1 The Corporation of the Town of LaSalle By-law Number 2025-096 A By-law to regulate the use of Off-road Vehicles within the Town of LaSalle Whereas Section 11(3) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality may pass by-laws with respect to traffic on highways, within their spheres of jurisdiction; And whereas Subsection 191.8(3) of the Highway Traffic Act, R.S.O. 1990, c. H.8 ("HTA"), as amended, provides that the council of a municipality may pass by-laws permitting the operation of off-road vehicles or classes of off-road vehicles on any highway within the municipality that is under the jurisdiction of the municipality, or on any part or parts of such highway, and only during specified times. And whereas the Council of the Town of LaSalle deems it in the public interest to regulate the operation of off-road vehicles upon its highways or parts of its highways. Now therefore the Council of the Corporation of the Town of LaSalle hereby enacts as follows: 1.0 Definitions 1.1 In this By-law: "Boulevard" means the portion of a Highway in LaSalle that is situated between the edges of a roadway, or shoulder where one exists, and the adjoining property line; "Corporation" means the Corporation of the Town of LaSalle "Highway" mean a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaductor trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof,including any open or unopened road allowances under the jurisdiction of the Corporation of the Town of LaSalle. "Officer" means a person appointed by Council to enforce By-laws within LaSalle, a police officer while in a course of their duties, or any other persons duly appointed by the Corporation. "Off-road Vehicle ("ORV")" as defined by Off-Road Vehicles Act, R.S.O. 1990, c.O4 ("Off-Road Vehicles Act") means a vehicle propelled or driven otherwise than by muscular power or wind and designed to travel, a) on not more than three wheels; or b) on more than three wheels and being of a prescribed class of vehicle. Off-road Vehicle shall include the following vehicles, for which the following shall have the same meaning as in O. Reg 316/03: i. All-terrain Vehicle("ATV"),means an Off-road Vehicle that: a) has four wheels, the tires of which are all in contact with the ground; b) has steering handlebars; ii. Extreme Terrain Vehicle ("XTV"), means an Off-road Vehicle that: a) has six or eight wheels, the tires of which are all in contact with the ground; b) has no tracks that are in contact with the ground; c) has seats that are not designed to be straddled, and; d) has a minimum cargo capacity of 159 kilograms. 2 iii. Multi-purpose Off-highway Utility Vehicle ("UTV"), means an Off-road Vehicle that: a) has four or more wheels, the tires of which are all in contact with the ground; b) has a steering wheel for steering control; c) has seats that are not designed to be straddled, and; d) has a minimum cargo capacity of 159 kilograms. iv. Off-road Motorcycle ("ORM"), means an offroad vehicle, designed primarily for recreational use, that: a) has steering handlebars; b) has two wheels, the tires of which are all in contact with the ground; c) has a minimum wheel rim diameter of 250 millimetres; d) has a minimum wheelbase of 1,016 millimetres; e) has a seat that is designed to be straddled by the driver; f) is designed to carry a driver only and no passengers; and g) does not have a sidecar. v. Recreational Off-highway Vehicle("ROV") means an off-road vehicle that: a) has four or more wheels, the tires of which are all in contact with the ground; b) has a steering wheel for steering control; c) has seats that are not designed to be straddled, and; d) has an engine displacement equal to or less than 1,000 cubic centimetres. "Property Owner" shall mean the registered owner, condominium corporation, assessed owner, occupant, tenant, person for the time being managing or receiving the rent for the property whether on his/her own account or as any agent or trustee or on account of any other person. "Sidewalk" shall mean the portion of a Highway between the curb line or edge of a roadway and the adjacent property line that is designated and intended for the use of pedestrians. "Town" shall mean the geographical location of the Corporation of the Town of LaSalle; "Trail" shall mean a recreational pathway on the Corporation's property intended for use by pedestrians, bicyclists and Persons using Wheeled Conveyances, which is improved by asphalt, concrete, brick or any other surface, whether or not it is located in a park, and includes any bridge or structure with which it is contiguous. 2.0 Prohibitions 2.1 No person shall operate an Off-road Vehicle upon any Highway, or part thereof, under the jurisdiction of the Corporation, except as provided for in Section 2(2) of the Off-Road Vehicles Act to allow for the crossing directly across a highway or for agricultural purposes or those licensed under the Fish and Wildlide Conservation Act,1997. 2.2 No person shall operate an Off-road Vehicle in the Town on private property between the hours of 11:00 p.m. and 6:00 a.m. 2.3 No person shall operate an Off-road Vehicle over or upon any of the following under the jurisdiction of the Corporation: a) any park, sports field, playground, communiy center, or Trail; or b) any public property without the consent of the Town. 3 2.4 No person shall operate an Off-road Vehicle on any property adjacent to any places of worship, cermonies or funeral homes when services are in progress. 2.5 No person shall operate an Off-road Vehicle on any property adjacent to a school between the hours of 8:00 a.m. to 4:30 p.m. during the school year (September to June). 2.6 No person shall operate an Off-road Vehicle on any Sidewalk or Boulevard within the Town. 2.8 No person shall operate an Off-road Vehicle on private property within the Town without permission of the Property Owner. 2.9 No person shall operate an Off-road Vehicle in such a way as to disrupt or destroy the natural environment or create a nuisance by method of frequency of operation. 3.0 Exemptions 3.1 If the operator of an Off-road Vehicle is actively participating in farming or snow clearing activities, the hours of operation in Section 2.2 of this By-law are not applicable. 3.2 The prohibitions set forth under Section 2 of this By-law do not apply to the following: a) Officers while performing their duties. b) All Town of LaSalle Fire Service personnel while performing their duties. c) All medical rescue personnel while performing their duties. d) All employees of the Corporation while performing their duties. e) All persons operating an Off-Road Vehicle for the purpose of rendering assistance during a declared emergency within the Town. f) Contractors employed by the Corporation while completing work within the Town. 4.0 Penalty Provisions 4.1 The provisions of this By-law shall be enforced by an Officer 4.2 No person shall obstruct, hinder, or otherwise interfere with an Officer, employee of the Corporation, or contractor acting on behalf of the Corporation, in the lawful carrying out of their duties and responsibilities. 4.3 No person shall fail to stop when directed by an Officer. 4.4 No person operating an Off-road Vehicle or any passenger thereof shall fail to identify themselves when demanded to do so by an Officer while executing their duties under this By-law. 4.5 Every person who contravenes any section of this By-law is guilty of an offence and upon conviction is subject to any penalty as provided for in the Provincial Offences Act, R.S.O. 1990, с. P.33, as amended ("POA"). 4.6 Any Person who contravenes a provision of this By- law may be liable to pay an Administrative Penalty in accordance with the Town' s Administrative Penalty By- law, as amended from time to time. 4.7 If a Person is issued an Administrative Penalty in respect of a contravention of this By-law, the Person shall not be charged under the POA with an offence in respect to the same contravention. 4.8 In the event payment is not received, the fees and penalties will constitute a debt owing to the Corporation. The cost will be collected in accordance Subsection 398(2) of the Municipal Act, by which the Corporation's treasurer, or delegate may add unpaid fees, charges and/ or fines issued under this By- law to the tax roll and collect them in the same manner as property taxes. 4 5.0 Short Title 5.1 This By-law may be referred to as the "Off-road Vehicle By-law" 6.0 Effective Date 6.1 This By-law shall come into force and takes effect on the date of its final passing.
