## TOWNSHIP OF LANARK HIGHLANDS
## BY-LAW NO. 2000-126
## BEING A BYLAW TO PROHIBIT OR REGULATING THE OBSTRUCTING, ENCUMBERING, INJURING OR FOULING OF HIGHWAYS, BRIDGES, DITCHES OR CULVERTS
WHEREAS The Municipal Act R.S.O. 1990 Chapter M.45 Section 314. (1) provides that councils of all municipalities may pass bylaws: Subsection 1. For prohibiting or regulating the obstructing, encumbering, injuring or fouling of highways or bridges;
AND WHEREAS the said Municipal Act, Section 314. (1) provides that councils of all municipalities may pass bylaws: Subsection 6. For prohibiting the obstruction of ditches or culverts upon highways;
AND WHEREAS in accordance with Section 13 of the Restructuring Order 'all bylaws and resolutions of the former municipalities and their local boards shall become the bylaws and resolutions of the new Township and its local boards and shall remain in effect in the areas of the former municipalities for five years, or until amended or repealed by the council or board of the new Township";
AND WHEREAS the Council deems it advisable to prohibit the obstruction, etc of highways, bridges, ditches or culverts within the Township of Lanark Highlands;
NOW THEREFORE the Council of the Corporation of the Township of Lanark Highlands ENACTS AS FOLLOWS:-
1. THAT the obstructing, encumbering, injuring or fouling of any highways (as defined by the Municipal Act) or bridge within the Township of Lanark Highlands is hereby prohibited.
2. THAT the parking of any vehicle on the road allowance of any highway, road or street where the said vehicle obstructs or interferes with public travel, or where the said vehicle obstructs or interferes with the winter snow removal operation within the Township of Lanark Highlands is hereby prohibited.
3. THAT the building or maintaining of fences on any highway or street, or the placing or depositing of firewood or logs, or any other thing calculated to obstruct it, or to obstruct or interfere with public travel, on any highway, street or bridge within the Township of Lanark Highlands is hereby prohibited.
4. THAT the obstruction of ditches or culverts upon highways or streets within the Township of Lanark Highlands is hereby prohibited.
5. Any person who contravenes this bylaw shall be liable upon summary conviction to a fine of not less that $50.00 plus costs, and not more than $300.00 plus all costs, and such penalty shall be recoverable under the provisions of the Provincial Offences Act.

IT IS ORDERED pursuant to the provisions of the Provincial Offences Act and the rules for the Ontario Court of Justice that the amount set opposite each of the offences in the schedules of offences under the Provincial Statutes and Regulations thereunder and Municipal By-law Nos. 2000-113, 2000-114, 2000126, 2000-127 and 2000-144 of the Township of Lanark Highlands, Lanark County, attached hereto is the set fines, including costs, for those offences. This Order is to take effect January 24, 2001.
