## THE CORPORATION OF THE TOWNSHIP OF MAPLETON BY-LAW NUMBER 2024-013
Being a By-law to provide for reduced load mits in the Township of Mapleton and 1 peal By-law 99-6
WHEREAS the Council of the Corporation of the Township of Mapleton deems it advisable and expedient to regulate the reduced load period for the protection of certair roads in the Township of Mapletor
AND WHEREAS Section 8(1) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, appropriate and to enhance the municipality's ability to respond to municipal issues;
AND WHEREAS Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act;
AND WHEREAS Section 11(3) 1 and 11(3) 8 of the Municipal Act authorizes a municipality to pass By-laws regarding highways;
AND WHEREAS Section 122(7) of the Highway Traffic Act R.S.O. 1990, c.H.8, as amended, authorizes the municipality having jurisdiction over a highway to pass By-laws to designate the date of which a reduced load period shall start or end and the highway or portion thereof under its jurisdiction to which the designation applies;
NOW THEREFORE, the Council of The Township of Mapleton enacts as follows:
1. This By-law may be cited as the "Reduced Load Limit By-law".
2. That pursuant to section 122, subsections 1, 2, 3 and 4 of the Highway Traffic Act, a reduced load period shall apply to all the Township of Mapleton roads under the jurisdiction of The Corporation of the Township of Mapleton during the period from the first day of March to the last day of April, inclusive in each year and every year. With the exception of road sections deemed to be County Roads under the jurisdiction of The Corporation of the County of Wellington.
3. The road reduction limit shall be a maximum of five thousand (5,000) kilograms per axle.
4. The Director of Public Works or designate is hereby authorized to place, erect and maintain such authorized signs as may be necessary to give effect to the provisions of this By-law.
5. No person shall alter, deface, injure, knock down, damage or remove without permission an authorized sign.
6. The Director of Public Works or designate may at any time where circumstances warrant, either extend the Reduced Load Period set out in #2 or impose such additional Reduced Load Period at any time during the year, as may be required.
7. That this by-law shall apply to all Township of Mapleton roads that in the future come under the jurisdiction of The Corporation of the Township of Mapleton by downloading assumption or new construction without having to amend this By-law.
8. That pursuant to the provisions of Section 110 of the Highway Traffic Act, permits may be issued, upon application in writing to the Director of Public Works or designate for the moving of heavy vehicles, loads, objects or structures.
9. That every person who contravenes any of the provisions of this By-law is guilty of an offence and on conviction is liable to a penalty as provided for in the Highway Traffic Act.
10. That By-law 99-60 is hereby repealed.
11. That this by-law shall come into force and take effect upon the final passing thereof.
READ a first, second and third time, and finally passed this 27th day of February 2024.
