## THE CORPORATION OF THE TOWNSHIP OF MACDONALD, MEREDITH & ABERDEEN ADDITIONAL BY-LAW #26-2276 Being a By-law to Authorize the Installation and Maintenance of Seasonal Traffic Calming Measures in the Vicinity of Hurley Park WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes municipalities to pass by-laws respecting highways under their jurisdiction; AND WHEREAS Section 27 of the Municipal Act, 2001 authorizes municipalities to pass by-laws respecting municipal highways; AND WHEREAS Council recognizes Hurley Park as a community gathering place frequented by pedestrians, children, cyclists and motorists and considers it desirable to implement seasonal traffic calming measures to enhance public safety and reduce vehicle speeds in the vicinity of the park; NOW THEREFORE the Council of The Corporation of the Township of Macdonald, Meredith & Aberdeen Additional hereby enacts as follows: ## 1. SHORT TITLE This By-law may be cited as the Hurley Park Traffic Calming By-law. ## 2. DEFINITIONS For the purposes of this By-law: "Traffic Calming Area" means the section of municipal highway identified in Schedule "A" attached to this By-law. "Road Superintendent" means the Township's Road Superintendent or designate. "Traffic Calming Measure" means any physical device, roadway modification, pavement marking, sign or traffic control installation intended to reduce vehicle speeds or improve pedestrian safety, including but not limited to: - : Flexible delineator posts; Speed humps; - Speed cushions; - Lane narrowing devices; - Curb extensions; - Pavement markings; - Warning signs; and - Other traffic calming devices approved by the Township. ## 3. DESIGNATION The roadway described in Schedule "A" is hereby designated as the Traffic Calming Area for the purposes of this By-law. ## 4, AUTHORIZATION Council authorizes the Road Superintendent to install, maintain, seasonally remove, seasonally reinstall, replace, relocate within the Traflic Calming Area, and remove traffic calming measures in accordance with this By-law. ## 5. PLACEMENT AND DESIGN The number, location, type, design and placement of traffic calming measures within the Traffic Calming Area shall be determined by the Road Superintendent having regard to public safety, roadway conditions and operational requirements. ## 6. SEASONAL INSTALLATION Traffic calming measures authorized by this By-law are intended to be seasonal in nature and may be installed, maintained, removed and reinstalled from time to time as determined by the Road Superintendent having regard to roadway conditions, weather, winter maintenance operations, public safety and operational requirements. The seasonal removal of traffic calming measures shall not affect the designation of the Traffic Calming Area established by this By-law. ## 7. TRAFFIC CONTROL DEVICES The Township is authorized to erect and maintain all regulatory, warning and informational signs, pavement markings and other traffic control devices necessary to give effect to this ## 8. LIABILITY Nothing contained in this By-law shall impose any greater duty upon the Township than otherwise exists at law respecting the maintenance of municipal highways. ## 9. SEVERABILITY Should any section or provision of this By-law be declared invalid by a Court of competent jurisdiction, such section or provision shall be severed and the remainder of the By-law shall continue in full force and effect. ## 10. SCHEDULES Schedule "A" attached hereto forms part of this By-law. ## 11. EFFECTIVE DATE This By-law shall come into force and take effect on the date of its passing.
