By-law Number 8798
A By-law to regulate Vehicular Parking within
the Limits of the Town of LaSalle
Whereas pursuant to the provisions of the Municipal Act, 2001, s.11(3)(1) municipalities
are empowered to pass by-laws regarding highways, including parking and traffic on
highways;
And whereas it is deemed expedient to pass by-laws to regulate vehicular parking
within the Town of LaSalle;
Now therefore the Council of the Corporation of the Town of LaSalle hereby
enacts as follows:
Interpretation
1.
In this By-law:
(1)
"Boulevard" shall mean any sidewalk, pathway, footpath or crosswalk used
or set aside for the use of pedestrians or any ornamental median strip of the
highway;
(2)
"Chief of Police" shall mean the Chief of Police of the Corporation of the
Town of LaSalle or his designates;
(3)
"Commercial Vehicle" shall mean a motor vehicle having permanently
attached thereto a truck or delivery body, and includes ambulances,
hearses, fire apparatus, buses and tractors used for hauling purpose on
highways;
(4)
"Corporation" shall mean the Corporation of the Town of LaSalle;
(5)
"Council" shall mean the Council of the Corporation;
(6)
"Crosswalk" shall mean any portion of a roadway at an intersection or
elsewhere distinctly indicated for pedestrian crossing by signs or by lines or
other markings on the surface;
(7)
"Curb" shall include the edge of the travelled portion of a street;
(8)
"Derelict vehicle" shall mean a motor vehicle that is wrecked, dismantled,
discarded or abandoned or in a state of disrepair that renders it currently
inoperable, or the operation of which on a highway would be in contravention
of any provincial law or regulation;
(9)
"Designated Accessible Parking Space" shall mean a parking space marked
by a sign or otherwise, indicating such space to be for the sole use of
vehicles operated by or conveying a person with a physical disability and in
respect of which a permit has been issued;
(10)
"Double Park" shall mean to park or stand a vehicle on the same side of the
highway alongside or and parallel to, or nearly parallel to another vehicle
already parked or standing at the curb of such highway except in obedience
to traffic regulations, signs or signals;
(11)
"Driveway" shall mean the part of the highway that is improved, designed
and used to provide vehicular access between the roadway and land
contiguous to the highway, but does not include any part of the roadway.
(12)
"Electric Vehicle" shall mean vehicles that are propelled by one or more
electric motors, using electrical energy stored in one or more rechargeable
batteries or another energy storage device as is capable of being plugged
into an Electric Vehicle Charging Station and includes a plug-in electric car
and plug-in hybrid car;
(13)
"Electric vehicle charging station" shall mean any facility or equipment that is
used to charge a battery or other energy storage device of an Electric
Vehicle;
(14)
"Fire Route" shall mean any private access, route, road, way, lane, ramp, or
other means of vehicular access to or egress from a building and it may
include part of a parking lot set aside for use by emergency vehicles;
(15)
"Intersection" shall mean the area embraced within the prolongation or
connection of the lateral curb lines or, if none, then of the lateral boundary
lines of two or more streets, which join one another at an angle, whether or
not one street crosses the other;
(16)
"Loading zone" shall mean an area or place on a street established for
accommodation of commercial vehicles for the loading or unloading of
goods, wares, merchandise or passengers;
(17)
"Municipality" shall mean the geographic municipality of the Town of LaSalle;
(18)
"Operator" shall mean any person who operates or is the owner of a vehicle
upon a street;
(19)
"Park", "Parked", or "Parking" shall mean the standing or stopping of an
object or a vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in loading or
unloading merchandise or passengers;
(20)
"Person with disabilities" shall mean a person who is physically
handicapped in such a way that their mobility is seriously restricted,
including, without limitation, a person who uses a wheelchair, crutches,
braces or other mobility assisting devices and who holds an accessible
parking permit issued by the Province under the Highway Traffic Act;
(21)
"Officer" means:
i.
Any individual appointed by a Town by-law, or pursuant to the
delegated authority to appoint under a Town by-law, to enforce a
Town by-law; or
ii.
A police officer employed by LaSalle Police Services, Ontario
Provincial Police or the Royal Canadian Mounted Police;
(22)
"Recreational Trail" shall mean a path physically separated Motor Vehicle
traffic by an open space ir barrier located in public property, which
accommodates two-way non-motorized travelers including Bicyclists and
Pedestrians.
(23)
"Recreational Trail Crossing Location" shall mean a location where a
Recreational Trail enters and/or crosses a Highway.
(24)
"Recreational Vehicle" shall mean a vehicle which is intended to provide
sleeping and other facilities for short periods of time, while travelling or
vacationing, designed to be either towed behind a motor vehicle or is self-
propelled, and includes such vehicles commonly known as travel trailers,
camper trailers, pick-up coaches, motorized campers, motorized homes,
boat, utility trailer, motorized snow vehicles, personal watercraft, all-terrain
vehicles or other similar vehicles;
(25)
"Sign" shall mean any sign or roadway, curb or sidewalk marking or other
device placed or erected under the authority of this by-law for the purpose of
regulating, warning or guiding traffic and/or prohibiting or regulating parking;
(26)
"Small Commercial Vehicle" shall mean a motor vehicle having dimensions
not greater than 2.4 metres (7.9 ft) of width, 3.0 metres (9.8 ft) of height, and
6 metres (20 ft) of length, used for commercial purposes;
(27)
"Stop" or "Stopping" shall mean a vehicle's complete cessation of movement;
(28)
"Street" shall include a common or public highway, street, road, avenue,
parkway, place, way, or any part of which is designated or intended for or
used by the general public for the passage of vehicles;
(29)
"Through Street" shall mean a street or part of a street designated as such
by by-law of the Municipality and every such street shall be marked by a stop
sign in compliance with the regulations of the Highway Traffic Act;
(30)
"Vehicle" shall mean a motor vehicle, trailer, traction engine, farm tractor,
road building machine, recreational vehicle and any vehicle drawn,
propelled, or driven by any kind of power, including muscular power, but
does not include the cars for electric or steam railways running only upon
rails;
(31)
"Yard" shall mean an open space on the same lot with the main building or
structure, unoccupied and unobstructed;
i.
"Front Yard" shall mean a yard extending across the full width of a lot
between the front lot line and the nearest wall of the main building or
structure on the lot.
ii.
"Side Yard" shall mean a yard extending from the front yard to the
rear yard and from the interior side lot line to the nearest part of the
building, or structure on the lot.
iii.
"Rear Yard" shall mean a yard extending across the full width of a lot
between the rear lot line and the nearest part of the building, or
structure on the lot.
(32)
"Winter Recreational Vehicle" shall mean a self-propelled vehicle designed
to be driven primarily on snow and shall include the trailer for the purpose of
transporting the winter recreational vehicles.
General
2.
In the event of street construction, repairs or maintenance, erection, or placement of
traffic control devices, or in the event of a fire or other emergency, or during a
parade or other concourse of traffic, traffic may be directed by any officer or by
signs erected or placed at the direction of the Chief of Police or the Town Engineer
as conditions require. No person shall disobey or refuse to comply with the orders,
signal or direction of such officer or a sign erected.
3.
Subject to the approval of Council, the Chief of Police and Town Engineer are
hereby authorized to place or erect, or to cause to be placed or erected, signs and
to maintain such signs as may be necessary to give effect to the provisions of this
by-law, or as are required to warn or guide and direct traffic for the safety and
convenience of the public.
4.
The streets and/or parts of streets set out in Schedule "B" of this by-law are hereby
designated as through streets.
5.
Stop signs shall be erected at the intersections of all streets entering a through
street as designated in Schedule "F".
6.
Every person in charge of a vehicle and every person on any street shall comply
with the requirements of every sign, symbol or mark legally erected or placed for the
control, direction or regulation of traffic or for the regulation or prohibition of parking.
7.
Any and all Schedules attached to this by-law shall form a part of this by-law.
8.
Any officer as defined in this by-law shall have the duty of enforcing the provisions
of this by-law.
9.
No person shall place, maintain or display upon any street, any sign, signal,
marking or device which purports to be or is an imitation of or resembles any traffic
control device not authorized by this by-law.
10.
No person shall willfully move, alter, deface, obstruct the view of, or therwise
interfere with any traffic control device or parking sign erected or placed pursuant to
the provisions of this by-law.
11.
The provisions of this by-law shall not apply to any emergency vehicle that is
stopped or parked on any street or in any parking lot for the purpose of providing
emergency services.
Parking and Stopping Regulations
12.
(1)
When properly worded or marked signs have been erected and are on
display, no person shall park or stop a vehicle on any street, in any area
designated as a "No Parking" and "Alternate Side Parking - No Parking
On" area as designated on Schedule "A" and "C" attached hereto.
(2)
No person shall park or, being the owner thereof permit to be parked, any
recreational vehicle on any street in the Municipality.
13.
(1)
No person shall park a vehicle on any street with the left wheels of the
vehicle at the curb or the side of the street.
(2)
Notwithstanding Section 13(1) a person is permitted to park a vehicle with
the left wheels to the curb or side of the street or on a one-way street
having regard to the parking signs on the said street.
(3)
No person shall park a vehicle on any street where the distance between
the front and rear wheels is more than six inches (6") from the edge of the
street or curb.
14.
No operator of a vehicle used for the purpose of delivering goods, wares or
merchandise or any other commodity shall, when stopping to make a delivery, stop
his or her vehicle on a street, save and except at the right-hand curb or edge of the
street.
15.
(1)
An officer may require the removal of a parked vehicle from a street when
the officer is of the opinion that traffic congestion, proximity to a fire or any
other condition renders the removal and impounding or restraint and
immobilizing of a parked vehicle necessary or desirable.
(2)
The owner or operator of a vehicle parked at the curb of any street shall, at
the request of an officer move the said vehicle as directed by the officer.
16.
No person shall park a vehicle on any street at any time:
(1)
in the same location, upon any street for an uninterrupted period of seven
consecutive days or more;
(2)
within ten feet (10') of a fire hydrant; or
(3)
on any bridge, or on the approaches thereto or in any alley; or
(4)
in such a position as to prevent the convenient removal of any other
vehicle previously parked; or
(5)
on the same side of the street alongside of a parallel or nearby parallel to
another vehicle already parked at the curb of such street; or
(6)
immediately in front of any portion of any driveway; or
(7)
immediately in front of any community mailboxes; or
(8)
within an intersection; or
(9)
for the purpose of washing, greasing, repairing or performing other
maintenance on the vehicle
(10)
in such a manner as to interfere with the movement of traffic, street cleaning
measures or the clearing of snow from the street.
(11)
Within forty five feet (45') from the centre of a Recreational Trail Crossing
or a designated pedestrian crossover.
17.
When properly worded or marked signs have been erected and are on display, no
person shall park a vehicle:
(1)
within fifty feet (50') of any intersection on any street measured form the
end of each radius as per schedule 'F' drawing - No parking at
Intersection, attached hereto and forming part of this By-Law
(2)
within the area designated as a bus or a coach stop on any street; or
(3)
on any street along the curb adjacent to school premises between the
hours of 8:00 am and 5:00 pm, except on Saturdays, Sundays and any
other school holidays.
(4)
perpendicular to a curb or edge of any cul-de-sac or on any angle within a
cul-de-sac along its circular turnaround.
(5)
within a bicycle lane.
(6)
within fifty feet (50') on the inside of any curve in any road that has a
centerline intersecting angle of 120 degrees or less and has a centerline
radius of 65 feet (65') or less, measured from the end of each radius as
per schedule 'F' drawing - No Parking at Curves in Road, attached hereto
and forming part of this by-law.
18.
No person shall park, permit to be parked, any Small Commercial Vehicle on any
street in front of any lot, where parking is permitted in the Municipality unless:
(1)
the Small Commercial Vehicle is operational and has licence plates.
(2)
the Small Commercial Vehicle is operated by the owner or occupant of a
dwelling unit on the lot.
19.
No person shall park, on any street, derelict vehicle and/or a vehicle that is
advertised or displayed for sale, a vehicle with no plates, or a vehicle with expired
plates.
20.
No person shall park a vehicle on, over or along any boulevard, sidewalk, curb, or
pathway, footpath or crosswalk used by or set aside for the use of pedestrians and
forming part of any street. No person shall park a vehicle on, over or along any part
or on any road within any parks owned by the corporation except in the designated
parking areas for such park.
21.
No person shall park a vehicle on or in roundabouts, within any roundabout and
within seventy five feet (75') of the outmost end of a splitter island in any direction.
Private Property
22.
No person shall park a vehicle on a lot in any zone other than in a garage or on a
driveway.
23.
Notwithstanding section 23, no person shall park a derelict vehicle on a driveway
and/or a vehicle with no plates, or a vehicle with expired plates.
24.
Notwithstanding section 23, no person shall park a Small Commercial Vehicle in
any zone unless:
(1)
the owner or full-time occupant of the property is also the owner or operator
of the Small Commercial Vehicle;
(2)
the Small Commercial Vehicle is located on a driveway that has been
properly constructed on the said property, or it is fully contained within a
garage located on the subject property;
(3)
there is only one (1) such Small Commercial Vehicle so parked at any time;
(4)
nothing in this by-law shall be deemed to prohibit the parking of a
commercial vehicle on any street in any zone where the owner or operator of
the commercial vehicle is providing a service to the owner or occupant of the
property for a temporary period of time.
25.
Notwithstanding section 23, no person shall park a recreational vehicle in any zone
unless:
(1)
the owner or full-time occupant of the property is also the owner or operator
of the recreation vehicle;
(2)
there is only one (1) such recreational vehicle so parked at any time;
(3)
the recreational vehicle must be operational and have valid license plates;
(4)
the recreational vehicle may be parked or stored in a side or rear yard year-
round; or
i.
located on the driveway for the period from May 1 to October 31.
(5)
the recreational vehicle is fifteen feet (15') from the edge of the paved
surface of a road with or without a curb or sidewalks;
(6)
if the said recreational vehicle is less than twenty feet (20') in length and is
less than six feet (6') in height, the recreational vehicle may remain parked
or stored on the driveway year round;
26.
Notwithstanding section 26(4)(i), recreational vehicles are permitted on a driveway
between November 1 to April 30 for the purposes of either loading or unloading
goods and materials from the said recreational vehicle for not more than four (4)
consecutive days in a 30 day period.
27.
Notwithstanding section 23, no person shall park a winter recreational vehicle in any
zone unless:
(1)
the owner or full-time occupant of the property is also the owner or operator
of the winter recreation vehicle;
(2)
there is only one (1) such winter recreational vehicle so parked at any time;
(3)
the winter recreational vehicle must be operational and have valid license
plates;
(4)
the winter recreational vehicle may be parked or stored in a side or rear yard
year-round; or
i.
located on the driveway for the period from November 1 to April 30.
(5)
the winter recreational vehicle is fifteen feet (15') from the edge of a paved
surface of a road with or without a curb or sidewalks;
(6)
if the said winter recreational vehicle is less than twenty feet (20') in length
and is less than six feet (6') in height, the recreational vehicle may remain
parked or stored on the driveway year round;
Parking Lots
28.
(1)
No person shall park any motor vehicle on private property without the
consent of the owner or occupant of such property.
(2)
No person shall park or leave any motor vehicle on property owned or
occupied by the Corporation without the consent of the Corporation.
(3)
An owner of a parking lot may cause the removal and impounding or
restraining and immobilizing of a vehicle that is parked or left on their
parking lot contrary to the provisions of this by-law.
29.
No owner or operator of a parking lot and no person carrying on a business with
which a parking lot is connected shall tow or cause any vehicle to be towed from the
parking lot unless the parking lot is posted with one (1) or more signs or notices at
each entrance to the parking lot which signs shall include the following information:
(1)
parking is restricted to the vehicles of customers, visitors, patrons, clients,
patients or guests; and
(2)
any other vehicle may be towed from the parking lot at the vehicle owner's
risk and expense.
30.
A sign or notice required under section 30 shall:
(1)
must have a minimum width of 18 inches and length of 24 inches
(2)
be constructed of durable, weather-resistant material;
(3)
be permanently affixed to a building, structure, post or pole;
(4)
be clearly visible at a minimum of seven feet (7') and maximum height of
nine feet (9') above the grade of the parking lot.
Accessible Parking
31.
No person shall park any vehicle in any space that has been designated for a
person with disabilities within the Municipality unless the said vehicle is operated by
or is carrying a person with disabilities and they have been issued a permit under
the provisions the Highway Traffic Act, which permit shall be displayed at the
driver's side front windshield of such vehicle while parked.
32.
(1)
An owner of a parking lot may cause the removal and impounding of a
vehicle that is parked or left on their parking lot in a parking space
designated for the use by a person with disabilities contrary to the provisions
of this by-law.
(2)
Every person who is an owner of private property shall mark such
designated accessible parking spaces with a sign in accordance with the
provisions of this By-law.
(3)
Each sign shall:
i.
bear the appropriate markings and have the dimension as shown on
schedule "D". Painting the universal symbol of access in the
pavement does not constitute appropriate signage;
ii.
be erected no less than five feet (5') and not more than nine feet (9')
in height measured from the finished grade and their view shall not be
obstructed in any way;
iii.
not be erected so that it is capable of being moved;
iv.
be permanently installed.
Other Designated Parking Spots
33.
No person shall park any vehicle in any space that has been designated:
(1)
For Electric Vehicles unless the vehicle is an Electric Vehicle, and the
Electric Vehicle is actively connected to the Electric Vehicle Charging
Station.
(2)
For Veteran Parking unless the vehicle has the required MTO Veteran plate.
Fire Routes
34.
No person shall park or stop a vehicle on or along a fire route designated under By-
law 6894, as amended of the Corporation of the Town of LaSalle.
Violation and Penalty
35.
An Officer who has reason to believe that a vehicle has been left parked, standing
or stopped in contravention of any means a by-law, or a part or provision of a by-
law, that is listed in Schedule "E" attached to this by-law and designated as part of
Town By-law 8289 may issue a penalty notice as soon as reasonably practicable.
36.
Every person who is the owner of a vehicle in contravention of a by-law designated
as part of Town By-law 8289 shall, upon issuance of a penalty notice, be liable to
pay to the Town an administrative penalty in accordance with Town By-law 8289.
37.
Where any vehicle, recreational vehicle, or commercial vehicle is parked in
contravention of this by-law, a police officer or provincial offences officer may cause
it to be removed or taken to and placed in storage and all costs for removing and
storing the vehicle shall be a lien upon the vehicle which may be enforced in the
manner provided in the Mechanics' Lien Act.
38.
By-law 8398, and all amendments thereto, to the extent that those by-laws amend
By-law 8398, be and are hereby repealed.
39.
This by-law shall come into force and take effect on the final passing thereof.
