on wheels driven by muscular or any other kind of power and used for the carriage of a person 2. General 2.1 The Schedules referred to in this by-law shall form part of this by-law and each entry in a column of such a Schedule shall be read in conjunction with the entry or entries horizontally across there from and not otherwise. 2.2 If any section, subsection, or part of this by-law be declared by any Court of Law to be void, illegal or ultra vires, such part or parts hereof shall be declared to be separate and independent and enacted as such. 2.3 The provisions of this by-law may be enforced by any Peace Officer 2.4 Unless specifically noted in this by-law that prohibitions are in effect only where signs are posted, prohibitions stated in this by-law are considered to be in effect even where no such signs are posted. These include, for example, without limiting the generality thereof, parking in intersections, near fire hydrants, or so as to block a driveway 3. Time 3.1 Where any expression of time occurs, or where any hour or other period of time is stated, the time referred to shall be Eastern Standard Time except in periods when Eastern Daylight Time is in effect, in which periods it shall be Easter Daylight Time. 4. Obedience to Traffic Control Devices or Signals 4.1 Every person shall promptly obey all signals or directions given either by a Police Officer or by a traffic control device, including traffic control signals and official signs. 5. Miscellaneous Driving Rules 5.1 No person shall drive a motor vehicle upon a curb, sidewalk, pathway, footpath, footbridge, or boulevard or a highway except for the purpose of directly crossing the sidewalk or footpath, or where permission has been obtained from a Police Officer. 5.2 No person shall drive a motor vehicle over a raised curb except at a place where there is a ramp. 5.3 No person shall ride a bicycle with a wheel or wheels more than sixty (60) centimetres in diameter upon a sidewalk, pathway, footpath, or footbridge which forms part of any highway, except that bicycles shall be permitted on: (a) pathways in parks and open areas designated by signing as a bicycle path; (b) pathways in road right-of-way designated by signing as a bicycle path Notwithstanding the foregoing, a newspaper carrier on a bicycle actually engaged in the delivery of newspapers or a wheelchair may be driven upon a boulevard, sidewalk, pathway, footpath, or footbridge 5.4 No person riding in or by means of a toy vehicle, skateboard, scooter, or similar device shall go upon the roadway except while crossing a street on a crosswalk or pedestrian crossover. 5.5 No parade or other procession other than a funeral procession, shall be permitted on any highway within the Town, until such parties in charge thereof have first obtained approval from the Council. 5.6 Except during Special Events as authorized by Council, no person shall drive or ride 5.7 No person shall drive or ride a horse on any sidewalk or footpath on any highway in the Town or on any boulevard in the built-up areas of th Town. 5.8 No person shall offer for distribution or for sale, or sell goods, wares, merchandise, services or produce from a vehicle on a highway in the Town unless he/she has first obtained approval from the Council. 5.9 No person driving a vehicle shall intersect or otherwise interfere with any parade or other procession lawfully using the highway, except under the direction of a Police Officer. 5.10 No person driving a vehicle upon a highway shall turn the vehicle so as to proceed in the opposite direction, where u-turns are not prohibited, without ensuring such turn can be made safely and without interfering with other traffic. 5.11 No person shall drive a vehicle over an unprotected hose of the Fire Department. 6. Traffic Control Devices 6.1 The Director of Municipal Services or his/her authorized representative and the Chief of Police are hereby authorized to erect or place a temporary "No Parking" signs or "No Stopping" signs, or both, on any highway. Such a temporary sign shall not be installed for longer than one month. 6.2 Authorized locations for traffic control signals are shown in Schedule 1. 7. Pedestrian Duties 7.1 Except where traffic control signals are in operation, or at a crosswalk/pedestrian crossover, or where traffic is being controlled or regulated by a Police Officer, a pedestrian crossing a highway shall yield the right-of-way to all vehicles upon the highway, but nothing in this section shall relieve the driver of a vehicle from the obligation of taking all due care to avoid an accident. 7.2 No pedestrian shall proceed over or under a barrier temporarily or permanently installed on a highway. 7.3 Where there is a sidewalk that is reasonably passable on either or both sides of a highway, a pedestrian shall not walk on a roadway. 7.4 No person upon roller skates or in-line skates or riding in or by means of any coaster, toy vehicle or similar device, shall go upon a roadway except for the purpose of crossing the roadway and when so crossing such person shall have all right of and be subject to the obligations of a pedestrian. 8. Regulations for Bicycles 8.1 Every rider of a bicycle shall at all times when riding on a roadway, keep his or her feet on the pedals and both hands on the handlebars, except when signaling. 8.2 No person while riding on a bicycle shall indulge in trick riding or carry any articles in his or her hands or otherwise ride so as to prevent the full use of both hands to operate or control such bicycle. 8.3 No bicycle shall be allowed to remain, either on a bicycle stand or in any other manner, on a sidewalk, footpath, or footbridge in such a way as to obstruct or interfere with the use of such sidewalk, footpath, or footbridge by pedestrians. Any bicycle found obstructing pedestrians may be taken into possession by a Police Officer and removed and stored, and any storage charge shall be a lien upon such bicycle, and such costs and charges shall be in addition to any penalty imposed under this by-law. There shall be no liability to the owner of such bicycle on the part of the Town, or the Police Officer, for any damages occurring to the bicycle while in the custody of the Police or in storage. 8.4 A person operating a bicycle upon a roadway shall ride as near the right hand side of the roadway as practicable and shall exercise due care when passing a standing vehicle or one proceeding in the same direction. 8.5 Persons operating bicycles upon a roadway shall ride in single file. 8.6 No person shall park a bicycle on a roadway except in an area designated for bicycle parking. 9. Regulations for Personal Mobility Devices 9.1 No person shall operate a personal mobility device on a roadway in the Town where sidewalks are available and accessible. 9.2 Notwithstanding Section 11(1), where a sidewalk cannot be used by a personal mobility device due to weather conditions or physical conditions of the sidewalk, the operator is authorized to use the traveled portion of the highway. 9.3 A person operating a personal mobility device upon a roadway shall in all cases travel with the flow of traffic and as near to the right-hand side of the roadway as practicable. 9.4 Persons operating personal mobility devices upon a roadway shall travel in single file. 9.5 All persons operating a personal mobility device shall obey all traffic regulations. 9.6 Every person, while operating a personal mobility device on a Town roadway or sidewalk shall attach to its framework a red or orange fluorescent flag at a height of no less than 1.5 metres (about 5 feet) from ground level, with dimensions of the flag being a minimum of 17.5 centimetres (about 7 inches) tall by 20 centimetres (about 8 inches) long. 9.7 Every person while operating a personal mobility device on the roadway between sunset and sunrise shall have mounted: (a) on the rear of their device an illuminated red tail light at a minimum distance of 0.6 metres (about 2 feet) from ground level with minimum dimensions of 5 centimetres (about 2 inches) by 7.5 centimetres (about 3 inches); and (b) on the front of their device a white illuminated light 9.8 Every person while operating a personal mobility device on a sidewalk shall yield the way to pedestrians. 10.General Stopping and Parking Regulations 10.1 No person shall park a vehicle more than fifteen (15) centimetres from the edge of the roadway adjacent to which such vehicle is parked. 10.2 Where parallel parking is permitted, no person shall park any vehicle on any highway or portion thereof except upon the right side of the traveled portion of the roadway, having regard for the direction in which such vehicle was proceeding, with its right front and rear wheels parallel to the edge of the roadway adjacent to which such vehicle is parked, unless parking is permitted on the left side of the traveled portion of a highway designated for one-way traffic. 10.3 No person shall on any highway stop any vehicle: (a) on or over a sidewalk or footpath; (b) within an intersection or crosswalk/pedestrian crossover; (c) within nine (9) metres of a crosswalk/pedestrian crossover; (d) on the roadway alongside of any stopped or parked vehicle; (e) upon any bridge or within any tunnel or underpass or within thirty (30) metres of either end of any such structure except where parking within such marked and designated limits is hereby expressly permitted; (f) other than a bus in a designated bus stop, except that the driver of a vehicle may temporarily stop therein for the purpose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any bus; (g) alongside or across the highway from any excavation or obstruction in the roadway where the free flow of traffic would thereby be impeded; (h) on any centre boulevard or centre strip separating two roadways or adjacent to either side or ends of such middle boulevard or centre strip; (i) between a safety zone and the adjacent side of the roadway or within fifteen (15) metres of the points of such side opposite the ends of the safety zone; (j) where signs have been erected pursuant to Section 12(6) of this by-law 10.4 No person shall on any highway park any vehicle: (a) on or over a sidewalk or footpath; (b) opposite, in front of, or within 0.5 metres of a driveway or laneway so as to obstruct vehicles in the use of a driveway or laneway; (c) within three (3) metres of a point on the curb or edge of the roadway adjacent to any fire hydrant; (d) within ten (10) metres of an intersection (e) within fifteen (15) metres of any intersection controlled by traffic signs; (f) within fifteen (15) metres of any level crossing or a railway; (g) alongside the tracks of any railway; (h) on any roadway having an overall width of less than six (6) metres; (i) in front of an entrance to or exit from any building or enclosed space in which persons may be expected to congregate in large numbers; (j) upon any boulevard, except where the same are built up with gravel, stone, or other road material, or paved with the permission of and to the satisfaction of the Director of Municipal Services; no person shall change the surface of a boulevard without the written permission of the Director of Municipal Services (k) for the express purpose of advertising or promotions; (l) for the purpose of displaying the vehicle for sale. Notwithstanding the foregoing, this provisions shall not apply to a person who is not in the business of selling motor vehicles; (m)for the purpose of washing, greasing, or repairing the vehicle; (n) for the purpose of unloading or transferring of materials of any kind from one vehicle to another, except in cases of emergency; (o) in such a position as will prevent the removal of any other vehicle previously parked; (p) where signs have been erected pursuant to Section 12(7) of this by-law 10.5 No person shall park or leave any motor vehicle on any municipal property, including police parking areas where by means of one or more signs, it is indicated that such parking is not authorized. 10.6 Where authorized signs to that effect are displayed, no person shall on any highway stop any vehicle: (a) within forty-five (45) metres of the approach side of any crosswalk or pedestrian crossover or school crossing; (b) within fifteen (15) metres of the leaving side of any crosswalk or pedestrian crossover or school crossing; (c) between the hours of 08:00 and 18:00, Monday to Friday inclusive, other than a school purpose vehicle in a school bus loading zone; (d) between the hours of 08:00 and 18:00, Monday to Friday inclusive, on one or both sides of a highway or portion of a highway which is immediately adjacent to a school; 10.7 Where authorized signs to that effect are displayed, no person shall on park any vehicle: (a) within thirty (30) metres of the approach side of the nearest rail of any level crossing of a railway; (b) within fifteen (15) metres of the leaving side of the nearest rail of any level crossing of a railway; (c) within fifteen (15) metres of an intersection (d) within thirty (30) metres of an intersection controlled by traffic control signals; (e) within twenty-five (25) metres of any point designated as a bus stop (f) on any roadway anytime between the hours of 03:00 and 06:00; (g) on any highway in front of an entrance to or exit from any public building, including a hospital or enclosed space in which persons may be likely to congregate in large numbers; (h) on any highway within 7.5 metres of any fire hall on the side of the highway on which the fire hall is located or within thirty (30) metres of such fire hall on the opposite side of the highway; (i) from a point of location of a sign indicating "No Parking Anytime" to the intersection, or from the sign to the next designated parking zone; (j) between 08:00 and 16:00 upon that side of a highway adjacent to any school property; (k) any time on one or both sides of a highway or portion of a highway which is immediately adjacent to a park or playground; (l) on the curves or cul-de-sacs where there may be limitations on sight distance or on the maneuverability of emergency vehicles. 10.8 Any vehicle standing or parked on any street shall be moved away by the owner or operator thereof at the request of a Peace Officer when, in the opinion of such officer, traffic congestion, fire or any other condition renders the removal of such vehicle necessary. 10.9 Where parking spaces are designated by lines painted on a highway or on a municipal parking lot, no person shall park any vehicle except entirely within an area designated as a parking space. 11.Stopping Restrictions and Prohibitions on Certain Highways 11.1 Where authorized by signs to that effect are displayed, no person shall stop a vehicle on any highway at the side and between the limits set out respectively in Columns 1, 2, and 3 of Schedule 2 to this by-law during the prohibited times or days set out in Column 4 of the said Schedule. 11.2 Nothing in this section shall be deemed to permit stopping or parking at any location where or at any time when stopping or parking is otherwise prohibited. 12.Parking Restrictions and Prohibitions on Certain Highways 12.1 Where authorized by signs to that effect are displayed, no person shall park a vehicle on any highway at the side and between the limits set out respectively in Columns 1, 2, and 3 of Schedule 3 to this by-law during the prohibited times or days set out in Column 4 of the said Schedule. 12.2 Where authorized by signs to that effect are displayed, no person shall park a vehicle on any highway at the side and between the limits set out respectively in Columns 1, 2, and 3 of Schedule 4 to this by-law during the prohibited times or days set out in Column 4 of the said Schedule for a longer period than that set out in Column 5 of the said Schedule. 12.3 Nothing in this section shall be deemed to permit parking at any location where or at any time when parking is otherwise prohibited. 12.4 In any zone other than a commercial or industrial zone as defined in the Zoning By-law of the Town, no person shall park a commercial motor vehicle unless he/she/it is the owner or occupant of the lot and it is parked within an enclosed private garage and such commercial vehicle is not used in connection with any business or other use on the premises which is prohibited. 12.5 No person shall park boats or recreational vehicles on any highway. On-street parking of commercial/personal utility trailers shall only be permitted from 7:00am to 7:00pm. No person shall park or leave an unattached trailer of any kind on any highway 12.6 Parking of buses on any highway shall only be permitted from 9:00 a.m. to 3:00 p.m., Monday thru Friday, from September 1st to July 1st each year. 13.Permitted Angle Parking 13.1 Where authorized by signs to that effect are displayed, angle parking in accordance with the provisions of Subsections (3) and (4) of this section is permitted on highways at the sides and between the limits set out respectively in Columns 1, 2, and 3 of Schedule 5 to this by­ law. 13.2 The provisions of Subsections (1) and (2) of Section 12 do not apply where angle parking is permitted under this section. 13.3 Where angle parking is permitted on a highway and parking spaces are not designated by lines on the roadway, no person shall park any vehicle except at an angle of approximately sixty (60) degrees from the curb or edge of the roadway. 13.4 Where angle parking is permitted on a highway, no person shall park a vehicle or permit a vehicle to remain parked on such a highway except with the back of the vehicle next to the edge of the traveled portion of the roadway. 14.Commercial Loading Zones 14.1 Where authorized by signs to that effect are displayed on the highway at the side and between the limits set out respectively in Columns 1, 2, and 3 of Schedule 18 of this by-law, no person shall park a vehicle or permit a vehicle to remain parked in a loading zone for any purpose other than the expeditious loading and unloading, delivery and receipt of goods, wares or merchandise for commercial purposes, or a licensed taxi dropping off and picking up passengers, or a vehicle dropping off or picking up any passenger in possession of a disabled person parking permit during the days or times set out in Column 4 of the said Schedule. In no case shall the stop for loading or unloading exceed fifteen (15) minutes. 14.2 Each designation made by Subsection (1) shall be effective upon the erection of official signs. 15.Through Highways 15.1 The highways set out in Column 1 of Schedule 9 to this by-law between the limits set out in Column 2 of this said Schedule, are, except as provided in Subsection (2) of this section, hereby designated as through highways for the purposes of the Highway Traffic Act. 15.2 The designation in Subsection (1) of this section of a highway or portion of highway as a through highway shall not include any intersection thereon where the road intersected is a King's Highway or where traffic control signals are installed. 16.One-Way Traffic 16.1 The highways set out in Column 1 of Schedule 10 to this by-law between the limits set out in Column 2 of this said Schedule, are, hereby designated for one-way traffic only in the direction set out in Column 3 of the said Schedule. 16.2 Each designation made by Subsection (1) shall be effective upon the erection of official signs. 16.3 No person shall drive any vehicle on a one-way street as set out in Columns 1 and 2 of Schedule 10 in a direction other than that set out in Column 3 of the said Schedule. 17.Prohibited Turns 17.1 Where authorized signs to that effect are displayed, no vehicle in any intersection or portion of highway set out in Column 1 of Schedule 11 to this by-law proceeding in the direction or emerging from a property set out in Column 2 of the said Schedule shall be turned in the direction set out in Column 3 of the said Schedule, during the times or days set out in Column 4 of the said Schedule. 17.2 Where authorized signs to that effect are displayed, no person operating a vehicle shall at any time make a u-turn at the locations set out in Column 1 of Schedule 11 to this by-law while traveling in the direction set out in Column 2 of the said Schedule during the times or days set out in Column 4 of the said Schedule. 18.Stop Signs The erection of stop signs is hereby authorized at each of the intersections set out in Column 1 of Schedule 12 of this by-law facing traffic as set out in Column 2 of the said Schedule. 19.Yield Signs The erection of yield right-of-way signs is hereby authorized at each of the intersections set out in Column 1 of Schedule 13 of this by-law facing traffic as set out in Column 2 of the said Schedule. 20.Speed Zones, Community Safety Zones and School Zones 20.1 Where highway or portion of highway set out in Column 1 of Schedule 14 of this by-law between the limits set out in Column 2 of the said Schedule, is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in Column 3 of the said Schedule. 20.2 Where any highway or portion of highway is not marked with a posted speed, the maximum rate of speed thereon shall be 50 km/h. 20.3 The speed limits prescribed under this by-law do not apply to motor vehicles of the Fire Department when responding to a call (excluding private vehicles) or Police Officers and ambulance attendants while on duty. 20.4 Community Safety Zones Where authorized signs are erected, any highway set out in Column 1 of Schedule 23 in the direction set out in Column 2 between the points set out in Column 3, shall be designated as a Community Safety Zone. 20.5 School Zones Where authorized signs are erected, any highway set out in Column 1 of Schedule 23 in the direction set out in Column 2 between the points set out in Column 3, shall be designated as a School Zone. 21.School Crossings 21.1 Upon application by the school board in question, the Director of Municipal Services may approve the identification of specific school areas and the posting of school area warning signs. 21.2 Upon application by the school board in question, and its agreement to ensure that the school crossing is supervised in accordance with the Highway Traffic Act, the Director of Municipal Services may approve the installation of specific School Crossings, including its School Crossing warning signs and pavement markings as set out in Schedule 16. 22.Heavy Vehicle Traffic 22.1 Where authorized signs have been erected, a heavy vehicle as defined in Section 1 hereof is prohibited on the highways or parts of highways set out in Column 1 of Schedule 19 to this by-law between the limits set out in Column 2 of said Schedule during the times or days set out in Column 3 of said Schedule. 22.2 The provisions of Subsection 1 of this section shall not extend to any vehicle actually engaged in making a delivery to or a collection from premises which cannot be reached except by way of a highway or part of a highway as set out in Column 1 of Schedule 18 to this by­ law or to prohibit the use of such vehicle for such purpose, provided that in making such delivery or collection the said highway or part of highway is traveled only insofar as is unavoidable in getting to and from such premises; not to a privately owned heavy vehicle, without the trailer portion, being driven to or from the residence of the owner. 22.3 The provisions of Subsection 1 of this section shall not extend to the use of said highways or parts of highways to ambulances, police or fire department vehicles, public utility emergency vehicles, agricultural farm equipment or vehicles actually engaged in works undertaken for or on behalf of the Town. 23.School Bus Loading Zones and Taxicab Stands 23.1 Where signs are erected in accordance with the regulations made under the Highway Traffic Act, the highways or portions of highways set out for School Bus Loading Zones in Column 1 of Schedule 17 to this by-law, on the side of the highway set out in Column 2 of the said Schedule, between the limits set out in Column 3 of the said Schedule, during the times set out in Column 4 of the said Schedule, are hereby designated as school bus loading zones. 23.2 Where official signs are erected and are on display, the highways or portions of highways set out for taxicab stands in Column 1 of Schedule 17 to this by-law, on the side of the highway set out in Column 2 of the said Schedule, between the limits set out in Column 3 of the said Schedule, during the times set out in Column 4 of the said Schedule, are hereby designated as taxicab stands. 23.3 No person shall park a vehicle in a designated zone as described in Subsections 1 and 2, except in accordance with the provisions hereof for school bus loading zones and taxicab stands. 24.Parking for the Phyiscally Disabled 24.1 No person or organization shall park, stop or leave standing, a motor vehicle in a designated parking space or be entitled to the benefit of an exemption under this by-law unless a currently valid disabled person parking permit has been issued to that person, organization or to a passenger being picked up or transported in the vehicle and such permit is displayed on or in the vehicle in accordance with the requirements of the Highway Traffic Act, the regulations made there under and this by-law, on any of the streets or parts of streets or municipal or private property as outlined in Schedules 7 and 8. 24.2 Designated parking spaces shall be distinctly indicated in accordance with the requirements of the Highway Traffic Act, and regulations made there under. 24.3 Designated parking spaces: (a) on streets and highways are described in Schedule 7; and (b) on municipal or private property are described in Schedule 8 25.Parking for the Physically Disabled - Private Property 25.1 Every owner or operator of a municipal or private parking area shall provide designated parking spaces therein in accordance with Schedule 8 to this by-law. 25.2 Every owner or operator of a municipal or private parking area to which this section applies shall identify designated parking spaces distinctly in accordance with the requirements of the Highway Traffic Act, and the regulations made there under. 25.3 Each off-street designated disabled parking space shall have a minimum width of not less than 4.5 metres and shall be the nearest parking space(s) to the principal entrance(s) to the main building(s). 25.4 No fee shall be charged for the use of a designated parking space in excess of that fee charged other members of the general public in respect of non-designated parking spaces. 25.5 Designated parking spaces: (a) on streets and highways are described in Schedule 7; and (b) on municipal or private property are described in Schedule 8 26.Parking on Private Property 26.1 No person shall park or leave any motor vehicle on private property without the written consent of the owner or occupant of such property. 26.2 Any motor vehicle which is parked or left in contravention of this section may be removed or impounded by a Police Officer or Provincial Offences Officer or by the owner of the property or his agent, and all costs and charges for removing or impounding the vehicle shall be paid by the owner thereof and shall be a lien on the vehicle, which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, c.R. 25, as amended 26.3 Subject to Subsection 5 of this section, a Police Officer or Provincial Offences Officer appointed for the carrying out of the provisions of this by-law may act to remove or impound a motor vehicle parked or left on private property only upon the written complaint of the owner or occupant of the property. 26.4 Where the owner or occupant of property affected by this section has posted signs stating conditions on which a motor vehicle may be parked or left on the property or prohibiting the parking or leaving of a motor vehicle on the property, a motor vehicle parked or left on the property contrary to such posted conditions or prohibition shall be deemed to have been parked or left on the property without the owner's or occupant's written consent. 26.5 A special constable appointed under the Police Services Act, R.S.O. 1990, c.P.15, as amended, in respect of a particular property to enforce this section shall be deemed to have written authority of the owner or occupant of the property to enforce this provisions of the by­ law and such special constable is not required to receive a written complaint before enforcing the by-law. 27.Fire Routes 27.1 The Fire Chief shall have the authority to designate Fire Routes in the Town. Fire Route means a width of at least 6 metres (unless some lesser width is satisfactory to the Chief of the Fire Department of the Town) of any road, alley, driveway, ramp, parking lot or other area and if the road, alley, driveway, ramp, parking lot or area is adjacent to a building or structure, than that portion of the road, alley, driveway, ramp, parking lot or area that is closest to the building or structure. 27.2 (a) Upon the designation of a fire route, the Fire Chief is hereby authorized and directed to enter or cause entry on the property to erect or cause to be erected, inspected and maintained, such signs as are required to give effect to this by-law and as are required to regulate and govern traffic for the safety of the public. (b) The designated fire route sign shall: - be thirty (30) centimetres in width and forty-five (45) centimetres in height; - have a black border; - bear the No Parking symbol in red on a white background on the top portion of the sign; - bear the word Fire Route directly there under in red letters and the words Tow Away Zone in black letters on the lower portion of the sign with an arrow on either side pointed outwardly; - be placed at intervals of not more than thirty (30) metres along the designated fire route 27.3 No person shall park or leave a vehicle in an area designated by a sign as a designated fire route in Schedule 20 of this by-law. 28.Reduced Load Period 28.1 For the protection of highways in the Town, all highways or parts of highways in the Town of Kingsville are designated as Reduced Load Highways under the provisions of Sections 110, 118 and 122 of the Highway Traffic Act. 28.2 The Reduced Load provisions apply to all highways or parts of highways in the Town of Kingsville and for the Reduced Load Period from the 1st day of March to the 30th day of April inclusive, in each and every year. 28.3 The penalties provided in the Highway Traffic Act shall apply to contraventions of this Section of the by-law. 28.4 If deemed necessary by the Director of Municipal Services, the reduced load period can be lifted or altered as required in whole or part. 29.Parking during Emergencies and Special Events 29.1 For the purposes of this section, "Winter Weather Event" means a weather condition affecting transportation infrastructure (roads, sidewalks, and bicycle lanes) such as snowfall, wind-blown snow, sleet, freezing rain, frost or ice, and to which a Winter Event Response is required; 29.2 For the purposes of this section, "Winter Event Response" means a series of activities, such as plowing, salting, or the application of other materials, in response to a Winter Weather Event; 29.3 The Director of Infrastructure and Engineering may declare a "Winter Weather Event" for the purposes of initiating a Winter Weather Response. 29.4 When a Winter Weather Event is declared, there shall be no parking on Municipal Highways for a period of 72 hours unless terminated before that time or extended for a further 72 hours. 29.5 When a Winter Weather Event is declared or ended, the Town shall provide notice in one or more of the following ways: - By posting a notice on the Town's website; - By making an announcement on one of the Town's Social Media pages; - By any other media platform deemed appropriate by the Town. 29.6 After the declaration of a Winter Weather Event, associated parking restrictions will come into effect 4 hours after notice is provided. 30.Penalties 30.1 Every person who contravenes any provisions of this by-law is guilty of an offence and on conviction, where a penalty is not otherwise provided for herein or in the Highway Traffic Act, shall be liable to a fine in the amount to be determined pursuant to the provisions of the Provincial Offences Act, R.S.O. 1990, c.P.33, as amended. 30.2 A defendant who does not wish to dispute any charge under this by­ law may deliver the parking infraction and/or offence notice and amount of the set fine to the place shown on the notice within the timeframe set out therein. 30.3 A defendant who is served with a parking infraction and/or offence notice may give notice of intention to appear in Court for the purpose of entering a plea and having a trial of the matter by so indicating on the notice and delivering the notice to the place shown on the notice. 30.4 The owner of the vehicle may be charged with and convicted of an offence under this by-law for which the driver of the vehicle is subject to be charged, unless at the time of the offence, the vehicle was in the possession of some person other than the owner without the owner's consent and on conviction the owner is liable to the penalty prescribed or provided for the offence. 30.5 A Police Officer or other individual authorized under the Highway Traffic Act, upon discovery of any vehicle parked or standing in contravention of this by-law, may cause it to be moved or taken to and placed and stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, c.R.25. 31.Application 31.1 This by-law applies to all highways under the jurisdiction of the Town. 31.2 Sections 12, 13, 14, 15, 23, 25, 26, 27, 28, 29 or 31 of this by-law shall not, if compliance therewith would be impracticable, apply to (a) ambulances, police or fire department vehicles or public utility emergency vehicle; or (b) vehicles actually engaged in works undertaken for or on behalf of the Town; or (c) vehicles actually forming part of a funeral procession for as long as may reasonably be required for the purpose of such funeral 31.3 Section 14(2) of this by-law shall not apply to a vehicle displaying an Ontario Veteran's Licence Plate. 31.4 The provisions of this by-law require signing to be effective only where so stipulated in the individual sections. Provisions which do not require signing to be effective include, without limiting the generality thereof, Sections 5(1-8, 9-10), 7, 8, 9(1), 10(1), 11, 12(1, 2, 3(a-i), 4(a), 8, 9), 14(4), 24(3), 28(1-5). 31.5 All previous traffic by-laws for the Town, former Township of Gosfield South, and the former Township of Gosfield North, are hereby repealed. 31.6 This by-law shall come into force and effect on February 28, 2005. 31.7 The provisions of this by-law affecting traffic on a highway designated as a connecting link pursuant to the Public Transportation and Highway Improvement Act, R.S.O. 1990, c.P.50, shall become effective when approved by the Ministry of Transportation.
